یہ والا انصاف بھی نہ ملا تو؟

قتل تو خیر ہوتے ہی رہتے ہیں۔ البتہ شاہ رخ جتوئی چونکہ ایک امیر کبیر اور بااثر گھرانے سے تعلق رکھتا ہے جبکہ مقتول شاہ زیب ایک حاضر سروس ڈی ایس پی کا بیٹا تھا۔ لہذا ٹی وی چینلز اور سوشل میڈیا کے طفیل یہ مقدمہ ابتدا ہی سے ہائی پروفائل بن گیا۔ اور پھر ملزمان کو قواعد و ضوابط کے برخلاف جیل کے اندر اور باہر رہائش و علاج معالجے کی، جو خصوصی سہولتیں فراہم کی گئیں، ان کے سبب بارہ برس کے دوران قتل سے سزائے موت اور سزائے موت کے عمر قید میں بدلنے اور پھر حتمی طور پر بری ہونے تک یہ مقدمہ کبھی بھی میڈیا اور عوامی یادداشت سے محو نہیں ہو سکا۔ عدالتِ عظمی کا فیصلہ سر آنکھوں پر مگر یہ فیصلہ نظامِ انصاف کے جسد پر مزید سوالیہ نیل چھوڑ گیا ہے۔ اتنے سوال کہ تفصیلی فیصلے کا انتظار کیے بغیر ہی ریاست کے نمائندہ اٹارنی جنرل نے فیصلے پر نظرِ ثانی کی درخواست بھی دائر کر دی۔ یقیناً ملزموں کی بریت کا فیصلہ عدالت کے روبرو پیش کردہ قانونی حقائق کی روشنی میں ہی ہوا ہو گا۔ مگر بقول شیسکپئیر، ”ریاستِ ڈنمارک میں کچھ تو ہے جو گل سڑ چکا ہے‘‘ (ہیملٹ)۔

کہتے ہیں انصاف نہ صرف ہونا چاہیے بلکہ ہوتا ہوا نظر بھی آنا چاہیے۔ عملاً اس جملے کا پہلا نصف حصہ ہی اس وقت ریاستِ پاکستان پر منطبق ہے۔ مجھ جیسے لاکھوں شہریوں کا جی چاہتا ہے کہ اپنے نظامِ انصاف پر اندھا یقین کر سکیں مگر جب یہ لگنے لگے کہ انصاف اندھا نہیں بھینگا ہے تو اپنے وجود پر بھی اعتماد متزلزل ہونے لگتا ہے۔ ایسا ملک، جہاں نہ اینگلو سیکسن قانون خالص ہے، نہ ہی شرعی قوانین اپنی روح کے ساتھ نافذ ہیں اور نہ ہی غیر رسمی جرگہ نظام اکسیویں صدی کا ساتھ دے پا رہا ہے۔ وہاں لا اینڈ آرڈر دراصل لیگل انارکی کا مہذب نام محسوس ہوتا ہے۔ اب تو فن ِ قیافہ اس معراج تک پہنچ چکا ہے کہ وارادت کی خبر میں کرداروں کے نام اور سماجی حیثیت دیکھ کے ہی دل گواہی دے دیتا ہے کہ کس مجرم کو زیادہ سے زیادہ کیا سزا ملے گی اور کون سا خونی کردار تمام تر روشن ثبوتوں کے باوجود آنکھوں میں دھول جھونکے بغیر صاف صاف بچ نکلے گا۔

بھلا ایسا کتنے ملکوں میں ہوتا ہو گا کہ دو بھائیوں ( غلام سرور اور غلام قادر ) کی سزائے موت کی توثیق ہائی کورٹ کی سطح پر ہونے کے بعد سپریم کورٹ میں ان کی جانب سے نظرِ ثانی کی اپیل زیرِ سماعت ہو اور سپریم کورٹ، جب ان ملزموں کو بے گناہ قرار دے دے، تب اس کے علم میں آئے کہ دونوں کو تو چند ماہ پہلے پھانسی دی بھی جا چکی ہے۔ ایسا کہاں کہاں ہوتا ہے کہ ایک چیف جسٹس نظریہِ ضرورت کے تحت اقتدار پر غاصب کا قبضہ قانونی قرار دے دے اور لگ بھگ ساٹھ برس بعد ایک اور چیف جسٹس نظریہِ ضرورت کو کالعدم قرار دیتے ہوئے ہمیشہ کے لیے دفن کر دینے کا اعلان کر دے۔ یہ بھلا کس کس ریاست میں ہوتا ہے کہ ایک غریب مقتول کے ورثا ایک طاقت ور قاتل کو ”اللہ کی رضا‘‘ کی خاطر معاف کر دیں۔ تاہم کوئی ایسی مثال ڈھونڈھے سے بھی نہ ملے کہ کسی طاقتور مقتول کے ورثا نے کسی مفلوک الحال قاتل کو بھی کبھی ”اللہ کی رضا‘‘ کے لیے معاف کر دیا ہو۔ 

