President Trump’s fight to overturn his criminal conviction returned to the spotlight on Wednesday, as his legal team clashed with the Manhattan district attorney’s office over whether the appeals process should play out in state or federal court.
Mr. Trump was convicted last spring of 34 felonies related to his attempts to cover up sex scandals during his 2016 run for the White House. His lawyers have argued several times that the case properly belongs in federal court, rather than the New York State Court in which it was brought, given that evidence in the case involved actions taken during his first presidency.
Prosecutors working for the Manhattan district attorney, Alvin L. Bragg, have countered that the accusations of which Mr. Trump was eventually found guilty — the falsification of 34 business records to disguise reimbursements for a hush-money payment to a porn star — have nothing to do with the presidency and that Mr. Trump was acting in his capacity as a private citizen.
A federal judge who has scrutinized the case, Alvin K. Hellerstein, has agreed with the Manhattan prosecutors. But Mr. Trump’s lawyers have appealed Mr. Hellerstein’s decision, leading to the arguments on Wednesday at the U.S. Court of Appeals for the Second Circuit in Manhattan.
There, a lawyer from Mr. Trump’s new legal team, Jeffrey B. Wall, argued that the Supreme Court’s 2024 decision on presidential immunity — which held that Mr. Trump was immune from prosecution for acts taken in his official presidential capacity — provided a new rationale for moving the criminal case to federal court. Doing so could allow Mr. Trump’s lawyers to appear in a more favorable forum for persuading judges to overturn the case — four Supreme Court justices have already indicated that they might be favorable to his point of view.
However, Mr. Trump could not pardon himself for the state conviction even if the case was moved to federal court.
Mr. Wall, a former acting U.S. solicitor general, argued that there was good cause to move what he called an “anomalous, one-of-its-kind prosecution” given that prosecutors had relied on evidence from Mr. Trump’s first term in the White House, which could run afoul of the Supreme Court’s ruling on presidential immunity.
But Steven Wu, the chief of appeals at the district attorney’s office, said that the law did not allow for the case to be moved to federal court after sentencing and that even if the judges found otherwise, Mr. Trump’s lawyers had squandered their chance to move it by not acting within 30 days of the Supreme Court’s immunity decision.
Moving the case, he said, “offends fundamental principles over respect for state sovereignty.” He noted that a number of “significant state law” issues were relevant to the case, and if judges were to decide against prosecutors on some of the major ones, the federal issues that are of concern to Mr. Trump could be rendered moot.
In the normal course of events, the state case would be appealed to a midlevel state appeals court, and after that to New York’s highest court — and potentially to the Supreme Court. But Mr. Trump’s lawyers were seeking to circumvent that lengthy process.
Mr. Trump’s effort to remove the case was once considered a long shot. But the judges — Raymond J. Lohier, Susan L. Carney and Myrna Pérez — paid careful attention to both lawyers’ arguments, and asked them what procedure should be followed if they did determine that there might be cause to move the case to federal court. Judge Carney acknowledged that any decision would need to weigh the interests of the presidency against those of New York State.
Mr. Trump’s criminal defense team, led by Todd Blanche, first tried to move the state prosecution to federal court before his criminal trial. They were roundly rejected then by Judge Hellerstein, who wrote “hush money paid to an adult film star is not related to a president’s official acts.”
Mr. Blanche, now a top official in the Justice Department, had to keep political considerations in mind as he fought the case, given that Mr. Trump was running for office at the time. But Mr. Wall, a lawyer with Sullivan & Cromwell, did not have to contend with similar considerations.
His presentation on Wednesday lacked some of the bombast that characterized the arguments of Mr. Trump’s lawyers at trial as they sought to convince the press and the public. Mr. Wall, by contrast, appeared to be focused solely on the judges.

