Hi, I'm Mia!

I am a middle child, born and raised in Wellington. I have grown up around lots of animals and pets, my grandparents had a farm and I grew up with an amazingly friendly, food orientated lab. He was one of the sweetest dogs I have ever known and his presence definitely had a big impact on my life. My parents, who are now empty nesters (my older brother is about to get married and lives in auckland working in health management, while my younger sister has just started her second year of law at Otago), have a one year old cavoodle puppy name Billie. Whenever I go home I love to spend almost all of my time with her. One of the downfalls of flatting and studying in Auckland is that I can not spend as much time with animals or Billie.

I am the creative one in my family. Both my parents were lawyers and my siblings have all taken directions that will led them to office jobs. I was always encouraged by my mum to be creative (she always wishes that there were as many options for design and art as there are now back when she was at school). Some of my best childhood memories have been drawing and spending time doing crafts with her. Even though my mum was a lawyer, she was an amazing drawer and I always aspired to be able to draw as well as her which is why I put so much time into developing my illustration skills. She has always been my biggest influence and support in studying design.

I was also born with amniotic band syndrome which means that my left arm stops just after my elbow. Being one handed is a massive part of my identity, even when I have not always wanted it to be, and has shaped and influenced everything I have and will ever do. It made me switch from skiing to snowboarding and stopped me from ever getting the perfect cartwheel. I think part of the reason I am a designer and creative is because of my arm. Creativity gives me a way to express myself that isn't defined by my physical appearance or lack of hand.

My capstone project which detailed mine and my parents experience of having a kid with one hand.

Through University I have become more and more comfortable with my identity as a disabled designer (something I would have never wanted to be associated as during high school) and it has given me the chance to grow. I have learnt how I can use design to give voice to my younger self and others who feel they have none. I think that this is one of the most valuable assets of a designer, their ability to speak for those who society does not let.

Don’t talk to me about timelines XD lockdown 3.0 was an unpleasant surprise but it did give me some fun fodder to play with. Missing from this were the stream of Valentines to Covid that spread around my section of NZ social media XD I was tempted to make Scott write some, but alas it didn’t fit. Obviously plenty has been fudged, it’s definitely not meant to be taken too seriously and more allows me to collect together some of the mixed emotions of getting a five hour countdown to lockdown D: That was not fun lol like far out, and we had to prepped for remote learning by 9am the next day. Scott is not allowed to complain further in his swanky apartment and no job XDD

“With the civil defence response, with the company, I don’t know!” He looked up, desperation in his eyes. “What can I do to help?”

Charlotte shook her head, pressing her lips together tightly.

“Mr Tracy, we have an isolation response in place, at your father’s request. Leave the board to organise the company, you need to get home and…”

“No.”

“There are lockdown protocols on the island as well,” snapped Scott. “I can’t just go home, risk my family, my Grandma.”

“You can’t help here. They’ve done it before. It’s Level Three, people will be able to collect gear tomorrow if needed, we’re set up for remote offices and the last thing people need is you dilly-dallying in the top office.”

A loud shrieking alarm pierced through her final words and Scott flinched at the sound.

Len yelped next to him, dropping his comm with a curse.

“Damn emergency alerts, don’t they know the whole country has heard by now? Why do they just SHUT UP!” he bellowed at the still beeping comm. “It’s so unnecessary, the first time we went under, I thought we were about to evacuate for a volcanic eruption. Staying home, it’s hardly an emergency.”

Charlotte did little to hide her scorn, but Scott smothered a smile as he read through the full message.

“Okay, fine,” he said at last. “I can bunker down at the apartment for a few days.”

“Weeks, I’d be prepping for,” interrupted Len. “Hard to say of course, but they keep extending them.”

“You know why we do it,” said Charlotte, coolly.

He shrugged. “Doesn’t mean I have to pretend it’s a holiday like everyone else seems to do.”

“Well, there never was any rest for the wicked, they say,” quipped Scott.

Len barked a sudden laugh.

