California Gov. Gavin Newsom proposed Thursday adding a 28th Amendment to the U.S. Constitution, which he said will address the country's gun violence crisis.
The amendment would raise the minimum age to purchase a gun from 18 to 21, mandate universal background checks, institute a reasonable waiting period for all gun purchases and bar civilians from purchasing assault weapons, according to a statement from the Governor's office.
"This will guarantee states as well the ability to enact common sense gun safety laws, while leaving the Second Amendment intact, and respecting America's gun owning tradition," Newsom said in a video statement. "The 28th Amendment locks in the common sense constitutional protections that Democrats, Republicans, Independents and gun owners overwhelmingly support and ensures NRA-owned politicians can never strip those protections away."
6 in 10 Americans, including 4 in 10 gun owners, said controlling gun violence is more important than protecting gun rights – the highest percentage in a decade – according to a national poll released last month.
Newsom told Politico and NBC the move was inspired in part by the rollback of gun safety measures by the courts.
The move comes amid speculation that Newsom may run for President, which grew after he won a second term as Governor, which ends in 2026, and dropped $10 million on a new political action committee. Newsom has denied planning to run in 2024 or 2028, saying he supports President Joe Biden and wants Vice President Kamala Harris, a fellow Californian, to be President.
PROPOSAL SPARKS CRITICISM FROM GUN GROUPS
The move has drawn opposition from gun-ownership groups. A spokesperson for The National Rifle Association said in a statement to USA TODAY that the majority of Americans reject Newsom's "California-style gun control.”
“Newsom’s latest publicly stunt once again shows that his unhinged contempt for the right to self-defense has no bounds," the statement said. "California is a beacon for violence because of Newsom’s embrace of policies that champion the criminal and penalize the law-abiding."
Erich Pratt, senior vice president of Gun Owners of America said "Newsom's proposals will fail miserably to control crime."
"It's a foreign concept to wealthy anti-gun political elites like Mr. Newsom that the common people have a right to possess arms for self-defense and repelling government tyranny, so it's no surprise to us that he hopes to butcher that right with a new Constitutional amendment," he said in a statement to USA TODAY.
ADDING CONSTITUTIONAL AMENDMENT 'WON'T BE EASY'
Adding a constitutional amendment requires either a two-thirds majority vote by both houses of Congress or a constitutional convention convened by two-thirds of State legislatures, according to Thomas Donnelly, chief content officer at the National Constitution Center. None of the 27 amendments to the Constitution have been proposed by a convention and the last time the Constitution was amended was in 1992, he said.
Three-fourths of the states must ratify the proposed amendment in order for it to become part of the Constitution, Donnelly said. Donnelly declined to speculate on the likelihood of Newsom's success. But he said the process is "meant to be difficult."
"The Founders really wanted to limit new amendments to those that can actually secure the broad support of the American people, so for them, they would have said 'an idea that would transcend faction,'" he said. "Today, we would say it's often something that's going to transcend partisan politics."
Given the impact of the Supreme Court's landmark ruling on gun control last year, "something like a Constitutional amendment may seem absolutely necessary," according to Michael Waldman, president and CEO of the Brennan Center for Justice at NYU Law.
Waldman, author of "The Supermajority: How the Supreme Court Divided the Country," called Newsom's approach, which leaves the Second Amendment intact but allows for "common sense gun laws" that may be palatable to some gun rights supporters, creative and interesting. He said Newsom's amendment "is not likely to happen, but it's important to think about it."
"Constitutional amendments seem completely impossible to do until suddenly they seem doable, and that's how it's worked all throughout our history," Waldman said. "If the Court's doctrine is so misguided and the carnage on the streets is so undeniable, you might get a surprising outcome."
Newsom acknowledged how challenging the process would be, saying "this fight won't be easy, and it certainly won't be fast."
California State Sen. Aisha Wahab and Assemblymember Reggie Jones-Sawyer will introduce a joint resolution to make California the first state to call for a convention, also called an Article V Convention or amendatory convention, according to the Governor's statement.
Newsom will then work with "grassroots supporters, elected and civic leaders, and broad and diverse coalitions across the nation" to get similar resolutions passed in the 33 other states required to convene the convention, the statement said.
"California will be the first but that's just the beginning," Newsom said in a statement.

