ملک ریاض پر فوجی عدالت میں مقدمہ چل سکتا ہے؟

آپ بھی کہیں گے وہ بات سارے فسانے میں جس کا ذکر نہ تھا وہ میں کہاں سے لے کر آ گیا۔ لیکن ہمیں چونکہ فسانے کے مرکزی کردار کا نام نہیں بتایا جا رہا، نہ ان پر لگے الزامات پر بات ہو سکتی ہے اس لیے بصد احترام بتاتا چلوں کہ ملک ریاض نے پاکستان نیوی سے اس کا نام چرایا ہے۔ پاکستان نیوی چونکہ ہماری سمندری سرحدوں کی محافظ ہے اور مارشل لا لگانے یا اٹھانے سے پہلے یا کسی سیاستدان کو جیل میں ڈالنے سے پہلے یا جلا وطنی پر بھیجتے ہوئے ان سے مشورہ نہیں کیا جاتا۔ نیوی کے ساتھ وہی سلوک ہوتا ہے جو کھاتے پیتے لوگ اپنے غریب رشتے داروں سے کرتے ہیں۔ نیوی نے کوئی 20 سال سے ملک ریاض پر مقدمہ کر رکھا ہے کہ یہ شخص ہمارا برانڈ نیم یعنی کہ بحریہ چرا کر بھاگ گیا ہے۔ سنہ 2015 اور سنہ 2018 میں پاکستان نیوی کے حق میں عدالتی فیصلے بھی آ چکے ہیں لیکن غالباً اپیلیں چل رہی ہوں گی۔ ویسے بھی ایسے فیصلے پر عملدرآمد کرانے کی کسے جرات ہے۔ جب ملک ریاض اخبار میں ضرورت ہے کا اشتہار دیتے ہیں تو ان کو ضرورت ہوتی ہے تازہ ریٹائر ہوئے ہائی کورٹ اور سپریم کورٹ کے ججوں کی اور جنرلوں کی۔
ایک دفعہ وہ سپریم کورٹ پیش ہوئے تو ان کے ساتھ اتنے تازہ تازہ ریٹائر ہوئے سینیئر جنرل تھے کہ لگتا تھا ملک ریاض نے کور کمانڈروں کا اپنا ہی اجلاس بلا لیا ہے۔ ملک ریاض نے البتہ یہ اشتہار نہیں دیا کہ انھیں صحافیوں کی ضرورت ہے، کیونکہ صحافت ان کے گھر کی لونڈی ہے۔ گھر سے یاد آیا کہ ان کے ہاں گھریلو جھگڑے میں خاتون چیخ کر کہتی ہے بلاؤ فلاں والے آئی ایس آئی والے کرنل کو۔ اسی لیے القادر ٹرسٹ کی خبریں ہر طرف چل رہی تھیں لیکن ہمارے وزیر داخلہ سے لے کر ہمارے چیتے اینکروں تک ملک ریاض کا نام آتے ہی بیپ بیپ بول جاتی تھی۔ اب تو دیہاتی عورتیں بھی اپنے خاوند کو منے کا ابا نہیں کہتی لیکن ہم ملک ریاض کو صرف اور صرف پراپرٹی ٹائیکون کہنے پر مصر ہیں کیونکہ نیوز روم والوں کی تنخواہیں ان کے اشتہاروں سے آتی ہیں۔ خان اور اس کے مخالف سب کبھی نہ کبھی اس کے جہاز میں ’جھوٹے‘ لے چکے ہیں اور ریٹائرڈ ججوں اور جرنیلوں کو بھی ریٹائرمنٹ کے بعد کچھ مصروفیت چاہیے ہوتی ہے۔

