PT. Perusahaan Listrik Negara (Persero) adalah perusahaan pemerintah yang bergerak di bidang pengadaan listrik nasional. Hingga saat ini, PT. PLN masih merupakan satu-satunya perusahaan listrik sekaligus pendistribusinya. Dalam hal ini PT. PLN sudah seharusnya dapat memenuhi kebutuhan listrik bagi masyarakat, dan mendistribusikannya secara merata.
Usaha PT. PLN termasuk kedalam jenis monopoli murni. Hal ini ditunjukkan karena PT. PLN merupakan penjual atau produsen tunggal, produk yang unik dan tanpa barang pengganti yang dekat, serta kemampuannya untuk menerapkan harga berapapun yang mereka kehendaki. Pasal 33 UUD 1945 menyebutkan bahwa sumber daya alam dikuasai negara dan dipergunakan sebesar-besarnya bagi kemakmuran rakyat. Sehingga. Dapat disimpulkan bahwa monopoli pengaturan, penyelengaraan, penggunaan, persediaan dan pemeliharaan sumber daya alam serta pengaturan hubungan hukumnya ada pada negara. Pasal 33 mengamanatkan bahwa perekonomian Indonesia akan ditopang oleh 3 pemain utama yaitu koperasi, BUMN/D (Badan Usaha Milik Negara/Daerah), dan swasta yang akan mewujudkan demokrasi ekonomi yang bercirikan mekanisme pasar, serta intervensi pemerintah, serta pengakuan terhadap hak milik perseorangan. Penafsiran dari kalimat “dikuasai oleh negara” dalam ayat (2) dan (3) tidak selalu dalam bentuk kepemilikan tetapi utamanya dalam bentuk kemampuan untuk melakukan kontrol dan pengaturan serta memberikan pengaruh agar perusahaan tetap berpegang pada azas kepentingan mayoritas masyarakat dan sebesar-besarnya kemakmuran rakyat. Contoh kasus monopoli yang dilakukan oleh PT. PLN adalah:1   Fungsi PT. PLN sebagai pembangkit, distribusi, dan transmisi listrik mulai dipecah. Swasta diizinkan berpartisipasi dalam upaya pembangkitan tenaga listrik. Sementara untuk distribusi dan transmisi tetap ditangani PT. PLN. Saat ini telah ada 27 Independent Power Producer di Indonesia. Mereka termasuk Siemens, General Electric, Enron, Mitsubishi, Californian Energy, Edison Mission Energy, Mitsui & Co, Black & Veath Internasional, Duke Energy, Hoppwell Holding, dan masih banyak lagi. Tetapi dalam menentukan harga listrik yang harus dibayar masyarakat tetap ditentukan oleh PT. PLN sendiri. 2   Krisis listrik memuncak saat PT. Perusahaan Listrik Negara (PT. PLN) memberlakukan pemadaman listrik secara bergiliran di berbagai wilayah termasuk Jakarta dan sekitarnya, selama periode 11-25 Juli 2008. Hal ini diperparah oleh pengalihan jam operasional kerja industri ke hari Sabtu dan Minggu, sekali sebulan. Semua industri di Jawa-Bali wajib menaati, dan sanksi bakal dikenakan bagi industri yang membandel. Dengan alasan klasik, PLN berdalih pemadaman dilakukan akibat defisit daya listrik yang semakin parah karena adanya gangguan pasokan batubara pembangkit utama di sistem kelistrikan Jawa-Bali, yaitu di pembangkit Tanjung Jati, Paiton Unit 1 dan 2, serta Cilacap. Namun, di saat yang bersamaan terjadi juga permasalahan serupa untuk pembangkit berbahan bakar minyak (BBM) PLTGU Muara Tawar dan PLTGU Muara Karang.Dikarenakan PT. PLN memonopoli kelistrikan nasional, kebutuhan listrik masyarakat sangat bergantung pada PT. PLN, tetapi mereka sendiri tidak mampu secara merata dan adil memenuhi kebutuhan listrik masyarakat. Hal ini ditunjukkan dengan banyaknya daerah-daerah yang kebutuhan listriknya belum terpenuhi dan juga sering terjadi pemadaman listrik secara sepihak sebagaimana contoh diatas. Kejadian ini menyebabkan kerugian yang tidak sedikit bagi masyarakat, dan investor menjadi enggan untuk berinvestasi.
Jika dilihat dari teori etika deontologi : Dalam kasus ini, PT. Perusahaan Listrik Negara (Persero) sesungguhnya mempunyai tujuan yang baik, yaitu bertujuan untuk memenuhi kebutuhan listrik nasional. Akan tetapi tidak diikuti dengan perbuatan atau tindakan yang baik, karena PT. PLN belum mampu memenuhi kebutuhan listrik secara adil dan merata. Jadi menurut teori etika deontologi tidak etis dalam kegiatan usahanya. Jika dilihat dari teori etika teleologi : Dalam kasus ini, monopoli di PT. PLN terbentuk secara tidak langsung dipengaruhi oleh Pasal 33 UUD 1945, dimana pengaturan, penyelengaraan, penggunaan, persediaan dan pemeliharaan sumber daya alam serta pengaturan hubungan hukumnya ada pada negara untuk kepentingan mayoritas masyarakat dan sebesar-besarnya kemakmuran rakyat. Maka PT. PLN dinilai etis bila ditinjau dari teori etika teleologi. Jika ditinjau dari teori utilitarianisme : Tindakan PT. PLN bila ditinjau dari teori etika utilitarianisme dinilai tidak etis, karena mereka melakukan monopoli. Sehingga kebutuhan masyarakat akan listrik sangat bergantung pada PT. PLN.
KESIMPULAN
Dari wacana diatas dapat disimpulkan bahwa PT. Perusahaan Listrik Negara (Persero) telah melakukan tindakan monopoli, yang menyebabkan kerugian pada masyarakat. Tindakan PT. PLN ini telah melanggar Undang-undang Republik Indonesia Nomor 5 Tahun 1999 Tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat.
