The upside down flag was made a symbol of the “Stop the Steal” campaign. There was a massive email/social media blitz instructing supporters Trump supporters to display an upside flag after his election loss. This was also a prelude to rally the insurrectionists for the Jan 6th Trump coup attempt.

This was a massive orchestrated propaganda campaign and not just a sarcastic distress message. Billionaire oligarchs and their rightwing political think tanks were strategizing a revolution/coup/civil war in advance of Trump’s loss.

"This behavior is disqualifying for a Supreme Court justice," said one critic.

U.S. Senate Judiciary Committee Chair Dick Durbin was among those on Friday who called for Supreme Court Justice Samuel Alito's recusal from cases related to the 2020 election after The New York Timesreported the justice flew an upside-down flag outside his home in the days leading up to President Joe Biden's inauguration.

The display of an inverted flag officially symbolizes "dire duress" according to the U.S. code, and has been used at various times by people across the political spectrum to signify distress over U.S. policy and disapproval of the government.

At the time Alito's family displayed the flag, just over a week after then-President Donald Trump urged his supporters to riot at the U.S. Capitol when lawmakers were certifying the election results, the "Stop the Steal" movement had embraced the symbol to show their belief that the election had been stolen for Biden—despite all evidence to the contrary.

Alito told the Times on Friday that he "had no involvement whatsoever in the flying of the flag" and that "it was briefly placed by Mrs. Alito in response to a neighbor's use of objectionable and personally insulting language on yard signs."

But Durbin (D-Ill.) said the display on January 17, 2021—and for several days before that—clearly created "the appearance of bias."

"Justice Alito should recuse himself immediately from cases related to the 2020 election and the January 6 insurrection, including the question of the former president's immunity in U.S. v. Donald Trump, which the Supreme Court is currently considering," said the senator.

The news of Alito's upside-down flag comes after numerous reports about ethical breaches by right-wing Supreme Court justices including Alito and Justice Clarence Thomas.

Both of the justices have accepted luxury travel and have had other financial transactions with right-wing operatives who have been involved in cases before the court, and Thomas has drawn condemnation for continuing to serve on a case regarding documents being turned over to the House Select Committee on the January 6 Attack after it was revealed that his wife had supported efforts to overturn the 2020 election results.

In the coming weeks, the court is set to rule on Trump's claim that he has immunity in his federal election interference case and in a separate case regarding whether January 6 defendants should be charged with obstructing an official proceeding.

Despite four ongoing criminal cases, Trump is the presumptive Republican nominee to face Biden in November.

"The court is in an ethical crisis of its own making, and Justice Alito and the rest of the court should be doing everything in their power to regain public trust," said Durbin. "Supreme Court justices should be held to the highest ethical standards, not the lowest."

The senator added that the latest reporting offers new proof that Congress must pass the Supreme Court Ethics, Recusal, and Transparency (SCERT) Act, which would create an enforceable code of conduct for the high court.

Indivisible co-executive director Ezra Levin applauded Durbin's call and said the news about Alito's flag "just confirms what we already knew: that the Supreme Court is stacked with far-right, partisan justices intent on using the bench to institutionalize MAGA extremism."

"This behavior is disqualifying for a Supreme Court justice," said Levin. "Alito is not an impartial arbiter of the law, especially when Donald Trump is involved. His brazen actions underscore the urgent need for increased congressional oversight of the court as well as structural reforms to restore its legitimacy."

Levin also called on Durbin to use his committee leadership position to "rigorously investigate corruption on the court and lead efforts to expand the court to unrig the MAGA supermajority."

Devin Ombres, senior director for courts and legal policy at the Center for American Progress, said Alito's display of the flag was a "matter-of-fact admission of his partisan sympathy with Donald Trump's 'Stop the Steal' movement, which led to the violent insurrection on January 6."

"His pathetic excuse that his wife hung the flag as part of a political dispute with a neighbor is even more damning because he's admitting it was a partisan act," said Ombres. "It's unacceptable that Alito now sits in judgment of whether Trump's actions deserve the imprimatur of presidential immunity. Chief Justice John Roberts and the other justices must demand Alito's recusal from any case related to the January 6 insurrection. If Alito had any sense of propriety or humility, he would resign."

