Not to be That Guy about an episode of a show behind a paywall but to Emily’s point about the Adam Sandler surgery, she actually would not qualify for a medical malpractice suit. Medical malpractice only applies if a person is injured or dies due to the actions of the medical professional. If Adam Sandler does the surgery within proper training and it goes fine, she cannot sue for malpractice.

However. Emily could report Adam Sandler, the supervising surgeon, and the hospital to the police and state medical boards as it is illegal to practice medicine without a license. Adam Sandler and the supervising surgeon could face heavy fines or time in prison for their actions, and the hospital could get investigated for misconduct.

Alternatively Emily could sue for medical negligence, which is a lighter charge than malpractice as no one has to be injured.
