Did Your Business Suffer from a Contract Law Breach? Here's What to Do
Introduction Contract law is a fundamental aspect of the legal system, governing the formation, execution, and enforcement of agreements between parties. In business transactions, contracts serve as the backbone, ensuring that all parties involved are clear about their obligations and expectations. These legal instruments are pivotal in managing relationships and operations within a business…

can we finally admit that people are being weird and over the top about how they hate hearing other people talk or exist in public and can we finally talk about how the recent crusade against playing music out loud sounds a lot like racist “ban boomboxes from public” rhetoric from the 80s

Can you please drop the name of the KJ Parker book involving contracts? A (brief) browse of his works didn’t make it obvious but my silly paralegal heart is intrigued…
So the KJ Parker novellas I'm talking about are primarily Prosper's Demon, Inside Man, and Pulling the Wings off Angels. However, while I did enjoy the others, Pulling the Wings off Angels is my favorite---it should shock no one that I love infernal/heavenly deals, moral arithmetic, and trying to out-lawyer god.
(The other series I'm looking into is published by Parker's alter ego, but still sounds up my alley.)
However, maybe you're asking for the other series that ties legalese to magic---in which case, I would look into the Craft Sequence from Max Gladstone. Admittedly, I haven't read all of it, but Three Parts Dead/Four Roads Cross is one of my favorite duologies, and I could have read about Tara Abernathy, her first job out of law school, and all the headaches (and power, and conniving, and history, truth, fellow feeling) she encounters there, for much more than two books.
#put that lawyer in a fantasy situation!!!#(this is because everyone in the legal profession deserves not to be in the legal profession.#it's an arms of an angel sort of sitch.#but honestly the world can't rehome that many poor souls who like to pontificate in front of their subordinates#so instead#stick them next to a dragon insisting on enforcing verbal contracts.#have them talk about establishing a new changeling(tm) franchise in multiple states simultaneously.#ask ''have we thought about permits; specifically who will ask the local water spirit and what offerings they will present?''#I'm just saying.)#from the bookshelf

I wonder if the people will hate me if I said my true opinion on Michelle
(I think she's like if Light Yagami never got a chance to live beyond sixteen)
#evillious chronicles#michelle marlon#source: trust me bro#on a more serious note. it's because she seems so perfect. an innocent-seeming young upperclass woman with a family in law enforcement#a girl who lies a bit too easily‚ especially to her family. a teenager who is so clearly mentally ill but hides it all too easily#someone who has been lying for a very long time. for what? to keep up appearances? to keep others happy? because it's all she knows?#i think people underestimate michelle. i think not enough people bother looking beyond her mask#i think Ma was planning to make michelle the sinner of greed. someone young‚ charming‚ and unsatisfied with her life#but tbh people woobify gallerian‚ bruno‚ and michelle a lot. people might tell me i'm insane or smth#but trust me on this. michelle is like if light yagami died young#sixteen is a perfectly normal age to make demonic contracts! just ask riliane and nemesis!

Americans: normalize calling your representatives, especially if they're Republicans, to say, "Musk is usurping Congress' power of the purse by deleting entire agencies while Trump is ignoring the Courts, what are you doing to defend the Constitution from this ongoing coup? & if the answer is 'nothing,' then what is stopping DOGE or J6 goons from declaring you surplus to requirements?" then loudly demand the fall of this regime at every opportunity.
#us politics#canadians tell yours: no cooperation with bullies; no contracts with dealbreakers; support interprovince trade & east-west infrastructure#maybe an independent foreign intel collection capability that isn't enmeshed with the US via Five Eyes?#POTUS' declared intentions to attack NATO own Gaza & commit genocide are NOT FINE regardless of how 'unthinkable' markets may think they ar#institutions don't defend themselves & laws are not self-enforcingnobody's coming to save us but 'We The People'!

To be clear, it’s not that they raced each other, it’s that Oscar compromised the race result and almost crashed them both out. It would’ve been fine if he made the move after they built up a gap, but doing it at T4 invited Charles through and completely compromised the entire strategy for the rest of the race
I mean I get the frustration, I have felt the same with Carlos when he's raced Charles really aggressively. But I do still think it's something you have to expect when you have two drivers that are closely matched. Sometimes it's going to be fantastic racing and sometimes they're going to misjudge the margins.
I don't think that there's anyway to guarantee that Oscar trying to overtake Lando (or vice versa) doesn't potentially open the door to another driver. This is always a risk when attempting an overtake ("Through goes Hamilton" for example), though I will give you more detrimental when it's teammates racing hard.
So it seems to me that McLaren needs to decide to either officially prioritize Lando and put Oscar under stricter orders, or things like this will keep happening. I know what I would prefer as a fan of hard racing but with no skin in the McLaren game, but I don't think there's a way out of this problem without naming an official second driver.
#just my opinion#Lando Norris#Oscar Piastri#McLaren#Monza GP 2024#Now there's also the question of whether or not Oscar's contract stipulates that he *can't* be made a second driver#I wouldn't put it past him considering Mark Webber is his manager who notoriously had his own horrors as a second driver (Multi 21!)#so McLaren may not even be able to enforce a second driver situation unless Oscar allows it#which not many racing drivers are willing to sandbag their own races to win *someone else* a WDC