The Proud Boys are back: How the far-right domestic terrorist group is rebuilding to rally behind Trump

A dark SUV cruised past former President Donald Trump’s supporters near his Bedminster golf club in New Jersey on a windy April afternoon. Billowing from the vehicle were three flags: one for the Trump campaign, two others with the initials “PB” – the insignia of the far-right Proud Boys movement. Through the open windows, three Proud Boys flashed the “OK” sign with their hands, a gesture often associated with white supremacy and the far right. Trump’s fans cheered. Four men dressed in the signature black-and-yellow shirts of the Proud Boys spilled out of the SUV and began glad-handing the crowd like homecoming heroes. The Proud Boys are back. Four years after the failed effort to overturn Trump’s 2020 electoral defeat, the violent all-male extremist group that led the storming of Congress on Jan. 6, 2021, is rebuilding and regaining strength as Trump campaigns to return to the White House, according to interviews with eight Proud Boys, two U.S. law enforcement officials and four experts who track the group’s online activity.

Since the Jan. 6 Capitol riot, four former Proud Boys leaders have been convicted in federal court of seditious conspiracy, each sentenced to 15 or more years in prison. At least another 70 members were charged with participating in the violence. But that crackdown hasn’t stopped the Proud Boys. Some Proud Boys say they are preparing to emerge once again as a physical force for Trump, drawn to his hardline nationalism and convinced their leaders will be pardoned if he wins. Trump himself promises to pardon convicted Jan. 6 rioters if he’s elected. After last Thursday’s historic guilty verdict against Trump, an Ohio Proud Boys chapter vowed “war” and posted a video of Proud Boy street brawls that ended with the message, “Fighting solves everything.” A Miami chapter said, “Now, more than ever, we are recruiting!” Some posted images of the upside-down American flag symbolizing the “Stop the Steal” movement that falsely claims Trump won the 2020 election. One Proud Boy told Reuters that America is in a period of “calm before the storm.”

The group’s main Telegram channel, however, posted a message urging Proud Boys to stay calm and not get drawn into a trap and risk arrest. “Trump is, of course, getting railroaded but we will not be walking into any honey pots over this.” In recent weeks, the group has become more prominent at pro-Trump events, highlighting the risk of renewed violence in this year’s presidential election. Dozens of Proud Boys – some in body armor and helmets – marked the third anniversary of the Jan. 6 insurrection with a show of force at the statehouse in Columbus, Ohio. On April 20, nearly a dozen gathered at a rally for Trump’s Republican campaign in Wilmington, North Carolina.  More recently, groups of Proud Boys from two chapters mixed with tens of thousands of Trump supporters at a campaign rally in Wildwood, New Jersey, in May.

On a boardwalk near the entrance of the Wildwood rally, several Proud Boys identified themselves as members of the “New Jersey State” chapter. One said they were there to provide security and stop agitators from “disrespecting or assaulting everybody.” Inscribed on his wraparound sunglasses were the initials “POYB” – short for “Proud of Your Boy.” He wore a ring with the initials “PB” and a black shirt with the yellow laurel wreath of the Proud Boys. Three men from another chapter greeted them, their faces hidden by gaiter masks. The re-emergence of the Proud Boys at Trump’s political rallies and events coincides with polls showing a majority of Americans fearing political violence will flare around November’s election. It also comes when Trump’s use of incendiary rhetoric is inspiring his supporters to target his opponents – including judges, prosecutors and political rivals – in a wave of threats that’s unprecedented in modern American politics.

Trump himself has not ruled out the possibility of political violence if he loses in November. “If we don’t win, you know, it depends,” he said when asked by Time magazine in April if he expected violence after the election. If he’s jailed or put under house arrest, “I’m not sure the public would stand for it,” he said in a Fox News interview that aired on Sunday. “At a certain point there’s a breaking point.” Before the last election, Trump told the Proud Boys to “stand back and stand by.” Three months later, federal prosecutors say, the group’s leaders plotted and led the insurrection of the U.S. Capitol. Trump’s baseless, rigged-election claims inspired the gathering, and Trump himself urged the assembled crowd to march on the Capitol as Congress certified Democrat Joe Biden’s victory.

