Maternity leave in rwanda
the new maternity leave in the labor code has raised many critics. Some woman and men have questioned the influence of women in parliament. Rwanda has been developing fast. In order to keep this economic growth, the government had to make some changes in the labor code. To protect investments and job creation. Thus, change in maternity leave.
As it stands now a female employee is entitled to a maximum of 12 weeks of maternity leave . First 6 weeks of maternity leave fully paid leave. While for the last 6 weeks: A new mother may resume work or receive 20% of her salary for these 6 weeks (art 64&65)
6 weeks are few for a new mother and a child to bond. But one has to consider why? The circumstance? What could be the reason a parliament with a majority of woman passed such law.
The state exists to protect “property” be it individual property or collective property. By property I mean “liberty, freedom and estates” It has been noticed that private business in Rwanda don’t like to hire women; Especially young women. It cost more money the company when she takes maternity leave. A company had to pay a woman in maternity leave while hiring someone else.
In an economy made largely by small and medium business that seems like burden. The government has to protect investors. On another hand the government have to protect women’s rights (socio-economic rights)
How to balance both?
Businesses have to hire women . That is the only way. But government has to create a safe environment for businesses and protect the investors. In the new law a woman still can enjoy 12 weeks of maternity leave. Only 6 weeks are fully paid. This may leave no choice to many mothers other than to go back to work after 6 weeks. Not only this creates a family problem but in near future it might impact the whole society.
However when the bill was introduced it had another provision: that provided for creation of an assurance that would cover the 80% missing. The maternity leave as it stands today violent mothers rights, child rights. It protects investors at the expenses of women and family stability- in terms of freedom, liberty and most important economical emancipation of women.
the law isn’t evil in nature. So, we should not criticize it only but we should ask, push, urge our parliamentarian to pass the other half of the law soon as possible. Otherwise the society will pay the price of absent parents; unhealthy mothers and babies and family economic crises.
