A federal judge rejected Florida’s request to dismiss sex discrimination claims in a lawsuit against the state’s ban on teachers using the pronoun that corresponds to their gender identity. In a brief order on Wednesday, U.S. District Judge Mark Walker denied motions from the state and other defendants to dismiss sex discrimination claims raised in the lawsuit under Title VII of the Civil Rights Act of 1964 and Title IX of the Education Amendments Act of 1972. Under the anti-transgender law, teachers in the state can only use the pronouns associated with their biological sex assigned at birth in the classroom — or risk discipline that can include suspension or even licensure revocation.
Walker issued a preliminary injunction in April against enforcement of the ban as to Katie Wood, one of the teachers who sued, under a free speech claim, writing, “Once again, the State of Florida has a First Amendment problem. Of late, it has happened so frequently, some might say you can set your clock by it.” Wednesday’s ruling expanded which claims will be allowed to go to trial. Walker, an Obama appointee, initially allowed parts of the lawsuit to proceed as to free speech and equal protection claims, as well as a preemption claim, but agreed with the state in the April 19 order that the challengers — three current or former teachers — did not show that the pronoun ban constituted a “term or condition” of employment that could justify the sex discrimination Title VII or Title IX claims.
In a somewhat unusual moment for a federal judge, however, Walker on Wednesday reversed course — acknowledging that he got that latter part wrong the first time. After dismissing the sex discrimination claims, the parties filed a second amended complaint to provide more information to Walker backing those claims. Additionally, the Justice Department weighed in, with a “Statement of Interest” setting forth the position of the United States on the matter — and backing the teachers’ Title VII claims. “The mandatory nature of the title/pronoun policies and the consequences for non-compliance make clear that the policies are a term or condition of Plaintiffs’ employment,” the Justice Department lawyers wrote in the statement. In response, Walker on Wednesday changed course.

Additionally, he further detailed the effect of a U.S. Supreme Court decision from this term, Muldrow v. St. Louis, which was issued April 17 and set forth standards for determining the “terms [or] conditions” requirement under Title VII, beyond his consideration of it in the earlier ruling. Specifically, Walker wrote, ”This Court’s incorrect analysis relied on case law that is no longer good law following” the Muldrow decision.1
Challengers score a big win on the fight against Florida’s forced misgendering law HB1069 in Wood v. Florida Department of Education that bans the usage of pronouns congruent with their gender identity instead of the gender assigned at birth.

DUCKIE JONES, born as 'Noelle Duckstein', is a wonder of sorts. She's not a humble girl, and one of her favourite activities is looking at her own reflection. But she's not ashamed of it. She loved attention bring on her, she loved being loved. Noelle loved sparkly dresses that neckline's maybe just a bit too low down, always carried around a compact mirror and you would never catch her dead leaving the house without a full face of makeup; even if it was just to answer the door to a delivery. This all most likely stemmed from the fact her mother had put her into this lifestyle at a young age, her own mother being a burlesque performer and pageant queen. Noelle was born to a Mexican woman, Daphne, who grew up in Brooklyn, New York, and whitewashed herself as she grew to gain more opportunities. Noelle never really learnt about her culture. Noelle's dad was a rich man, some fancy lawyer who was an (in)famous criminal defense lawyer but ended up mysteriously dying leaving all his inheritance to Daphne and their only child. He was an all American man, who was born and bred in Brooklyn. Growing up, Noelle's mother entered her into beauty pageants presumably trying to push her daughter into her footsteps.
JUST BEFORE HER FATHER PASSED, the Ducksteins moved from Brooklyn to Miami. It was a rushed move but they ended up in a nice house. Noelle was not even a teenager when her dad passed, being a daddy's girl this death upset her deeply. Noelle and her mother never really got along, and she always had a feeling that Daphne was somewhat jealous of her daughter. There were a handful of heavy arguments but there would never be a conversation that went by that didn't have sly catty remarks made towards one another. As Noelle grew older and went up school years, she became more and more popular due to, not only her looks, but her natural ability to make people want to be her. She did have a handful of people who disliked her, mostly due to her romantic altercations, but she paid no mind to them. Noelle was a cheerleader in her high school, and loved performing and making up routines.
IT CAME AS NO SURPRISE WHEN NOELLE FOLLOWED HER IN MOTHER'S FOOTSTEPS. Her mother originally wanted her to just be married off to some rich man, and Noelle wasn't really opposed to the idea. But she was opposed to the idea that the 'rich man' was a guy who's personality and lifestyle was as dry as a slice of bread. She lived for rushes of adrenaline. Noelle became a popular performer at the 'Babylon Club' being a dancer and occasional singer. She quickly became a local's favourite. Her mother didn't exactly disapprove of Noelle's lifestyle, as it would be hypocritical, but she did believe Noelle could do better than being "some dancer in some club". But Noelle didn't care, she loved her job. But she did always want more. So what happens when the 'more' she was looking for stumbles into the club with a scar across his face?

