Coeur d’Alene Loop (Day 3)

The third day of my trip was the longest (70+ miles) but it was all paved and except for a hilly stretch in the first hour and a very gradual climb at the end, it was flat. And while it began gray and misty, the rain had ended overnight and the sun gradually came out during the ride.
Highway 5 west of St. Maries isn’t terribly bike friendly (curves, hills, limited shoulders, traffic, trucks) and I had sort of hoped to take advantage of a shuttle offered by the motel, but it wasn’t available today, so I headed out early and took as many precautions as I could. Fortunately, traffic was light and I was able to pull over when I felt that cars coming up behind me wouldn’t be able to see me or wouldn’t have room to get around safely.

It was only 12 miles to Heyburn State Park, where I left the highway and cut over to the Trail of the Coeur d’Alenes. I picked up the trail at Mile 6 (the trail begins in Plummer) and rode it all the way back to Wallace at Mile 65. The trail is beautifully done - good pavement, great scenery, occasional restrooms and pullouts.

I crossed the Chatcolet Bridge, then followed the southeastern shore of Lake Coeur d’Alene north to Harrison (Trail Mile 15) where I stopped for coffee at the Cycle Haus. The trail then follows the Coeur d’Alene River upstream through a broad valley of lakes and wetlands, eventually reaching the I-90 corridor at Cataldo (Trail Mile 42). The old mission is definitely worth a side trip, but I’d visited it before so didn’t make the effort. The trail continues along the river while the Interstate takes a more direct route, so for the next several miles it is far out of earshot, making this a very pleasant segment.

After Trail Mile 48, the route parallels the highway and now you’re passing through the heart of the old smelter district, where mining, smelting, and the subsequent cleanup have left a fairly barren landscape (it sounds like the Trail of the Coeur d’Alenes is to a large extent a product of the cleanup since the old rail bed needed cleaning up and there was funding to reimagine how this might be done and to assist communities and the tribe to build amenities). The trail remains excellent, even through this more desolate stretch, and Kellogg has redeveloped itself as a major recreation (summer and winter) destination (particularly the Silver Mountain complex with its hotels and long gondola to the top). I stopped for coffee at The Beanery before continuing the last ten miles through the old mining districts of Osborne and Silverton and back to my car in Wallace.

I got back to the car by 2:30, unpacked the gear, tossed the bike into the back, and changed out of my filthy riding clothes. I was in Seattle (360 miles, all on I-90) by 9:30.

Idaho Vandals sign #25 ranked recruiting class following Dyansty Year #2
Following a season in which they finished #4 in the final BCS Rankings and played in the National Championship Game, the Idaho Vandals have announced their recruiting class for the end of Dynasty Year #2 / Start of Dynasty Year #3.
According to 24/7 Sports - the Vandals class ranks 25th best in the nation, after mustering just the 104th best class after Year #1 of the Dynasty.
Idaho was able to sign a total of 19 players

Obviously the name that jumps off the page in this class is QB, Akim Mills. In the 24/7 Sports rankings, he was the #5 rated quarterback in this class and should step-in to be the starter on day one of his college career after Matt Linehan has graduated.
Coach Idaho Coach spoke with the media on a conference call at the end of National Signing Day.
"We are so excited about this recruiting class, not only did we sign 19 great football players, but 19 young men that are going to be wonderful additions to our university campus. I think the flashiest commitment we got this year will likely be Akim Mills at quarterback. We have been on Akim since I was hired here, and have maintained a relationship with him that made us and him comfortable about what we are trying to build here. We think he can be successful as a freshman, but he won't just be handed the starting job, we have a strong quarterbacks room, so he'll have to earn that spot.
I'm really glad that we got a handful of in-state kids. As we elevate the status of our program, we don't want to leave our home state kids behind. I've seen that with another program down South of here, and it started to bite them in the back side. As long as I am here, we will continue to recruit players from the state of Idaho, not just to pander to our alumni, but because this state produces great football players.
We can't wait for spring ball to get started. A few of our commits will be graduating early and joining us for that, including Akim Mills. We're fired up and ready to start our third season here in Moscow.