A spokesperson for Trump did not respond to questions for this story about his rhetoric, Jan. 6 and the Proud Boys. As the Proud Boys regroup, they’ve made changes designed to make them less vulnerable to law enforcement scrutiny, including doing away with layers of top leadership, according to interviews with members. The Proud Boys now operate with self-governing chapters in more than 40 states, with little apparent central coordination, members said. While the group’s structure has changed, its Canadian founder remains an inspirational figure to today’s Proud Boys. Gavin McInnes, a British-born far-right commentator who lives in New York, announced his resignation from the Proud Boys in 2018. But he remains deeply involved with the group, according to interviews with Proud Boys.

After McInnes stepped down, his successor, Henry “Enrique” Tarrio, raised the Proud Boys’ profile, pulling them from the fringe of the far-right toward the center of Trump-era Republican politics. Tarrio, a Floridian of Afro-Cuban descent, was sentenced last September to 22 years in prison for seditious conspiracy, defined as an effort by two or more people to overthrow the government or use force to hinder its operations, and other charges related to the Capitol riot. He has appealed.

Two criminal defense attorneys for Tarrio did not respond to emailed questions and phone calls. In the past, McInnes, Tarrio and a group of leaders dubbed “Elders” spoke publicly on the group’s behalf, set the agenda and guided its confrontations with left-wing groups around the country. They sat atop a formal structure and could disband Proud Boy chapters or expel members. Now, members say, the chapters are largely independent of each other and ban communications with the media. Most members who spoke to Reuters for this report did so on condition of anonymity. The group’s resilience has surprised some extremism experts. “The amazing thing is that so many people from the Proud Boys can be in jail and yet you have these active chapters,” said Heidi Beirich, co-founder of the nonprofit Global Project Against Hate and Extremism. “Traditionally when the head of a neo-Nazi or white supremacist group goes to jail or dies, the organization will collapse, but that does not seem to be happening with the Proud Boys.”

During the Trump administration, the Proud Boys engaged in large-scale street brawls with antifa – antifascists – and other leftist groups across the country, typically by taunting demonstrators to instigate a fight. They adopted the slogan “Fuck Around And Find Out,” and emblazoned the letters “FAFO” on hats and t-shirts. Some historians compare the Proud Boys to fascist European militias of the 1920s and 1930s such as the Brownshirts, a Nazi paramilitary group that helped bring Hitler to power in Germany. Proud Boys say they’re nothing like the Brownshirts and bear no resemblance to fascists. But street violence and extreme nationalism are features of both groups. In the weeks before the Capitol riots, some wore a patch inscribed with “RWDS,” short for “Right Wing Death Squad,” a term used to describe Central and South American paramilitaries who supported right-wing governments and dictatorships. After Trump left the White House, the Proud Boys turned to America’s culture wars. They clashed with supporters of abortion rights and vaccine mandates, and harassed organizers of Drag Queen Story Hours, where female impersonators read at libraries or bookstores to children. Fights often ensued. Since the 2021 Capitol attack, Reuters identified 29 incidents of political violence involving the Proud Boys, almost all of them centered around social issues. All but one of the eight cases in 2023 involved clashes between Proud Boys and left-wing activists at demonstrations supporting LGBTQ+ rights. The tally was based largely on news reports and court records of fights, assaults and other physical confrontations. This year, the Proud Boys have returned to politics. In the first three months of 2024, there have been far fewer Proud Boys public events than in the same period last year. But half of them have been pro-Trump and the rest have been political in nature, related to guns or immigration, said Kieran Doyle of the Armed Conflict Location & Event Data Project, a U.S.-based nonprofit that monitors political violence.

On April 24, Proud Boys founder McInnes appeared at Columbia University’s pro-Palestinian protests. He told Reuters that the Proud Boys were not getting involved in the anti-Israel unrest, saying he was there to “ridicule” liberals by pretending to be a left-wing journalist. It didn’t work, he said, because people saw him and posted alerts on social media. “They recognized me and were scared.” There’s no authoritative count of Proud Boy members. McInnes claims there are about 5,000, down from 8,000 during Trump’s presidency but up from lows after the Capitol riot arrests. Official estimates of the Proud Boys’ strength vary widely, from 300 to 3,000 members, said a law enforcement source who has monitored the group. Reuters could not independently corroborate its numbers. Some former Proud Boys have abandoned the group for other, more overtly racist and violent groups, including the neo-Nazi Blood Tribe and the underground “Active Club” scene, a white supremacist male movement, one Proud Boy told Reuters.