Pratt’s activities didn’t stop at the U.S. border. Throughout the 1980s, Pratt added the last missing element to his extensive portfolio of conservative causes: foreign policy.
Pratt did more than support Reagan’s arms build-up. He assumed a major role in a global operation assisting in the brutal, sometimes extralegal, execution of Reagan’s “full-court press” against leftist forces in Central America and beyond. Under the direction of his friend Pat Buchanan, Pratt served as secretary for the privately run Council for Inter-American Security, or CIS. Ostensibly a think tank advocating an “activist” hemispheric foreign policy, the CIS in fact engaged in propaganda and intelligence gathering in the service of U.S. client states.
Sometimes this made a scramble of Pratt’s anti-statist ideology. When it came to the ATF, he saw an American Stasi. But he was happy to help the FBI build files on activists. During Pratt’s tenure, the CIS collaborated with the Bureau in tracking undocumented Salvadoran refugees living in the U.S. In his book, Break-ins, Death Threats and the FBI: The Covert War Against the Central America Movement, Ross Gelbspan documented the joint CIS-FBI effort to identify and deport political refugees back to El Salvador. The Political Asylum Project of the American Civil Liberties Union estimates that of the 154 people sent back between 1983 and 1984, over 100 were either killed or disappeared.
The CIS was part of a larger network of rightwing Cold War groups that launched Pratt well beyond his public orbit of religious conservatives focused on guns, taxes, and abortion. One CIS allied organization was the Unification Church-funded World Anti-Communist League (WACL) a notorious Who’s Who federation of neo-Nazis, war criminals, and rightwing terror outfits. A Washington Post reporter who observed the League’s 1979 conference counted “former Nazi SS officers, two neo-fascists from Italy reportedly wanted for terrorist acts, [and] members of Alpha 66, a right-wing Cuban exile group.” (The reporter didn’t know it at the time, but one of the attendees he quoted, Sam Dickson, was a white power activist and Atlanta-based Klan attorney.) The chair of WACL’s US branch was Roger Pearson, a former Heritage Foundation hire of Pratt’s friend Paul Weyrich. After revelations of Pearson’s neo-Nazi activities, he stepped down, replaced by Elmore D. Greaves, a former organizer with the segregationist Citizens Councils.
During the 1980s and early Nineties, it was difficult to look at Pratt’s network without tripping over a WACL connection. Pratt was also active in the United States Taxpayers Party, led by WACL member Howard Phillips. WACL ties carried over into a transitional phase of Pratt’s activism: His work hyping Hispanic immigration and bilingual education as national security threats. In the mid-Eighties, Pratt launched another organization, English First, as a project within his Family Foundation to wage a racially charged war against bilingual education. He got help from Anthony Bouscaren, a CIS advisor who also sat on the board of WACL. Bouscaren’s publishing credits included numerous articles in the neo-Nazi Roger Pearson’s Journal for Social, Political and Economic Studies. This didn’t stop more than a dozen GOP legislators, including Dick Armey, from joining the board.
It was during his involvement in Central American policy and supporting counterinsurgencies around the world that Pratt made multiple trips to Guatemala to observe rural “Civil Defense Patrols.” Contemporary human rights observers (and two subsequent Truth Commissions) consider them “death squads” for their role in killing and torturing civilians. But Pratt found much to admire. He combined observations from these visits with similarly impressed notes on the Civilian Home Defense Forces, vigilante patrols in Ferdinand Marcos’ Philippines, for a slim book published by the Gun Owners Foundation in 1990, Armed People Victorious. In it, he praises the leadership of Efrain Rios Montt, the country’s military leader during 1982 and 1983 who greatly expanded the civil defense patrols. Twenty years later, Guatemalan judges would find Montt guilty of genocide and crimes against humanity. One Amnesty International Report from Montt’s tenure detailed massacres in 60 Indian villages over a three-month period, leaving more than 2,500 dead. As late as 2001, Pratt was publically praising Montt as a “powerful Christian leader.” In the concluding chapter of Armed People Victorious, titled “Bringing the Lessons Home,” Pratt writes:
The War on Drugs can be won the same way the guerilla insurgencies were pushed back in Guatemala and the Philippines… The history of the United States for years before and after the founding of the Republic was the history of an armed people with functioning militias involved in civil defense… While the United States has forgotten its successes in this area, other countries have rediscovered them. It is time that the United States return to reliance on an armed people. There is no acceptable alternative.
