Feast of Saints Simon and Jude, Apostles

Reflection: Opening to God

One of the beautiful traits I admire in millennials is their openness to other people. It is always a sight to behold when young people come together regardless of their color and creed. It is a beautiful image of the universal Church as the word “catholic” means. As we celebrate the Feast of Saints Simon and Jude, let us remember the Twelve Apostles as prefigures of the Church where there is room for all peoples and races. Let us remember the different kinds of people Jesus had called in unity with Him despite their different backgrounds and beliefs, just like Simon and Jude.

Matthew and Mark called Simon as “Cananaean” while Luke referred to him as the “Zealot.” Their nicknames mean the same thing in Hebrew, where the word qana means “to be zealous or ardent,” like someone who serves God with devotion, or one who is patriotic and belongs to the nationalist movement of zealots. From his nickname, we can assume that Simon was passionate for God and for his country. Here, we see that Jesus Christ calls not the qualified but qualifies the one He calls. Jesus was interested in people, not labels or affiliations.

Jude Thaddeus is a combination of two names. Matthew and Mark called him Thaddeus while Luke described him as “son of James.” John mentioned Jude asking Jesus during the Last Supper why He would manifest Himself to them but toe the world (John 14:22). And the Lord’s reply is also a timely reminder for us: “If a man loves me, he will keep my word, and my Father will love him, and we will come to him and make our home in him” (John 14:23). The Twelve Apostles came together because of their openness to Jesus Christ who united them in His love and guidance.

The debtor who has consented to the assignment of rights made by a creditor in favor of a third person, cannot set up against the assignee the compensation which would pertain to him against the assignor, unless the assignor was notified by the debtor at the time he gave his consent, that he reserved his right to the compensation.

If the creditor communicated the cession to him but the debtor did not consent thereto, the latter may set up the compensation of debts previous to the cession, but not of subsequent ones.

Facts:

Primitivo Perez has been isured with the BF Lifeman Insurance Corporation since 1980 for P20,000. Sometime in 1987, Rodolfo Lalog, an agent of BF, convinced him to apply for additional insurance coverage of P50, 000. Perez accomplished the application form and passed the required medical exam. He also paid P2,075 to Lalog for premium. On Nov. 25, 1987, Perez died while riding a banca which capsized during a storm. During this time his application papers for the additional insurance coverage was still in the office of BF. Without knowing that Perez died, BF approved Perez’s application and issued the corresponding policy for P50,000. Virginia Perez, his wife, claimed the benefits of the insurance policy for her deceased husband but she was only able to obtain P40,000 under the first insurance policy. BF refused to pay the proceeds amounting to P150,000 under the additional policy coverage of P50,000 because they maintain that such policy had not been perfected. On Sept. 21, 1990, BF filed a complaint against Mrs. Perez seeking recission and declaration of nullity of the insurance contract in question. Mrs. Perez file a counterclaim for the collection of P150,000 plus damages.

Issue:

Whether or not there was a consummated contract of insurance between Primitivo Perez and BF.

Held:

No. An essential requisite of a valid contract is consent. Consent must be manifested by the meeting of the offer and acceptance upon the thing and the cause which are to constitute the contract. The offer must be certain and the acceptance absolute. When Perez filed the application , it was subject to the acceptance of BF. The perfection was also further conditioned upon 1) issuance of the policy; 2) payment of the premium and; 3) the delivery to and acceptance by the applicant in good health.

The delivery and acceptance by the applicant was a suspensive condition which was not fulfilled inasmuch as the applicant was already dead at the time the policy was issued. The non-fulfillment of the condition resulted in the non-perfection of the contract. An application for insurance is merely an offer which requires the overt act of the insurer for it to ripen to a contract. Delay in acting on the application does not constitute acceptance even though the insured has forwarded his first premium with his application. Delay, in this case, does not constitute gross negligence because the application was granted within the normal processing time.

Reflection: To Be Fruitful, Be Faithful

Various parishes and communities rejoice and celebrate today the Feast of Saint Isidore, patron of farmers. In our province of Bulacan, they continue the tradition of parading carabaos who would kneel—to show their strength, not holiness—in front of the parish church of San Isidro Labrador. There are many stories of Saint Isidore’s deep devotion to the Eucharist as a farmer who lived near Madrid, Spain in the year 1000. If we follow closely the stories about his piety, he was more faithful to the Mass and prayers than with farming.

According to stories, Saint Isidore would never miss the daily early-morning Mass. His fellow farmers knew he was always in church but they wondered how he still had more bountiful harvests than them. When they investigated, they found out that while Saint Isidore was in church, angels would come to do his farm work. Stories about his charities among the poor also abound. One story goes that his wife, Saint Maria Torribia, would always keep a pot of stew or any soup to feed beggars who followed him every afternoon from the farm. The pot had miraculously never ran dry despite their poverty.