Samuel Alito Can’t Even Lie Properly About That Upside-Down Flag

At the very least, Alito needs to recuse himself from all Trump-related court cases. Though frankly, he should be impeached.

Alito was appointed to SCOTUS by George W. Bush. Bush won the 2000 election after the Supreme Court stopped vote recounting in Florida as Democrat Al Gore was closing the gap with Bush. And we remember that Alito wrote the majority opinion in the overturning of Roe v. Wade in 2022.

Think of Alito when you're tempted to waste a vote on an impotent third party candidate who has no chance of getting elected president and appointing Supreme Court justices.

The Democratic presidential ticket of Vice President Kamala Harris and Minnesota governor Tim Walz continues to gain momentum, with people flocking to their rallies and pouring money into the Democrats’ campaign: in the first 24 hours after Walz joined the ticket, the party raised $36 million from more than 450,000 donors, more than a third of them giving for the first time. In contrast, the Republicans seem to be imploding. For years, people have noted that the party seemed to be painting itself into a corner, but it’s very odd to watch it now seem to be trapped.

Yesterday afternoon, after Harris’s selection of Walz had hit social media and enthusiasm was building, Trump posted on his social media company an elaborate and bizarre fantasy that President Joe Biden would suddenly try to take back the 2024 Democratic presidential nomination.

“What are the chances that Crooked Joe Biden, the WORST President in the history of the U.S., whose Presidency was Unconstitutionally STOLEN from him by Kamabla, Barrack HUSSEIN Obama, Crazy Nancy Pelosi, Shifty Adam Schiff, Cryin’ Chuck Schumer, and others on the Lunatic Left, CRASHES the Democrat National Convention and tries to take back the Nomination, beginning with challenging me to another DEBATE. He feels that he made a historically tragic mistake by handing over the U.S. Presidency, a COUP, to the people in the World he most hates, and he wants it back, NOW!!!”

Aside from Trump’s obvious yearning to go back to running against Biden, on whom his personal attacks seemed to stick, and his attempt to find some nickname that will stick to Harris, this rant shows that the Republicans seem unable to counter popular Democratic policies.

The heart of their policies were in Project 2025, the extremist vision of a country ruled by a strongman who took the civil service, the Department of Justice, and the military under his own control in order to slash the popular, secular parts of the government and replace them with Christian nationalism. Right-wing evangelicals liked what was outlined in the project, but when the majority of Americans began to understand what was in it, they were quite clear they wanted no part of it. Trump then tried to distance himself from it, although he had publicly praised it, his political action committee had called it his plan, and more than 100 of its architects were people who had served in his administration.

And then it turned out that Trump’s vice presidential pick, J. D. Vance, had written the introduction for a book by Heritage Foundation president Kevin Roberts, the chief author of Project 2025. The original publication date for the book, which calls for “a peaceful ‘Second American Revolution,’” was in September, shortly before the election, but today the publisher announced it would put off publication until November, after the election.

But advance reader copies of Roberts’s book are already in the hands of reviewers, and Madeline Peltz of Media Matters is posting some of the content online. In it, she notes, Roberts “rails against birth control, in vitro fertilization, abortion, and dog parks. He says that having children should not be considered an ‘optional individual choice,’ but a ‘social expectation,’” and that reproductive choice is a “snake strangling the American family.” It is no accident that Vance’s numbers with women continue to fall.

And the Roberts book is only one of Vance’s recent unpopular steps: it turns out that he also wrote a glowing blurb for a book written by ghostwriter Joshua Lisec under the name of far-right conspiracy theorist Jack Posobiec. The book, titled “Unhumans: The Secret History of Communist Revolutions (and How to Crush Them),” calls for purging their enemies from society. “In the past, communists marched in the streets waving red flags,” Vance wrote. “Today, they march through HR, college campuses, and courtrooms to wage lawfare against good, honest people… In ‘Unhumans,’ Jack Posobiec and Joshua Lisec reveal their plans and show us what to do to fight back.”