Arguably, world making is essentially a feature or narrative experiences, the foundation of storytelling and stories that should comprise the starting point for narrative evaluation and tools of analysis created from within. Consideration given to narrative worldmaking reveals the manner in which storytellers use different symbol systems like written or spoken language, static or moving images, and world-image amalgamation, to trigger critics to involve in the process of co-establishing narrative worlds (Kolker, 2009, p. 9). This determines whether the worlds are imaginable as autonomous worlds of fiction or whether fictional accounts show the subject to falsification. Although stories offer a way for establishing, transforming, and aggregating narratives in a wide range of settings and media, diverse forms of story activities involve different protocols for worldmaking with a variety of consequences and impacts. In this film, Steven Spielberg explores twofold virtuosity. First, he shows his skill in designing powerful cinematic stories. Second, the filmmaker made his movie a public event, invoking an intense debate. The film opens with the slogan “inspired by real events”, in which case it relies on rhetoric devices usually employed to claim a narratives reference to historical incidences (Inaugural Symposium of the Center for Narrative Research, Heinen & Sommer, 2009, p. 172). The movie commences with the terrorist event transforming into a media incident broadcasted live. It continues with joint military and intelligence retaliations against potential organizers and other foes of the country under the perception of this first shock, and resulting into an increasingly painful pondering over a person’s value structure within the retaliations. In the film, Avner Kaufman and his crew easily present OR When writing a narrative essay, the pre-writing and revising stages become handy, in that they allow for the collection of ideas as well as editing them (Clemens, n.d).The pre-writing session of a narrative essay enables the writer to put precisely, the information and verbs of the story together. While as the narrator gathers information in the pre-writing session, he edits the information in the revising session (Clemens, n.d). Then, the writer’s aim of putting across his intended message is achieved indeed, following a good pre-writing and revision exercise. Usually, the narrative’s point of focus is evident in the first sentence and eventually appears in the closing sentence, thereby driving the point home.Narratives are purely reliant on personal experience and, therefore, going through the stage of pre-writing and revising ensures that only the important parts, relevant to the story are written. After the narrator has achieved a good pre-writing and editing session and obtaining the clarity intended for the reader, the outcome is usually a notable impact on the reader. Notably, a narrative essays writer does not only center on giving an interesting story but also focuses on exhibiting the influence of the change brought about by the life experience and to impact the audience’s mind for reflections. Judge Merchan Rejects Request To Toss Alvin Bragg Charges On Presidential Immunity Basis

Judge Juan Merchan has rejected President-elect Donald Trump’s attorney’s request to dismiss charges brought against him by Manhattan District Attorney Alvin Bragg on the basis of presidential immunity.
The trial evidence, according to Merchan on Monday, was “entirely to unofficial conduct and thus, receive no immunity protections.”
“Further, even if this Court were to deem all of the contested evidence, both preserved and unpreserved, as official conduct falling within the outer perimeter of Defendant’s Presidential authority, it would still find that the People’s use of these acts as evidence of the decidedly personal acts of falsifying business records poses no danger of intrusion on the authority and function of the Executive Branch, a conclusion amply supported by non-motive-related evidence,” Merchan wrote.
The decision followed in July when President-elect Trump and his staff asked Merchan to reverse the guilty conviction in New York v. Trump, citing the U.S. Supreme Court’s decision regarding how presidents are immune from prosecution for official actions.
The judge also said that “if error occurred regarding the introduction of the challenged evidence, such error was harmless in light of the overwhelming evidence of guilt.”
He rejected the request, but has yet to rule on Trump’s formal motion to dismiss the case altogether.
Meanwhile, Trump spokesman and incoming White House communications director Steven Cheung told Fox News that the decision is a violation of the U.S. Supreme Court’s decision on immunity.
“Today’s decision by deeply conflicted, acting Justice Merchan in the Manhattan DA Witch Hunt is a direct violation of the Supreme Court’s decision on immunity, and other longstanding jurisprudence,” Cheung said. “This lawless case should have never been brought, and the Constitution demands that it be immediately dismissed, as President Trump must be allowed to continue the Presidential Transition process, and execute the vital duties of the presidency, unobstructed by the remains of this, or any other, Witch Hunt.”
“The sooner these hoaxes end, the sooner our country can unite behind President Trump for the betterment of all Americans,” he added.
As part of the Manhattan District Attorney’s Office’s years-long investigation into the president-elect, Trump entered a not guilty plea to 34 charges of first-degree falsification of business documents. Bragg brought charges against Trump, and the inquiry was initiated by former Manhattan District Attorney Cyrus Vance.
After an unprecedented six-week trial in New York City, a liberal New York jury found the former president guilty on all counts. However, the U.S. Supreme Court ruled that a former president has substantial immunity for official acts carried out while in office.
In a formal motion filed in July, Trump’s attorney, Todd Blanche, cited the Supreme Court’s immunity decision and argued that certain evidence related to “official acts” should not have been admitted during the trial.
Blanche specifically contested the inclusion of testimony from former White House Communications Director Hope Hicks and former Special Assistant to the President Madeleine Westerhout. He also challenged evidence regarding the Special Counsel’s Office, Congressional investigations, the pardon power, Trump’s responses to FEC inquiries, his “presidential Twitter posts,” and other related testimony, claiming they were impermissibly admitted during the proceedings.
Earlier this month, Trump attorneys officially requested to “immediately” dismiss charges against the president-elect in New York v. Trump, declaring the “failed lawfare” case “should never have been brought.”
“The case would never have been brought were it not for President Trump’s political views, the transformative national movement established under his leadership, and the political threat that he poses to entrenched, corrupt politicians in Washington, D.C. and beyond,” Trump attorneys said. “Wrongly continuing proceedings in this failed lawfare case disrupts President Trump’s transition efforts and his preparations to wield the full Article II executive power authorized by the Constitution pursuant to the overwhelming national mandate granted to him by the American people on November 5, 2024.”
Trump’s lawyers pointed out that the Justice Department’s Office of Legal Counsel came to the conclusion that “the categorical prohibition on the federal indictment of a sitting president…even if the case were held in abeyance…applies to this situation.”
Last month, Bragg asked Judge Juan Merchan to postpone the case until the end of Trump’s second term.
They further stated that Bragg’s “ridiculous suggestion that they could simply resume proceedings after President Trump leaves Office, more than a decade after they commenced their investigation in 2018, is not an option.”

