Eight journalists who covered the farmer protests in India and violence in Delhi on January 26, 2021 are facing baseless criminal charges, Human Rights Watch said today. The Indian authorities should drop the charges, which include sedition, promoting communal disharmony, and making statements prejudicial to national integration. “The Indian authorities’ response to protests has focused on discrediting peaceful protesters, harassing critics of the government, and prosecuting those reporting on the events,” said Meenakshi Ganguly, South Asia director at Human Rights Watch. “The government instead should conduct a transparent and impartial investigation into the January 26 violence in Delhi.” Hundreds of thousands of farmers have been protesting on the outskirts of Delhi since November 2020, demanding that the Bharatiya Janata Party (BJP)-led government withdraw three farm laws passed in September. The protests were peaceful until January 26, India’s Republic Day, when protesters broke through police barricades to enter Delhi and clashed with the police. A group of protesters breached the historic Red Fort and hoisted the Sikh religious flag alongside the national flag. Many of the farmers are Sikhs. One protester, Navreet Singh Hundal, 26, died in the violence. Delhi police said nearly 400 police officers were injured. The police in BJP-ruled Uttar Pradesh, Madhya Pradesh, Karnataka, and Haryana states have filed cases of sedition and promoting communal disharmony against six senior journalists and editors – Rajdeep Sardesai, Mrinal Pande, Zafar Agha, Paresh Nath, Anant Nath, Vinod K Jose, and a Congress party politician, Shashi Tharoor – for allegedly “misreporting” the facts around the death of the protester. Republic Day violence: SC stays arrest of Tharoor, Sardesai & others

The Supreme Court Tuesday stayed the arrest of Congress MP Shashi Tharoor and six journalists including Rajdeep Sardesai in connection with FIRs lodged against them for their alleged "misleading" tweets on the violence during the farmers' tractor rally here on the Republic Day.

A bench headed by Chief Justice S A Bobde issued notices and sought responses from the Centre and others on the petitions filed by Tharoor, Sardesai and journalists Mrinal Pande, Zafar Agha, Paresh Nath, Vinod K Jose and Anant Nath.

When the bench said it was issuing notice in the matter, senior lawyer Kapil Sibal, appearing for Tharoor, said that no coercive action be taken against the petitioners in the meantime.

Nothing is going to happen. Where is the danger, said the bench, also comprising Justices A S Bopanna and V Ramasubramanian.

Delhi Police file FIR against ‘The Caravan’ for spreading fake news

NEW DELHI: The Delhi Police have registered an FIR against ‘The Caravan‘ magazine for allegedly misleading and providing false information that a farmer died in police firing at the ITO intersection on January 26 after the proposed tractor rally by the protesting farmers rally turned violent in the national capital on Republic Day. The post-mortem report of the deceased person suggested the cause of death to be head injury after his tractor turned turtle. “As per the post-mortem report, the cause of death is shock and haemorrhage due to a head injury received after his tractor overturned,” said a senior police officer. The case has been registered at the IP Estate police station. The FIR also names certain other persons who too tried to mislead the public. On 26 January, The Caravan had put out a tweet citing an eyewitness, saying the farmer was shot by the police. Earlier on Thursday, the Noida Police had booked Congress MP Shashi Tharoor, journalists Rajdeep Sardesai, Mrinal Pande, Vinod K. Jose (The Caravan) and others for sedition on Thursday. An FIR lodged at the Sector 20 police station stated that they were booked for tweeting and spreading fake news pertaining to the death of a farmer during the tractor rally in Delhi on January 26.
