New Delhi: The Supreme Court of India will release its detailed judgment on Friday, explaining its decision not to cancel the NEET-UG 2024 examination. This follows the court's rejection of a plea for a re-test on July 23. Chief Justice of India DY Chandrachud emphasized the significant repercussions of conducting a fresh exam, noting that it would impact over 24 lakh students who had already taken the test. He highlighted that such a move would disrupt the admission schedule and cause cascading effects on the medical entrance exam and its subsequent counselling process.

Meanwhile, the Central Bureau of Investigation (CBI) has intensified its probe into alleged irregularities surrounding the NEET-UG 2024 examination. On Thursday, the CBI filed its first chargesheet, charging 13 individuals under various sections of the Indian Penal Code (IPC) including sections 120-B (criminal conspiracy), 201 (causing disappearance of evidence), 409 (criminal breach of trust by public servant), 380 (theft in dwelling house), 411 (dishonestly receiving stolen property), 420 (cheating), and 109 (abetment).
Names Of NEET Paper Leak Accused The chargesheet names the following accused: Nitish Kumar, Amit Anand, Sikander Yadvendu, Ashutosh Kumar-1, Roshan Kumar, Manish Prakash, Ashutosh Kumar-2, Akhilesh Kumar, Avdesh Kumar, Anurag Yadav, Abhishek Kumar, Shivnandan Kumar, and Ayush Raj. The case was initially registered at Shastri Nagar Police Station in Patna and later transferred to the CBI on June 23. To date, the CBI has arrested 40 individuals, including 15 apprehended by Bihar Police, and conducted searches at 58 locations.
Last week, the CBI revealed in an official statement that the NEET-UG 2024 question paper was illicitly accessed from the Oasis School in Hazaribagh on the morning of May 5. The key figure behind this act was identified as Pankaj Kumar, also known as Aditya or Sahil, one of the masterminds in the case. The theft was reportedly carried out with the connivance of the Hazaribagh NTA City Coordinator cum Principal of Oasis School and the Centre Superintendent cum Vice Principal of the same institution.
The investigation is ongoing, with several other suspects already in police or judicial custody. The CBI has stated that supplementary chargesheets will be filed as further investigation into these suspects and other aspects of the case progresses.

Impossible for law and ethics to accept compromise with Child's kidnappers
Smt. Rubina & Others v. The Govt. of NCT & Others

