Infowars host Alex Jones was forced to answer for his years of spreading conspiracy theories as he took the stand this week in a defamation damages trial brought against him by the parents of a 6-year-old child killed in the Sandy Hook Elementary School mass shooting. The jury spent less than a day deliberating the case, awarding more than $4 million dollars in compensatory damages. Tomorrow the trial will continue to the punitive phase, with further awards possible.

In the aftermath of the tragedy, Jones misled his audience of millions, telling them that the Dec. 14, 2012, massacre, which killed 20 children and six adult staff, was an elaborate hoax perpetrated by the government to undermine gun ownership rights. For years, he claimed that “crisis actors” staged the attack. In 2018, multiple families of Sandy Hook victims and an FBI agent who responded to the scene of the crime brought defamation charges against Jones and Infowars, alleging that his lies made them the target of harassment and violent threats.

On Oct. 1, 2021, a Texas judge found Jones liable for damages in three of these defamation lawsuits by default, after the Infowars host failed to turn over documents to the families’ lawyers. The trial to determine damages in the first of these lawsuits that he lost, brought by Neil Heslin and Scarlett Lewis, parents of victim Jesse Lewis, began July 26. They are seeking $150 million. Lewis directly addressed Jones in court before the conspiracy theorist took the stand.

In his testimony on Tuesday and Wednesday, a visibly uncomfortable and sweating Jones was repeatedly admonished by Judge Maya Guerra Gamble and brutally cross-examined by the parents’ lawyer, Mark Bankston. The Infowars host was confronted not just with his past statements about the Sandy Hook shootings, but also with remarks that he’d made about the judge, jury, and trial on his show earlier in the week.

Who owns Alphatale?

Hey everybody. If you remember from the last post that tackled this, I (Alphasaith) made a serious mistake. After talking about it with SHADIKAL15 and Nytethelad, we have decided that it would be best to perform a follow-up post to it. This post was made in full collaboration between SHADIKAL15, Nytethelad, and me (Alphasaith).

So for starters, the question posed in the title of this post: who owns Alphatale? The answer is Team Lavender. Team Lavender, since its formation in late-2018, has always owned Alphatale in its entirety. Each member of the Team owns a portion of Alphatale, and no member owns more than any other member. At present, there are five members of Team Lavender, these five you can see in the right bar if you are on Desktop view: SHADIKAL15 (the creator), Alphasaith (the editor, advisor, and continuity boi), Bladeinthelight (another/the original advisor), Kagami Shinami (original artist), and Nytethelad (the writer and current team leader).

In the previous post, it was stated that Nyte is the owner of Alphatale. This is true to a degree, though not the full truth. As stated in the previous paragraph, there are five owners to Alphatale. Nyte was generally called the owner in the past because he is the current leader of Team Lavender. We at Team Lavender hope to stop using this terminology, as it has done nothing but spread confusion. Instead of “Owner”, you will hear “Team Leader” for example.

You might now be wondering “if there are multiple owners, who should I credit when making art or other stuff related to Alphatale?” This is an excellent question. In the past, SHAD or Nyte have been individually credited, but going forward, try to instead credit the entire Team. “Alphatale is from Team Lavender”, for example. Continuing forward, we also wanted to talk about the future of Alphatale. Going forward, there are going to be three primary variations of Alphatale. Alphatale or Alphatale Classic, created by SHAD and presently being worked on by SHAD and Nyte; Alphatale Rho, a variation of Alphatale that exists in the Rhoverse created by me (Alphasaith); and Alphatale Nyte or N!Alphatale, created and written by Nyte.

Within Alphatale Classic, Nyte is going to continue and finish with Chapter 10, and SHADIKAL15 is going to be working on and writing Chapter 0 along with a number of short stories that help elaborate on the world. Alongside that, SHAD is also working on another related story known as AlphaRune.

Within Alphatale Rho, I am slowly working on that variation, though it falls into line with the greater story of the Rhoverse. The story that aligns with Alphatale Explained in the Classic story is already outlined, and the story itself is currently being written.

Within Alphatale Nyte, Nyte has drafted the story all the way through, and is about halfway done on prose-writing. Alphatale Nyte is said to be Nyte’s own take on Alphatale Classic, but to have its own unique story, similar to yet also different from the story of Alphatale Classic.

On the note of Alphatale variations, we would also like to make it known (again) that you (the audience) can make your own variations of Alphatale. Thank you for submitting this paper to our Tumblr. We appreciate the value and consideration you demonstrate in doing so, and respect the time and effort this research has taken.