شاید یہ بھی اسی دنیا میں کہیں نہ کہیں تو ہوتا ہی ہو گا کہ ایک معزول وزیرِ اعظم ( بھٹو ) کو قانون کے مطابق مقدمہ چلا کے پھانسی دے دی جائے مگر پھانسی کے اس فیصلے کو قانونی نظائر کے ریکارڈ میں شامل نہ کیا جائے اور پھر اسی عدالت کا ایک جج وفات سے کچھ عرصہ پہلے یہ اعتراف بھی کر لے کہ ہم پر اس فیصلے کے لیے بہت زیادہ دباؤ تھا۔ اور پھر کوئی بھی آنے والی حکومت تاریخی ریکارڈ کی درستی کے لیے اس مقدمے کے ری ٹرائل کی درخواست دائر کرنے سے بھی ہچکچاتی رہے۔ کیا یہ ممکن ہے کہ اعلیٰ عدالت کا کوئی جج آئین کی ایک شق کی تشریح کے فیصلے میں یہ لکھ دے کہ پارٹی صدر کے فیصلے کی پابندی اس پارٹی کے ہر رکنِ اسمبلی پر لازم ہے بصورتِ دیگر وہ اپنی نشست سے ہاتھ دھو بیٹھے گا اور پھر وہی جج کچھ عرصے بعد بطور چیف جسٹس اپنے ہی سابقہ فیصلے کو ایک غلطی قرار دیتے ہوئے یہ کہے کہ دراصل پارٹی صدر کے بجائے ارکانِ اسمبلی پارلیمانی لیڈر کی ہدایات کے پابند ہوتے ہیں۔

اور ساتھ ہی یہ رولنگ بھی دے کہ ایک جج سے اگر پہلے فیصلے میں غلطی ہو جائے تو اسی نوعیت کے کسی اور مقدمے میں وہ اپنی سابقہ غلطی کو درست کرنے کا مجاز ہے۔ یہ روزمرہ گفتگو کتنے ملکوں کی زیریں عدالتوں کی غلام گردشوں میں ہوتی ہو گی کہ مہنگا وکیل کرنے کے بجائے ”مناسب جج‘‘ مل جائے تو زیادہ بہتر ہے۔ اس وقت پاکستان کی تمام عدالتوں میں بیس لاکھ سے زائد مقدمات سماعت یا فیصلوں کے منتظر ہیں مگر سیاسی نوعیت کے مقدمات ہائی کورٹس اور سپریم کورٹ کا زیادہ تر وقت اور شہرت لے اڑتے ہیں۔ اس بحران سے نپٹنے کے لیے یہ تجویز بھی بارہا پیش کی گئی کہ آئینی نوعیت کے مقدمات نمٹانے کے لیے علیحدہ اعلی آئینی عدالت قائم کر دی جائے تاکہ لاکھوں فوجداری مقدمات کی بلا رکاوٹ سماعت ہو سکے۔ مگر یہاں تو روایتی عدالتوں کے ججوں کی آسامیاں کبھی پوری طرح نہیں بھری جا سکیں چے جائیکہ ایک اور اعلی عدالت قائم ہو سکے۔ چنانچہ اب عوامی سطح پر یہ کہہ کے صبر کر لیا جاتا ہے کہ جیسا کیسا ہی انصاف سہی، مل تو رہا ہے، یہ بھی نہ ملا تو کیا کر لو گے؟

پھر بھی ہم سے یہ گلہ ہے کہ وفادار نہیں ہم وفادار نہیں تو بھی تو دلدار نہیں (اقبال)

Sentinels CEO and ShahZam drama on twitter

There’s nothing more entertaining than a bit of some drama in valorant. Despite VCT is still a month away the scene is already heating up.