Before Delhi High Court
The Bench of Hon’ble Madam Justice Swarna Kanta Sharma J pronounced the judgement on 01.12.2023 holding that ‘A practice of compromising cases which involves kidnapping of innocent minor children cannot be allowed and the criminal proceedings cannot be quashed based on settlements reached between the Kidnapper and the biological parents.
It is crucial to set a precedent that unequivocally condemns the act of kidnapping and trafficking of children, ensuring that rule of law prevails in the society.’
  Facts:
1.      Inherent power of the High Court is invoked u/s 482 Cr PC for quashing the FIR for offence of kidnapping & proceedings emanating therefrom.
2.      Complainant father lodged missing report of his daughter and son on 13.12.2017 when he had gone for work at Mukundpur leaving behind wife, one son & two daughters.
3.      Eldest daughter had gone to school where as his son and other daughter had gone to the house of his elder brother which was behind his house.
4.      Thereafter his son and daughter had gone missing. He filed a complaint that some unknown person might have kidnapped his son and daughter.
5.      FIR u/s 363 was registered.
6.      Police tried to find out the missing children but could not trace out them.
7.      However, on 17.12.2017 complainant informed police that he has found his missing son.
8.      Daughter still was not found.
9.      Three years later while carrying out investigation U/S 363/365/368/370/120B/34 of IPC at Police Station Bhalswa Dairy, Delhi, the police had arrested three accused persons in connection with the present case i.e. Rubina (petitioner no. 1), Nisha (petitioner no. 2) and Kapil Kumar (petitioner no. 3) on 12.08.2020, and had also recovered the minor daughter of the complainant from them.
 Submission of the Counsel of the Petitioner
1.      The matter has been settled between the complainant & the present petitioners/accused persons.
2.      The accused persons should not undergo trial as the child now loves the accused persons and that the accused persons have been taking care of the child. I
3.      It is also stated that the accused Nisha and Kapil were not aware that children had been kidnapped, and since they could not have become biological parents of a child, a lenient view may be taken and the FIR for kidnapping and the chargesheet filed under Sections 363/365/368/120B/34 of IPC be quashed.
4.      It was also argued that the Courts in such cases should take humanitarian approach and quash the criminal proceedings and the accused persons are willing to adopt legally the girl child.
 Submission of the Counsel of the State
1.      Kidnapping of a child and recovery after a period of about three years is a serious offence.
2.      The accused Nisha and Kapil were aware about kidnapping of the child as they had bought the child for Rs. 20,000/- from the accused Rubina.
3.      Therefore, it is prayed that present petition should be dismissed and such settlements must not be allowed in the larger interest of the society
 Observation of the Court
 1.      While the criminal act itself is distressing, a new layer of complexity has arisen as the parents of the kidnapped child have entered into a settlement with the accused persons.
2.      This Court is unable to accept this argument of the petitioner’s counsel of taking lenient view as it is not only against the fundamental principles of criminal jurisprudence but also against the legitimate expectations of the society to punish those who commit heinous offences.
3.      This case brings to light the critical question of the commodification of children, a practice that goes against the moral values and ethical standards of the society.
4.      The idea that a girl child can be subjected to a transaction, where her custody is negotiated as if it was a piece of property, challenges the very principles of rule of law.
5.      The Court's role in such a situation is pivotal, as it must grapple with the desire of the parties and the broader societal implications of accepting such settlements.
Court’s Dilemma
1.      There are few cases wherein the Courts and the Judges are faced with a dilemma. The present case is one such case.
2.      It is unfortunate that the parents of the child want the child also to remain with the kidnappers since they state that the accused persons will adopt the child as On one hand, it is stated that the child is being looked after by the kidnappers, and the parents themselves do not want the girl child back.
3.      On the other hand, there is a situation that the child was kidnapped and was bought by the kidnappers, as one of the accused is unable to give birth to a child, due to some medical infirmity
Conflict faced by Court
1.      The dilemma is between the rigors of law, and the emotional attachment put forth by the complainant themselves, who presume that as a matter of right, the FIR can be quashed in a criminal case on the basis of their compromise.
2.      They presume and take it for granted that the manner in which their complaint was registered and investigated by the police, as it was a matter of their right to quash FIR & proceeding arising therefrom as they had settled with the accused persons.
Courts conscience
1.      The Court, however, has to stand by those, who cannot stand by themselves, as the child in the present case. One has to appreciate and imagine the trauma, stress, the agony of the child, who was only three years of age, that she would have gone through after being kidnapped by the kidnappers from the lawful guardianship of her parents.
2.      The statement recorded under Section 164 Cr.P.C. of the victim child narrates that how she was forcefully kidnapped by accused Rubina.
3.      Placing a child in a situation where her lawful custody is being determined through a settlement, it will have a long-term impact on the girl child, both psychological and in terms of her overall development.
4.      In the face of a crime against a minor girl child, the Court's duty is to ensure that justice is not only served, but the sanctity of child's rights is preserved, reinforcing the unequivocal message that children are not tradable entities, and their safety and well-being is non-negotiable.
5.      The fact remains that they had got the child kidnapped, made payment of money to separate the child from the biological parents and her siblings, which is a crime under the law.
6.      In case lenient view is taken in such cases and FIRs are quashed on the basis of such agreements, it would amount to defeating the principles of criminal law, and in the process weakening the rule of law.
7.      The offence of kidnapping and trafficking of children are serious offences, having an impact on the society at large as well as on the child's well-being and development.
8.      Such a settlement raises ethical and legal concerns as it involves a practice where a child is effectively being treated as a commodity, jeopardizing the child's well-being and contravening basic principles of law.
9.      The acceptance of such settlements could contribute to the perpetuation of a culture where the rights and dignity of children are subjugated to negotiation and compromise.
10.   This would set a precedent that contradicts the principles of justice and protection inherent in our legal system.
11.   Quashing criminal proceedings in such cases would send a message to society that the severity of crimes against children, even those involving kidnapping and trafficking, can be mitigated or overlooked through private agreements, thereby eroding the very foundation of the rule of law.
 Order
The petition is dismissed as there is no reason to quash the FIR or proceedings arising therefrom.