This paper has an interesting premise (the impact of cat owners' conduct on the local wildlife), but this is set up quite poorly, due to the lack of real introduction. This could be improved by better framing the issue, for example by refering to previous studies proving a decline in the local wildlife, in relevant geographical areas. Indeed, according to Loss et al (2013), birds are less dangerous to mammals in Europe than to birds in the US, for example. Relatedly, it is unclear what is the novelty of the argument presented here, and the article could benefit from better identifying what is the contribution to the litterature.

The methdology suffers from a clear case selection bias. While qualitative rather than quantitative methods can yield strong insight into the causal mechanism linking the independent variable (cat ownership conduct) and the dependent variable (local wildlife), the case (me) seems to follow a selection process based on convenience. Even if convenience can sometimes be an acceptable criteria, it would need to be justified, but it does not seem that the author has particular knowledge of the case at hand, knows said cat owner, or particularly investigated the impact of said cat on the local wildlife.

Another issue is the definition of the case itself ; the author seems to assume that both them and the reader have sufficient information on the case (once again, the case being me) to consider it relevant to test the theory. But one of the assumption of the theory is that the cat belongs to the individual under study ; this has been infered from one (several) occurences of the individual calling the cat "my cat", with the implication being of course that the individual car regulate he cat's behaviour, i.e. preventing it from going outside. Has the author perhaps checked that the "my" of "my cat" indicates genuine ownership of the individual (me) over the cat, and not simply fondness for an un-owned cat in the neighbourhood ? This is particularly important, as the implication would be that the individual in question would not actually be able to control whether the cat goes outside or not. I do not doubt that the author has sufficient knowledge of the case being studied (me) to include it in the paper. It could still be a relevant case-study on the impact that un-owned cats have on local wildlife, as they do tend hunt more than owned cat (Trouwborst et al, 2020), but removes the human from the theory, which would have much impact on the policy required to solve the issue.

The second issue with the methodology is the operationalization of the variable. The independent variable is well defined as binary : cat ownership conduct can be "lets the cat go outside" or "does not let the cat go outside". However, the operationalization of the dependent variable is very unclear : is it the number of wild animals in the area ? How is the area defined? Are all potential species included ? Has the individual under study specified which animal was the prey ? Domestic cats have been proven to be more dangerous to birds than to mammals and reptiles, does the author plan on making this distinction ? This would require more observations on the case study. Is the dependent variable the actual number of individual animals, or the rate at which the single cat observed is killing them ? The author rightfully characterised one of the observation as being the killing of "a prey" , demonstrating vast knowledge in their field, and I do not doubt that they could therefore elaborate on this operationalization.

I have difficulties assessing the theory itself. The methodology of research being so poor makes the overall argument very unconvincing. I cannot give much more insight into the theory itself ; indeed, while I am indeed an academic, my speciality diverges slightly from Biology, as I specialize in International Law and Politics. Given the clear expertise of the author, I do not doubt that they understand that "academics" can study a few different topics, and are not experts in every single one of them, and that scholars specializing in legal studies and social sciences do not actually have time to pour over a wholly different literature.

Summary, Reading I Discourse and Authorship in Design Practice by Adelaida, 27 Sept 2021

My main take around the reading and the group discussion is that collaborative authorship is a weak concept, that works in terms of creatorship and credits, but fails when discussions about ownership start applying.

I worked back in Colombia for three years in an independent digital news media publication. I worked in hand with journalists who were in charge of doing the reporting and the writing. I was in charge of creating the visuals necessary to explain in a clear way the story’s main argument. Sometimes that meant doing a couple of graphics, or sometime it could requiere designing a whole web site. I was generally regarded as “co-author” and my name appeared in the published story right next to the journalist’s name.

But, when we participated in journalists prizes the rules mostly never contemplated this kind of situation of collaborative work and the authorship situation got more complicated. I could only enter competitions if the journalist wanted to present the work, since I wasn’t reporting the story I couldn’t apply by myself. Sometimes we agreed on presenting a story without my name, for the journalist to be able to compete.

At the end of my time there, we won a prize (yei!) for an intimate story about how the pandemic had a bigger take on women, specially in terms of income and job. The idea was to reflect the daily conversations the journalists had with these women in order to tell how their daily life had been affected. Along with a special design for the web site, the story was told as a sort of WhatsApp chat.