Coach Idaho Coach is coming off of the best season in Idaho Vandals history, leading his team to a 13-1 finish, and an appearance in the BCS National Championship Game. Coach Idaho Coach himself, was also named the National Coach of the Year following Dynasty Year #2, and should be able to use those accomplishments as increased leverage for recruiting players in Dynasty Year #3.

March 04, 8:00 am Moonrise - September 2023 I had hopes of catching the moon rising over the mountains, but once I was out on the bridge waiting for the moon to rise, I realized that the mountains were south of the bridge. At first I was disappointed that I had to settle for the moon rising over some trees, but then the moon broke through the clouds and created this image. The second image is a closeup of the moon wreathed in clouds. MWM

This is part 2 of a series concerning Ethicon’s concerted effort to judge shop and forum shop in the ETHICON PHYSIOMESH™ medical device lawsuits pending in Federal Court. This scorched earth legal strategy by Johnson an Johnson’s corporate subsidiary is disconcerting to say the least. If you don’ believe this occurred, just read their memorandum they submitted to the Court. It reads like a judge shopping and forum shopping manifesto and guide. See part 1 of 2 of this series here
ETHICON’S MESH ATTORNEYS TRY TO STEER CLEAR OF JUDGES IN FLORIDA!
In a unusual tactic, Ethicon challenged the capabilities and experience of an entire Federal District Court to handle the Psyiomesh lawsuits! Normally, it is best practice for corporate counsel to show proper respect and deference to Federal Court judges. After all, these judges may hear sensitive and lucrative cases that such attorney are involved with in the future.
Nonetheless, Ethicon’s hernia mesh lawyers in a scortched earth legal tactic argued that: “The Middle District of Florida is not an appropriate venue.”  This is a slap in the face to the entire Middle District of Florida! This type of command and control scorched earth litigation is not surprising, to say the least. Ethicon’s mesh defense attorneys even tried to censor our legal articles as you will see by the cease and desist notice they sent to us.
If this isn’t forum and judge shopping then we don’t know what is!
The Middle District of Florida is comprised of the following divisions:  Ft. Myers Division, Jacksonville Division, Ocala Division, Orlando Divisionand Tampa Division. This District has a proud tradition of judicial independence, judicial fairness and competency. Some of the greatest legal minds in the Federal Courts are in the Florida Federal Court Judiciary .
Nonetheless, Ethicon asserted that these Florida judges lacked the experience and capability of determining these surgical mesh causes of action. Perhaps, Ethicon’s lawyers should spend more time attempting to settle the Physiomesh claims rather then disparaging Florida Federal Court Judges. Ethicon’s corporate  hernia mesh defense law firm does not seem interested in a Physiomesh settlement 2017. A global Physiomesh settlement 2018 also seems highly unlikely.
Hypocritically, Ethicon’s lawyers accuse the victims attorneys of judge shopping while in the midst of shopping for judges themselves!
Ethicon’s mesh attorneys, citing a very well respected manual, authored by David F. Herr, asserted that: “(“The Panel . . . will act to avert or deflect attempts by a party or parties to ‘game’ the system”); David F. Herr, Multidistrict Lit. Manual §§ 5:41, 7:7 (2016) (noting “the judiciary’s traditional opposition to tactics designed merely to permit forum-or judge shopping,” that “[t]he Panel does not give the parties an opportunity to judge-shop,” and that “[t]he Panel is quite ready to ignore the positions taken by the parties, especially when the odor of forum shopping is present”)” DEFENDANTS’ RESPONSE IN OPPOSITION TO PLAINTIFFS’ MOTION FOR TRANSFER PURSUANT TO 28 U.S.C. § 1407 , In re: Ethicon Physiomesh Flexible Composite ) MDL No. 2782 Hernia Mesh Products Liability Litigation, William M. THE AUDACITY OF ETHICON’S MESH LAWYERS
Ethicon’s  hernia mesh attorneys have the audacity to rail against the “odor of forum shopping”. At the same time, Ethicon’s mesh lawyers are authoring what is essentially a manifesto attempting to forum shop and judge shop themselves. Id. Ethicon’ actions does not have just an odor of forum shopping, it stinks like a  cesspool.  Say it ain’t so! To add insult to injury, Ethicon has the chutzpah to suggest that any attempt to judge shop by the victim’s lawyers should be ignored.  Ethicon has reached new heights in hypocrisy.

