I think I figured out where we're talking past one another.
The legal issue isn't just the content of the generated work. It's not that every step of the generative machine learning process is legal up until the point where an output is generated and sold for profit, which is illegal because that output contains some fraction of an intellectual property.
That's typically how misuse of creative property occurs when a human generates something copyright violating, and it's typically how it is proven when a computer generates something copyright violating. Because it's really easy to say "look, a duplication of my work". But the actual framework of intellectual property protection in international law is broader than that. It has to be, to encompass things like the validity of printing out a paywalled article for a classroom or storing it as a PDF in a college course's dropbox, versus saving it to pass around freely. The nature of fair use exceptions requires that copyright law have an understanding of the intent of an agent when performing replication of a material.
Intellectual property violation occurs when you perform a transformative or reproductive act on that ip, in such a way that doesn't fall within non-profit or for-profit fair use. For generative machine learning, that moment is when you download (and thus reproduce) a work for a purpose beyond the permission given by the ip holder. (Also arguably at the moment of creation but that depends on, well, arguable points we clearly disagree on).
In this context you could scrape the internet to build a machine learning model and that might still be illegal if you violated copyright protections in the process, even if you're not producing any generative output for sale. A simple music tagging algorithm would violate copyright protection in this way, and we even have an example of that in how Pandora had to get legal permission of music copyright holders to use their music in this way.
This is also the basis of illegality of piracy of a streaming service without duplication. Yes the data is being downloaded to your computer, but that becomes illegal at the moment the download is being performed for an unpermitted purpose (storage).
And yes, this is typically difficult to enforce for individuals and would require draconian powers of the state to enforce as things currently are, which is why it's not typically enforced except on the large corporate scale.
And that's why the EU proposal is just: Hey. So you should already be keeping track of the copyright of everything you scrape, in case some of it is behind paywalls you accidentally breached or if some of it was pirated from behind paywalls and hosted publicly (which does not convey permission to use contrary to the copyright holder's permissions). We are going to require you to keep track of that in a way we can access. And why yes, this does make the typically difficult to enforce and little enforced parts of copyright law very enforceable against you, large corporations.
WRT laws against generative AI, I think the most persuasive proposal I've heard so far is to make works produced by gen-AI uncopyrightable. A friend of mine champions a particularly radical version of this, where even if some post-generation modifications have been done by a person, the work would still be considered public domain (i.e. gen-AI at any phase of the production of a work, or as any kind of component of a work, negates copyright). This is supposed to target only commercial applications of gen-AI, leaving the hobbyists and non-profit uses untouched.
(This is not really my position, because honestly my brain is fried every time I think about this stuff and I haven't decided where to settle intellectually, although emotionally I have an anti-AI bias.)
My understanding is that works produced by AI are already uncopyrightable. Copyright only attaches to works produced by humans--cf. the infamous monkey selfie--and AI prompts don't meet that standard. The legal question of, under current rules, how much remix/modification of an uncopyrightable work constitutes a copyrighted work is something there's jurisprudence on (I believe), but I don't have the time right at this moment to look it up. But if even a small amount of contribution from a non-copyrightable work makes a work as a whole uncopyrightable, I think that would produce some legal issues.

Welcome to Delves & Denizens blog!
What is Delves & Denizens?
Delves & Denizens is a hack / addon / mod for the IRONSWORN TTRPG. Its purpose is to modify and add to the Ironsworn Core rules in order to achieve a more classical fantasy RPG feel.
What is the deal with this blog?
The Delves & Denizens blog was created to periodically share information and ideas, modular rules or hacks related to Ironsworn and more specifically to the Delves & Denizens mod.
But I'll also will be posting other Ironsworn related news, and maybe TTRPG stuff not directly related to Ironsworn but to the fantasy RPG scene in general; Stuff that the readers might find useful or actionable.
Why Classic Fantasy?
Ironsworn's default setting (and assets, creatures, etc) is close to Classic Fantasy, but with a nordic or viking-style theme. It is awesome by itself, but once you play it you can quickly notice that it would be easily adapted to other fantasy settings with little effort. The idea of Delves & Denizens is to create a default (some could say "generic") fantasy proto-setting, in order for players to adapt to any other sub-setting of their choice. Each subsystem or hack is meant to be modular, so you could easily pick to use some and discard others. For instance, a player could decide that they want the Magic system from Delves & Denizens but not the Ancestries (elves/dwarves/etc).
In a similar fashion to Fate RPG "dials", the intention is to give players the ability to customize their experience and setting for any fantasy world and lore with as little effort as possible. Ironsworn Core already provides modular mechanics that can help with that. These hacks provide even more means to do it.

