hi. i know a lot of stuff are happening right now with the pandemic and our own problems in our country, not to mention other school related requirements that some of us still need to pass or the pressure that we feel especially since a lot of us just graduated and are trying to find universities for our first year in college.
however, it’s kind of hard for me to stay quiet even though i’m miles away from the U.S. i can’t help but feel devastated over the current events that is happening there which is mainly about racism.
also knowing the fact that there are people out there who doesn’t have the same privilege each time they set foot outside their homes. i want to use at least use this platform to speak about the issues that MATTER. I stand with the #BlackLivesMatter movement along with the protesters out there, and YOU should too.
On May 25, 2020 in the evening, George Floyd was murdered by police officer Derek Chauvin by kneeling on George’s throat. George was arrested supposedly because he used a counterfeit 20$ bill in buying cigarettes. George did not show any aggressive behavior while he was being arrested, but he was still murdered by three other policemen.

House Passes Bill To Legalize Marijuana For Federal Purposes
As more and more states legalize marijuana, pressure has been growing for Congress to take some action. This week, the House passed legislation that would end the federal ban on marijuana.
The Marijuana Opportunity Reinvestment and Expungement Act (MORE Act) garnered support from both sides of the aisle, passing with a 228-164 vote in the House. Under the terms of the bill, marijuana would be removed from the Controlled Substances Act.
History Of the Criminalization Of Marijuana
In the early part of the 20th century, booze was illegal during Prohibition, but marijuana was not. Under the 1937 Marihuana Tax Act, there was a two-part tax on the sale of marijuana, one which functioned like a sales tax and another which was more akin to an occupational tax for licensed dealers. Violations of the Act resulted in severe consequences.
In 1969, Timothy Leary challenged his arrest for possession of marijuana under the Act; the case of Leary v. United States��made it to the Supreme Court. The Court invalidated part of the Act as a violation of the Fifth Amendment (against self-incrimination). The result was a new law, the Controlled Substances Act, passed in 1970, which criminalized the possession or sale of marijuana. It has remained so to this day.
Marijuana Is Legal In Most States
While still prohibited by federal law (possession can lead to fines and jail time), today, forty-four states and the District of Columbia currently have laws legalizing marijuana for either medical or recreational use. States which allow marijuana for medical use include Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Hawaii, Illinois, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Dakota, Texas, Utah, Vermont, Washington, and West Virginia – as well as the District of Columbia (some states allow CBD oil use only, including Georgia, Indiana, Iowa, Kentucky, Texas, Virginia, and Wisconsin). And, one in three Americans lives in a state that allows for recreational use.
Most Americans Think Marijuana Should Be Legal
According to a 2019 Pew poll, a whopping 91% support making medical marijuana legal, and 67% of Americans think marijuana should be legal, full stop. Despite the trend, possession of marijuana remains a federal crime. Under federal law, marijuana is still classed as a Schedule I drug – on par with heroin, LSD, and ecstasy – which means that it is not legal in any form. It is against federal law to grow, sell, or use marijuana for any purpose, including medical purposes.
The MORE Act
The MORE Act would change that.
The Act would also, among other things, impose a 5% tax on marijuana to fund community and small business grant programs, make Small Business Administration (SBA) loans and services available to cannabis-related legitimate businesses, and prohibit the denial of federal public benefits based on certain cannabis-related conduct or convictions.
Economic Considerations
Currently, taxpayers and the government bear the burden of costs (but do not enjoy the revenue) to investigate and prosecute marijuana crimes. The federal government spends approximately $33 billion a year on drug control, while state and local governments spend nearly the same on criminal justice expenditures related to drug crimes. According to the National Drug Intelligence Service, the war on drugs costs the United States almost $200 billion a year in indirect costs (downloads as a PDF).
Current drug laws target users, peddlers, and hardcore dealers. In 2018, there were 1.65 million arrests for drug violations in the U.S. Of those related to marijuana, more than nine-in-ten arrests were for possessing marijuana (92%), rather than selling or manufacturing (8%).
What does that mean to you? Tax dollars. In 2015, the total state expenditure – not including federal costs – on prisons among 45 reporting states was around $43 billion.
In 2012, it was estimated that the legalization of marijuana (not just for medical purposes) could take $10 billion away from the cartels and dealers. A 2018 presentation before the Joint Economic Committee in Congress reported that the marijuana economy totaled more than $8 billion in sales in 2017, with sales estimated to reach $11 billion in 2018 and $23 billion by 2022.