It started on Jan 13th when a rather silly tweet by the official sentinels twitter handle posted a skit video poking fun at the stratbook of their team for last year which was just a roulette wheel with callouts written as ‘Tenz go do things’, this tweet took a quick turn as the former igl and sentinels star Shahzeb “ShahZam” Khan replied at it.

“Oh yeah, one time I spun the wheel and it landed on ‘please play with shroud, we don’t care if you win just make it hype. we’ll personally guarantee you a spot in franchising if you do’, “wrote the former sentinels’ player, indicating that Sentinels decision to bringing in the counterstrike superstar Shroud in the roster was more for clout other than winning.

This reply did not sit well with the Sentinels CEO Rob Moore, who blasted his former player by alleging that he had a poor attitude and didn’t want to be on the team while being in Sentinels.

“It’s weird that since you left all you talk about is how you want to be with the organization,” Moore replied. “When for all of 2022 you behaved like you didn’t want to be here. It seems like you have returned to the focus you had in 2021. If so, [G2 Esports] will be in great hands.”

Following the reply, ShahZam added to his allegation that Sentinels had him play with shroud as a “huge favor” and promised him a spot in the franchised roster to which Moore denied that he did not make any such promise.

This exchange ignited NA Valorant twitter with pro players, media and community members talking and tweeting about the exchange between Sentinels CEO and the former star.

With the current state of the scene G2 will have to reach VCT Americas League through Ascension league for ShahZam to face off against his former team, which means it wont be possible until 2024 , but  that match would spice up the scene.

UK police documents obtained by the BBC list more than 70 London bank accounts related to a Pakistani party being investigated for money-laundering.

Twenty-six are in the name of MQM leader Altaf Hussain. UK-based party officials are waiting to hear if they will face money-laundering charges.

Six British detectives were recently in Pakistan seeking co-operation in the alleged money-laundering case.

The MQM has said Scotland Yard's claims about the bank accounts are baseless.

British police have been investigating the MQM, one of Pakistan's main political parties, for several years but the pace of their investigations has picked up markedly since a meeting in London in April between Pakistan's Interior Minister, Chaudhry Nisar Ali Khan, and Home Secretary Theresa May.

The Scotland Yard documents, which include details of both open and closed bank accounts, were submitted to Pakistan's Federal Investigations Agency (FIA) as part of a British request for assistance.

Scotland Yard has declined to comment on the documents.

The UK's Crown Prosecution Service is already considering whether leading MQM officials should be charged with money-laundering offences but police say that does not stop them making further inquiries.

"The investigation continues and any further relevant information would be discussed with the CPS," said a spokesperson at Scotland Yard.

The British police team in Pakistan was also seeking to advance a separate investigation into the 2010 murder in north London of a senior MQM leader, Imran Farooq.

Three suspects in the case are being held in Pakistan. The UK police want to extradite one of the three - Mohsin Ali Syed - who they claim was present at the scene of the killing.

Pakistan is insisting that either all three should be extradited - or none at all.

The MQM denies any wrongdoing and insists that all the allegations made against it are false.

The British judiciary has been highly critical of the MQM. Back in 2011 a British judge adjudicating an asylum appeal case found that "the MQM has killed over 200 police officers who have stood up against them in Karachi".

During their investigation into the murder of Mr Farooq the police found £167,525.92 (about $235,000) in the MQM's offices in London and a further £289,785.32 in Mr Hussain's home in Edgware, north London.

Previous investigations in London uncovered a list in Mr Hussain's home itemising weapons, including mortars, grenades and bomb-making equipment. The list included prices for the weapons.

The Scotland Yard documents include a number of other British requests for assistance from their Pakistani counterparts.

The British asked for information about cash and weapons found at the MQM's Karachi headquarters. They also asked for official confirmation of Pakistani media reports that the MQM was involved in extortion in Karachi.

In response to a reduction in investment by VCT organisations, a discussion about the pay and transparency of esports players has arisen, with Shahzeb 'ShahZaM' Khan offering his opinion. This has caused player salaries to take a tumble, as it has been reported that Evil Geniues, the Valorant Champions 2023 winners, will have to either take a pay cut or hit the open market.