“You’re alright, Tracy. Shame about how this ended, I’d have liked a bite with you.”

“Well, there’s always next time. Maybe we’ll find time for a shared celebration after all this.”

“My treat, Tracy, my treat,” he said with a chuckle. “Take care now.”

Scott nodded a farewell and turned back to Charlotte.

“You’re going to be fine?”

Scott stared at him, then looked over at the line snaking through the frozen food aisle, between the meat and dairy and coiling up in the sad looking and so-called fresh produce.

The two chocolate bars and eggs he’s managed to grab hardly seemed worth it at all.

“I can put those back if you want.”

“Yeah,” said Scott, dazedly. “Yeah, thanks that’s be great.”

Ariki smirked a little.

“We’re reopening at seven, yeah? I’ll see you then.”

“Thanks again,” called Scott as he hurried from the shop.

The rain that had been threatening its arrival all weekend was starting to appear, and Scott hurried home, ducking his head down and shoving his hands in his pockets. He knew there’d be enough food for at least his dinner tonight and Ariki was right, he could sort the rest in the morning.

A swipe of his keycard, and he shut out the world with a muffled slam of the door and a sigh.

He shucked off his rain jacket, not bothering to hang it up, and trudged into the kitchen. It wasn’t like there’d be anyone around to complain for a while and he was starving. Lunch, the little afternoon tea nibbles they’d provided, even his last coffee felt like it had been drunken in another life.

Dinner, then finally he’d call home.

He didn’t doubt they already knew what was happening, was probably wondering why he hadn’t called, but none of them had even been swept up in the chaos of lockdown preparations.

He stared blankly in front of the fridge, the cold, bluish light illuminating him in the dark room. The sun had fully set by now, and the last vestiges of twilight had given way to the true, deep night with the onset of rainfall.

Gordon yelped as he dove over the couch.

“Okay, I can see there’s been some errors in judgement here,” said Gordon, panting. “I’m sorry, Scott, I really am.”

Scott glared.

“Not good enough.” He paused, eyeing Gordon as he cowered behind the sofa. “What are you even doing here?”

“Uh, excuse me?”

“Here. What are you doing in Auckland?”

“Happy birthday to me too, love you bro, congrats on surviving another year.”

“You came to Auckland for your birthday?”

“Yeah.” Gordon sat up cautiously. “Couldn’t exactly see Penny, and it’s not like there’s many other places that will let us in.”

“I thought we counted as a US territory.”

“John cleared it with someone, I don’t know.” He shrugged. “Didn’t want to be stuck at home for my birthday. And look how that turned out.”

He did look extraordinarily sorry for himself.

Scott sighed, and reached out a hand.

“Go get some damn pants on,” he grumbled. “And go look for Virgil’s emergency snacks, I know he stores them everywhere.”

“Yeah, okay.”

“I mean it, don’t you dare come back unless you bring me food.”

Gordon snorted.

“Sure, wouldn’t want to provoke the wrath of a starving Scooter.”

Scott jerked his body towards Gordon, and smirked as he bolted up the stairs towards the bedrooms, before sinking down into the cushions and closing his eyes.

The comm beeped gently, a stark contrast from the blaring alert from earlier.

“Hey,” he said, opening an eye as Virgil was projected in front of him.

“Tell me you’re not–”

“Oh, I am.”

“Gordon too?”

“Yep.”

“Damn.”

“Tell me about it.”

They were both quiet for few seconds, thinking about how rapidly the world had seemed to shift around them.

“I suppose it’s only for a few days,” began Virgil, but Scott was already shaking his head.

“We gotta do the full two weeks. After that, we ought to be able to clear an exit with the harbourmaster and the coast guard, even if it’s not over, but we can’t come back earlier. The only reason we could move freely before without our helmets is because–”

“Preaching to the choir, Scott. I get it.”

“You gonna be alright without us?”

Virgil shrugged. “Rescues are down what with more people staying at home. Alan and I can handle the small change, and Kayo’s been itching for some POD practice recently. We’ll manage. Besides, you’re the one stuck with Gordon.”

