"Convict Trials Began At Court House Today," Kingston Whig-Standard. June 14, 1933. Page 3. ---- Counsel Claimed He Had Not Had Time to Prepare Case - True Bills Are Returned. ---- Trial of Convict Hugh Burling of the Kingston Penitentiary, charged with rioting at the institution on October 17 last, and with damaging property there, was commenced before Judge McLean in County Court Wednesday morning, but as court adjourned at noon no witnesses had been called.

The prisoner was defended by W. H. Herrington, while Col. Keiller MacKay, K. C.. was crown prosecutor, with considerable time being taken this morning over the arranging of the defence of the prisoners who claimed that he was not ready to stand trial as he had not had sufficient time to have witnesses interviewed. Judge McLean, however, was convinced that ample time had been given and accordingly proceeded with the case.

Court Opened When court opened this morning before Judge McLean of Picton, the Grand Jury returned true bills against two penitentiary convicts, Hugh Burling and Ivan Perry, and also against Harold Pappa, charged with arson in the Township of Olden, and A. N. Lyster, charged with theft of money from the Bank of Nova Scotia.

Convict Burling was immediately placed in the box and Judge McLean asked him if he was represented by counsel. "I don't know, your honor," replied the prisoner. "Mr. W. H. Herrington came to interview me, but I don't know if he is going to defend me."

Court was held up for a few minutes while Mr. Herrington was communicated with.

Convict Burling is 22 years of age and was sentenced at Sandwich in 1931 to five years for robbery. Col. Keiller MacKay, K.C..conducted the prosecution, while the grand jury retired to consider indictments against other convicts.

On Mr. Herrington's arrival, a conference was held with Judge McLean and Col. MacKay as to the defence of the accused, the upshot being that court was adjourned for half an hour while Mr. Herrington interviewed the accused.

Mr. Herrington Protests As court resumed at eleven o'clock, Mr. Herrington said he was not prepared to go on with the case as he had not had an opportunity to interview witnesses.

"When were you retained?" asked Judge McLean.

"About ten days ago, but I have not had the chance to prepare a case. I don't know what it's all about,"

"I'm sorry Mr. Herrington." replied the Judge, "but I intend to go on with the case. Mr. Rigney will give you the opportunity to interview witnesses."

The charge of rioting was read against Burling and he was asked, on pleading not guilty, if he was ready for his trial.

"I am not ready." said Burling. "I have not had the opportunity to interview prisoners as other convicts have had."

This rather unusual procedure did not affect Judge McLean's attitude, who on being told by Col. Mackay that permission to retain counsel had been given ten days ago, decided to go on with the came.

Mr. Herrington contended he had had no chance to interview the accused until last Saturday and did not have the case prepared. The cast proceeded, however, and the petit jury was sworn in as follows: John H. Brown, Harry Alexander, William Hawkins, Abraham Barr, Joseph E. Barrett, George Cadotte, Jr., Rupers Aylesworth, W. J. Douglas, David Dixon, Vincent Crowe, Arthur Clark, Robert Patterson. Twelve jurors were challenged by the defense and nine by the Crown. Consider Evidence Only Col. MacKay at considerable length reviewed the entire case of the disturbance of October 17 at the penitentiary. He went into every detail emphasizing at the same time that the jury are the guardians of society and are concerned with evidence only.

"It does not matter," he said, "if there are things at the penitentiary which can bear criticism. That need not be considered by you. You are to be influenced by the evidence given in this court and nothing else. If you have friends in the penitentiary and most of us have, disregard entirely".

Court was adjourned until two o- clock before any witnesses were called.
