Towards Equality: A Review of Women’s Property Rights in India
Women’s Right to Property Under Hindu Law
Hindu women's inheritance rights have been limited since the start. Women were not viewed as equals to men in the past, and they did not have the same rights as males in society.
Women were denied property rights because they were deemed incapable of participating in sacrificial rites and were not allowed to provide funeral cakes for the spiritual redemption of the common ancestor. This prohibition dates back to religious customs.

Woman’s Property Right under Mitakshara and Dayabhaga Schools
While the Dayabhaga School was practiced across Eastern India, particularly in Bengal and Assam, the Mitakshara School was practiced throughout India, with the exception of the Eastern region.
Women's property rights were severely limited at Mitakshara School, where it was thought that they would never be able to become coparceners.
The widow of a deceased coparcener was not permitted to enforce a division of her husband's portion against his siblings, nor was she able to obtain his half.
In contrast to Mitakshara school, Dayabhaga school was more permissive and had different views on women's inheritance and heirs.
o Compared to Mitakshara School, widows at Dayabhaga School enjoyed stronger property rights. They could execute a division against their deceased husband's brothers and were entitled to inherit his portion.
The Dayabhaga school of thought placed restrictions even if it allowed for some degree of independence. In situations where a widowed woman without sons dies, for instance, her husband's portion is inherited by the closest male heir rather than her daughters.
Hindu Woman’s Right After the Hindu Succession Act, 1956
In the modern era of changing standards, it is recognized that women should be given the same position and rights as males in order to promote the development of the country.
As a result, the Hindu Succession Act, 1956 (HSA), the first significant piece of legislation acknowledging women's property inheritance rights, was created. Since then, women's property inheritance rights have developed.
Section 14: A female Hindu's property is her absolute property: (1) Any property owned by a female Hindu, whether acquired before to or following the implementation of this Act, is hers as complete ownership, not as limited ownership.

Women are granted unlimited rights over any property they own, as per the terms of Section 14 of the HSA.
Women are granted unrestricted rights under the Act, including the ability to sell their property. Both immovable and moveable property are possible.
Any Hindu woman can use her property without the authorization or approval of her father, spouse, or other family members thanks to Section 14 of the HSA. She can transfer her property whenever she wants and use the money that is received whatever she pleases.
Hindu Woman’s Right after Hindu Succession (Amendment) Act, 2005
· Sons had rights over the deceased father's property prior to the Hindu Succession Amendment Act of 2005, whereas daughters could only do so while they were still single. · The 174th Law Commission Report's recommendations led to the passage of the Hindu Succession (Amendment) Act, 2005, which significantly altered the 1956 Act. · Previously reserved for the male family members, married women could now inherit their father's property. · To put it another way, women might now enjoy equal depositionary rights to the patriarch's property and become coparceners in a succession. · Women can now inherit property as coparceners according to an amendment to Section 6 of the Hindu Succession Act that addresses the devolution of coparcenary property.
Section 6 of HSA
· The long-standing discriminatory practice of barring women from the coparcenary system was abolished by the 2005 Amendment, as stated in Section 6 of the HSA. It was accomplished by changing HSA Section 6. · According to Section 6(1) of the modified HSA, a coparcener's daughter will naturally become a coparcener in her own right, just like her sons. · In this manner, Section 6(1) grants the coparcener's sons and daughters equal rights and obligations. · A portion of the coparcenary property. · A deceased coparcener's interest in a Hindu Undivided Family's assets will pass through testamentary or intestate succession, per Section 6(3) of the HSA. Hindu Adoption and Maintenace Act, 1956
· In addition, Section 19 of the Hindu Adoption and Maintenance Act, 1956 (HAMA) allows a daughter-in-law to demand maintenance from her father-in-law if she is unable to support herself out of her own income or assets. If she has no assets, she cannot receive maintenance from her spouse, parents, or kids.
· If the father-in-law does not possess any coparcenary property from which the daughter-in-law has not received a share, then any obligation under sub-section (1) of Section 19 as previously mentioned will not be enforceable. Additionally, any such obligation will end upon the daughter-in-law's remarriage.
The advancement of a nation in the modern day depends on making sure that its women are not left behind. Theoretically and practically, women should have the same rights and opportunities as men. A country can only start along the path of growth when it really maintains gender equality in both concept and practice. Since the daughters now have the same birthright to the ancestral property as the sons, their interest in it is protected now that they have been acknowledged as coparceners. The father cannot deny the daughters their portion of the property by testamentary disposition.