Judge shopping and forum shopping is wrong, no matter the rationale. Judge shopping is even unseemly when such judge shopping is reactive to what the other side is doing.
ETHICON APPEARS TO ARGUE THAT THE MIDDLE DISTRICT OF FLORIDA IS INAPPROPRIATE PARTLY BECAUSE THE PLAINTIFF’S REQUESTED THAT DISTRICT.
In the Memorandum to the Federal Court, Ethicon’s high powered hernia mesh defense attorneys quote Plaintiff’s hernia mesh lawyers who stated that the, “Middle District of Florida is uniquely situated as the appropriate forum to handle these cases because that Court has the most constituent cases filed, and one of the first-filed cases in the country.” (Doc. 1-1, p. 4).” Id.
ETHICON’S ATTORNEYS ATTEMPT TO ASSAIL THE VICTIM’S ATTORNEYS REQUEST THAT THE CASES BE DETERMINED IN FLORIDA BY ARGUING IN SUMMARY:
The victims have filed more cases in Florida so that they can get all the claims resolved in Florida federal Courts.
The Federal Court’s should not give any credence to where the hernia mesh victim’s filed their cases.
The incidents in the case did not occur in Florida.
HERE IS AN EXCERPT OF ETHICON’S MEMORANDUM PREPARED BY THEIR ETHICON PSYIOMESH HERNIA MESH DEFENSE LAWYERS:

“While there are more cases pending in that district than other districts, that is because Plaintiffs’ counsel have chosen to file more of the earlier suits there, perhaps in order to influence the Panel’s choice of MDL venue. This is a matter virtually exclusively under the control of Plaintiffs’ counsel. There is no product-related reason to believe that there will be a disproportionate number of filings in the Middle District of Florida as opposed to any other district. Little deference should be accorded to the plaintiffs’ choice of forum when the events giving rise to their claims occurred outside the district and their primary goal in bringing suit in that district is to create a de facto MDL. See In re: Eastern Dist. Repetitive Stress Injury Litig., 850 F. Supp. 188, 194 (E.D.N.Y. 1994). The gravamen of Plaintiffs’ claims is that PHYSIOMESH was defectively designed and/or the warnings contained in the IFU were inadequate. None of the events connected with these claims took place in Florida.” Id.