Saint Isidore’s stories of piety and charity tell us today that for us to be fruitful in life, we have to be faithful to God. This was also the message of Saint Paul to the leaders of the church in Ephesus before he left them for Rome to face his trial and death. He reminded them of fidelity to the Gospel and the teachings handed down to them because after his departure, “savage wolves will come among you, and they will not spare the flock” (Acts 20:29). It is also a warning to us today. Like Saints Paul and Isidore, let us sincerely proclaim—in word and in deed—our fidelity to Christ and His teachings.

Let us examine the kind of life we live in these trying times, when faith and spirituality are laughed at and even disregarded. The modern forces have long been destroying us, young and old alike, enslaving us and affecting so much the way we see the world and life itself. May we keep in mind how we were consecrated by Jesus Himself to His Father after His Last Supper.

Ano ang Panitikan?

Panitikan o sa Ingles ay literature, ito ay mga letra na naisayos upang makabuo ng mga salitang pinagtipon-tipon hanggang sa ito ay maging pangungusap na sumasalamin sa damdamin, pangyayari, karanasan, hangarin, ideolohiya,at kasisipan ng mga tao. Ito ay maaring pasulat o pabigkas.

Ito ay instrumento upang magkaintindihan ang mga tao o maaari rin namang ang kabaliktaran nito. Dahil sa iba't-ibang wika sa mundo isama pa rito ang mga dialekto, ito ay hindi naging hadlag upang magkaroon ng matinong komunikasyon ang mga taong hindi magkapareho ang wikang binibigkas. Kaya rin nagkaroon ng mga translators o tawag sa mga taong may dalawa o higit pang wika na alam at binibigkas, sila ang naging daan upang lalog magkaintindhan ang mga taon noon.

Ang Panitikan ay makapangyarihan, dahil sa panitikan nagkakaroon tayo ng mga ideya at detalye ayon sa nangyari noon sa pamamagitan ng pag sulat ng mga kwento. Isa na rito ang ang mga akda ni Dr. Jose Rizal na isa sa naging daan sa pagmulat noon sa kalagyaan ng mga Pilipino sa ilalim ng mga Kastila. Dito natin napapatunayan ang panitikan ay hindi lamang para mag "entertain" o maging pampalipas-oras, ito rin ay isang matalim na sandata o depensa sa mga nangyayari sa kalagayan ng ating paligid.

Bakit kailangan pag-aralan ang Panitikan?

Bakt nga ba kailangan pag-aralan ang panitikan?

Sa totoo lang naman, hindi naman talaga madali at kung madalas pa nga ay nababagot akong pag-aralan ang panitikan pero nasisisyahana ako sa tuwing nakakabasa ng mga kwentong may punto yung tipong nakakapag-pabago ng pananaw pagkatapos mong basahin. Sa mga ganitong pakakataon ko napagtatanto na hindi lang pala sa isang babasahin ang mga akda, na marami pa pala ang kailangan kong malaman, na sila rin ay may sariling buhay at kung iintindihin at susuriin sila, ito ay mga hiyaw o panawaga ng akda maaring nagmulasa sa kanilang imahinasyon maaring dahil sa tunay na kwento.

Dahil sa lawak ng sakop ng panitikan, nagging daan sila para hindi ka maging mang-mang at ignorante sa paligid mo. At bilang isang Pilipino, isa sa responsibilidad natin ang kilalanin ang wika at pagkakakilanlan natin.

 Paano pinag-aaralan ang Panitikan?

May tamang paraan ba kung paano dapat pinag-aaralan ang panitikan? Yung tipong kapag pinag-aralan mo tiyak na gamay mo na ang panitikan. Sa tingin ko ay wala pero ang pagbabasa at pauloy na pagbabasa at pag intindi sa mga binasa at tulong mula sa mga pag-himay at pagbahgi ng mga guro at ga taong may ekspiryensya ay mag dudulot sa atin nang malawak na pag-intindi sa mga bagay-bagay at ang pag-intinding ito ang kinakailangan upang pag-aralan ang panitkan.

Hindi madaling pagaaralan ang pantikan kinakailangan mong magkaroon ng determinasyon at pagpupursige para mo ito maintindihan.

Sa kabila ng lahat, ang panitikan ay hindi lamang ginawa upang tayo ay may mabasa at pagkatapos ay maging walang kibo na lamang sa totoong nangyayari sa ating lipunan, gamitin dapat ang ating utak upang ang mga masasalimuot na nangyari noon ay hindi na muling mangyari ngayon.
