some very important info re: paid accounts~

I am not a lawyer, but I can decently interpret legalese and, being as I also suffer from tl;dr syndrome and assume others may as well, I took one for the team and went through the updated TOS for the post+ accounts and highlighted (what I understand to be) the most pertinent information, which ultimately comes down to this:

You cannot monetize copyrighted works (aka charge and earn money from fanfic, fanworks, etc) and if you do decide to put your fanworks behind a paywall via Tumblr, when you are inevitably sued, Tumblr will not protect you and will not defend you and you alone, personally, will be responsible for whatever monetary damages said lawsuit results in.

If anyone is a lawyer and knows I've gotten any of this wrong, please do not hesitate to correct me/this post.

1. Your paid account will not be hosted by tumblr; it is routed through a 3rd party.

2. By signing up for a paid account, you're entering into an agreement with Stripe, so in addition to Tumblr's TOS, you are also bound to Stripe's TOS.

3. Stripe, like Tumblr, will not defend you or protect you against any lawsuits.

4. Furthermore, you may end up owing Stripe money (indemnify = compensate)

5. Tumblr's TOS specifically states that you can't put any content on your post+ account that violates any laws, including laws that protect intellectual property rights of others. This is super important, because Tumblr's post+ FAQ also states that you can post anything that you would regularly post on tumblr, which I'm sure many will take to mean that gifsets, fanworks, etc are fair game, since all of that stuff can be posted on tumblr now. However, the difference is, you're not making money from the fanworks you're posting or reblogging now. Once money enters the equation, the game changes.

Tumblr is making it seem like any and all content goes for post+ accounts, knowing 90% of this site is fanworks. This is not true and you'll be opening yourself up for lawsuits if you charge for fanworks.

6. Tumblr further disclaims any and all liability in any legal issues.

tl;dr: Please do not make a post+ account, bc you will be opening yourself to lawsuits and if that happens, Tumblr's response will be not our problem, you agreed to all the terms which said you couldn't do that, sorry not sorry. Please protect yourself.

Do you ever think you'll stop drawing fanart? No offense it just seems like the kind of thing you're supposed to grow out of. I'm just curious what your plans/goals are since it isn't exactly an art form that people take seriously.

Girls who are taught that it’s shameful to be excited or passionate about anything, that it’s pathetic to gush about what attracts them, that it’s wrong to be a geek, that they should feel embarrassed about having a crush, that they’re not allowed to gaze or stare or wish or desire. Girls who need to grow out of it.

I was in line at Aldi and this girl with two toddlers in front of me had her card declined and she looked so fucking sad and said “let me call my husband real quick” and it was only 18 dollars, so I just paid for it, and she was very sweet and then as she walked off, the lady behind me said `”You know that was probably a scam, right?” and like, even if it was, like what a sad fucking scam, right? 18 dollars at the Aldi. If you’re “scamming” me for some Tyson chicken and apple juice and cauliflower, then just take my fucking money. 

“A scam” people are fucking wild.

Listen yall are just lucky i cant draw or animate. One day i might and when i do. Im drawing hardwon holding a dead moonshine with tears streaming down his face. A few panels of erlin on the altar hand stretched towards an unconscious bev a lil light in his hand as he desperately tries to cast a healing spell. The light flickers and goes out and his hand falls. I wanna draw them on the beach as the wave crashes onto them. Beverly under water crying out and one hand outstretched to the surface as the turtle dragon pulls him down. Bev on his knees clutching erlins sword to his chest surrounded by dead bodies. Maybe three panels from the crick when they were separated in the fog with moonshine and hardwon cryin and bev tryin to process moonshine bein sick. The death wraiths hovering behind a trancing lucanas. And i will send at least a copy of these to the naddpod mailbox. I just need to learn how to draw first.

Listen. Ive been tryin to slow down my relisten of naddpod. Maybe listen to the same episode a few times. Reaaaallyyy soak in and listen for those lil character interactions. But i love Deadeye and brennan lee mulligan and i cannot help but keep goin and listenin in those episodes. I finished his whole arc in one night yall. Maybe ill listen to the whole thing over again to make up for it. Theres too many good moments yall.

What do u think it was like when Erlin was killed Thiala? Like was he knocked out first & killed in his sleep or was he awake? Like dragged to the altar kickin n screamin and he watches them put bev on the altar beside him filled wth panic and fear and feelin so useless/powerless. They hold him down and raise the knife over him. Do u think he thought they were both gonna die? Hed only been reunited with bev for maybe an hour before this...they barely got through the fight wth the jubilex. Do u think Thiala said anything to him? Shushin him and tellin him his sacrifice will bring about peace. Would she really be completely icy while killin this kid? Long story short my heart hurts.