While marijuana sales are reportable – even if not legal – the Internal Revenue Service (IRS) has not always been successful in collecting the related revenue. As marijuana is increasingly legal in various states – while still illegal at the federal level – the IRS is taking steps to educate taxpayers about the tax consequences. The agency has even released a new marijuana business webpage to help business owners understand and meet their tax responsibilities.
However, since marijuana remains illegal for federal purposes, the IRS still takes the position that some related expenses are disallowed under Section 280E of the Tax Code:
§280E. Expenditures in connection with the illegal sale of drugs. No deduction or credit shall be allowed for any amount paid or incurred during the taxable year in carrying on any trade or business if such trade or business (or the activities which comprise such trade or business) consists of trafficking in controlled substances (within the meaning of schedule I and II of the Controlled Substances Act) which is prohibited by Federal law or the law of any State in which such trade or business is conducted.
Today, only the cost of goods sold is deductible for marijuana businesses. Traditional business costs, like employee payroll and marketing, remain non-deductible. The result is that marijuana businesses can be left with an effective tax rate between 40 and 70 percent.
Of course, this would change if marijuana is made legal for federal tax purposes. And even though the MORE Act passed the House, there’s no a guarantee that it will pass the Senate where it’s expected to face some opposition.

Because state laws, rules, and regulations are changing frequently, sometimes in connection with litigation, we research and update the entries for each state on a monthly basis.
This post is about Indiana, which prohibits the sale of smokable hemp, and a lawsuit that seeks to overturn that prohibition. A bit of background will be helpful. As we wrote in July 2020:
Indiana has long been at the forefront of hemp product regulations. Two years ago in 2018, Indiana passed a comprehensive law that regulated low-THC hemp extracts. At the time, state-level regulation of CBD was mostly limited to medical marijuana programs in conservative states that only allowed CBD extracts for use by medical patients. Very few states were making the distinction for CBD derived from hemp (Hemp CBD) and fewer still were imposing manufacturing, testing, and labeling requirements .
Indiana’s hemp framework, however, was similar to the packing and labeling requirements for cannabis products in west coast states where recreational marijuana is legal. We may see more states adopting similar requirements, and possibly even the FDA. So should everyone do what Indiana is doing? No.
In 2019, Indiana passed Senate Enrolled Act 516 (“SEA 516â€) to bring Indiana’s definition of hemp in line with the 2018 Farm Bill and to establish a regulatory framework for hemp production. SEA 516 criminalized the possession of “smokable hemp,†which it defines as any industrial hemp product “in a form that allows THC to be introduced into the human body by inhalation of smoke.†Ind. Code § 35-48-1- 26.6. The law provides that “[a] person who knowingly or intentionally manufactures, finances the manufacture of, delivers, finances the delivery of, or possesses smokable hemp … commits dealing in smokable hemp, a Class A misdemeanor.†Ind. Code § 35-48-4-10.1.
In short, Indiana made it a crime to manufacture, deliver, or possess smokable hemp. The law was challenged in a federal lawsuit arguing, among other things, that the ban on smokable hemp was preempted by the 2018 Farm Bill. That lawsuit was appealed to the Seventh Circuit Court of Appeals, which issued an opinion this past summer. You can read our coverage of that opinion here.
While that appeal was pending, Indiana enacted Senate Enrolled Act 335 (“SEA 335â€), which limited the scope of the scope of SEA 516 in an attempt to save the law. But SEA 335 did not make smokable hemp legal. Rather, SEA 335 tried to make it clear the prohibition on the delivery and possession of smokable hemp did “not apply to the shipment of smokable hemp from a licensed producer in another state in continuous transit through Indiana to a licensed handler in any state.†So smokable hemp passing through Indiana to another state is “legalâ€, whereas smokable hemp otherwise possessed or delivered in Indiana is not. And that is not good for sellers and buyers of smokable hemp.
The Seventh Circuit remanded the case and plaintiffs moved to amend their complaint to add claims challenging both SEA 516 and SEA 535 and to conform their complaint to the Seventh Circuit’s decision. This meant including allegations that:
SEA 516 violates the 2018 Farm Bill’s prohibition on restricting the interstate transport of hemp products, a problem which was not remedied by SEA 335 because SEA 335 imposes licensing requirements that are not included in the 2018 Farm Bill; thus, Plaintiffs now allege that both statutes are expressly preempted. Plaintiffs also allege that the criminalization of hemp bud and hemp flower in SEA 516 conflicts with the 2014 Farm Bill’s legalization of all parts of the hemp plant, including hemp bud and flower, and the 2018 Farm Bill’s reaffirmation of the legalization of all parts of the hemp plant and its clear prohibition against states modifying the federal definition of hemp, and is therefore conflict preempted. Y. Wholesale, Inc. v. Holcomb, No. 119CV02659SEBTAB, 2020 WL 6583069, at *2 (S.D. Ind. Nov. 10, 2020).
