michael at his core is very sensitive to the idea of being left behind— he fears abandonment and losing those around him, intensifying with every loss but initially rooted in his home life. he was the least favored, faced the brunt of neglect/abuse ( which, it’s important to say that none of the kids were wholly exempt from this at least in my interpretation, michael only perceives it as such because he ends up viewing the bare minimum they got as more ), acted out due to trauma and untreated mental illness ( which only made most around him dislike him more ), forced himself to ‘grow up’ too fast and struggled with real emotional expression. this lead to many mistakes, but deep down? he was a kid who wanted to be loved. and since he was never given the chance to healthily express or cope with this, younger michael projects it outwards. 

                 ( this is also why, for example, if one of his friends were to defend or try and get him to stop harassing evan, michael would NOT react well— in reality, he panics, immediately fearing that yet another person is tossing him aside in favor of his brother, that he’ll always end up inferior just like his father thinks. but he refuses to explain this, it just comes off as lashing out over something so small as his brother ‘being a stupid crybaby.’ )

  HOWEVER, starting after the bite and onwards throughout his life, he develops a tendency to isolate himself and push people away intentionally. for starters, michael ends up with an intense fear that he’ll get others hurt or killed, that everyone’s better off without him, that he’s poisonous. his guilt is also so intense that he thinks he doesn’t deserve that kind of comfort, finding himself inherent bad and unlovable. despite how much it hurts, he forces himself through it for the good of everyone else and convinced he shouldn’t be at ease.

Good Morning everyone! I'm back!

 I am happy to say that it is over, any reported harassment's against me were investigated; I had to send so much crap in and was told to wait; I was not guaranteed anything but it is luckily over and I can move past that and enjoy my followers and dear Tumblr family once again

Thank you for the few who gave me the support; I did get the messages whoever you are, I really would like to put a face to them but will not post them publicly to keep everyone safe. 

Now I want to take this time to apologize to everyone for whatever I did because for the two people I had contact with talked me out of a very permanent plan to officially leave here if I lost my page after many years of being able to confide in people who cared and built me up because this is my safe zone; my safe haven away from my reality which I do need my escape to forget for just a second. 

Returning to Tumblr after a forced hiatus, I was just happy to be back and check on my loved ones; getting my new phone in and finally having access to the internet again had me so happy until I got a message I did not fully understand

Now I had just returned; I had no clue what was going on when this happened and, yes, it upset me deeply to be delighted to talk to somebody I considered a friend and instead while replying to ask how they were doing wanting to be sure they were okay ((Understanding the person had been having troubles before I vanished I was looking in on a friend)) before the chat showed they had blocked me right after

Like everyone on here except one person; there is no way to contact me if I go missing. If I am not here due to I either: 1.) not having internet thanks to the person in control of it or 2.) functioning with a broken phone meaning - I did not get updates unless it was somebody who knew who to contact

I had no other way of reaching out since the friend is no longer active here after leaving months ago.

I had no clue what was transpiring and, Lexi, who anyone who has followed me since the beginning, is my lovely Anonymous penpal who sends me writing ideas for stories and the only real reason I left anonymous asks active because she, like me, suffers from extreme anxiety was trying to boost positivity for me because she understood my situation and the place I am in

I understand now she contacted a lot of people looking for me because; my anon messaging was finally turned off weeks before I left right after I stood up to my bully – I am sorry for that I did not get to say goodbye to anyone because it happened without warning and to those who knew what was going on I knew you would understand, and I know I worried a few people, it was never my plan to be such an inconvenience 

Now at some point in the last few days, I had a dear friend send me some things in a submission that I never saw and wish I never had, thankfully; I know now, and for the sake of their sanity and to keep from adding any more drama or toxic actions to our wonderful fandom, they will remain unnamed because I do not want them catching any hate

Nobody here deserves hate.

So I will not be posting the original nor will I release the creator's name; this was a problem between us it stays between us because I do not wish ill on you; I hope you are successful and are having no more issues, I know returning to my page and not seeing any anon hate in my box after ten days is very refreshing for a change

I have seen everything said about me in three possibly four separate posts since it was all sent to me as one with little separations in-between, and I’m okay with it; I guess I have to accept this is how you feel I have nothing else to say on the matter

What you are saying is fine; I’m not going to let it get me, that is your opinion, and as human's, we are all allowed to have an opinion 

Now, I don't know if you will see this, but I don’t think you are crazy in any way; I think you are intelligent and you have a huge heart; in our IM's you told me about your disorder also about you mental problem and like I said there I still understand; it runs in my family and, thankfully it bypassed me; but I still have compassion for those battling mental illnesses since I do have a few myself

I didn’t know about the ask you got until you mentioned it before I returned, and since mentioned by my best friend that she got one too earlier in the day I already knew who you were talking about

