UT Southwestern officers named in man's death at Dallas hospital

Four UT Southwestern Medical Center police officers were identified in court filings this week as those accused in the death of Kenneth Knotts, who become unresponsive as he was restrained during a mental health crisis in November 2022.
Brandon Ledbetter, Anaid Vejar, Barry Secrest and Donald McKenzie face allegations in the family’s federal civil lawsuit that the officers recklessly used excessive force and killed Knotts at UT Southwestern in Dallas on Nov. 29, 2022.
The lawsuit, originally filed last year, was amended this week to include the officers’ names and details from body-camera footage obtained earlier this month.

Geoff Henley, the attorney representing Knotts’ family, also released more body-camera footage that he says shows the officers begin to come up with their version of events after Knotts’ death.

“The family has been fighting for more than a year just to find out how their son was killed and who did it,” Henley said in a news release. “Now, we know and can pursue these officers and attempt to get justice. Before, they were just unknown John Does.”
Vejar immediately ended a phone call when reached for comment Wednesday.
The other officers could not immediately be reached.
UT Southwestern and the Texas Attorney General’s Office — which is listed as representing the defendants — did not respond to requests for comment.
Knotts, 41, died in UT Southwestern police custody after he was brought to the Dallas hospital for a mental health evaluation.
Body-camera footage obtained by the family’s attorney — which UT Southwestern would not release when asked multiple times by The Dallas Morning News — shows he was handcuffed and yelled for water and screamed he couldn’t breathe as officers pushed him into a hospital bed.
He screeched and appeared to fidget under the officers for several moments, then became unresponsive.
The News first reported Knotts’ death last year after spending months trying to piece together the death of a man in hospital police custody.
His death was ruled a homicide in the autopsy report.
Medical examiners said he died of sudden cardiac arrest after law enforcement physically restrained him in a “semi-prone position.”

A Dallas County grand jury declined in November to indict the officers involved.
The amended lawsuit, which seeks unspecified actual and punitive damages, alleged the officers killed Knotts in about four minutes and 53 seconds after he was handcuffed and sandwiched by the officers against a hospital bed.
The officers then gave false statements to investigators by saying they did nothing to impede Knotts’ breathing and that he was conscious and alert during their interaction with him, the lawsuit stated.
Body-camera footage shows Knotts was held down on the hospital bed by officers for several moments as he lay on his stomach with handcuffed arms.
He appeared to yell out in pain, then stilled.
All except one officer — Ledbetter, according to the amended lawsuit — then released Knotts, who hung off the bed limp.
At least seven members of medical staff stood around him watching the officers.
Knotts remained motionless, face down on the bed, as medical staff discussed whether to remove the restraints.
“Lift him over!” one woman yelled, sounding urgent.

Henley said the footage shows Knotts’ breathing was labored and that he screamed so loudly about his inability to breathe that a nurse came into the room.
The lawsuit includes a screenshot of medical records, which the filings say are from a nurse who said she heard Knotts yell, “I can’t breathe!” and went into the room to ensure his safety.
Ledbetter and other officers — except for Vejar — told investigators that Knotts never showed signs of difficulty breathing, the lawsuit said.
They asserted they “never witnessed another officer do anything that would interfere with Kenneth’s breathing,” according to the lawsuit.
“The footage undermines what the defendants told others,” Henley said in the news release. “We see onscreen how Kenneth becomes unresponsive — rather than alert and awake.”
The autopsy report said Knotts had THC, which is found in marijuana, in his system.
He also had Narcan, a life-saving medication that can reverse an opioid overdose.
He did not have any opioids in his system, according to the report.
He was 5-5 and 212 pounds.
Newly obtained body-camera footage released by Henley shows a man, who appears to be a police employee, walk through the hospital.
The footage is from after Knotts lost his pulse, according to the lawsuit, which notes Vejar was visibly agitated and Ledbetter was “more nonchalant.”
In the footage, the man recording enters a UTSW police department room, where a female — identified in the lawsuit as a sergeant — and a male officer are leaning against the walls.

Two other officers sit in chairs facing them.
The man recording mumbles to the sergeant.
She looks at him and says, “But he had a pulse.”
“They’re doing checks,” the man appears to reply.

The seated male officer talks about trying to get a report from a paramedic, and the sergeant says, “I wouldn’t worry about it right now.”

“Ain’t gonna happen,” the woman appears to reply.
“Vejar!” someone in the group yells as one of the two seated officers leaves the room.
“Is she OK?” The man recording asks the sergeant.
“No,” the sergeant says, and shuts the door.
“What’s wrong?” the man recording asks.
The sergeant opens her mouth, then shuts it as she looks down at his body-camera. She appears to squint down at the camera, then looks up at the man.
“What?” the man asks softly.

She looks back down at the camera and raises her eyebrows, then looks up at him.
The man sighs and turns off his camera, ending the clip.
That footage shows the officers “began working on their story,” the amended lawsuit alleged.
Henley related the case to other deaths in police custody, including Tony Timpa, a 32-year-old who died in 2016 as a Dallas officer knelt on his back during a mental health crisis.
Henley represented Timpa’s family in a lawsuit against the officers involved.
Earlier this year, Dallas approved a $2.5 million settlement in the case, which also went to trial in September.
“Like George Floyd, Tony Timpa and victims of crowd crush, Kenneth Knotts could not breathe,” Henley said. “We all need air, and these officers took Kenneth’s.”