What about other Ironsworn Homebrew?
There have been other attempts to do what Delves & Denizens does, and even total conversions (like Eldersworn for Call of Cthulhu style of games, or Bloodsworn for Vampire urban fantasy). Even while this blog will be mostly dedicated to my homebrew and design, it will probably provide information or news on other hacks and modifications from the Ironsworn community, which is very prolific.
Will Delves & Denizens be released as a standalone product?
Probably not, since most of the hacks and ideas are "borrowed" from other modules or add-ons provided by the community or other IPs (like the magic system from a very popular trading card game), which I wouldn't have permission to use in a commercial product.
Having said that, a PDF compilation of the hacks and lists could be possible, as a non-commercial community-made tool for those who prefer that format.
This is not a disclaimer or responsibility; While most of the creations are mine, some are based on other community members' ideas and I will give credit where is due as much as I can. Again I must acknowledge that many concepts and tropes are very popular and widespread (albeit not in the public domain) like "beholders" or "displacer beasts", which are properties of huge corporations like Wizards of the Coast. I have no intention on profiting on those; I just include them for me and anyone who likes to use them for a more "classical RPG experience". Ultimately it's up to you if you use those names or concepts in your private games or not.

New framework seems to have performance issues
This version of ABP for the new Safari framework unfortuantely seems to kill performance on my computers. Maybe it’s partially related to them being a bit older (one is a Mid 2011 Mini, the other is a 2012 iMac), but with ABP enabled I can’t even open a new tab/window and type a URL into the bar and expect Safari to accept the input without having to hold down the return key until it goes or wait a minute after opening a new tab or window. I also noticed that using Twitter was jumpy and lagged even with simple typing, it felt like all the dynamic content it relies on was just struggling to be processed through whatever framework Apple is forcing. Hopefully the devloper can figure out the performance issues because it’s really, really bad now.

why isn’t this working?
I have ABP and it wasn’t perfect but worked fairly well for my needs. Recently, it simply disappeared. (I see someone else said that could be from the latest iOS update, but I don’t have that on my desktop yet). When I tried to reinstall, it showed me two boxes to check. The way I read it, if you checked the box that said you wanted the icon visible in the toolbar, it would be able to read sensitive information of all kinds on any page. What good is an app of any kind that allows for that?! As it was, with only the one box checked, it only blocked very few ads, and I was still getting requests from sites to be whitelisted without being able to fnd any way to do it. I’ve got all kinds of garage showing up on my Facebook page, and you guys have ruined what was a reasonable product. WHY?

Still works for me
Almost didn’t download the new version based on the recent reviews, however after looking at the other apps here that claim to be ad blockers I didn’t’t see too many alternatives. I decided to go ahead and get the new version and so far its pretty much the same as the old version, lots of ads blocked. I’m happy, just make sure you go through the simple set-up.

Works well but
After much research, I understand the issue with Apple changing the rules on the devs so they had to build this app from scratch. Works well for me so far, except for one annoying problem. I use Yahoo mail and it's not hiding the ad that appears in the top line of the inbox even with unchecking the Acceptable Ads box, which is super annoying. I know the devs are watching these reviews, so if someone can point me to an extension or something that will fix that, I'd appreciate it. Was using AdGuard and it fixed that problem, but that app behaves like spyware and is constantly running in the background even after you close Safari.

