Timeline for Luigi's Federal Case, which is proceeding on two tracks: 1. Precluding the government from seeking the DP to determine if this will be a capital or non-capital case. For reference, capital cases require at least ~x2 more resources. 2. Standard pretrial discovery & motions stage.

🚨Luigi's prosecutor Joel Seidemann responds to defenses claims about their calls being monitored - he claims that he didn't know how a legal call ended up being sent to them. When, in fact, his office has known for years about prison phone companies illegally recording attorney-client calls (which they then marketed to law enforcement agencies & prosecutors).

Every time defense attorneys are given reassurances that this a mistake/ they're looking into it, etc… Or, like Joel claimed, a pre-recorded warning was played before the call - so defendants knew about monitoring - however, many attorneys have denied this happening.

The procedure at MDC Brooklyn for nonprivileged calls & legal calls is also quite different. An inmate has to make a request to their Unit Team to have an attorney-client call on a separate "unmonitored telephone".. Anyone would definitely expect not to have such call recorded.

Not to mention that Joel's paralegal literally listened to the whole phone call AND took notes before notifying him. His claims that prosecutors didn't listen to it and that the call & notes got deleted - are weak to say the least. The call should've NEVER been recorded & paralegal should've know not to listen - IT IS NOT LEGAL.

❗ 3 SDNY Federal prosecutors (from the same office prosecuting Luigi) resigned after DOJ pressured them to lie about wrongfully handling Eric Adams' case. They claim that "Department has decided that obedience supersedes all else, requiring us to abdicate our legal and ethical obligations in favor of directions from Washington. That is wrong."

As a reminder, in her statement from Apr 1, Luigi's Lawyer, Karen Friedman Agnifilo, also claimed that DOJ wanted the SDNY federal prosecutors to obey their directive to seek death penalty despite the local prosecutors recommending against it: "Their decision to execute Luigi is political and goes against the recommendation of the local federal prosecutors, the law, and historical precedent."

To summarize, even the prosecutors cannot handle this level of corruption anymore.