There were no pre established guidelines of how money prizes were distributed. So, the journalist proposed to divide the prize in four equal parts between the three journalists who reported and wrote the chronicles and me. But that meant we were leaving out the illustrator who did the cover, the creative editor that participated in the elaboration of the concept, the software engineer who developed the interactive code for the chat layout. Until now no decision has been made yet, but the final word is in the hands of the news media's director.

And that is when the notion of authorship is not enough, because it implies that in a collective work all the participants must have contributed in the same way, with the same kind of work, the same effort. Easily the discussion turns into what type of work is most important and what type of skills are more valued. Particularly in interdisciplinary contexts, there is still special attention given to the ideator as the main “creator”.

I was surprised to realize that in our group discussion we agreed on the part designers play in a collaborative work. Although we three come from very different experiences and backgrounds we agreed that as designers we are prone to not figure and not necessarily be defined by our work. Maybe we’ve learned to be more confident in collaborative work environments than other disciplines? Or is it because of our personality? Or is it gender related to the fact that women are not always taking the staring role?

Cobra Kai Season 5 Sweeps the Leg of Doubt Ahead of Season 4

Netflix might as well be the San Fernando Valley, since the streaming giant has karate on its algorithmic brain, thanks to escalating hype from hit television acquisition Cobra Kai. Indeed, the series has just nabbed an advanced fifth season renewal, arriving on the heels of a status-elevating Emmy nomination for Outstanding Comedy amongst other nods. The move occurs as the show’s slowly-teased upcoming fourth season heads toward a still-date-less December release window. After recent changes to Netflix’s formerly-spendthrift content-ordering habits, the renewal certainly solidifies the series as one of the streamer’s primary pillars.

Yes, it appears that the high-stakes tournament tussle teased for Cobra Kai’s upcoming fourth season, while inevitably consequential, will not serve as a colossal climax—as some fans speculate—to The Karate Kid television series sequel. Netflix has indeed made Cobra Kai Season 5 official with its production announced to commence in the show’s usual location of Atlanta sometime this fall. For now, information on the fifth frame is obviously nowhere to be found, given the veil of plot secrecy currently covering Cobra Kai Season 4.

However, even as Cobra Kai stands at the presumed peak of its popularity, it is reasonable to speculate that a natural endpoint is visible on the horizon. After all, the series has already taken viewers on quite the loopy ride as the character arcs of The Karate Kid movie rivals Daniel LaRusso (Ralph Macchio) and Johnny Lawrence (William Zabka) made wildly divergent—sometimes-comical—turns before arriving at their current intertwining state of an alliance between their respective karate dojos, Miyagi-Do and Eagle Fang, for a loser-leaves-town tournament challenge—made in the Season 3 finale—against the reconstituted Cobra Kai, which has fallen back under the ideologically-malicious ownership of John Kreese (Martin Kove). Said challenge has, likewise, defined the paths of the dojos’ impressionable high-school-aged karate students such as Miguel (Xolo Maridueña), Samantha (Mary Mouser), Robby (Tanner Buchanan), Tory (Peyton List), Demetri (Gianni DeCenzo), Hawk (Jacob Bertrand) and more—many of whom have bounced between sides as proverbial foot soldiers in this martial-arts war, which has rekindled a rivalry that goes back to the 1980s.

Cobra Kai Season 4 Trailer Teases Tournament Showdown for December

Assuming that the big battle, set for the franchise-familiar All-Valley Under-18 Karate Tournament, plays out in a climactic manner in the finale of Season 4, it stands to reason that Cobra Kai Season 5 represents a committed follow-through on the event’s implications, which—per the challenge—would leave either Miyagi-Do/Eagle Fang or Cobra Kai as the clear winner of the evolving series-long struggle. Intriguingly enough, Cobra Kai’s officially tweeted logline for the Season 5 renewal seemingly teases an expanded scale, stating, “The dojo is about to be 5x as rad.” While that line could be easily dismissed as a PR person’s idea of a pun, it could be indicative of what the landscape of the show’s karate-addled San Fernando Valley will look like once all the dust has settled from Season 4’s climactic All-Valley scrap.