Four out of the six female sportspersons who charged Wrestling Federation of India (WFI) Chief and Bharatiya Janata Party (BJP) MP Brij Bhushan Sharan Singh of sexual harassment have offered audio and visual proof to support their claims, the police said on Sunday.
Some of India’s most accomplished athletes, including Olympic medalists and world champions, have been protesting against Singh, and the police are getting ready to submit a complaint against him. However, they have halted the protests until June 15 in response to the government’s request for more time to file a chargesheet.
Senior Delhi Police Officer’s Remark On Wrestlers Protest
According to a senior Delhi Police officer familiar with the situation, the special investigation team (SIT) looking into the case sent separate notifications to the six complainants on June 5 under Section 91 of the Criminal Procedure Code (CrPC).
“Investigating agencies bear the burden of proof in such circumstances. And for that, we are attempting to acquire the smallest amount of proof available in the custody of both the suspect and the victims. In this case, we gave the complainants 24 hours to provide all the evidence they possessed. But so far, only four of them have been able to provide us with documentary, audio, or video evidence,” he said, declining to be identified.
On May 12, the Delhi Police informed a local court about the SIT. When asked why they gave the complainants only a day’s notice to submit evidence on June 5, the police declined to comment.

The Delhi Police’s behavior raises serious concerns. Due process is vital, and the nature of the charges against Singh, with his position of power, make for a challenging mix that will need police and prosecutors to go above and beyond to establish they are operating independently of political interference. It already raises the question regarding the reliability of the investigation and the fact that the police held off on filing a first information report (FIR) until the SC ordered them to do so.
Former DGP of Uttar Pradesh’s Remarks On Wrestlers Protest
However, several retired police officers feel that the way the investigation is going is suspicious and wrestlers protest is being suppressed. “First, the police should have taken the initiative in these situations, but they haven’t done so yet. Without the Supreme Court’s involvement, the FIR would not have been filed, which was against all logic. “The less said about the way Delhi Police is handling this investigation, the better,” remarked Vikram Singh, erstwhile DGP of Uttar Pradesh.
“This inquiry is fairly straightforward. The FIR comes first, then the victim’s, the survivor’s, or the prosecutor’s statement is recorded and corroborated by the evidence and other materials discovered during the investigation. That concludes the investigation. However, nothing like this has occurred in this case,” Singh explained.
On Friday, a team from the Delhi Police went to the WFI office with one of the complainants to reenact the incidents while Singh was at home on the same property. Bajrang Punia, a key figure participating in the movement, stated that the complaint experienced “mental trauma” following the visit.