Although federal rules provide that courts should freely permit amendment, the standard differs when the defendant contends that amendment would be “futile,†which the defendants argued here in opposition to the motion to amend. When a party argues that an amendment would be “futile,†the party is saying, “Listen judge, you should not let the other side amend because the new complaint cannot survive a motion to dismiss. Even if everything in the new complaint were true, the plaintiffs will lose as a matter of law. So granting the motion to amend is futile.†When a party makes this argument, the court analyzes the proposed amendment under a motion to dismiss standard—nowhere near as lenient as the rule directing courts to “freely permit†amendments.
Luckily for sellers of smokable hemp everywhere, the trial court disagreed with the defendants and granted the motion to amend. This ruling means that plaintiffs may continue their legal challenge to Indiana’s smokable hemp ban, though the trial court noted that plaintiffs face a steep uphill battle. If plaintiffs ultimately prevail, then Indiana’s prohibition on smokable hemp will be struck down. Perhaps just as important, other states with smokable hemp bans may see those statutes fall, and still other states will be reluctant to enact bans on smokable hemp products. On the other hand, if Indiana prevails in keeping the ban, we may see other states enact similar measures. We will continue to watch this case closely.

Texas And The Absentee Ballot Battle

In light of the ever-escalating COVID-19 crisis, social distancing has entered every aspect of American life. Since the federal government has been maddeningly silent over policy measures to halt the spread of the virus, states have had the responsibility of mitigating the pandemic hoisted upon themselves. As many world health experts expect a “second wave” of COVID to emerge in the fall, much controversy has arisen over an aspect of American life that is notoriously crowded, boggled down with lines, and often mismanaged: voting.
Late last week, the Supreme Court issued a decision saying it would not require Texas to let all eligible voters vote by mail. The decision came after the a protracted back-and-forth over the matter in a series of federal courts.
The court battle originated as part of the ongoing urgings by the Texas Democratic Party to expand access to mail-in ballots in light of COVID-19. Last week, Texas saw a record increase in COVID cases [1]. Around the same time, Governor Greg Abbott, who was among the first to reopen his state at the end of May, scaled back his plans for reopening [2].
The initial claim of the Texas Democratic Party, who brought the issue to court hoping for an expansion of voting rights, was that the current Texas laws violated the 26th amendment’s protection against voting restrictions [3].
While many states allow so-called “absentee ballots” to be cast by any person regardless of an excuse, Texas does not, allowing only people 65 and over to vote-by-mail without an excuse — anyone under this age limit must have a valid medical disability or health concern [4] The Federal District Court in San Antonio agreed with this argument, ruling in an injunction that “any eligible Texas voter who seeks to vote by mail...can apply for and receive” an absentee ballot [5].
However, the Fifth Circuit Court of Appeals blocked this injunction, claiming it would be remembered more for its “audacity” than its “legal reasoning” [6]. Judge James C. Ho of the Fifth Circuit Court wrote in a concurring opinion that, though he agreed with the case may raise an interesting legal question on the role of the 26th amendment — it was not clear how the issue should be resolved. In support of this train of logic, Judge Ho noted the similarities between the 26th and 15th amendment, claiming that a law allowing only one race access to absentee ballots would obviously be unconstitutional [7].
The Supreme Court largely concurred with the Fifth Circuit’s ruling. Issuing only a brief order, as the case was presented for emergency decision, the court denied the Texas Democratic Party’s application to vacate the appeal court’s stay on the injunction [8].
However, Texas’s battle for mail-in-ballots is not over yet. The Texas Democratic Party still has various filings before appellate courts and the Supreme Court — all of which relate to the issue of absentee ballots and the 26th amendment. Chair of the Texas Democratic Party, Gilberto Hinojosa, hopes that these suits “will restore equal voting rights in time for the November elections” [9]. If COVID-19 cases continue to climb, it would certainly be in every Texan’s best interest to be able to vote by mail. As the TDP notes in its writ of certiorari, the CDC officially recommends this method of voting [10]. Though detractors are often quick to cry that vote-in ballots are riddled with fraud, actual research on voter fraud shows that its occurrence is still quite low no matter the method of voting [11].