“Alright, don’t kill each other before the two weeks is up. John’s already organised a betting pool, don’t give him the satisfaction of winning again, he’ll be insufferable.”

“Oh, he’s on,” said Gordon, grinning. “Tell him I put fifty bucks on Scott tipping me out of bed or off the couch by the end of the week.”

“Got it.”

“You can’t bet against us,” said Scott, mumbling around the chocolate. “I thought you were on my side.”

“You tried to murder me over a steak.”

“The jury would have never convicted.”

“Okay, I can see you two are going to have a fun time,” said Virgil, loudly over their bickering. “See you in two weeks.”

He didn’t wait for a response. After all, two weeks was a smidge outside even his patience.

There was another flurry of camera noise and light as Virgil stood up. His eyes only for her.

Scott was saying something, pulling at his harness, but Virgil was stronger.

The woman stared at him, tears running down her face.

Words fell from his lips.

The accountant with a negative ledger

So another high profile male has been discharged without conviction due to the restrictions a record would create for his ability to travel.

Given it’s September 2020, and travel is, well, off the table for goodness knows how long while the rest of the world battles with COVID-19, that excuse doesn’t really wash.

Plus, he’s an accountant, travel as part of his business, um, really...

So what did he do to land in court?

He and his now ex-wife had been arguing.

His ex-wife retreated and was lying on a bed and crying when he came into the room and told her to “shut up”.

And this is where it gets dark and twisty.

He then put one of his hands over her mouth and the other on her neck and threatened to punch her if she didn’t stop crying.

When she began to cry louder, he punched her in the eye.

She ran to a friend's house nearby for help.

His punch left her with bruising to her right eye and a broken nose. 

Clear assault and clear evidence, case closed right.  Wrong.

He was found guilty of injuring with reckless disregard and not guilty of two charges of male assaults female, after a five-day trial at the Auckland District Court.

 And the Judge also noted that her previous surgery may have left her nose “somewhat weakened”.  Yeah, okay.  (If you didn’t know, Judges are renowned for not only being legislative experts, they also class themselves as medical experts too and yes, that’s a perfect tui ad.) 

His excuse was “the punch had been in the heat of the moment.”

The Judge gave him credit for his previous good behaviour, noting he had done work for charity organisations.

His lawyer, a prominent QC (whom I refuse to name mention as I’m not giving out free airtime for her services) applied for a discharge without conviction for her client, arguing the consequences of a conviction were out of all proportion to the seriousness of the crime.

She filed 39 references from his friends and business associates.  He had also attended Man Alive, Reducing Harm and the Community Drug and Alcohol Service.  He had also seen two psychologists, one of whom assessed him as being a low risk of re-offending.  His lawyer also filed an affidavit from an immigration lawyer who described his ability to travel with a conviction as “complicated and time-consuming”.

So who is he?

She wished her well and sent the response to her and to Cleaver, an employee of Cleaver Richards Accountants who had been party to the original email. She received a reply from Mr Cleaver's email account a few hours later that said: "whore".

Lucky for her, she simply wasn’t accessible for him to take his anger out on, and rightly so she replied to Cleaver.  "Thanks for your intelligent response. I also know that rich white males in a Court of Law, normally get slapped with a wet plus ticket from a Judge.

These cases are a smattering of the ones I know that go on behind closed doors.  Since when is a right to travel valued above a serious assault which is then trivialised by a Judge.  It wasn’t just a I pushed her, she fell and broke her nose, her crime was crying in a room by herself, where he then held her down, attempted to strangle her and then assaulted her point blank.  An assault like that can kill you in an instant.  And yes I can say that, as I have a medical background. 

Is that really OK New Zealand, is it okay for our justice system to value travel over a life?

Maybe normal people need to be Judges, because, I for one, would’ve sentenced him to jail time.