Conservative calls to deport Representative Ilhan Omar over comments she purportedly made about Somalia have no legal merit, experts tell Newsweek.
The progressive Democrat, a Somali American and Muslim, has been under fire for remarks she allegedly made to Somali American constituents that have been viewed over 7 million times on X. Omar, a Somali American and Muslim, seemed to address a deal struck by Somalia's breakaway region of Somaliland with landlocked Ethiopia to give it access to the sea.
Republicans, including Florida Governor Ron DeSantis and Georgia Representative Marjorie Taylor Greene, have openly called for Omar to be deported, with the latter saying: "She flaunts using her position as congresswoman to protect Somalia's border while our border is invaded by MILLIONS of illegals who are a danger to America."
Immigration lawyer Rosanna Berardi told Newsweek that since Omar is a naturalized U.S. citizen, calls for deportation lack legal ground unless the individual in question gained citizenship through nefarious means such as fraud, misrepresentation or membership in certain organizations—or being dishonorably discharged from the U.S. military if citizenship was based on military service.
The Minnesota representative's statements, whether accurate or taken out of context, are also protected under the First Amendment, which extends not just to U.S. citizens but also to public officials who routinely express opinions on foreign and domestic matters and do so without fear of legal repercussions—especially deportation.
"The Immigration and Nationality Act allows for deportation/removal of individuals due to criminal activities, violations of status or violation of immigration law," Berardi said. "Deportation for expressing political views, particularly those covered by the First Amendment, is not legally supported. Political speech does not constitute a valid basis for deportation.
"In essence, we have a series of sound bites here that are legally baseless. Typical political banter."
Stephen Schnably, a law professor at the University of Miami, told Newsweek that calls for the deportation of a sitting member of Congress for expressing personal views—whether accurate or spun by political adversaries—is "far beyond the realm of any reasonable response to her remarks."
"It's just not in the cards, deportation as punishment for a U.S. citizen," he said. "That is something that just cannot be done."
He said that even if Omar's statements, as attributed by some conservatives, are taken at face value, favoring foreign country interests over U.S. interests "is not a First Amendment violation to do that." Members of Congress can say what they want, and ultimately, voters have their say in elections.
The situation would potentially be different if Omar did not hypothetically register as an agent of a foreign government, comparing Omar's casual remarks to criminal charges against Democratic Senator Bob Menendez. The New Jersey legislator and his wife are accused of accepting bribes, including gold, cash, a luxury vehicle and payments toward a home mortgage, allegedly in exchange for advancing their interests, as well as those of the Egyptian government, in his role as the chair of the Senate Foreign Relations Committee.
But in Omar's case, there is no indication that anything of that sort—of "committing a well-defined crime where conduct or actions are not in accordance with a statute that is not constitutional."
Politicians make similar remarks all the time, Schnably added, saying there is nothing unusual about foreign policy positions that favor one country over another in a dispute.
Omar's alleged statements, backlash
According to one translation of Omar's remarks first shared on X by Ambassador Rhoda J. Elmi, Somaliland's Deputy Minister of Foreign Affairs, Omar purportedly said that she was "Somalian first, Muslim second" and "here to protect the interests of Somalia from inside the U.S. system."
Omar is also alleged to have said that "as Somalis, one day we will go after our missing territories."
But Omar has refuted the retelling of her statements, calling the viral clip "not only slanted but completely off," adding that she "wouldn't expect more from these propagandists."
Another translation posted online by Abdirashid Hashi, a researcher and Somalia analyst, states that Omar said that Somalis "are sisters and brothers, supporting each other, people who know they are Somalis and Muslims, coming to each other's aid."
Per that translation, she also said: "While I am in Congress, no one will take Somalia's sea. The United States will not back others to rob us. So, do not lose sleep over that, O Minnesotans. The lady you sent to Congress is on this, and she is as cognizant of this interest as you are."
Greene bashed Omar and her comments in an X post, saying: " Patriots, you must show up big in 2024. We have a country to save and people to deport."
"Expel from Congress, denaturalize and deport!" DeSantis wrote on X.
In the past, DeSantis has singled out Omar as allegedly propagating antisemitic movements within Congress. In January 2022, after a group of people wearing Nazi symbols made national headlines for yelling antisemitic slurs on streets and highway overpasses in the Orlando area, DeSantis said he would not let others shame him for his support of Jews.
"I'm not going to have people try to smear me that belong to a political party that has elevated antisemites to the halls of Congress, like (US Rep.) Ilhan Omar, that have played footsie with the (boycott Israel) movement," DeSantis said at the time.

