What's your stance on net neutrality? Is the video gaming industry (from indie to AAA) concerned?
I’ve had a few questions about net neutrality, so I thought I’d answer one. [Net Neutrality], for those who don’t know, is the legal concept that Internet Service Providers cannot give preferential treatment to network traffic from specific sources or to specific destinations. It’s a big deal at the moment because the current law of the land states that American ISPs cannot favor specific internet traffic, meaning that data from 4chan is treated the exact same as data from Tumblr, Pornhub, Google, or Steam. Tomorrow, the American Federal Communications Commission (FCC) will hold a vote as to whether the wish to repeal the current rules in place.
If they repeal it, there are a couple of potential consequences that will possibly come down the road.
#1. ISPs can purposely and arbitrarily limit data access to and from specific sources
This means that a liberal-leaning service provider could ban Breitbart or Fox News from their customers, a provider with a contract with Hulu could push you towards Hulu by giving them preferential treatment and throttling Netflix speeds, etc.
#2. Due to the arbitrary nature of this, ISPs can charge for access
Maybe your ISP signed a deal with Hulu to give them preferential treatment, but they know that there’s a lot of die-hard Netflix 4 life fans out there. They come up with a solution - if you are on that company and really want Netflix access, you just have to pay an extra $5 per month for the “Netflix” package and they will remove the speed bumps on the transfer speeds. Maybe you really like Facebook, or Tumblr, or Steam, or whatever. Pay that extra cash and you can have speedy access to it again.
It’s also important to note that this sort of thing exists already. We’ve seen cases of ISPs controlling the message, such as [Canada’s Telus ISP blocking pro-union sites from their customers]. (Edit: Apparently the source I was using was wrong, and Portugal ISPs do not piecemeal out network access for non-mobile carriers).
So how will this affect video games?
With any sort of regulation, it comes down to compliance with the rules, and the cost for that compliance. It depends on the deals that get made, and that requires lawyers and business dudes doing a lot of negotiating. This, of course, heavily favors bigger businesses like Steam, EA, Activision, etc. because they have the resources to make big stuff happen. Smaller businesses won’t have as much to offer, thus getting the shorter end of the stick.

This will probably have potentially interesting side effects. For example, in 2016 T-Mobile partnered up with Pokemon GO and didn’t charge for any cellular data used to play Pokemon GO. We could get similar promotions or tie-ins with other properties in the future. In a Net Neutrality-free future, we could see stuff like “Get a free copy of Battlefield 5 with your Gaming Package Subscription”, or a package where you can get guaranteed latency caps (by prioritizing your traffic to their servers) when you play games like League, Overwatch, etc. But you’ll also probably see options for gaming broaden to a more microtransaction-like model where you put the packages you want into a bundle and pay for that each month.
The other side of the coin is that publishers that don’t or can’t make deals might find it harder to get traffic. This means that smaller or indie games that have the potential to go huge will have a much harder time doing so. Small games that have the potential to explode in popularity (like how League of Legends, Minecraft, PUBG, etc. did) could be throttled in their infancy because more of the traffic would be directed to the big publishers instead.