Having defeated communism abroad, might not similar tactics work against enemies within? After the election of Bill Clinton, a significant chunk of gun culture would begin wondering the same thing — and about enemies more diverse than drug dealers. Just as he did during the social and foreign policy clashes of the Cold War, Larry Pratt would make sure he was right in the middle of things.

A bill that would let people carry concealed firearms without a permit and without training passed out of the House on Friday, putting the bill just a step away from the Governor’s desk. The legislation lets people who are otherwise qualified to purchase and carry a firearm avoid the permitting process to conceal carry their weapon.
Rep. Chuck Brannan, R-Macclenny, said the bill was about removing red tape, and that “Florida will not come between you and your freedom to protect yourself anymore.” The legislation passed 76-32.
Despite intense lobbying, the legislation does not open the door to allow people to openly carry their guns in public — a point of anger among pro-gun advocates who say the bill does not go far enough in protecting Second Amendment rights.
Rep. Mike Beltran, R-Riverview, briefly filed an amendment earlier this week that would have allowed for open carrying in certain kinds of holsters. But he withdrew it the next day. On the House floor, he spoke at length about why he believes open carry would be a good move.
Beltran said in a text that the amendment “was and is good policy but unfortunately this is not the right time or the right vehicle.”
“I’d prefer to pass this legislation and lock in what we can, and then see what we can accomplish later,” Beltran wrote.
House Speaker Paul Renner said he supports open carry, but said there’s concern among his caucus and in the Senate about the issue. He said he and Beltran discussed the amendment and identified some problems that would have made things “worse, not better,” which were flagged by the National Rifle Association.
“There are a lot of things I don’t get as Speaker that I want, and I’m very very happy that this bill moves us forward, expands rights in a way that are material and important,” Renner said.
Luis Valdes, Florida director of Gun Owners of America, said in a statement that the permitless carry bill is a step in the right direction, but said it isn’t “constitutional carry” like Gov. Ron DeSantis promised last year.
“Governor DeSantis promised Floridians that we’d get constitutional carry and the Republican supermajority is failing to bring that,” Valdes said.
Members of pro-gun groups speaking out against the bill found themselves strange bedfellows with gun safety advocates, who argued the removal of an additional background check and the training requirement made the public less safe.
An amendment to require training was one of more than a dozen amendments put forward on the permitless carry bill, nearly all of which were sponsored by Democrats, and nearly all of which failed.
Brannan, the sponsor of the bill, said he thought training was important, and pointed to $1.5 million in the bill allotted for it, but said he did not think it was “the nanny government’s job” to mandate it.
Democrats also argued the bill would increase the risk of profiling, and would acutely impact Black communities.
One of the amendments, from Rep. Anna Eskamani, D-Orlando, would allow people to carry firearms into meetings in the Legislature. Legislative meetings are one place, along with courthouses, polling places, and a handful of other designated areas, where Florida law prohibits people from carrying firearms, concealed or otherwise.
Eskamani said “if the majority party thinks guns make us more safe, we should strike this.” Republicans voted the amendment down.
Another amendment by Eskamani would have created an avenue for people to put themselves on a voluntary do not sell list, which they could remove themselves from later. Eskamani said it was designed to help protect people contemplating suicide.
During the debate, Rep. Michele Rayner-Goolsby, D-St. Petersburg, told legislators that in 2021, she attempted suicide with a gun and later checked herself into a mental health facility.
“At the end of the day I don’t see the harm in this type of amendment if it can save someone’s life like mine,” Rayner-Goolsby said.
The amendment failed.
Alexis Dorman, a 19-year-old volunteer with Students Demand Action, said she expected that the bill would pass because of the Republican supermajority, but said she was surprised by the speed at which it moved. By the first week of Florida’s legislative session, the bill was through all of its committees in the House and Senate.
“The youth in our state today are going to grow up around people who can legally carry a firearm without any proper training, and that’s really scary to think about,” Dorman said.
The permitless carry legislation is also available for a vote on the Senate floor, but hasn’t yet been scheduled.