Miami Vice S1E13: Milk Run
An almost perfect episode with an ending that guts like a fish knife.
Milk Run is the episode that Little Prince wanted to be, and it's super weird to me that they're back to back. It's better written, better paced, and commits much more strongly to its message, so it feels a bit like you watch the rough draft of an idea and then the final draft right in a row.
It's also significantly more fun than Little Prince, which both makes it more enjoyable to watch, and makes the tragedy that much more painful. The first half of the episode is played very light-- jokes and smiles and sunshine-- and then by the final quarter you're left with the cold, sinking feeling that something terrible is going to happen and it's going to fuck everyone up forever.

The episode opens with Sonny creeping on a lady who bends over at the airport, and Rico walking (crotch first) into his line of view and giving him a serious Sitcom Wife look. It's hard to shake the sense that this is a "Rico shoots his shot and Sonny straight up doesn't notice" episode; the smile he gives Sonny when he tells Sloane they're partners is shy and flirty as all get out, he literally grabs Sonny and walks with him arm and arm as they cross the street, he brushes his fingers against Sonny's and pivots around him a centimeter away as they lean on the hotel counter. Sonny ever so slightly leans into him after that, like there's some recognition of their closeness, and then they see Eddie and Sonny spends the rest of the episode freaking out about Justice(TM).
This is the episode where Rico reveals he is a vegetarian, and Sonny kind of brushes it off like "that's simply impossible, no such thing."
Tubbs says a bunch of stuff about a Colombian god who originated in Nigeria and seems to be surprisingly knowledgeable about folk religion, and then in the next scene he and Sonny have a conversation about Santeria that's so far removed from anything anyone has ever known about Santeria that you begin to wonder if he just made this "Colombian god" up to sound smart.
While Crockett speaks to the "Santeria Priestess" (a teenage punk who works at a movie theater and is absolutely not a Santeria Priestess), a bald woman behind him sports what appears to be leather bondage gear
A young Eric Bogosian roughs up Tubbs; later in the episode he says that Pepe Moya is "a freak" who "gets off on weeeeiiiiaaaahhhhd stuff." Okay, Worcester boy. Sure. That's how everyone in Massachusetts Miami talks.
The transition from Rico leaping into the car to the boxing gym, overlaid with Hit Me With Your Best Shot is just an absolute joy, A+ fun, silly, wholesome sequence.
Castillo asks Crockett to put surveillance in place and Sonny says he's already put "Mann and Terranova" on it. While I believe wholeheartedly that Miami Vice and Wiseguy take place in the same universe, it's a but strange to get your creator to do surveillance for you.
Tubbs makes the obligatory S1 "you will be sexually assaulted in prison" threat this episode, which is highly out of character and, as far as I can recall, never happens again. Sonny just screams at the kid.
Eddie tells Sonny that he can't speak to the police because his lawyer told him "you're just gonna use me."
Well.