7 Deputies And 3 Others Face Murder Charges In A Black Man's Death At Mental Hospital
Seven law enforcement officers and three hospital employees have been charged with second-degree murder over the death of a Black man at a state psychiatric hospital last week, according to a Virginia prosecutor.
Irvo Noel Otieno, 28, was taken into emergency custody on March 3 after experiencing mental health distress.
He spent three days in a local jail in Henrico County, south of Richmond, Va., where his family's lawyer says he was "brutalized" by officers — including being pepper sprayed, stripped naked and deprived of his medications — before being transferred to Central State Hospital, a state-run mental facility in Dinwiddie County.
Otieno was restrained with handcuffs and leg shackles throughout the hospital intake process, according to Dinwiddie County Commonwealth's Attorney Ann Cabell Baskervill. In court on Wednesday, she said videos show that seven sheriff's deputies held him on the ground for some 12 minutes.
"They smothered him to death," she said. "He died of asphyxia due to being smothered."
"This legal tactic is for the purpose of protecting other Henrico County jail residents," she said. "It allows for a justified and immediate removal of these seven individuals from their current capacities."
Baskervill's office named the deputies as Randy Joseph Boyer, 57; Dwayne Alan Bramble, 37; Jermaine Lavar Branch, 45; Bradley Thomas Disse, 43; Tabitha Renee Levere, 50; Brandon Edwards Rodgers, 48; and Kaiyell Dajour Sanders, 30.

The jury found that the egg suppliers exported eggs to reduce the overall supply in the domestic market, as well as limiting the number of chickens through means including cage space, early slaughter and flock reduction, court documents say. “We are incredibly pleased by the jury’s decision to hold egg producers Cal-Maine Foods and Rose Acre Farms accountable alongside United Egg Producers and United States Egg Marketers for conspiring to inflate the price of eggs,” Brandon Fox, an attorney representing the food manufacturers, said in a statement. “For the first time, the defendants have been held liable for their antitrust violations. We are now going to turn our attention to the damages phase.” Court documents say the jury found the food manufacturers suffered injury in the timeframe of 2004 to 2008. Jurors were specifically told not to consider more recent egg pricing during their deliberations. Other food manufacturers joining as plaintiffs in the lawsuit against the egg producers are General Mills, Inc. and Nestle USA, Inc. The jury found the egg suppliers who participated in the conspiracy were Cal-Maine Foods, Inc., United Egg Producers, Inc., United States Egg Marketers, Inc. and Rose Acre Farms, Inc., a southern Indiana-based company previously chaired by John Rust. Rust, who is running for Indiana’s U.S. Senate seat in 2024, declined to comment Wednesday citing the ongoing litigation. Rose Acre Farms identifies itself as the second-largest egg producer in the U.S. Rust is currently suing Indiana’s Secretary of State over a contested state law that could prevent his name from getting on the primary ballot as a Republican. According to the law, a candidate must vote in two primaries with the party they are affiliated with or the county party chair must approve their candidacy. Rust has argued the law is unconstitutional and vague. The egg farmer faces an uphill battle for the GOP nomination: Opponent U.S. Rep. Jim Banks has received the endorsement of the Indiana Republican Party and former President Donald Trump. Dallas Bar poll isn’t perfect, but it offers valuable insight about our local courts

The Dallas Bar Association finally released its 2023 Judicial Evaluation Poll, a report card on some of the most influential people in Dallas County.
The public needs this useful tool to evaluate the elected officials who have so much power over the lives of people whose legal cases they oversee.
Delayed for more than six months, the poll was published last week.
On the bright side, it shows there are some standouts on the local bench who are widely respected and admired for their work ethic, such as state district Judges Brandon Birmingham and Tonya Parker, far and away the top rated felony and state civil jurists, respectively.

But the results also indicate that a few judges have such a poor reputation in the Dallas legal community that voters should question whether they are fit for the bench.
One of them is state District Judge Amber Givens, the lowest-rated felony judge overall and whom we recently criticized for a docket scheduling stunt.

Givens challenged the validity of her rating, noting in part that only 45 bar association lawyers participated in her evaluation out of the thousands of practicing attorneys in the county.

Givens’ criticism of her poll results might be more persuasive if she weren’t so frequently in the news over multiple controversies.
With the intent to help judges improve, the bar surveys courtroom lawyers who practice in the federal, state and county civil and criminal courts in Dallas.
It asks that respondents only evaluate judges before whom they have practiced.
Attorneys rate judges on six metrics: preparedness, timeliness in ruling, impartiality, knowledge of the law, judicial temperament and overall performance.
Results are routinely issued in odd-numbered years.
If judges do well, we often see them showcase their scores in campaign brochures.
If they don’t, they usually dismiss the poll as a popularity contest.
That’s exactly what state District Judge Staci Williams called it when we asked her to comment on why she received the lowest overall rating among the state civil court judges.

The poll results are “less significant than an election for homecoming queen at a local high school,” Williams told us in an email.

But we don’t see it that way.
The poll isn’t perfect.
We wish more of the bar’s members would participate.
But it is one of the only measures of judicial performance we have. Lawyers who have firsthand knowledge of this and anonymously offer their opinions are providing a valuable public service.
None of the judges who were elected within the last year were evaluated.
But of those who were, the county’s misdemeanor judges overall were the most highly rated.
The lowest-rated overall were the county courts of law judges, who hear civil cases.
The worst was Judge D’Metria Benson, who 84% of respondents said “needs improvement.”

That’s not surprising given she was privately sanctioned by the State Commission on Judicial Conduct in May.
She did not return a message to her court asking for comment.
Judges in other court groupings we examined — the state civil, felony and family courts — had a variety of ratings but were overall average.
As useful as the bar poll is, we will know even more about judicial performance beginning this spring when the state Office of Court Administration begins releasing detailed data on individual court activity.
By adding this data to the bar poll’s results, we deepen our understanding of individual county judges, who have so much power over our lives.