ETHICON’S CORPORATE DEFENSE LAWYERS IN SUMMARY ARGUE:
The victims argue that the first case filed was in Florida
There are actually two cases in Georgia that were filed before the Florida case
Nothing is going on in the case filed in Florida to help the inexperienced Florida judges learn how to handle the cases
HERE IS AN EXCERPT OF ETHICON HERNIA MESH DEFENSE ATTORNEYS MEMORANDUM:
“Plaintiffs suggest that the Middle District of Florida is the appropriate forum on the purported basis that “one of the first-filed cases in the country” [Quinn] is in that district. (Doc. Doc. 1-1, p. 5). Yet as explained above, two other cases have been pending longer, including the Lucas case, which has been pending in the Northern District of Georgia since December 2015— nearly a year longer than the Quinn case.” Id.  DEFENDANTS’ RESPONSE IN OPPOSITION TO PLAINTIFFS’ MOTION FOR TRANSFER PURSUANT TO 28 U.S.C. § 1407 , In re: Ethicon Physiomesh Flexible Composite ) MDL No. 2782 Hernia Mesh Products Liability Litigation, William M. “More important, the Quinn case is truly in its infancy. Not only was the complaint filed relatively recently—September 22, 2016—but the plaintiff in that case has not yet served written discovery requests, and no depositions have been scheduled or taken. The parties have not personally appeared before the assigned judge. Quite simply, nothing has transpired in that case that would afford that court greater knowledge about the issues in these cases than any other federal court in the country.” Id.
ETHICON’S LAWYERS BELIEVE THE HONORABLE JUDGE BYRON SHOULD NOT HANDLE THE ETHICON PSYIOMESH CASES AND ARGUE IN SUMMARY:
The victims want Judge Byron because he ““has already developed familiarity with the issues present.”
Judge Byron is not familiar with the Psyiomesh case issues.
In fact, the judges in Florida are just as unfamiliar with these issues as Judge Byron.
There are not many Psyiomesh cases in Florida and these cases are stagnant without progess and as a result there is no good reason to litigate these cases in Florida.
ETHICON’S PUBLIC AIRING OF DISCONTENT WITH JUDGE BYRON DETERMINING THE CASES IS UNSEEMLY, DISCONCERTING AND UNPROFESSIONAL.
According to his biography, “Born in Queens, New York in 1959, between 1986 and 2014 Judge Byron served four years in the United States Army Judge Advocate General’s Corps, twelve years in the Department of Justice, two years at the International Criminal Tribunal for the Former Yugoslavia, and Judge Byron spent 10 years in private practice as a civil trial lawyer. On June 27, 2014, Judge Byron was sworn in as a United States District Judge for the Middle District of Florida. http://www.flmd.uscourts.gov/judicialinfo/Orlando/JgByron.htm
HERE IS AN EXCERPT OF ETHICON’S HERNIA MESH LITIGATION POSITIONS FROM THEIR ACTUAL MEMORANDUM SUBMITTED TO THE FEDERAL COURTS:
“Advocating for an assignment to Judge Byron, Plaintiffs quote from In re: American Inv. Life Ins. Co. Annuity Mktg. & Sales Prac. Litig., 398 F. Supp. 2d 1361, 1362 (J.P.M.L. 2005), which suggests that the Panel should assign an MDL to a judge who “has already developed familiarity with the issues present in this docket as a result of presiding over motion practice and other pretrial proceedings in the actions pending before her for the past year.” In stark contrast to the court in American Inv., Judge Byron has not had the opportunity to develop any familiarity with the issues. Nor have the judges for any of the other cases filed in the Middle District of Florida developed any familiarity with the issues. Indeed, even Plaintiffs acknowledge that “[n]one of the related actions are sufficiently advanced toward trial.” (Doc. 1, p. 2). Thus, the statistically insignificant number of cases that happen to be currently pending in Florida and the lack of significant progress in those cases does not support centralization in Florida. See In re: Darvocet, Darvon & Propoxyphene Prod. Liab. Litig., 780 F. Supp. 2d 1379, 1381-82 (J.P.M.L. 2011) (“[T]he location of the currently filed cases is not a particularly significant factor in our decision. . . . Since all the actions in this docket are at an early stage, transfer to another district should not be disruptive”).” DEFENDANTS’ RESPONSE IN OPPOSITION TO PLAINTIFFS’ MOTION FOR TRANSFER PURSUANT TO 28 U.S.C. § 1407 , In re: Ethicon Physiomesh Flexible Composite ) MDL No. 2782 Hernia Mesh Products Liability Litigation, William M. HERE IS A SUMMARY OF ETHICON’S ARGUMENTS IN THEIR MEMORANDUM:
The movers and shakers such as witnesses, physicians and experts involved in this litigation are not in Florida and are across the United States
Steer clear of this corner of the United States because it is not accessible or convenient