The Kickstarter for They Came From Beyond the Grave! finished up last week with a massive surge of pledges in the last three days. This enabled us to achieve several more Stretch Goals than we expected, which is definitely the best way to end up with a Kickstarter!
Thanks to everyone who backed and spread the word about the project!
Looking at the number of backers, in addition to the pledge amount, we are absolutely thrilled to see that this second game in the series surpassed our first game, They Came From Beneath the Sea!. We kind of thought going in that the subject matter might line up with the interests of large portions of our community, so if that’s why TCFBtG! did so well, that works for us!
It certainly looks like a third game in the series might come moseying down the trail…
But before we get to that new game, whatever it is, and its inevitable Kickstarter, here’s a reminder that next week on Thursday the 3rd we are starting the Kickstarter for Scion: Demigod! More on that next week as I give you the rundown on this latest core book for Scion and how its Kickstarter is going to be verrrry different than the KS for Scion: Origin and Scion: Hero!

I’m really thrilled to be able to reveal today that on Wednesday, in addition to our releases for sale, our Scarred Lands adventure The Gauntlet of Spiragos will go live as an offering on the Astral TableTop virtual tabletop venue!
This is thrilling for me for a couple of reasons.
First, as long-time MMN Blog readers know, I’ve been beating the drum for us to make more of our worlds available on the various VTT venues that folks use to play online with their friends for years.
Now that the idea of playing TTRPGs online has really caught on, and the tools to do so are getting better and better every day, it’s satisfying to see that my impulse to push in that direction is more and more considered a viable direction for us to put effort towards.

It’s also thrilling for me because Gauntlet of Spiragos is an adventure I wrote because I had to do something creative in the TTRPG space while I was working on the late, lamented, WoD MMO.
Many a weekend I spent crouched over my laptop wresting with the writing and bouncing ideas off my housemates and my good buddy Aaron Voss. In fact, it was started during the onset of 4th Edition D&D, and edited into 5th Edition thanks to the keen eye and gaming knowledge of editor Scott Holden.
This was before Stewart Wieck and I bought the Scarred Lands IP from White Wolf, even. I just needed to create something that I could pull together without endless meetings and huge teams and giant budgets like the WoDMMO.
To see it now being reconfigured to work not as a book but as a VTT adventure is just amazing and I’m hoping that folks enjoy playing through it!

Speaking of creating games, last Friday’s Onyx Pathcast featured Dixie, Eddy, and Matthew spinning the “wheel of game concepts” and creating game pitches on the fly. The birth of new game ideas, with the three of them rocking the cradle. I think they managed to pull together nine of them, and honestly, each one could make for a viable game – and some are real gems!
I think they’d love to hear which ones sound the best from folks listening, so please do check out last Friday’s Onyx Pathcast and drop them a comment as to which games you personally would be interested in playing.

DiEM 25:  Technological Sovereignty: Democratising Technology and Innovation

What is DiEM25?
DiEM25 is a pan-European, cross-border movement of democrats.
We believe that the European Union is disintegrating. Europeans are losing their faith in the possibility of European solutions to European problems. At the same time as faith in the EU is waning, we see a rise of misanthropy, xenophobia and toxic nationalism.
If this development is not stopped, we fear a return to the 1930s. That is why we have come together despite our diverse political traditions - Green, radical left, liberal - in order to repair the EU. The EU needs to become a realm of shared prosperity, peace and solidarity for all Europeans. We must act quickly, before the EU disintegrates.

