The Center for Biological Diversity and Appalachian Voices today sued the U.S. Office of Surface Mining Reclamation and Enforcement and the U.S. Fish and Wildlife Service for failing to protect highly imperiled wildlife from the devastating harms of coal mining in Kentucky, West Virginia and Virginia.

The agencies have failed to implement required protections for imperiled species, putting wildlife such as the endangered Guyandotte River crayfish and candy darter and the threatened Big Sandy crayfish at great risk.

The lawsuit stems from an intensive investigation in progress since early 2022. The suit explains that the agencies have failed to ensure that essential protective measures are in place to prevent these federally protected species from going extinct, as the Endangered Species Act requires.

“Our in-depth investigation found a total breakdown in the process designed to protect imperiled wildlife from the disastrous harms of coal mining,” said Perrin de Jong, Southeast staff attorney at the Center for Biological Diversity. “Every state and federal agency responsible for implementing endangered species protections is asleep behind the wheel. If they put as much effort into following the law as they do helping the coal industry dodge its obligations to prevent extinction, these species would be in a much better place today.”

The Center and Appalachian Voices have uncovered hundreds of coal mining facilities in Kentucky, West Virginia and Virginia that threaten critical habitat for the two imperiled crayfish species and the candy darter — and which lack the required protections for the species and their habitat.

“Better protection for these rivers and creeks doesn’t just help threatened and endangered species, it is also crucial for the long-term wellbeing of the communities that depend on these important waterways,” said Willie Dodson, Central Appalachian field coordinator for Appalachian Voices. “It’s well past time that regulators do their jobs to ensure that the coal industry abides by the law and reduces water pollution that harms communities as well as at-risk species.”

The Great Guyandotte River Regatta in National Coal Heritage Area

Oak Hill, WV (August 31) –

Last month over 200 participants attended the inaugural Great Guyandotte River Regatta, an event sponsored by the National Coal Heritage Area and the Guyandotte Water Trail Alliance. This flat-water paddling event was held simultaneously at five different locations along the Guyandotte River, and was organized at each site by a local community organization, which included 58 volunteers and members of the local volunteer fire departments.

The 160 mile long Guyandotte River flows through five counties in southern West Virginia, and along its length 24 river access points have been developed. As the environmental quality of many of the rivers located within the southern West Virginia coalfields continues to improve, many residents are looking to the Guyandotte River for family recreation and tourism potential. For the past three years, the National Coal Heritage Area has worked with local residents, public agencies, and nonprofit organizations to develop the Guyandotte Water Trail as an accessible flat-water paddling trail.

A federal court on Friday approved a deal that requires two federal agencies to review the environmental impacts of coal mining on endangered species, including West Virginia's Guyandotte River crayfish.

Under the agreement, the Office of Surface Mining —  the agency that regulates mountaintop coal mining —  and the U.S. Fish and Wildlife Service —  the agency that protects endangered species —  will review a 1996 document or “biological opinion,” that lays out how coal mining is likely to affect endangered species or their habitat.

The deal was the result of a lawsuit filed last year by environmental groups, the Center for Biological Diversity, Appalachian Mountain Advocates, Ohio Valley Environmental Coalition, the Sierra Club and West Virginia Highlands Conservancy.

They argued the endangered Guyandotte River crayfish in West Virginia was at risk because the federal government was using outdated guidelines that failed to ensure that mining does not jeopardize endangered species.

Studies have shown that air and water pollution from coal mining can harm birds, fish, crayfish, insects and freshwater mussels, as well as nearby communities.

The Fish and Wildlife Service has until Oct. 16 to review the biological opinion and submit it to the Office of Surface Mining.

That night, Samantha used her cell phone to call her mother and told her she had been visiting friends at Marshall University Court Yard Apartments but was coming home soon. She never came home.

At 3:30 a.m. on November 12, Samantha’s 1999 burgundy Chevrolet Cavalier was found abandoned in Wayne County, West Virginia. The vehicle was discovered in a secluded area near the Cabell-Wayne county line. It had been set on fire and when police found it, was still burning. There was no signs of Samantha anywhere near the vehicle.

In July 2005, Chadrick Fulks and Branden Basham pleaded guilty to a federal charge of carjacking resulting in death to avoid their death sentence. Basham and Fulks had escaped from the Hopkins County Jail in Kentucky in November 2002. They claimed they carjacked Samantha and killed her, even though her body has never been found. They are already on death row because of the killing of another woman, Alice Donovan, who has also never been found.

The search for her was officially ended in 2015, though it continued into 2017. The last update in her case was Chadrick Fulks being let out of death row to assist in finding her body, also claiming that her body was thrown into the Guyandotte River near Huntington, West Virginia. Searches still have been fruitless, however.
