अवैध डोडाचूरा की तस्करी करने वाले आरोपी को 5 वर्ष का सश्रम कारावास और 50 हजार का जुर्माना

रतलाम. न्यायालय रुपेश शर्मा विशेष न्यायाधीश एनडीपीएस एक्ट ने आरोपी :राममुर्ति पिता प्रसादा राम उम्र 54 वर्ष,निवासी भाई जगता कॉलोनी बराडा अम्बाला हरियाणा को धारा: 8/15बी एन.डी.पी.एस एक्ट में 5 साल की सजा और 50 हजार रुपए जुर्माना की सजा सुनाई।

विशेष लोक अभियोजक एन.डी.पी.एस.एक्ट शिव मनावरे ने बताया कि 10.जून.2018 को थाना जावरा शहर पर पदस्थ उपनिरीक्षक विजय रावत को मुखबिर से सूचना मिली कि एक व्यक्ति जिसने लाइनिंग वाला शर्ट एवं ग्रे रंग का पेंट पहन रखा है, जो काले रंग के दो अलग अलग बैंग में अवैध मादक पदार्थ डोडाचूरा लेकर जावरा बस स्टेंड पर यात्री प्रतिक्षालय में कहीं लेकर जाने के लिए बैठा है।

सूचना पर उपनिरीक्षक विजय रावत द्वारा कार्यवाही हेतु थाने से पुलिस फोर्स एवं दो पंचान एवं अनुसंधान सामग्री लेकर मुखबिर के बताए स्थान जावरा बस स्टेंड यात्री प्रतिक्षालय पहुंचे।

जहां मुखबीर के बताए हुलिए का व्यक्ति दो बैग लेकर बैठा दिखा। पुलिस को देखकर जिसे घेराबंदी कर पकड़ा व उसका नाम पता पूछा तो उसने अपना नाम राममूर्ति पिता प्रसादाराम बताया। दोनो बैगों में 30 किलो डोडा चुरा मिला जो मौके पर दोनों बैगों में से रासायनिक जांच हेतु 5-5 सौ ग्राम के सेम्पल लेकर मौके पर एनडीपीएस एक्ट के प्रावधानों का पालन करते हुए कार्यवाही कर अभियुक्त राममुर्ति से अवैध मादक पदार्थ डोडा चुरा जप्त कर एवं उसे गिरफ्तार कर थाने वापसी पर अभियुक्त राममुर्ति के विरुद्ध एनडीपीएस एक्ट की धाराओं में प्रकरण पंजीबद्ध कर विवेचना प्रारंभ की गई।

विवेचना के दौरान अभियुक्त से उक्त अवैध मादक डोडा चुरा कहां से लाया और किसके लिए लाया इस बारे में पुछताछ करने पर अभियुक्त ने बताया कि मादक पदार्थ वह सोनु पिता रमेश निवासी ग्राम जोगी खेड़ा जिला मंदसौर से स्वयं के पीने के लिए लेकर आया था।

पुलिस ने जानकारी के आधार पर सोनु पिता रमेश को 11.जून. 2018 को गिरफ्तार किया।

अनुसंधान उपरांत अभियुक्तगण के विरु���्ध विशेष न्यायालय में अभियोग पत्र प्रस्तुत किया गया। प्रकरण के विचारण के दौरान अभियुक्त सोनु पिता रमेश अनुपस्थित होने के कारण उसे फरार घोषित किया गया।व विशेष न्यायालय द्वारा अभियोजन साक्ष्य को प्रमाणित पाते हुए,आरोपी राममुर्ति को दोषसिद्ध किया।