Get a federal judge who is experienced  in this type of lawsuit unlike the Florida judges
“Consideration of the location of the parties, witnesses, and documents also does not support the Middle District of Florida as the appropriate transferee court. Plaintiffs (and their counsel), treating physicians, and expert witnesses will be spread across the country. Defendants are New Jersey corporations, and Defendants’ witnesses and documents are located primarily in New Jersey and other places (i.e., Europe), not including Florida. There is no reason to centralize these cases in the southeast corner of the United States. Even if the Southeast is truly the “center of gravity” of this litigation as claimed by Plaintiffs (Doc. 1-1, p. 7), Atlanta (or even Covington, Kentucky) would be more accessible and convenient than any cities in Florida. Finally, considering judicial efficiency, caseloads, existing MDL dockets, and experience of proposed transferee courts, other venues are much more suitable than the Middle District of Florida. Should the Panel centralize these cases, they should be transferred to an experienced federal judge whose docket is equipped to handle such a proceeding. See, e.g., In re: Google Inc. Cookie Placement Consumer Privacy Litig., 867 F. Supp. 2d 1356, 1357 (J.P.M.L. 2012) (assigning MDL to “a jurist experienced in complex multidistrict litigation”); In re: Blood Reagents Antitrust Litig., 652 F. Supp. 2d 1373, 1374 (J.P.M.L. 2009); In re: Vioxx Prods. Liab. Litig., 360 F. Supp. 2d 1352, 1354 (J.P.M.L. 2005) (“[W]e are assigning this litigation to a jurist To the extent that filings have been weighted toward the Southeast thus far, it is only because Plaintiffs’ counsel strategically chose to file these cases early in order to argue for the venue of their choice. This is, at most, a temporary situation, and there is no reason to believe that will continue. Indeed, after Plaintiffs filed their motion, PHYSIOMESH cases were filed in the Western District of New York, the Western District of Washington, the District of Minnesota, the Western District of Michigan, the Southern District of Ohio, the District of North Dakota, and other jurisdictions. experienced in complex multidistrict products liability litigation and sitting in a district with the capacity to handle this litigation”).
PASSIVE AGGRESSIVELY, ETHICON SEEKS TO EVADE THREE FEDERAL JUDGES
The old adage that if you cannot say something nice don’t say anything at all. Ethicon’s attorneys apparently do not live by that adage questioning Judge Byron’s experience and ability to handle the Psyiomesh  hernia mesh cases. Ethicon’s hernia mesh attorneys questioned Judge Byon’s experience and indirectly his ability to handle the cases. Adding a passive aggressive flair, they questioned him “respectfully”. The word respectfully, does not make it any less of a slight.
IF THIS ISN’T JUDGE SHOPPING I DON’T KNOW WHAT IS JUDGE SHOPPING!
Ethicon’s mesh lawyers also questioned two other federal Judges ability to handle the Psyiomesh causes of action: Senior Judge Susan Bucklew and Judge James Whittemore.  This type of advocacy at the expense of esteemed federal Court justice’s experience and ability is not likely to win any admirers among the fraternity that are federal judges.
To add insult to injury, the mesh defense lawyers cite the importance of an “experienced” and “capable” judge immediately after disparaging Judge Byron’s experience.  Is this suggesting Judge Byron is not “capable” of handling the Psyiomesh claims? You be the judge. This also is no way to ingratiate yourself to Federal Court Justices.
The hernia mesh defense attorneys declared in there memorandum: “Respectfully, Plaintiffs’ first choice, Judge Byron, has no MDL experience and has been on the bench for fewer than three years. See In re: Ampicillin Antitrust Litig., 315 F. Supp. 317, 319 (J.P.M.L. 1970) (“[T]he availability of an experienced and capable judge familiar with the litigation is one of the more important factors in selecting a transferee forum”). As for Plaintiffs’ alternative suggestions, Senior Judge Susan Bucklew has never presided over an MDL, and Judge James Whittemore has not presided over a products liability MDL.” Id.
IT IS NOT JUST FLORIDA JUDGES, ETHICON’S LAWYERS THROW THE ESTEEMED JUDGES OF THE THE SOUTHERN DISTRICT OF ILLINOIS UNDER THE BUS!
“The Southern District of Illinois is not an appropriate venue. Plaintiffs, like many other recent plaintiffs, alternatively request transfer to the Southern District of Illinois and an assignment to Judge David Herndon. Plaintiffs’ only explanation for suggesting Judge Herndon is that he “has substantial product liability MDL experience, and he has proven to be an innovative and well-qualified MDL judge.” (Doc. 1-1, pp. 7-8).” Id.

