The defense lawyer minced no words as he addressed a room full of plastic-industry executives. Prepare for a wave of lawsuits​ with​ potentially “astronomical” costs​. Speaking at a conference earlier this year, the lawyer, Brian Gross, said the coming litigation could “dwarf anything related to asbestos,” one of the most sprawling corporate-liability battles in United States history.
Mr. Gross was referring to PFAS, the “forever chemicals” that have emerged as one of the major pollution issues of our time. Used for decades in countless everyday objects — cosmetics, takeout containers, frying pans — PFAS have been linked to serious health risks including cancer. Last month the federal government said several types of PFAS must be removed from the drinking water of hundreds of millions of Americans.
“Do what you can, while you can, before you get sued,” Mr. Gross said at the February session, according to a recording of the event made by a participant and examined by The New York Times. “Review any marketing materials or other communications that you’ve had with your customers, with your suppliers, see whether there’s anything in those documents that’s problematic to your defense,” he said. “Weed out people and find the right witness to represent your company.”
A wide swath of the chemicals, plastics and related industries are gearing up to fight a surge in litigation related to PFAS, or per- and polyfluoroalkyl substances, a class of nearly 15,000 versatile synthetic chemicals linked to serious health problems.
PFAS chemicals have been detected almost everywhere scientists have looked: in drinking water, in rain falling over the Great Lakes, even in Antarctic snow. They are thought to be present in the blood of nearly every American. Researchers have linked exposure to PFAS to testicular and kidney cancers, developmental delays in children, decreased fertility, liver damage and thyroid disease. The man-made chemicals are so long-lasting that scientists haven’t been able to reliably identify how long it might take for them to break down.
PFAS-related lawsuits have already targeted manufacturers in the United States, including DuPont, its spinoff Chemours, and 3M. Last year, 3M agreed to pay at least $10 billion to water utilities across the United States that had sought compensation for cleanup costs. Thirty state attorneys general have also sued PFAS manufacturers, accusing the manufacturers of widespread contamination.

Biodegradable Plastic made from Tequila Agave Waste
Tequila is one of Mexico’s most iconic and successful exports. According to the Tequila Regulatory Council, for each liter of tequila produced, twelve liters of organic waste is discarded.
Ana Laborde, a businesswoman from Mexico, discovered the wasteful practices behind tequila production – she thought that producing bioplastic bags could be a successful and sustainable business opportunity.
Ana began researching biodegradable alternatives to the ubiquitous plastic bag. However, she grew concerned that many of the common sources of bioplastics, such as corn and potatoes, might better be used as food. Mentioning this to her cousin, who worked in the tequila industry, Ana learned about the vast amounts of unused agave leaves – approximately 400,000 tons each year – created during the liquor’s production. If plant fibers could be easily extracted from agave leaves, she reasoned, this unwanted by-product might be an untapped source of bioplastic.
Her objective was to develop a process to extract cellulose, the molecule that gives plants their structural integrity, from agave leaves. The extracted cellulose could then be used to make biodegradable plastic bags, containers and cleaning supplies. With technical assistance from Mexico’s Center for the Investigation of Applied Chemistry, the team successfully developed this process.
Ana persevered, and in the years since BioSolutions has established strong links with plastic injection molding companies and manufacturers of homeware and promotional materials. BioSolutions’ flexibility has allowed it to expand its product line and customers over time. In 2019, it announced a collaboration with the Jose Cuervo tequila brand to for bars, restaurants and events across Mexico and the United States. BioSolutions is also producing bioplastic beer glasses for concert arenas and stadiums using waste from beer production, an opportunity which required Ana’s team to alter the manufacturing process.

A 30-ton shipment of a chemical that can be used as fertilizer or an explosive is missing from a California-bound railroad car after rail officials confirmed it disappeared during a trip across the West last month.
The railcar, loaded with 61,000 pounds of ammonium nitrate, left Cheyenne, Wyoming on April 12, a Union Pacific spokesperson told USA TODAY Tuesday. Two weeks later it was found empty at a rail stop in the California Mojave Desert, according to a report filed with the federal National Response Center on May 10.
Dyno Nobel, an explosives manufacturer, told local station KQED News the material − "transported in pellet form in a covered hopper car similar to those used to ship coal" − likely fell from a rail car on the way to a rail siding (a short track connecting with the main track) about 30 miles from Mojave in Kern County, just east of Bakersfield.
"The railcar was sealed when it left the Cheyenne facility, and the seals were still intact when it arrived in Saltdale," the company told the outlet. "The initial assessment is that a leak through the bottom gate on the railcar may have developed in transit."
In addition to Dyno, the Federal Railroad Administration (FRA), the California Public Utilities Commission (CPUC) and Union Pacific are investigating the case.
Neither the FRA nor CPUC could immediately be reached by USA TODAY on Tuesday morning.
'Seal still intact'
Officials told KQED the railcar was transported back to Wyoming where it will be inspected.
"At this point in the investigation, we do not believe there is any criminal or malicious activity involved," said Kristen South, a spokesperson for Union Pacific, who works with its customers to investigate any loss of commodity or damaged freight.
"Our investigation is in its early stages because the customer recently reported the possible loss of fertilizer from one compartment of a multi-compartment railcar," South told USA TODAY Tuesday. "The fertilizer is designed for ground application and quick soil absorption. If the loss resulted from a railcar leak over the course of transportation from origin to destination, the release should pose no risk to public health or the environment."
What is ammonium nitrate?
Ammonium nitrate is explosive under certain conditions. Mixed with something flammable and exposed to flame, it can explode.
Timothy McVeigh used 2 tons of ammonium nitrate mixed with fuel oil to destroy the Alfred P. Murrah Federal Building in Oklahoma City, killing 168 people in 1995.
But it's not a danger that exists in many places. That's because the chemical, once a popular fertilizer, is rarely used these days, USA TODAY reported in 2013.
Ammonium nitrate was the main suspected chemical in a Texas explosion that killed 14 people in April 2013.
The explosion at West Fertilizer Co. also injured more than 200 and left at least 50 homes uninhabitable.
