Love, actually

Love is a many-splendored thing, as they say. In its pure form, it touches divinity. Sometimes it's lust, sometimes madness, and sometimes regret. It can also be redemption. Haseen Dillruba touches upon all forms of love in its two-hour setting and makes you root for its characters. They are ordinary people like you and me but driven by passion, they turn into both the worst and the best parts of themselves. There are no heroes or villains in the film as it says we all have the capacity to be either. Time and circumstances shape our actions, our behaviour. We do crazy things to each other and for each other because at that point of time it felt right. Ultimately, we’re the product of our choices and have to bear the consequences of our actions. These standard noir tropes are utilised cunningly in the film. Neo-noir is on the rise in Hollywood and director Vinil Mathew, who made his debut with the hatke romantic film Hasee Toh Phasee (2014) seems to have the yen for it. The film is written by Kanika Dhillon, who certainly has a taste for out of the ordinary stories. 

This isn’t a film for those seeking an escapist fantasy. It wears the garb of a thriller but holds a mirror to our society nevertheless. One of the things it states quite clearly is that it’s considered taboo for a woman to have a sexual drive. And that men get uncomfortable and insecure when she chooses to express it. Marriages are a minefield of sexual politics and things can easily go wrong if it’s not navigated properly. It also points out that attraction can have many faces. The most boring person can look attractive, thanks to some crazy trait. Nothing is constant when it comes to matters of the heart. Everything is in flux. Things change and one must recognise the change and move along with it. 

It’s the unpredictability of behaviour that makes the film so interesting. We’re used to seeing black and white characters. But here’s a film which offers a glimpse of how real men and women behave. The characters in the film let go of all pretences towards nicety and behave in their most raw manner towards each other. Their true nature comes to the fore when the masks are dropped and it’s not a pleasant thing to witness. The film also points out that forgiveness is also a form of love and one should learn to forgive oneself first and then learn to forgive others. 

Rani Kashyap (Taapsee Pannu) is a middle-class girl from Delhi who has done a beautician’s course. She doesn’t have any ambitions in life and agrees to an arranged marriage as she’s on the wrong side of 20. Rishabh Saxena (Vikrant Massey) is a small-town guy who has the habit of falling in love with every prospective bride. He’s an electrical engineer with a government job and his only hobby is repairing electronic items of his neighbours. Their only common ground is the novels of Hindi pulp novelist Dinesh Pandit. They get married but soon their marriage deteriorates because of sexual incompatibility. At this juncture, Rishabh’s cousin Neel (Harshvardhan Rane) comes to stay with them. Neel is a hunk who is into adventure sports. Sparks fly and Rani is smitten by him. Things take a turn when Rishabh is supposedly killed in a gas explosion. Neel is missing and Rani is considered to be the prime suspect for Rishabh’s alleged murder by the police.

The film employs a multiple-narrative format where the same set of happenings are narrated through the viewpoints of different individuals. The police grill Rani incessantly and even resort to beating her. Her neighbours and family-friends too get questioned. The versions keep changing by the minute and one isn’t sure of what’s wrong and what’s right. It’s only towards the end, when the final version of events is narrated, that the viewer gets hold of the truth. 

The screenplay as well as the dialogue are quite gripping and full marks to Kanika for maintaining an even pace. The editing and cinematography too are on point. All the technical wizardry would have gone for a toss if the actors hadn't done their job. To sum it up concisely, they’re all quite brilliant. The hallmark of good acting is believability and all three main leads come out as extremely believable characters. None of them are playing conventional characters but are doing roles which are constantly evolving. And that evolution isn’t abrupt but gradual. Harshvardhan Rane plays the catalyst who tears Rishabh’s and Rani’s world apart but also acts as a binding agent of sorts. You don’t love him or hate him because you recognise that’s how people are. He’s such a natural fit into his role that you can’t decide if it's because he’s a good actor or whether his role was so perfectly written. 

Vikrant Massey has a tendency of underplaying his characters. And that's just perfect for the part of slightly henpecked character we see in the beginning. But then, his dark side begins to emerge. Again, nothing is over the top in this phase too. A subtle gesture, a certain look, a certain gleam in his eyes convey that this mild-mannered man carries hidden depths. He comes into his own in the climax, showing a 360 degree transformation. What can one say about Taapsee. She’s been evolving with every film. She played a stoic housewife in Thappad but here she’s anything but that. Her character knows she’s flawed and has a hard time accepting those flaws. But she knows she has the ability to change as well. She goes on a quest of love and in the end becomes a better person because of it. It would have been difficult for her to showcase all those shades but she managed to pull it off nicely. 

The film airs on OTT, thanks to the pandemic and the lockdown. But it’s one of those products that deserved a theatrical release. Perhaps, in the future, when things get better, the makers can opt for a theatrical release. Watch it for its dark take on love and for the brilliant performances by the entire ensemble cast.