Sarah, can I ask for some uni/career advice? I'm starting law school soon and I wanted to know what I should expect/what kind of area of law I should look into specialising to maximise career opportunities. iirc you're also Sporean/Msian so you would know best! I follow you on insta as well and you're always talking about your job and your post recent job talks about a negotiation which sounds so cool! Your job also put you in NZ which is amazing! Any advice you can give is appreciated!

Yay, congrats on starting law school soon! It’s a......rough ride, so be prepared for that. I have a tag here where I talk/whine about law school, so hopefully reading through it will give you an accurate-ish picture of what law school is supposed to be like. 

The best advice I can give you to get you through law school is to just stay ahead? I mean, it doesn’t necessarily mean that you won’t survive law school if you don’t, but it’ll make things so much easier on yourself! Law school is very exam-based, so if you can manage to stay ahead on readings and revision, exam season should be a breeze. 

As to what area of law you should look into to maximize career options, that really depends on the trend in the city you’re planning to practise in. For example, at this current job, while it isn’t the only thing I am in charge of, I do basically the bulk of property conveyancing at the firm because that’s just the most viable area of work in Auckland, and it’s the easiest to master so ofc that’s what they would give to a newbie like me. I also did quite a lot of arbitration/negotiation courses back in uni because ADR seems to be the trend NZ is moving towards, so I get put on corporate negotiations as well, which is. Honestly less cool and fun than it sounds. 

(Okay I’m just going to vaguely go through Singapore/Malaysia legal trends, but note that I don’t do any work there so it might not be very accurate. If you want, you can hmu on Instagram and I can hook you up with a couple of lawyer friends back home???)

Legal trends in Singapore are relatively easy to observe. Commercial law is booming. If you’re working with corporate or intellectual property law, that’s definitely in demand as well. Growth of Chinese firms within Singapore means that if you have knowledge of international trading laws, or specific knowledge of Chinese commercial law, finding a job will be hella easy. 

Malaysia is a bit harder to pinpoint. It definitely depends on the city. JB for example will be p much like Singapore, esp in terms of international trading. KL would be a good place for conveyancing. If you’re looking into smaller towns like uhm, let’s say Batu Pahat, generally, civil litigation is what you’ll want to bank on, but that means a wide variety of things to learn, e.g. debt collection, lease disputes. Family/probate law is a good area to go into if you’re in a smaller town.

Who Gets The Goldfish Or The Dog When Separating?

When a relationship ends it’s often difficult for couples to decide who should keep the family pet.  We often have clients ask us if they can ‘share custody’.  Despite the love we have for our pets, under Relationship Property law pets aren’t treated the same way as children, they’re considered ‘family chattels’ and should be included in your separation agreement.

The Law Society has recently identified pets as an issue for the Law Commission to consider in its review of the Property (Relationships) Act 1967 (Act) but until the law changes, pets need to be considered in the current relationship property context.  This means your beloved hound or cat has the same status as your Macbook or Sodastream.

Under current law, pets (as with all family chattels) should be divided equally on separation.  This is easier said than done given you can’t actually divide a pet and both parties want to retain it.  A recent case, Sydney v Sydney [2012] NZFC 2685, has given some guidance on this issue and has held that the welfare of pets is the primary consideration when determining who keeps the animal.  In this case, the family dog had been an “outdoors dog” enjoying a country lifestyle and when the dog’s owners separated one of them was likely to move to town.  Not surprisingly the court decided that it would be in the dog’s best interest to remain in the country.  This may have been a more obvious case but what happens in a situation where you can each provide the family pet with the same standard of living?

The Law Society has picked up on the dilemma of pets and has suggested that the new Act should include a test for determining who gets to keep pets after separation. While consideration of this issue is a positive step, unfortunately, the new test proposed also appears problematic as it requires the court to consider which family member has the closest relationship with the pet.  This is no easy task and is likely to cause just as many arguments as the current situation, if not more.

If you’re concerned about what will happen to your pet if you separate talk to your family lawyer, and if you’re in a new relationship give some thought to whether the pup, kitty or turtle should be included in the pre-nup.
