Hemp CBD Across State Lines: Virginia

The Agriculture Improvement Act of 2018 (2018 Farm Bill) legalized hemp by removing the crop and its derivatives from the definition of marijuana under the Controlled Substances Act (CSA) and by providing a detailed framework for the cultivation of hemp. The 2018 Farm Bill gives the US Department of Agriculture (USDA) regulatory authority over hemp cultivation at the federal level. In turn, states have the option to maintain primary regulatory authority over the crop cultivated within their borders bysubmitting a plan to the USDA.

This federal and state interplay has resulted in many legislative and regulatory changes at the state level. Indeed, most states have introduced (and adopted) bills that would authorize the commercial production of hemp within their borders. A smaller but growing number of states also regulate the sale of products derived from hemp. Our attorneys track these developments in real-time on behalf of multiple clients, and we provide those clients with a 50-state matrix showing how states regulate hemp and hemp products.

In light of the rapidly evolving legislative changes, we are also presenting a 50-state series analyzing how each jurisdiction treats hemp-derived cannabidiol (Hemp CBD). Today we turn to Virginia.

Earlier this year, the Virginia Department of Agriculture and Consumer Services (VDACS) submitted its plan to regulate hemp production to the USDA for review and approval. Shortly thereafter, the USDA requested that VDACS revise and resubmit its plan, which is now under second review. According to the VDACS hemp webpage, the state agency expects its plan will go into effect on October 31, 2020. This means that until then, the VDACS will continue to operate under the 2014 Farm Bill.

Virginia’s hemp rules mandate that hemp growers, handlers and processors wishing to engage in the production of hemp secure a registration from the VDACS.

Virginia is also one of the states that expressly regulate the production of hemp products intended for human consumption.

Under Virginia law, “hemp product†means

any finished product that contains industrial hemp, including rope, building materials, automobile parts, animal bedding, animal feed, cosmetics, oil containing an industrial hemp extract, or food or food additives for human consumption.â€

On July 15, 2019, the VDACS Commissioner announced it would treat hemp-derived extracts intended for human consumption, such as a Hemp CBD oil, as approved food additives. Yet, neither Virginia law nor the VDACS rules overtly addressed the sale and marketing of these products. Then, in April, the governor signed into law SB 918, which helped clarify this issue. The new law, which went into effect upon its passage, provides that hemp extract that contains no more than 0.3 percent THC shall be treated as a food. A food is defined as:

any article that is intended for human consumption and introduction into commerce, whether the article is simple, mixed, or compound, and all substances or ingredients used in the preparation thereof. ‘Food’ does not mean drug as defined in § 54.1-3401.†(Emphasis added)

Therefore, the sale of these products is now expressly allowed, provided they meet “specific laws, regulations, or criteria that pertain to the manufacturer of industrial hemp extracts or food containing an industrial hemp extract in the location in which such manufacturing occurs.†It is unclear whether this law applies to both in-state and out-of-state hemp extracts or food, but this issue will likely be clarified by the VDACS, which is tasked with adopting labeling and testing requirements for these products.

Although the manufacture of cosmetics infused with Hemp CBD is allowed, their sale is not expressly addressed under Virginia law. This is likely due to the fact that the VDACS does not have jurisdiction over this category of products. Nevertheless, because cosmetics can be lawfully manufactured in the state, it seems reasonable to infer that the sale of these products is allowed so long as they contain no more than 0.3 percent THC and are safe for human consumption.

On March 23, the governor signed into law HB 962, which clarifies that the sale of Hemp CBD smokable products is lawful, provided certain packaging requirements are met and the products are not sold to any person under 21 years of age. This new law will go into effect on July 1.

GREENSVILLE, Va. -- For generations, the Powell family has farmed Virginia tobacco fields in Greensville County near the North Carolina state line. Up until recently, their biggest challenge was keeping the farm up and running while tobacco sales declined.

Kenny Powell and other tobacco farmers had to switch gears to survive. Now, the 52-year-old farmer is growing hemp used to make CBD oil.

"This hemp market is going to get me back on my feet," Powell told CBS 6 senior reporter Wayne Covil. "[It will help] keep [me] from losing everything I've worked for all my life and what my daddy left me."

But with the new crop has come a new, and dangerous, challenge -- armed thieves.

Powell's sons sleep in their hemp fields to prevent thieves from driving off with plants that can easily be mistaken for marijuana.

When one of Powell's sons confronted thieves over the weekend, the thieves opened fire, striking Powell's truck.

"I ain't never got shot at over a crop," the farmer explained.

History of Hemp

Hemp is an ancient plant that has been cultivated for millennia. The Columbia History of the World (1996) states that that weaving of hemp fiber began over 10,000 years ago! Carbon tests have suggested that the use of wild hemp dates as far back as 8000 B.C.

In Great Britain, hemp cultivation dates back to 800AD. In the 16th Century, Henry VIII encouraged farmers to plant the crop extensively to provide materials for the British Naval fleet. A steady supply of hemp was needed for the construction of battleships and their components. Riggings, pendants, pennants, sails, and oakum were all made from hemp fiber and oil. Hemp paper was used for maps, logs, and even for the Bibles that sailors may have brought on board. The history of hemp is amazing, we could go on for pages, this is just a quick primer.

Cultivation Hemp drying 17th Century America, farmers in Virginia, Massachusetts, and Connecticut were ordered by law to grow Indian hemp. By the early 18th century, a person could be sentenced to jail if they weren’t growing hemp on their land! Hemp was considered to be legal tender. For over 200 years in colonial America, hemp was the currency that one could use to pay their taxes with! (Don’t try that today, kids!)

The 1850 U.S. census documented approximately 8,400 hemp plantations of at least 2000 acres. Strains in cultivation included China hemp, Smyrna hemp, and Japanese hemp.

For years, hemp farmers used a hand break operated machine when harvesting. Finally, a machine was built that would take care of all the processes, breaking the retted stalks and cleaning the fiber to produce clean, straight hemp fiber which was equal to the best grades prepared on hand brakes. This machine was able to harvest 1000 pounds or more of clean hemp fiber per hour. This breakthrough made cultivating more fiscally attractive by reducing labor costs. By 1920 the hemp crop was entirely handled by machinery.

In 1896 Rudolph Diesel had produced his famous engine. Like many others, Diesel assumed that the diesel engine would be powered by a variety of fuels, especially vegetable and seed oils. Henry Ford of the Ford Motor Company seeing the potential of biomass fuels operated a successful biomass conversion plant producing hemp fuel at their Iron Mountain facility in Michigan. When Congress passed the Marijuana Tax Act in 1937, the decline of hemp effectively began. The tax and licensing regulations of the act made hemp cultivation nearly impossible for American farmers. Anslinger, the chief promoter of the Tax Act, argued for anti-marijuana legislation around the world.

An interesting situation arose during World War II as American Farmers were prohibited from producing hemp because of the 1937 law. However, the Japanese attack on Pearl Harbor halted the importation of Manila hemp from the Philippines, prompting the USDA to rethink their agenda and creating a call to action with the release of the film Hemp for Victory, motivating American Farmers to grow hemp for the war effort. The government formed a private company called War Hemp Industries to subsidize hemp cultivation. One million acres of hemp were grown across the Midwest as part of this program. As soon as the war ended, all of the hemp processing plants were shut down and the industry again disappeared. However, wild hemp may be found scattered across the country.

From 1937 until the late 1960s the United States government recognized that Industrial Hemp and marijuana were two distinct varieties of the cannabis plant. After the Controlled Substances Act was passed, hemp was no longer recognized as being distinct from marijuana.