In our latest school show, undergraduate and postgraduate students at The Design Village in India present architecture and design projects ranging from a shelter for cats to an algorithmic learning aid for people with dyslexia.

Other projects include a music festival that aims to bring the sighted and visually impaired people together, and an analysis of the impact of menstrual euphemisms in India.  The projects aim to explore how informed processes are vital to developing solutions to solve today's problems.

"Aiming to address social exclusion and awkwardness (often experienced by the people with low or no vision) Vidita emphasizes auditory input rather than visual, creating a site for parity and increasing social interaction between the sighted and people with vision impairments."

Despite claims of modernity, most of India still refrains from having this conversation, resulting in countrywide problems of menstrual hygiene and an apparent lag in SDG indicators for health and well-being.

"Unnati argues that there is an urgent need to normalize and address the many associations people have with menstruation. This need to understand menstruation (beyond its scientific meaning) could be addressed by using visual euphemisms as a tool – allowing more open conversations between the menstruating and non-menstruating populations."

The parties are free to agree on the procedure to be followed by the arbitral tribunals in conducting its proceedings. If no such procedure agreed by the parties, the tribunal is authorised to conduct the proceedings in such a manner it considers appropriate.

The arbitral tribunal is expressly not bound to apply any provisions of the Civil Procedure Code 1908 and the Evidence Act, 1872. If under arbitration agreement it is mentioned, the arbitration is to be administered by arbitral institute, the rules of that institution become part of the arbitration clause by implication. The rules of arbitral tribunal includes power to determine the admissibility, relevance, materiality and weight of any evidence.

Place of arbitration

The parties are free to agree on the place of arbitration as per their convenience. In case failed to agree upon place of arbitration, the arbitral tribunal shall determine the place of arbitration considering the circumstances of case including convenience of the parties.

Language of proceedings

Parties are free to agree upon the language to be used in the arbitral proceedings. If the parties fail to agree on any language then arbitral tribunal decides  which language to be used in the arbitral proceedings.

Statement of claim and defence

The claimant have to state the facts supporting their claim, raise the points at issues and relief or remedy sought to the respondent within the time period stipulated by the parties or determined by the arbitral tribunal and the respondent replies filing an answer against the arbitration claim of claimant that specifies the relevant facts and available defenses to the statement of claim.

A party can amend or supplement his claim and defence throughout arbitral proceedings, unless the tribunal considers it unsuitable to allow the amendment or supplement in respect of the delay in making it.

Hearings

The parties shall be given sufficient prior notice before any hearing and of any meeting of arbitral tribunal for the inspection and verification of documents, goods and property. The arbitral tribunal shall decide whether to hold oral hearings for the presentation of evidence or for oral argument, or whether the proceedings shall be conducted on the basis of documents and other materials:

Arbitration and Conciliation (Amendment) Act,2015 requires the arbitral tribunal at least, hold oral hearings for the presentation of evidences or for oral arguments on a day-to-day basis, and not grant adjournments unless reasonable cause is given.

All documents, statements and required information supplied, and application made to the arbitral tribunal by the one party shall be communicated to the other party and any evidentiary document or expert report on which an arbitral tribunal can rely in making it decision shall also be communicated to the parties.

Default of a party

If claimant without providing sufficient cause fails to communicate his statement of claim to the tribunal, the arbitral tribunal can terminate the proceedings with immediate effects. But it is not the same in case of respondent if he fails to communicate his statement of defence, the arbitral can continue the proceedings without treating that failure in itself as an admission of alienations by the claimant.

Evidences

The parties are free to agree on the rules of gathering and submitting evidences. If they are not getting agree on these matters, the tribunal has the discretionary power to determine how evidence may be gathered and submitted to it. The arbitral tribunal can take both documentary and oral evidence on record. While considering evidence tribunal required to observe the fundamental principle of natural justice.

Court Assistance

Local courts can assist tribunals in arbitration proceedings. This includes the power of providing interim order and appointment of arbitrator if the parties are unable to agree on the appointment of arbitrator.

If a party makes any default, refuses to give evidence or guilty of contempt of arbitral proceedings shall be subject to penalties or punishment by the order of the court on the representation of arbitral tribunal.

Third party

In India, the question is yet to be answered whether the non signatory party bound by arbitration agreement or not. Arbitral tribunals and courts take different methods to bound non signatory parties to an arbitration agreement like “group of companies” doctrine where a  clear intent to bind such non signatory parties. However, in Indowind Energy Ltd V. Wescare (India) Ltd (2010) the Supreme court of India held a “third party not a signatory to an arbitration agreement would not be bound by such agreement, even if some sort of nexus exists between third party and transactions of questions.”
