Priyanka Gandhi Joins Wrestlers Protest, Asks Cops To Show FIR Copy

The Delhi Police, which functions under Amit Shah's Home Ministry, filed the two first information reports (FIRs) hours after the Supreme Court ordered them to do so.

New Delhi: Congress leader Priyanka Gandhi Vadra met protesting wrestlers at Delhi's Jantar Mantar today to express solidarity with their demand for action against the alleged sexual harassment of women athletes by superiors. The wrestlers have been on a sit-in at Jantar Mantar demanding the arrest of Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh on complaints of sexual harassment.

At the protest venue, the Congress general secretary hit out at the Delhi Police for not providing a copy of the First Information Report, or FIR, filed against Brij Bhushan Sharan Singh.

"I don't have any expectations from the PM (Narendra Modi), because if he is worried about these wrestlers, then why has he not talked to them or met them yet. Why the govt is trying to save him (Brij Bhushan Sharan Singh," she said.

The Delhi Police on Friday filed two cases against the Wrestling Federation of India (WFI) chief after the Supreme Court ordered them to do so. One of the FIRs is over a complaint of sexual harassment by a minor, filed under the stringent Protection of Children from Sexual Offences (POCSO) Act, which gives no scope for bail.

The Delhi Police will pursue the case actively, sources said.

But despite the assurance of police action, the wrestlers said they will continue their sit-in protest demanding the "immediate arrest" of the WFI chief.

"We respect Supreme Court's order, but we don't have faith in Delhi Police. This fight is not for an FIR. This fight is to punish people like him. He needs to be in jail and stripped of his portfolios," the wrestlers said.

Earlier this week, Priyanka Gandhi had slammed the government, saying that the pleas of the sportspersons, who enhance the country's honour, were being ignored. She had asserted that "when the arrogance of a party and its leaders" is sky high, then such voices are crushed.

Congress leaders such as Bhupinder Hooda, Deepender Hooda and Udit Raj had also joined the protesting wrestlers at Jantar Mantar earlier this week to express solidarity with them.

Mr Singh, who is also a BJP MP, welcomed the Supreme Court's order to file the police case into allegations of sexual harassment against him.

Mr Singh told reporters the wrestlers should have waited for the report of a committee that was tasked to look into the matter before they decided to sit on a protest in Delhi's Jantar Mantar.

"I am happy with the judiciary's decision. The Delhi Police will investigate the allegations and I am ready to cooperate with them in every possible way. No one is bigger than the judiciary in this country. The order has come to file an FIR (first information report). The government had also said it had no objection to filing an FIR. I am not larger than the Supreme Court. I welcome the order," Mr Singh told reporters.

Provision of Maintenance is not meant to create an army of idle people

 An application under Section 24* of the Hindu Marriage Act was filed by the Wife (*Maintenance Pendente lite and expenses of proceedings) during the pendency of the trial in the divorce proceedings. Wife an highly educated woman who was M. Phil and was working at the time of marriage and was also pursuing Ph.D. Later she completed Ph.D. (Management).

Background

The couple got married in the year 2014 but had compatibility issue so they couldn’t continue with their marital relationship and the respondent Husband filed for divorce. The divorce petition was withdrawn in February 2016 by the husband as a settlement was arrived between the couple. But few months after the withdrawal of the divorce petition appellant wife filed complaint on 06.05.2016 before the police station and the husband thereafter filed the Second Divorce Petition on 24.05.2016 under section 13(1) (ia) of the Hindu Marriage Act.

 The Principal Judge Family Court dismissed the section 24 petition of the wife in August 2018. Feeling aggrieved wife filed appeal before the Delhi High Court. Delhi High Court remanded the matter back to the Principal Judge Family Court for re adjudication in March 2019.

 The principal Judge Family Court re adjudicated the matter a fresh considered her qualification and the fact that she has been working even after marriage declined the application for maintenance pendete lite and expenses of the proceedings in September 2019.

 Feeling aggrieved wife approached Delhi High Court in appeal praying for interim maintenance @ of Rs.35000 per month and Rs.55000/- as litigation expenses.

 Submission of the Respondent Husband

1.    Appellant is not unemployed. She is working in the office of MP Udit Raj. Respondent Husband submitted a CD which showed the wife working in the office and also signing the attendance register.

 2.    When appellant wife was confronted with this fact by the Court, she said her friend is working at the office of MP Udit Raj and she often goes to meet her friend and whenever she is on leave, she in order to help her works at office.

 Observation of the Family Court

1.    It is difficult to accept that a highly educated women is not working.

2.    More so, she has not disclosed about her charity work in at her friend’s office in her petition. This is concealment of fact.

3.    Further it is also difficult to accept that she is working for charity.

 Observation of the Delhi High Court

1.    The documents and the admissions made by the appellant clearly lead to an irresistible conclusion that she is employed in the office of the M.P.

2.    This is a case where in addition to be qualified, the appellant has been working.

3.    There is no doubt a difference between “capacity” and “actual earning”, but here it is not a case where appellant had only the capacity but the document on record clearly points out that she has also been working.

4.    Section 24 of HMA is not meant to create an Army of idle people waiting for a dole to be awarded by the other spouse. 

5.    In the present case it is not only that the appellant is highly qualified and has an earning capacity, but in fact she has been earning, though has not been inclined to truthfully disclose her true. income. Such a person cannot be held entitled to maintenance.

6.    The claim for maintenance by the appellant under the provisions of Protection of Women against Domestic Violence Act has also met the same fate and the maintenance has been declined to her.