The idea of concepts getting expanded to the point of being “5x as rad” could also be attributed to a character whose Cobra Kai Season 4 arrival is already being heralded as crucial: Terry Silver, the returning villain from 1989 movie The Karate Kid Part III, as played by a returning Thomas Ian Griffith. As we saw in the Season 3 finale, Kreese, upon realizing the scope of what he faced in the tournament challenge, was shown making a crucial phone call to an old friend. While the identity of said friend is not explicitly stated, the context of the call itself was made clear by the Vietnam War-era flashbacks earlier in the season, which showed how a young Kreese (Barrett Carnahan) used his karate skills while imprisoned in a North Vietnamese prison camp to buy just enough time for a rescue by U.S. forces. His actions also happened to directly save the life of young G.I. on the chopping block, called “Twig,” who subsequently vowed to repay the favor to Kreese for his whole life, thusly revealing Silver as the call recipient, since events pertaining to the life debt were vaguely discussed in the film.

So, why does the presence of Terry Silver equate increased enormity? Well, that’s because he happens to be a super-rich industrialist who made his fortune through apparently-shady dealings in the arena of toxic waste disposal. Indeed, The Karate Kid Part III saw Kreese—down, defeated and left without students after the tournament loss of the 1984 original film—pay a capitulatory visit to the mansion-estate-dwelling Silver, who we learn initially bought the Cobra Kai dojo for Kreese as a gift. While Kreese was there to express that he was giving up his failed dojo endeavor, the proxy sting of that defeat instead inspired Silver to use his vast fortune and resources for an elaborate revenge plot against his perceived enemies, Daniel and Mr. Miyagi.

Silver’s reputation for going obscenely big manifested with elaborate machinations designed to culminate with Cobra Kai dojos opening all across the valley. This required a very-public defeat and humiliation dealt to reigning tournament champion Daniel. He first hired a brutal, nationally-recognized ringer opponent, Mike Barnes (Sean Kanan), to destroy Daniel in the imminent follow-up tournament. To further ensure his desired outcome, Silver insidiously pretended to be a friend and new mentor to Daniel, all while surreptitiously driving a psychological wedge between him and Miyagi. Indeed, Silver’s exploits were quite the expansion from the original film’s simpler case of a new kid in town being bullied by bellicose karate students. Thus, we can reasonably expect a similar expansion to occur analogously on Cobra Kai Season 4 upon his return; an expansion that might metastasize into something even bigger by the time we get to Season 5.

Consequently, attention of the fans will return to Cobra Kai Season 4, which is currently set to Crane-Kick streaming competition with a grand arrival in December on a date to be revealed. As for Season 5, its release window remains to be seen.

PENN PENS-IN INCLUSION

The next colonial tale this blog wishes to review is that of Pennsylvania, but as promised in the last posting, a short overview is helpful. That would be a comparison between initial natural rights view and a federal view.  The reason for this insertion at this time is that the development of Pennsylvania took place mostly during the 1700s – it started its existence as a colony in 1681 when William Penn was issued the land grant by King Charles II.  And, the ensuing years, as this blog has already described, saw an increased influence of Enlightenment ideas.

         Along with those ideas, John Locke’s arguments were being considered by the American educated class. Locke would pose serious questioning of prevailing either feudalistic notions, to the extent they existed in America, but also Puritanical rationales that promoted a more equitable social arrangement – as opposed to an Anglican/Roman vertical view that supports hierarchical church structures and power distributions.  Locke’s ideas, as he initially proposed them, promoted what would he called a “social contract” approach to the founding and development of polities.

         In formulative language, he described polities being initially created by free-standing individuals.  With complete freedom to act as each person wished, to formulate an authoritative entity for mutual benefits, each would surrender those rights – and only those rights – that allow for such an arrangement and retain all other rights.  This is a social contract.  And given the retention of each person’s bulk of rights – naturally endowed – this approach to government and politics can be called the natural rights approach or view.  These ideas were part of the array of Enlightenment ideas which also supported non-Lockean arguments.