CHENNAI/NEW DELHI: The scenes and their shrill cries sent shock waves across the sporting world. Olympic and world medallists were dragged and detained by Delhi police just a few kilometres away from where Prime Minister Narendra Modi was inaugurating the new Parliament building in the national capital on Sunday morning.
Country’s top wrestlers including Tokyo Olympic bronze medallist Bajrang Punia, Rio Olympic bronze medallist Sakshi Malik and two-time World Championships medallist Vinesh Phogat were trying to march towards the new Parliament to organise ‘Mahila Samman Mahapanchayat’ when they were stopped midway and were being forcibly taken to separate locations from Jantar Mantar where they had pitched in their tents for the protest that ran into Day 36. There was quite a commotion while removing Sakshi, Vinesh and Sangeeta Phogat.
It all started when the protesting wrestlers were in no mood to back out. They breached the security cordon while trying to move towards the new Parliament. Top official sources told this newspaper that the Delhi police are going to initiate legal action against the wrestlers and register an FIR under relevant sections of the Indian Penal Code for allegedly creating a ruckus around Jantar Mantar.
The Delhi police also uprooted the tents where these wrestlers were staying since they resumed their protest on April 23 demanding the arrest of the sidelined Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh. Other belongings of the wrestlers like cots, mattresses, coolers and fans were also removed from the place.
While the move was apparently aimed at ending the ongoing sit-in protest, the wrestlers insisted via social media posts that the protest will continue. “Our protest hasn’t ended. Once we are released from police detention, we will start ‘satyagraha’ at Jantar Mantar. Not dictatorship but this country will see women wrestlers’ satyagraha now,” tweeted Sakshi and Sangeeta Phogat, Bajrang’s wife.
Incidentally, Sakshi, her husband Satyawart Kadian and a few others met Home Minister Amit Shah on Saturday evening demanding the arrest of Brij Bhushan. Independent MLA from Charkhi Dadri, Sombir Sangwan, acted as a mediator. “We prepared a seven-point demand letter for the meeting. But wrestlers demanded the immediate arrest of Brij Bhushan even as the Home Minister told them that he will be arrested in one month after police file the chargesheet in court as per law,” Sangwan told this daily.

CHENNAI: A day before their detention on Sunday, a delegation from the protesting wrestlers met Home Minister Amit Shah in New Delhi. The delegation comprising Sakshi Malik and her husband Satyawart Kadian apart from a few other members apparently had prepared a seven-point demand letter. However, the meeting could not be fructified as the wrestlers demanded the immediate arrest of the former Wrestling Federation of India (WFI) president Brij Bhushan Sharan Singh.
Sombir Sangwan, an independent MLA from Charkhi Dadri, Haryana, told this daily that a meeting took place on Saturday evening. “The demand letter was prepared in consultation with the wrestlers. I along with Acharya Devvrat, Governor of Gujarat, facilitated the talk between the home minister and the wrestlers. I told Shah about the demand including the arrest of Brij Bhushan. The only condition was that he will be arrested once the Delhi police submit a chargesheet in court as per law. But wrestlers wanted an immediate arrest and that was where the talks failed,” Sombir told this daily.
Sombir, who is also Sangwan Khap Pradhan (head), is one of the several Khap leaders who extended support to the wrestlers. One such Khap is Sarv Jatiya Sarv Khap Mahapanchayat. Its national president Dr Santosh Dahiya also confirmed the development but said that immediate arrest should have been made as a case has been registered under POCSO Act against Brij Bhushan. “How can they not arrest him immediately? The law says so,” Dr Dahiya told this daily.
Even Dahiya was detained at her house in Kurukshetra, Haryana. She was supposed to join wrestlers for the ‘Mahila Samman Mahapanchayat’ scheduled to be held in front of the new Parliament building on Sunday morning. “I tried to leave my home at 4:30 in the morning but was not allowed. The cops deployed here asked me not to leave home and said I will be arrested and kept in the nearby police station if I don’t abide by the order.”
Dahiya said she has been trying to contact wrestlers but to no avail. “The oppressive tactics of the government will not be able to deter us from seeking justice for these champion wrestlers. I don’t where they have been taken by the cops as I could not talk to them till now. But the protest does not end here. I will meet the wrestlers and chalk out future strategies with them. The mahapanchayat will be held. The venue and date will be announced soon. This action by the government has emboldened us not to give up. We will intensify the protest as now the whole country is standing with us,” said Dahiya.
Meanwhile, it is learnt that wrestlers were detained separately after being whisked away from the protest site. Bajrang Punia has been detained at a police station near Mayur Vihar, Sakshi is in Burari. Vinesh Phogat and Sangeeta Phogat were taken to Kalkaji.
“The accused is roaming free. He is being given shelter by the government and athletes who won medals for the country are now being put in jail for demanding justice for the country’s daughters. Welcome to the new country,” Vinesh told reporters before being taken away on a bus.