This year were a hella busy and tough one, and I don't think it would've been bearable if i haven't met them

He is a amazing creator which I'll always be honored to have met and drawn for, and how they had rejuvenated my passion for SU and have been inspired me a lot to keep going
False is best boy, best bro, and best everything, and at least one Connie can agree *wink wink*
and for me to inspire them back even with sille doddle shenanigans is insane and i cherish every stream i got able to join to hear their plans and projects
Their determination is another level and they deserve a round of applause
It feels surreal how kind they are, and I'm proud to say it's been a honor to see a chapter from their SU AU finally reach it's conclusion

A lawyer from one of Manhattan’s most prominent law firms will lead the appeal of President Trump’s criminal conviction, according to court papers filed on Wednesday that formally announced the appeal.
The participation of the lawyer, Robert Giuffra Jr., a co-chair of Sullivan & Cromwell and one of New York’s better-known appellate lawyers, adds muscle behind Mr. Trump’s long-anticipated attempt to overturn his conviction. He was found guilty last year on 34 felony counts of falsifying business records in a case brought by the Manhattan district attorney’s office.
Mr. Giuffra’s involvement underscores how New York’s legal power players have warmed to the president. Mr. Trump was spurned by lawyers from major firms when he left office four years ago, but his second victory has brought about a sea change. Many large corporations and business leaders have lined up to support the second Trump administration.
“President Donald J. Trump’s appeal is important for the rule of law, New York’s reputation as a global business, financial and legal center, as well as for the presidency and all public officials,” Mr. Giuffra said in a statement. “The misuse of the criminal law by the Manhattan D.A. to target President Trump sets a dangerous precedent.”
A spokeswoman for the Manhattan district attorney, Alvin L. Bragg, declined to comment.
In a seven-week trial last spring, the district attorney’s office persuaded a jury that the president had approved the falsification of records to disguise a scheme to hide three potentially damaging stories from the public during his first White House run in 2016.
To conceal the last of those stories, prosecutors argued, Mr. Trump dispatched his fixer at the time, Michael D. Cohen, to pay hush money to Stormy Daniels, a porn star who told the jury her story of sex with Mr. Trump.
Mr. Cohen was then reimbursed in 2017, leaving a paper trail of 34 documents that prosecutors said were false business records.
Mr. Trump’s defense lawyers, Todd Blanche and Emil Bove, fought the conviction, but the president has named both men to high positions in the U.S. Justice Department. Now, Mr. Giuffra will face off against the district attorney’s head of appeals, Steven Wu, as the case is heard by a midlevel appeals court in Manhattan.
The case presents various issues for the court. Falsifying business records is a felony only if the records were faked to conceal a second crime. In Mr. Trump’s case, prosecutors argued that second crime was a violation of state election law that prohibits a conspiracy to promote a candidacy “by unlawful means.”
That complex legal theory was approved by the trial judge, Juan M. Merchan, and a federal judge who evaluated the case, Alvin K. Hellerstein, took no issue with it. But it may be vulnerable to the scrutiny of appellate judges.
Mr. Trump’s lawyers have also argued that the Supreme Court’s decision on presidential immunity last summer — a decision that fatally delayed a federal criminal case in which Mr. Trump was accused of working to overturn the 2020 election — invalidates some of the trial evidence.
Another vulnerability may spring from Ms. Daniels’s testimony. After her first morning on the stand, Mr. Trump’s lawyers moved for a mistrial, arguing that her graphic testimony about sex with their client had prejudiced the jury. Justice Merchan said that while he agreed that Ms. Daniels had said things “that would probably have been better left unsaid,” a mistrial was not warranted.
This month, Justice Merchan sentenced Mr. Trump, but gave him what is known as an unconditional discharge. The sentence carries no penalty, but formalized the president’s status as a felon. That status will stand until the appeal is decided.
Mr. Giuffra, and the other two Sullivan & Cromwell lawyers handling the appeal, Matthew Schwartz and James McDonald, all clerked at the Supreme Court and are partners at the firm. Their decision to take on the appeal is the latest link between the firm and the president. Mr. Trump named Jay Clayton, another partner, as his pick to lead the U.S. attorney’s office in Manhattan.
The posture of the firm echoes that taken by high-profile business leaders across the country. But it is not wholly without risk: Some clients might look askance at any affiliation with a polarizing president.
Mr. Giuffra, who donated to Mr. Trump’s campaign and other Republican causes, was under consideration to represent Mr. Trump during his first term, but ultimately did not join his legal team.