I think it's important to point out that Eddie, who is tragically killed in a way Sonny does not expect and cannot really have prevented (but feels like it could have been preventable to him), doesn't just share his first name with Sonny's prior partner. His last name is also Rivers-- too close to Riviera to be a coincidence. One of the themes of Vice is the cyclical and repetitive nature of tragedy for anyone who is involved in either criminality or the justice system (Mann generally posits these two things as mirror images or inexorably linked halves of one whole; see Heat). Eddie Riviera was a cop, thematically framed as an innocent, and Sonny couldn't save him, and Eddie Rivers was a criminal, thematically framed as an innocent, and Sonny couldn't save him. The only people who make it out are ones like Caroline, who divest themselves completely from that world. Anyone on either side of the law is equally damned.
From the time we see Eddie's body rolled away to the credits rolling is two full minutes of a 48 minute runtime; Sonny is sitting on the floor, mostly facing the camera, for the entirety of that two minutes. The amount of time from when the other characters leave and Rico sits down next to him to is itself a full minute, and the last 40 seconds of that minute are wordless. I don't think it can be overstated how endless a minute of hollow-eyed silence is in a television show feels.

RHOM truly is the gift that keeps on giving! They’ve delivered another amazing season while other shows are struggling with giving interesting storylines.
I’ve also made an appreciation post about Lisa Hochstein because what would this season have been like if she was deflecting from her failing marriage?
I can name so many housewives who would’ve kept this part of their lives a secret – and that’s the problem with the franchise right now.
So, while the other shows get a demand to do better, RHOM gets another appreciation! 
Let’s remind ourselves of the unforgettable moments from season 5.
1) It’s not about the mortgages!

Things were off with Lisa immediately this season. She shaded Larsa Pippen’s new apartment building, and Larsa retaliated by accusing Lisa of renting out her house to pay her mortgages. 
It was a petty clapback, but Lisa lost it! She was stuck in a hamster wheel and raging at Larsa. It wasn’t about the mortgages.
2) Date night from hell

It was shocking how much Lenny Hochstein was willing to film this season! 
And he is just the worst. Lisa had planned a romantic date for them, and he complained about it ruining his diet and he was on his phone the whole time! 
And then their nanny had an accident, which showed some uncomfortable dynamic between Lisa and Lenny. He talked to her like she was a child.
3) Lisa shocks the women about her marriage

While this was a difficult season for Lisa, Alexia Nepola was showing sides of herself that wasn’t so pretty. 
And it was really unfortunate that this was the direction this trip took.
Alexia had been so furious on behalf of Lisa, she was screaming and cursing in Spanish. But it seemed like her ego was inflated this season.
She acted as if she was untouchable. She called Julia Lemigova a prostitute, because she’s Russian… She called herself the star, and accused them all of making up shit to take her down.
Her energy was truly bizarre this season.

I just love Kiki Barth! She’s always a good time and she’s actually delivers a lot of great scenes on the show. 
She had a lot of hilarious confessionals this season and I hope they’ll try her out as a fulltime cast member. 
When she brought out her cold Burger King burger during an argument at Adriana de Moura’s music video shoot, it threw me for a loop.

6) Nicole’s shady disinvitation of Larsa!

After Larsa had accused Nicole Martin of sleeping with all the doctors at the hospital, Nicole naturally disinvited her to her engagement party. 
And she did it in the most perfect housewife manner! She sent Larsa a mirror that was engraved with the disinvitation. 
“See yourself uninvited to the party”?! That’s Housewives gold! And by doing that Nicole inserted herself as one of my favorite housewives!
7) Nicole’s epic engagement party!

Nicole was MIA in the beginning of the season, but she rose to become the MVP of the show. 
Her engagement party looked truly epic, and like such a fun party. But the women had to give her shit, even at her party.
Alexia and Marysol Patton were basically defending Larsa, and when Adriana and her date confronted Alexia for accusing her of dating a married man, things didn’t get any better.
8) Embarrassing meeting with the lawyers

It was utter chaos!

The way he talked to her and treated her was insane. 
When I first heard that Lenny had filed for a divorce, I had no idea that it would all play out on the show. As I’ve mentioned numerous times before, the women tend to keep that a secret while filming.
10) The OGs are fighting!

While Alexia’s energy was bizarre this season, it was nothing compared to Adriana. She must truly have gone through something this season, as her friends claimed, because she made no sense. 
On their trip to the Bahamas Kiki fell on Adriana’s foot and she claimed that it was broken. 
She wanted the other women to not have fun, feel sorry for her and cuddle her, and when they didn’t, she compared her “injury” to Alexia’s son’s horrific accident. 
While Adriana has tried to apologize to Alexia, Alexia wants nothing to do with her anymore.