Hinny 💍 - The One With No Voldy and Where Everyone Lives
AU, where Harry happens to hear a conversation between his grandfather, Fleamont Potter, and his father, James. Fleamont, who has been looking weaker by the day, tells his son he knows his and Euphemia's time is coming to an end, and his only regret is not being able to witness Harry grow up and get married. This bothers Harry, and while on a playdate at the Burrow, he confides in Ginny, who responds as if it were the most obvious solution: "Then let's get married."
They persuade their families to arrange a gathering, and they con the Weasley brothers into decorating the backyard. Ron stands by Harry's side as his best man, while Luna is Ginny's bridesmaid. All it took was one look from Harry and Ginny to convince Sirius to turn into Padfoot to be their ring bearer/flower girl; his outfit consisted of a bowtie and a tutu (James, Remus, Gideon, and Fabian nearly fell off their chairs laughing so hard).
They made each other's wedding rings. Harry's ring was made from the metal from his grandma's old Auror badge (which Euphemia gave to her willingly) and the very first snitch he caught for the first time and gifted to her. Ginny convinced Fabian and Gideon to transform into a ring. Ginny's ring was made of her favorite green bubble gum (that was suspiciously similar to Harry's eye color) and twigs of their broomsticks as the band, which Harry convinced his dad and Sirius to smooth out and place an unbreakable charm on with an auto-replenishing charm on the bubble gum.
They both dressed themselves for the occasion, and Harry asked his mom and godmother Marlene to help him pick flowers for Ginny's bouquet. He smelled each one and was very picky persistent it had to smell like Ginny's hair. It took Harry HOURS until he was finally satisfied with the arrangement. Molly volunteered to make their wedding cake, and a few days before the wedding, Ginny told her dad in a very grown-up tone to wear a bowtie because he was walking her down the aisle on Sunday. Hinny asked Hagrid to marry them, and when it was time to kiss the bride, Harry was just about to protest/lecture Hagrid about how he should have asked Ginny for her consent instead of giving him permission "to kiss the bride" (the boy was Lily Potter's son and a true feminist at heart), when Ginny pulled Harry down and gave Harry a big kiss on the lips. The kid was frozen for a solid minute and then couldn't stop smiling as he followed his 'wife' around all day.
They made Fleamont and Euphemia's wishes come true.
Then, 16 years later, they got married again.

Hey, I had a question. In Persuasion, why couldn't Mary's sons inherit Kellynch Hall? Entailed property goes to the closest male relative right? So why Mr.Elliot and not them?
It must go through the male line, children of daughters need not apply.
Sir Walter has no sons, so the entail goes back up the family tree and looks for his brother or his brother's sons. If there are none living, it goes back up and looks at his uncle and uncle's sons, and so on and so forth.
I have read about cases where daughters successfully challenged entails because there were no direct male heirs to be found, or they were super distant relations, but we know Sir Walter has a fairly close heir in Mr. Elliot (great grandson of the second Sir Walter).
General rules of entails:
The child must be an heir of his body, meaning a genetic child born within legal matrimony
It must go through the male line, so daughters are "dead branches" of the family tree
Not every estate is entailed, but people with titles (baronets and nobility) tended to have entails that passed on both the title and the primary estate or "seat" to the next male heir. Mansfield Park is likely entailed and both the baronetcy and the estate will pass to Tom
People could own land that was not part of the entail (eg. they bought it themselves) and this land could be willed to whomever they wanted. In A Woman of No Importance, a lord talks about how only the primary estate associated with his title is entailed, he can give the rest of his vast holdings to his natural son. Sir Walter also has land that is not part of the entail that he could sell but his pride prevents him from doing so

(Also, I read about one case where a member of the nobility accepted his wife's natural child because he had 3 or 4 sons and figured it would be fine. All his genetic sons died and the natural child got the title, but it was too late to disavow him by then!)

Women in ancient Egypt had the right to buy and inherit property, represent themselves in court, and own businesses.
A woman was free to leave her property to whoever she liked after she died, and she could even divorce her husband.
The will of Naunakhte from the 12th-11th Centuries BCE lists out which of her children were to inherit what, including some kids that would get nothing because they didn't care for their mom in old age.

I do think all of the adults had some part to play in creating the Dance but if I had to break it down to who had the most power to prevent it it would be Jaehaerys up to and including the Great Council, Viserys up until the moment Aegon is born and Otto from then on.
#jaehaerys could have named rhaenys his heir and prevented any sort of similar succession crisis from occurring in the future#all viserys needed to do was not get remarried and not have sons#i pass it to otto after that because the second that aegon came out male he began to scheme#(granted if viserys had stayed firm in his decision to remove him as hand i do think the chances of the dance go down#but this is still mostly on otto)#alicent's culpability is mostly from raising her sons to hate and fear rhaenyra's sons#so is rhaenyra's to a lesser extent but also for leaving king's landing and having three blatantly illegitimate children#(and then two blatantly legitimate children right after that)#daemon's is just from being generally unhinged and giving the greens legitimate reasons to fear for their safety#larys is the reason otto came back as hand#mysaria did technically help orchestrate blood and cheese#all the other members of the green council willingly committed treason#i was going to say corlys and rhaenys are blameless but no they pushed laenor into marriage knowing full well he's gay#forcing rhaenyra to have the aforementioned blatantly illegitimate children#also in the alternate universe where viserys chose laena they are probably a lot more culpable for that dance#but ultimately while all of the above are a series of bad decisions that culminated there were only three that could have stopped the dance#don't set a precedent that women inherit after men.#don't remarry or have sons after you've declared your daughter your heir.#don't scheme to usurp the rightful heir.#and that is why those three have the most culpability to me#house of the dragon
