În cadrul UE, terapiile avansate sunt strict reglementate prin intermediul unui regulament menit să asigure libera circulație a acestora în Europa, să faciliteze accesul pe piața comunitară și să promoveze competitivitatea companiilor europene în domeniu, garantând, în același timp, cel mai înalt nivel de protecție a sănătății pentru pacienți. Principalele elemente ale acestui regulament prevăd următoarele: – o procedură centralizată de autorizare de introducere pe piață – existența unui comitet multidisciplinar de experți (Comitetul pentru Terapii Avansate), în cadrul Agenției Europene pentru Medicamente (EMA), pentru evaluarea produselor de terapie avansată – cerințe tehnice adaptate caracteristicilor particulare ale acestor produse – stimulente speciale pentru întreprinderile mici și mijlocii.

De asemenea, regulamentul recunoaște că unele produse de terapie avansată combină materiale biologice, cum ar fi țesuturile sau celulele, cu elemente chimice, cum ar fi implanturile metalice sau structuri (schelete) de polimeri. Aceste produse combinate necesită cerințe de reglementare adaptate. În acest sens, în noiembrie 2017, Comisia Europeană a adoptat un set de orientări privind bunele practici de fabricație (GMP) specifice pentru produsele medicamentoase de terapie avansată (ATMP). Orientările oferă un cadru pentru GMP adaptat caracteristicilor specifice ale ATMP.

În contextul studiilor clinice cu celule umane modificate genetic a fost elaborat, de autoritățile competente naționale și de serviciile Comisiei, un document de bună practică privind evaluarea aspectelor legate de organismele modificate genetic (OMG). Acest document, care se bazează pe posibilitățile existente în legislația curentă pentru a facilita desfășurarea studiilor clinice cu acest tip de medicamente, a fost aprobat de Austria, Belgia, Cipru, Republica Cehă, Danemarca, Franța, Germania, Grecia, Ungaria, Italia, Luxemburg, Malta, Portugalia, România, Spania, Suedia și Norvegia. Dezvoltatorii care intenționează să efectueze un studiu clinic în aceste țări pot urma abordarea stabilită în acest document.

Studiile clinice cu medicamente care conțin sau constau în OMG sunt supuse atât legislației specifice în domeniu, cât și legislațiilor OMG. Serviciile Comisiei și Agenția Europeană de Medicină (EMA) au lansat un plan comun de acțiune pentru promovarea dezvoltării medicamentelor pentru terapie avansată (ATMP), cu scopul de a simplifica procedurile și de a răspunde mai bine cerințelor specifice ale producătorilor de ATMP. Una din aceste cerințe se referă la aplicarea conceptului de „substanță activă similară” (conceptul de similaritate) într-un cadru ATMP. În sprijinul acestora, a fost elaborat un document cu întrebări și răspunsuri actualizat permanent, în lumina experienței acumulate în timpul evaluării acestor medicamente.