To be told that the one you love, loves you and that you will marry them and be together for the rest of your life is intoxicating. They give you hope that keeps you calling and calling until after you see that you have been lied to, you begin to face reality and the truth sinks in, you now realize that what they said was not true when they said it nor will it ever turn out to be true. You will find yourself hurt and disillusioned beyond the ordinary disillusionment experienced from your own life's complications. You may even find yourself broke or in debt. It's unconscionable that people could prey on others' vulnerabilities and pain in this way. But that is exactly what they do. And in the end, there is only more pain. And the inevitable distrust of psychics. It's this "fake" paradigm, which has its roots in the first elemental phone psychic networks, that dominates the public's perception and legitimate scrutiny is reasonable. But real psychics around the globe are out there and you should make it your business to find a foolproof way of determining who is real and who is not until such time as this paradigm is changed to ensure that your advisor is authentic by virtue of their credentials as it is for any professional practitioner.
Now you may frequent sites where the advisor is given feedback after your call. This is a good thing but, it is not foolproof. I have seen fake psychics who will have almost perfectly glowing feedback that goes on and on for pages. Perfect! You may wonder why this occurs. Simple. After you hear exactly what you want to hear or want to believe verified, well, this is where that intoxication comes in, you tend to reflect your glorious feelings with equally glowing feedback! But when things don't happen the way were told, you never come back. So, others following in your footsteps will call this advisor because "they too want to believe." Another thing to watch out for is fake feedback. This is also a tactic used by fakes to fool you. On sites where feedback is left, an authentic psychic advisor has to have a very high level of integrity in order to be comfortable telling the truth despite the fact of what the client wants to hear. If the psychic does not tell them what they want to hear in a reading, the client may leave very bad comments and a bad rating. It's the price you pay for being real. In my experience when I tell a client something they didn't want to hear, for the most part, they don't leave any comments. The fact is, they will most likely go find another psychic who will reflect their own feelings about the situation. A reading can be truthful and uplifting without bringing the client down but you have to ready to hear the truth. So how do you know who is real and who is not based on feedback! That is not to say that an authentic psychic is not going to have great feedback. They do, but sometimes they will be the ones to receive bad ratings and feedback mixed in with the good. Life is all about taking the good with the bad. Honestly, it's very hard to tell. The proof is really in the reading and outcomes and developing a relationship with a few trusted advisors who have been able to connect with you and your energy and have proven that their insights and predictions have been accurate for you. But, just remember, if it sounds unbelievably good, it probably is not really true and the psychic is not real and only setting up a line to take your money and setting you up for emotional failure. So be careful of perfect feedback. It's really not always an accurate gauge of the psychic advisors true abilities; except of course their ability to fleece you out of your dollars. Of course, really consistently bad feedback is a good indication that the advisor is probably just very bad and should think about going into another line of work.
Another point, you need to understand that even if you are speaking with a gifted, authentic psychic, you and that particular psychic may not connect that well. That is different from the psychic being fake. There a many reasons why a particular psychic may not connect with you. They may not be rested and ready to take calls, or you may not be relaxed and ready to receive truthful information or in some other way blocking the flow of what is being channeled thereby skewing the information on either side. Psychic readings are not an exact science. Intuition is relied upon to conduct an accurate psychic reading for a client. The reading goes much better when both the psychic advisor and client are relaxed and ready to receive. I personally find it difficult to connect with a client who wants to hear a certain thing. I have experienced many times my client trying to guide the reading. So see your authentic psychic advisor as someone who wants to help you and be ready to assist in the flow of information. To spot a fake psychic is not impossible, but if there was a way to quantify the statistic of fakes out there, I would be willing to bet that most (due in large part to large networks hiring script readers) are not real. Unfortunate, but through observation and experience, I feel this to be true. One of the Oldest Tricks in the Book. First Warning Sign That You Have Got a Fake! One of the oldest tricks in the book and something which continues to surprise me because people are continually taken in is when a psychic tells you someone has put a curse on you or there is a negative block on you which only they can remove for some exorbitant price, HANG UP! Say goodbye, because this person could not care less about you or your problems. Psychic parlors are notorious for this kind of activity. It is not for real, the curse nor the psychic. I have always believed that having a good doctor, a good mechanic and a good psychic are all professionals that are worth taking the time to assess their skill, experience and credentials to see if they are the one for you. There is nothing more satisfying than actually making a positive difference in someone's life and their continued use of your service over many years. A walking, talking testimonial is very gratifying for this psychic advisor.

Katydid - October 2023 Riverside Park at Heyburn, Idaho, was a nice place to stop for a few days on our way south. As I was breaking camp and removing the sewer hose, something jumped from the hose onto my hand. I jumped and it jumped again onto the gravel alongside the site. It was a Katydid. These are somewhat reclusive and I was surprised to see one out in the open like this. It did stick around long enough for me to run into the camper and get one of my cameras for these neat images. MWM

Row of Geese - September 2023 I don’t very often have all my ducks in a row, but once in a while I capture an image of geese in a row. It was near sunset and the sun was very low. I didn’t realize how complex the waves patterns in the Snake River were until I looked at the images later. The wave lines at the bottom of the image and the choppy waves at the top create a border for the geese as the swim through in a line. MWM