The Division Bench of the Delhi High Court Comprising Hon'ble Mr. Justice Suresh Kumar Kait J and Hon'ble Madam Justice Neena Bansal Krishna J didn’t find any merit in the Appeal & it was dismissed on September 12, 2023.

NEW DELHI: Congress leader Priyanka Gandhi Vadra on Wednesday slammed the government over the protests by top wrestlers here, and asked whether it wants to save the culprits in the matter.

The Congress general secretary also said that the pleas of the sportspersons, who enhance the country’s honour were being ignored, and asserted that “when the arrogance of a party and its leaders” is sky high then such voices are crushed.

Her remarks came after India’s top wrestlers on Tuesday intensified their protest against Brij Bhushan Sharan Singh and asserted that they won’t leave the protest site until the WFI president, who is facing sexual harassment charges, is arrested.

The Supreme Court on Tuesday issued notices to the Delhi government and others on a plea by seven women wrestlers alleging non-registration of an FIR over their sexual harassment allegations against the WFI president, saying these are “serious allegations” requiring its consideration.

Expressing support for the protesting wrestlers, Gandhi said that sportspersons are the pride of the country as when they win medals despite all the difficulties and after working tirelessly, “their victory is our victory” and the whole country smiles.

“The victories of women players are bigger than the rest. They are sitting on the road next to Parliament with tears in her eyes. No one is listening to their complaint against exploitation that has been going on for a long time,” Gandhi said in a tweet in Hindi.

“These girls with strong arms and pure hearts believed the government when it told them that there would be an inquiry. But the investigation did not happen. The question of punishment did not arise at all. Does the government want to save the culprits?” the Congress leader said.

Whose pressure is there on the Delhi Police, Gandhi asked.

She also questioned why Opposition leaders are being questioned by the same police on hearing the pain of a girl during the Bharat Jodo Yatra, but the pleas of the sportspersons who enhance the country’s honour are ignored.

Her remarks were in reference to a Delhi Police team last month querying Congress leader Rahul Gandhi at his residence over his remark made during the Bharat Jodo Yatra that “women are still being sexually assaulted.”

The police team had asked him to provide information about the “victims” to take up their complaints.

“When the arrogance of a party and its leaders touches the sky, then such voices are crushed. Let’s support these sisters of ours. It is a matter of honour for the country,” Gandhi asserted.

The wrestlers, including Vinesh Phogat, Sakshi Malik and Bajrang Punia, have also alleged that the Wrestling Federation of India (WFI) chief is now resorting to strong-arm tactics and trying to break the “victims” by issuing threats and offering bribes.

Former Haryana Chief Minister and senior Congress Bhupinder Singh Hooda, Congress leader Udit Raj and CPI(M) leader Brinda Karat, who was stopped from joining the stir by the wrestlers in January, were welcomed by the wrestlers, at the protest site on Tuesday, a day after they had sought support from all quarters.

NEW DELHI: The Centre’s “silence” over the ongoing farmers protest seems to have left the farm leaders guessing and apprehensive about the government’s possible next moves. BKU leader Rakesh Tikait, a prominent face of the farmers’ protest, has claimed that this “silence” for the past few days indicates that the Centre is planning some steps against the farmers’ agitation over newly enacted agriculture laws. He also stressed that it is the government that will have to come forward with a proposal for talks to resume with the protesting farmers. Agriculture minister Narendra Singh Tomar had said on February 24 said that the government is ready to resume talks with protesting farmers if they respond to its offer to put the three contentious farm laws on hold for one-and-a-half year and work out the difference during that time through a joint committee. The farmers have been protesting at the borders of the national capital for nearly three months now. They have held several rounds of negotiations with the Centre to find a solution to their demands. While the Centre has agreed to keep the implementation of laws in abeyance for one and a half years, it has refused to withdraw the three farm laws. With no end in sight to the stalemate, the farmers are now gearing up for a harsh summer. They have put up tents with coolers and fans to ensure that those participating in the agitation are not inconvenienced. The farmer leaders have announced a series of mahapanchayats to drum up support across various states. Rakesh Tikait, the national spokesperson of the BKU, will tour five states – Uttarakhand, Rajasthan, Madhya Pradesh, Karnataka and Telangana. Two meetings will also be held in Uttar Pradesh in March. Tikait has warned that the farmers will intensify their agitation if the wheat crop is not sold on the minimum support price (MSP) in Uttar Pradesh and will hold dharnas outside district headquarters across the state. Meanwhile, representatives of a number of Dalit panchayats on Sunday got together and pledged their support to the farmers’ agitation against the farm laws. Organised by dalit Congress leader and former MP Udit Raj at the Constitution Club in Delhi, dalit representatives said dalits and farmers will now unitedly fight against the farm laws till they are withdrawn. Udit Raj said due to the stubborn attitude of the government, the dalits have been forced to take this step. Earlier, Congress spokesperson Udit Raj said that “even the spaceships could be controlled from the ground, so EVM could also be hacked”. The Congress was elated after the exit poll results, but after the trends started to come in on Tuesday, its leaders have been blaming the EVMs. The Election Commission has rejected these claims and said that the EVMs are tamper proof and cannot be compromised. Initially, the Grand Alliance led the trends, but as the day progressed, it became clear that the BJP was emerging as the single largest party and the Congress a distant fourth. The BJP and its ally JD-U’s key rival, the RJD was leading on 62 seats taking the Grand Alliance’s count to 100. By securing 19 seats, the Congress is in the fourth position. The grand old party is followed by three Left partners leading on 19 seats — the CPI-ML (13), and the CPI and CPI-M on three seats each.