Without popular policies, MAGA Republicans are simply falling back on the old narrative techniques they used in the past. This morning, Trump called into Fox & Friends, where he fell back on the old argument that Democrats are essentially communists who are undermining American culture. Of Harris-Walz, he said, “This is a ticket that would want this country to go communist immediately if not sooner.” Trump also tried to hit on the culture wars Republicans have fallen back on since the 1970s, warning that Walz is “very heavy into transgender. Anything transgender he thinks is great.”

Trump also tried to push the idea that Harris’s choosing of Walz over Pennsylvania governor Josh Shapiro proves that the Democrats are antisemitic. “I think it's very insulting to Jewish people,” Trump said. This is a hard sell considering that of the 26 members of Congress who are Jewish, 24 are Democrats, and of the 9 Jewish senators, 8 are Democrats and 1 is an Independent. And then, of course, there is the fact that Second Gentleman Doug Emhoff is himself Jewish.

When the stock market tumbled Monday, Trump tried to pin the slide on Harris—calling it the Kamala Crash—and Vance seemed to bet against the United States, predicting that “[t]his moment could set off a real economic calamity around the globe.” When the market rebounded Tuesday, the two remained silent.

Indeed, Trump is largely off the campaign trail, raising suggestions that his handlers don’t want him in public out of concern about what he will do—not a frivolous concern after his angry performance last week before the National Association of Black Journalists.

Meanwhile, Vance is traveling around to the sites where Harris and Walz are speaking. His crowds are embarrassingly small compared to theirs, and he seems perhaps to be trying to intimidate his opponents as Trump tried to do when he loomed behind his 2016 Democratic opponent, Secretary of State Hillary Clinton. Today Vance and a phalanx of his team approached reporters near Harris’s plane to attack her, only to discover she wasn’t around, at which point he boasted the plane would soon be his.

But rather than seeming intimidating, he came across as so desperate for attention that he had to stalk a more popular figure across the tarmac. Former representative Liz Cheney (R-WY) apparently thought so: she reposted Vance’s photo of his group of about nine people walking away from Harris’s plane and commented: “Looks like [Vance] brought all his rally attendees to the airport with him today.”

MAGA Republicans also appear to be reaching to their past by attacking Walz with the sort of “swift boat” smear campaign attacking his military service they launched against decorated veteran John Kerry when he ran for president in 2004. Indeed, the Republican operative widely thought to be behind the attacks on Kerry, Chris LaCivita, is now in charge of the Trump-Vance campaign. Vance today suggested that Walz is engaging in “stolen valor.” Vance served for four years as a Marine, including as a military journalist in Iraq, where he did not experience combat. Walz served in the Army National Guard for 24 years, during which he deployed in response to natural disasters in the United States and served in Europe in support of U.S. operations in Afghanistan.

A number of observers are saying that part of the genius of the Walz pick is that he seems to many people to be the dad and grandfather stolen away by the right-wing rage machine of talk radio and the Fox News Channel and replaced with frightened, angry people who suspect their neighbors and insist the country is going to hell. It seems unlikely that doubling down on that narrative will attract the voters the MAGA ticket needs to win a majority of votes in 2024.

Yesterday the Republican-dominated Georgia State Election Board passed a rule that could delay the certification of an election until “after reasonable inquiry that the tabulation and canvassing of the election are complete and accurate and that the results are a true and accurate accounting of all votes cast in that election.” In a rally on Saturday, Trump thanked the three Republican members of the board—Janice Johnston, Rick Jeffares, and Janelle King—by name, calling them “pit bulls fighting for honesty, transparency, and victory.”

In 2020, Trump tried to get Georgia to throw out its certification of Biden’s victory there, claiming the vote had been marred by fraud, especially among the state’s Black population. He told Georgia secretary of state Brad Raffensperger to “find” him 11,780 votes—one more than the 11,779 that had given Biden the state.

Yesterday, news broke that former Trump lawyer Jenna Ellis, who was indicted in Arizona for her participation in the scheme to replace the state’s real electors for Biden with fake ones for Trump, has agreed to a plea deal. In exchange for the state dropping its charges against her, she has agreed to provide information and materials about the scheme and to testify “at any time and place.”