So I just took a nap (as is my favorite thing to do) and during it I saw a dream/vision of a fair maiden or princess imprisoned in the dark lord's dungeon.
Am I now a hero of legend or can I just write porn about it...?
#cíl-irl#next question on the hero side would be:#if this is some sort of karmic contract#and if that's enforceable#plus the issue of me being a hellish servant of dark lords#as much as i would be down to be someone's bi lady knight i'm having a bit of a conflict of interests here#hmmmm

leon brainrot over in the way that it is no longer entirely exclusive and i’m being tossed like an infernal tennis ball between the two.
#‘I’m fixated on ajax again!’ ‘nevermind hi leon’ ‘I’m fixated on ajax again!’ ‘nevermind hi leon’ ‘i’m fixated on aj#still slightly leaning towards Leon though. sweet boy i cannot fix you but i can offer you my lap to lay your weary head for a while#actually wait i can make the same offer to ajax.#wow this is very similar to a contract law assignment; an offer made to several.#well. no. enforceability requires adequate consideration and natural affection is invalid consideration.#this wouldn’t be legally enforceable. sigh#what in god’s name am i even saying. i need to bite down on a glass vase.#✧.*🌹#✧.*🫀#🫀🐕

Switching up her modern verse to reflect where she’s at in her main verse too because Inej rescuing tr*fficking victims and breaking down those crime rings is so central to the timeline in her story that I’d like to focus on right now
#( Officially she no longer works with the Dregs. )#( She is technically still a spy and an assassin only now she is beholden to no one and nothing but her own agenda! )#( Unofficially SHE contracts Kaz and not the other way around anymore. )#( And yes……begrudgingly she sometimes still works jobs with him if he asks her Very Nicely. )#( She enforces the very nicely part LOL )#( This is also a great opportunity for more storylines because she also is an independent contractor of sorts… )#( I love the idea of Inej’s budding reputation as this liberator and people coming to her for help! )#( Anyway I do live. This time of year is hard for me as I’m sure it’s hard for many of you as well. )#( I thank you for your patience <3 )

I hate how conservatives are using these cases to fuel anti choice rhetoric but no one should be able to tell a woman to undergo a medical procedure
When you contract for a blue all-wheel drive Ford Flex and the dealership delivers a white front-wheel drive SUV, you can take the dealer to court and force him to deliver the agreed upon vehicle or pay damages.
But what happens when a same-sex couple contracts for a healthy baby boy, but tests reveal the baby has Down syndrome or is a girl? Can the surrogate mother be forced to terminate the pregnancy or pay damages for failing to deliver? What if the couple change their minds and decide they don’t want any baby. Can they force the mother to abort even if she wants to adopt?
These are not hypothetical questions but real situations that are common in the growing $6 billion surrogacy industry. They are the types of questions inevitable when human life is turned into a commodity, which is what commercial surrogacy does. They are why Congress should ban the enforcement of some items in surrogacy contracts nationwide.
Recently, a surrogate mother in Sacramento, California, contracted with a gay couple to deliver a baby boy. Then doctors discovered she had breast cancer. The mother wanted to deliver the baby early at 25 weeks so she could begin chemo treatment to save her life.
But this was not what the couple had contracted for. They had paid for a full-term baby and did not wish to accept a premature baby. So they asked the mother to abort the baby, a common clause in California surrogacy contracts. California courts do not have the power to force surrogate mothers to abort their babies, but they can find the mothers in violation of agreements, which can lead to loss of payments and medical insurance. The couple threatened legal action when the mother refused to abort.
When she offered to adopt the child, the couple again refused, because they didn’t want their DNA “out there.” The mother went ahead and had the child delivered at 25 weeks, at which point under California law, the couple automatically became the legal parents of the child. The mother had no rights. The couple reportedly refused life-saving care for the premature infant, who then died. The baby was cremated at the couple’s request.
Other mothers have fled California. One had a great relationship with her contracting couple until doctors discovered the child had a cleft lip and palate. The contracting couple asked her to abort the baby but she refused. The couple then offered the mother an extra $10,000 to abort the baby, but she again refused. Finally the mother fled to Michigan, a state where surrogacy contracts are not enforced, and she had the baby, which was adopted by another couple.
Commercial surrogacy contracts are inherently dehumanizing. In addition to often containing clauses about when a child should be aborted for not meeting contractually bargained for expectations, they also often direct surrogate mothers on how to live, including dietary, travel, and even sexual restrictions. Failure to behave as the contract directs can lead to financial penalties.
If a woman wants to serve as a surrogate for a couple she must be free to do so. There need be no criminalization of surrogacy. But when a state enforces contracts on the bodies of women, that is unnatural and inhumane and should not be condoned.
Surrogacy is a multi-billion dollar business. Congress has the power to regulate it, and should ensure that courts do not participate in its abuses.
I did a Google search on cleft palate surgeries and the best age to correct it is between 8 and 10 months. So the purchasing parents wouldn't even have to wait a year to get it fixed. I don't know their motives but as someone past 40 I will say that before social media and Instagram parents took things in stride. And yes I do have quite a few teachers in my family so I have heard about families of children with disabilities.
#anti surrogacy sunday#Surrogacy contracts should not be enforced#What would the couple with the baby with cleft palate done if they didn't use a surrogate?#How much emotional distance does going through Surrogacy lead to?#I'm no longer calling them biological parents#For now on I'm calling them purchasing parents

What obligation does a citizen have to a government that makes it clear they are not obligated to serve the citizenry? How long does a citizenry put up with a state that asks its citizens to obey the law but doesn’t give them equal benefit from fulfilling the duties of the law? How long when the citizenry derives no benefit from its participation in this system? How long when only the citizenry has responsibilities to a government, but the government believes it has no responsibility to its citizens? How long when it's clear this is not a two-way street? How long?
#The only thing that gives Supreme Court rulings any legitimacy#is our belief in the court’s legitimacy#The court cannot enforce its own rulings#it has no internal enforcement mechanisms#it relies on other governments. institutions. and federal branches to simply follow its word#but there is no legitimacy to 9 unelected nobles#The citizenry is not receiving the opportunity or security promised by the Social Contract#The idea that the first amendment can be used to deny services to protected classes you wish to discriminate against is ABSURD