Here is how Stanford Encyclopedia describes Lock’s contribution:

 In the Two Treatises of Government, [Locke] defended the claim that men are by nature free and equal against claims that God had made all people naturally subject to a monarch. He argued that people have rights, such as the right to life, liberty, and property, that have a foundation independent of the laws of any particular society.  Locke used the claim that men are naturally free and equal as part of the justification for understanding legitimate political government as the result of a social contract where people in the state of nature conditionally transfer some of their rights to the government in order to better ensure the stable, comfortable enjoyment of their lives, liberty, and property.  Since governments exist by the consent of the people in order to protect the rights of the people and promote the public good, governments that fail to do so can be resisted and replaced with new governments.  Locke is thus also important for his defense of the right of revolution.  Locke also defends the principle of majority rule and the separation of legislative and executive powers. In the Letter Concerning Toleration, Locke denied that coercion should be used to bring people to (what the ruler believes is) the true religion and also denied that churches should have any coercive power over their members.  Locke elaborated on these themes in his later political writings, such as the Second Letter on Toleration and Third Letter on Toleration.[1]

 What this blog has shared is that the ideas of Locke have been misinterpreted today – a philosophic point of contention – and have, therefore, helped lead the nation to the current polarized political landscape.  So, to help understand Pennsylvanian history and to help understand the current political debate, it is useful to review a set of distinctions between natural rights view and federal view.

         This review is organized by comparing the positions of these views in relation to a list of issues. The issues are general conception amongst people, moral role of government, era of dominance in American history, and expectations of individuals.

 ·       General conception amongst people:  natural rights view sees that political order is equal to marketplace relationships (competing interests); federal view sees that political order is equal to a commonweal (undivided interests)

·       Moral role of government:  natural rights view is neutral to this issue, it provides protection for individual moral positions and its emphasis is on governmental procedures (e.g., due process rights); federal view provides structural prerequisites for self-rule by which local/communal moral positions vie in the consideration of proposed policy

·       Era of dominance:  natural rights view has been dominant in the last 70 plus years; federal view was dominant from the beginning of colonial existence to the late 19th century with strong influence, if not dominance, through the New Deal and World War II period

·       Expectation of individual:  natural rights view expects people to be respectful of others’ rights and behavior from a self-interest point of view; federal view expects active participation in creating a common environment and caring attitudes of fellow citizens and for the whole community.

 So, with these general distinctions, one can better understand Pennsylvania evolvement.

         Pennsylvania (or Penn’s Woods) was granted to Penn late in the 1600s.  Actually, the territory is named for Penn’s father, Admiral Sir William Penn.  The family retained ownership of the grant until the American Revolution at which time the family was expelled.  The grant would eventually lead to two colonies, Pennsylvania and Delaware.

         Original settlers were mostly Penn’s fellow Quakers.  That religion was originally a radical form of Puritanism.  In addition to British Quakers, the area attracted large numbers of Germans and Scot Irish people.  One can detect that German influence by the number of towns or areas in Pennsylvania holding German or German derived names.  Roughly 30 percent of current Pennsylvanians claim German ancestry.[2]  And while initial relations with indigenous people, the Lenape, were cordial, eventual war broke out between settlers and local tribes (especially as extensions of the French and Indian War hostilities).

         The first efforts to establish a government was an extension of the land grant.  William Penn was the appointed governor, although he did not live there, and a 72-member council and larger general assembly constituted the colonies governance.  This did not work, and subsequent “frames of government” were written and put into effect in 1683, 1696, and 1701.  The last instrument was known as the Charter of Privileges and served as an organizing document until the American Revolution.  The next frame was to be a constitution, i.e., a compact-al instrument.

         Admittedly, Penn’s initial and subsequent “constitutions” were not occurrences in which a people gathered to hammer out an organizing document to arrange for a structure of governance and spelling out the other functions of government.  But Penn can be judged as being highly influenced by federal principles. Here is a short overview of his handiwork:

 [Upon visiting America in 1699], he put forward a plan to make a federation of all English colonies in America.  There have been claims that he also fought slavery, but that seems unlikely, as he owned and even traded slaves himself.  However, he did promote good treatment for slaves, and other Pennsylvania Quakers were among the earliest fighters against slavery.[3]

 One can readily read that he was biased toward inclusion and, given his Puritanical view, was biased against hierarchical structures.        

         But in all of this, one should not lose sight that Pennsylvania was a business arrangement and, unfortunately, Penn was not above racists attitudes prevalent during his time (and one can argue, still exist today).  But he had a demonstrable federal bent.  He attempted inclusive policies and even sided at times against his commercial interests.  And to put a finer point on this portrayal, this blog has clearly indicated that the federal views that existed at the time limited their inclusiveness to white, European peoples and has given that version of federalism the name parochial/traditional federalism.

         This blog will at this point stop this story and pick it up in the next posting with the political developments that characterize that colony’s experience in the years leading up to the Revolution and independence.  What one generally sees in that history is the story of an industrious people and the development of the colonies’ first prominent urban center, Philadelphia.