میں ہرگز نہیں چاہتا کہ ملک ریاض پر فوجی عدالتوں میں مقدمہ چلے۔ اللہ کرے کہ فوجیوں پر بھی فوجی عدالتوں میں مقدمہ نہ چلے اور اگر چلانا ہی پڑے تو ان کو بھی اعلیٰ عدالتوں میں اپیل کا حق ہونا چاہیے لیکن جس طرح موجودہ حکومت کے حامی اور خان کے مخالف یک زبان ہو کر یہ کہہ رہے ہیں کہ ریڈلائن کراس ہوئی ہے، فوجی تنصیبات پر حملے ہوئے ہیں تو فوج ہی آ کر انصاف کرے۔ یہ مطالبہ کرنے والے خود کسی نہ کسی فوجی کا انصاف بھگت چکے ہیں۔ باقی بھگتیں گے لیکن فوجی تنصیبات کی حدیں اتنی نہ بڑھائیں کہ پورا ملک ہی ایک فوجی تنصیب بن جائے۔ توڑ پھوڑ، لوٹ مار، آتشزدگی کے لیے قانون موجود ہیں ان کو کیوں کر پڑھیں۔ کسی جنرل کے گھر کے ڈرائنگ روم کے صوفے کیا دفاعی تنصیبات ہیں۔ کیا فریج سے قورمہ نکال کر کھانا دہشتگردی ہے۔ ایک بچے نے جلتے گھر سے مور اٹھایا ہے، ہمارے جوہری اثاثوں کے راز تو نہیں چرائے۔ (اگر کورکمانڈر صاحب پر فوج کو اپنی عدالت میں مقدمہ چلائے تو یہ بھی پوچھے کہ پسپائی اختیار کرتے ہوئے اپنے پالتو مور کو بلوائیوں کے رحم و کرم پر کیوں چھوڑا)۔ 
غمگین سروں والا میوزک بجا کر ہمیں یہ بھی بتایا جا رہا ہے کہ ہمارے شہیدوں کی بے ادبی کی گئی ہے۔ میں نے فوجی قانون کی کتاب نہیں پڑھی لیکن دعوے سے کہہ سکتا ہوں کہ عین جنگ کے دوران اپنے سپاہیوں اور افسروں کو تنہا چھوڑ دینا، ان شہیدوں کی لاشیں لینے سے انکار کرنا، کہنا کہ یہ ہمارے جوان تھے ہی نہیں۔ اس پر یقیناً فوجی عدالت والا مقدمہ بنتا ہے لیکن مشرف نے کارگل میں یہ سب کیا۔ ان پر کون سی فوجی عدالت میں مقدمہ چلا۔ جس ملک میں کچھ لوگ اتنے طاقتور ہوں کہ کوئی عدالت نہ انھیں بلا سکے اور اگر بلا کے سزا سنا بھی دے تو عمل نہ کرا سکے، وہاں پر ہم چند نوجوانوں کو فوجی عدالتوں سے سزائیں سنا کر اپنا مستقبل روشن کرنے کے خواب دیکھ رہے ہیں۔ یہ وہی سوچ ہے جو پاکستان کے ہر مسئلے کا حل یہ پیش کرتی ہے کہ ہر چوک کو پھانسی گھر بنا دو۔ اب وقت ہوا ہی چاہتا ہے کہ ملک ریاض بھی کہہ دے کہ بحریہ ٹاؤن کے خلاف بات کرنے والے کو بھی ہماری دفاعی تنصیبات پر حملہ سمجھا جائے گا۔ کیونکہ نام تو بحریہ ہے۔ بحریہ نام پر بھی چوری کا الزام اور جس زمین پر کراچی میں بن رہا ہے وہاں بھی چوری کا الزام۔

Imran Khan, the former Pakistan captain and Prime Minister, has been arrested in Islamabad. He was scheduled to appear at the Islamabad High Court to apply for bail in a number of cases that had required his presence, though local media reported that he has not been arrested for a charge for which he was appearing in court on Tuesday.
The arrest warrant, seen by ESPNcricinfo states that Imran has been "accused of commission of the offense of corruption and corrupt practices" under a section of the National Accountability Ordinance.
At approximately 2:15pm local time, Imran was arrested by, according to local media, the Pakistan Rangers, a paramilitary federal law enforcement corps in Pakistan. He was handed over to the National Accountability Bureau (NAB) for further investigation. Section 144, a colonial-era law that prohibits large gatherings, has also been imposed in Pakistan's capital.
Islamabad Police released a statement from their Inspector General on Twitter saying Imran had been arrested in the Al Qadir University, an institution he founded as prime minister in 2019 and where he remains chairman. The allegations centre around the alleged involvement of the former prime minister and his wife in the university being donated the land it stands on by the influential Pakistani businessman and real estate giant Malik Riaz. The UK's National Crime Agency seized assets worth £190m from Riaz in December 2019 and returned them to Pakistan and it is alleged links between the land allotted for the university and what the Pakistan government did with those funds that is unclear but has been the subject of a government investigative committee.
The current federal government in Pakistan, which replaced Imran's government in April 2022 after a vote of no confidence, has often called for his arrest, as have several courts over the past year. There were two separate concerted attempts to arrest him from his residence in March, where police were thwarted by huge numbers of supporters gathered outside his residence to help him resist arrest. Several senior figures of Imran's PTI party (Pakistan's Movement for Justice) have been arrested over the last year, on charges the party says are spurious. They have all been subsequently released.
Pakistan's Supreme Court had ordered elections in Punjab, the country's largest province, to be held on May 14, a few weeks after the constitutional mandate for the caretaker government, set up in the province in January, expired. The ruling party had rejected calls for those elections to be held in defiance of that order.
Several polls have shown Imran holding a clear lead as the most popular politician in the country, and he has accused the government of thwarting Pakistani citizens' democratic rights by refusing to hold elections.
The government and its backers are petrified of elections because so far in the last eight months, out of the 37 by elections, my party has won 30 out of them," Imran told Al Jazeera in March.
"They want to either arrest or disqualify me because they are scared [of the fact] that my party is one of the most popular in Pakistan's history," he said then, as attempts to arrest him from his residence in Lahore were underway.
The development escalates an already unstable political climate in the country. Last November, Imran suffered bullet wounds to his leg after an assassination attempt while he was leading a protest march in Wazirabad in Punjab.