1. Introduction: For Democracy to Be Possible, Technology Must Be Democratised.
Technology Is Essential
Our civilisation heavily depends on technology. Technology provides us with the possibility to feed more than 7.5 billion people, to prevent or cure sickness, to multiply social and cultural interaction and creation, to care for those in need, to learn and teach more, to provide safety and security and to improve the quality of life and increase happiness in many ways for all.
But it is only that: a possibility. Not a certainty, and, today, often not a reality.
DiEM25 is the one political movement that wants to create, shape and drive political debate and democratic process around technology, based on the concept of Technological Sovereignty. Technological Sovereignty in our definition means the right and capacity by citizens and democratic institutions to make self-determined choices on technologies and innovation.
Why? Because technology affects us all, and all of us, not just a powerful few, must have a voice in its development. For DiEM25, it is clear that without the introduction of technological sovereignty through the democrati- sation of technology, democracy itself is no longer possible.
The examples are manifold. We see monopolistic digital platform providers with tremendous powers to shape what we see, who we hear from or how we think, without any democratic accountability for that power. We be- come subject to automated decision-making, wrongly labeled “artificial intelligence”, functioning as a black box without any transparency or accountability.
But there’s more. We see how the costs of technology’s development and its usage are socialised, but the benefits are privatised to a very small group. We see how decisions on technological development are made by powerful, unaccountable private actors, and kept away from transparent and public debate.
Research and innovation must be beneficial for society and the prosperity of mankind. We must fight the absurd notion that the purpose of innovation is to make rich investors richer still.
We believe that start-ups and entrepreneurial process should not solely depend on venture capital and other financialisation schemes. The purpose of innovation is not only the aggregation of capital. To approach long-term solutions, we’ll need sustainable public funding and the democratic inclusion of citizens.
And we are told that we can change everything at any time, as long as we play by the rules of the status quo and come up with the next “disruptive” innovation by ourselves. But these rules do not allow us to put common goals first — and they exclude democratic participation by design.
DiEM25 has a different vision. We know innovation can be beneficial to all. We want to end the practice of social- ising the costs and privatising the profits from technological change. Instead, we want to foster innovations for the common good. We want to see an inclusive innovation ecosystem where all stakeholders, such as users, employees, citizens, and authorities are equally important. An inclusive system where women and other historically marginalised communities are empowered to actively participate in shaping our common technological future. A system in which society as a whole benefits from the liberated energy of socially responsible and democratically accountable entrepreneurs who are no longer shackled by the financialisation of their efforts. We believe in a positive and strong partnership of the public and private sector in creating and sharing knowledge, creativity, research, development, and innovation, to the benefit of the whole of society. And we also see the vast opportunities of commons and cooperative approaches that can be fostered with new technologies.
We are convinced that technological sovereignty through democratisation of technology is an absolute necessity for real equality in the technological era. We believe that Europe can become a beacon of hope if it unites political, social and technological progress — if it fosters a new enlightenment and puts the flourishing of all human beings in the centre of technological change. This could have transformative impact on a global scale.
The Relationship between People and Technology
Today people are increasingly defined as users or consumers of technology — sometimes even as the product itself — rather than citizens. Remember, when the service is free, you’re not the user, you’re the product.
But, as users, consumers or products, people are not empowered. They are not citizens who have a voice on how technology is shaped, who pays for it, and who benefits from it. They don’t get the real benefits of the knowledge, research and development funded by their tax money. They are effectively powerless against the monopolies of the platform giants.
DiEM25 wants technology to reflect the values and diversity of the society to which we aspire. Our different genders, ethnicities, capabilities, values and — most importantly — our dreams, shall be supported by technology. Technology has to be set up in such a way that it liberates and empowers each of us to fulfill our vast potential, both as individual citizens and as contributors to the collective good. And it must support the ecological and democratic transformations necessary for our society’s future.
That is only possible if we, as sovereign citizens, reclaim the ability to make self-determined choices, argue for different values and change the social and economic processes and powers that shape technologies. We can and shall develop technological citizenship in the 21st century, based on principles such as the commons, the capacity of self-organisation and the development of counter-power held by citizens and democratic institutions.
Technology has become a central form of power in society. This power must ultimately belong to the sovereign citizens of a technologised society.