I had just seen it when I got blocked, and I didn’t fully get to read it until this morning when I was finally able to log on, and yes, I privately told you who that anon was because I had told her what a sweet person you were encouraging her to friend you, I have no idea how I lied but it is okay too

I was not here for those hate messages nor was I involved in anything I get too much hate daily when I am here to even dream of sending it but, nobody will believe me except anyone who has ever interacted with me

In your post, you warned people about three of those five people (Again; the ones I know about will not be named) 

I only tried to interact once with your Raph; the response was enough to discourage me from ever trying again; you were stressed I got that because of everything going on I can only imagine you felt like it was an attack, I did not want an RP I just needed somebody to talk to that night, and, for once I didn't go directly to private messages as I do with everyone, that was my fault so I deserved the blow up even if I did not know about that RP until you explained. I apologized, profusely because I felt bad for bringing up – it was to talk, something many know I am not good at, I didn’t know the subject would hurt you; we had never interacted but you had offered to interact with me at one time if I needed you and trying to heal I attempted to reach out on the only thing I had seen on your page a long time ago

I don't get to RP for me haven't for a long while now, but I try to make others happy

Lastly, while I will be staying on Tumblr because I do not want to leave any of you, I will be making several changes to my several pages soon to make sure this never happens again and to all my followers; I love you guys, and for that, I will no longer be posting struggles on here anymore even though I only gave you guys a penny in a 10-gallon bucket because I needed comfort that was too much; my problems are my burden, not yours; and I can not say how sorry I am that I ever put that on any of you

Nobody needs to know what their friends are dealing with when we come here to be happy because it is too much to put on anyone not personally dealing with it, so you will only see the sadness in my stories and only see the struggle in my art

Star Tear AU - Alt. Timeline: Todoroki ver. [Part 1]

This is an AU I wrote on the todomomo discord server eons ago. Anything posted to this blog will be transcripts of old original work and not really edited, save for formatting. I have no guarantees if I will ever finish these AUs either so these will only be kept as an archive.

Star tears in which Todoroki falls for Momo first.

shortly after the exam with Aizawa he doesn’t know what he’s feeling but just admires her strength and quick thinking

and him hanging out with Deku and Iida at lunch means Todo hears all the nice and good things Momo does when she and Iida to discuss class prez stuff

which intensifies this ??admiration?? and respect more

and he just?? Holds onto those feelings unable to figure out what they are until idk maybe holidays where 1A and 1B throw that holiday hotpot party

and Momos really cute lookin’ in that Santa hat she made with the festive turtleneck

and so that feeling inside Todo grows into something more??? bc "oh shit she cute".... and Todo’s blushing while looking at her from afar. Probably.

so Todo talks to Fuyumi abt it and Fuyumi’s like: “I think you like her Shouto”

and he writes to his mom abt it and Rei's like: “she sounds like a lovely girl Shouto”

and he texts Natsuo abt it and Natsu's like: “aw little bro has a crush”

but all the while this is happening, Momo's gotten closer with Iida over class prez stuff and hero stuff and everyone in 1A (read: mina and hagakure) think iimomo might be a thing???

ofc Momo denies it and making excuses politely like "no no ofc not we're being responsible class prez and vice prez" but she’s kinda stuttery while doing so, so no one buys it

and no ones brave enough to ask Iida except Ochako but he gives some straight laced answer like "i admire her work ethic and respect her as a hero and vice prez" but he also has some tint of blush across his cheeks

so idk fast forward to graduation where Todo's been holding onto these feelings for Momo since first year and iimomo is still very very likely

so its all cherry blossom petals flying around and congratulatory celebrations

and when Todo sees Momo amongst the sakura trees smiling like he's never seen before (bc they're finally officially heroes!!) he thinks she’s beautiful

but just as he's about to approach her, Iida approaches her and Todo can see she's blushing and he knows its really not good to eavesdrop on one of his best friends and the girl he likes

But... he's curious.

or so he lies to himself.

Ofc what he hears isnt what he ever wants to,,,,

cuz Iida just confessed to her.

and she feels the same.

and a star tear slips from Todo's eye as he walks away.

he stops mid step as he touches his cheek bc he didnt even realize he was crying

but what are these tears??? What’s happening?? He's never had these before bc even though Todo is an emotional crier, he doesn’t cry that often.. only when he is completely overwhelmed with emotion

so he has this dumbfounded expression staring at his fingers as these star tears are twinkling out of his eyes catching sunlight and sakura petals

until he hears "Youre a fucking idiot" from a few steps away

Bakugou. 

(Baku really likes eavesdropping ok its not the first time lol)

Baku: theyre called star tears.

Todo: You know what these are?

Baku: it happens when you like someone and that person doesnt like you back, idiot.

Todo: ... oh.

Baku: get that shit sorted or you'll go blind

(And for those who are curious, yes maaaayyybe Bakugou has a case of the stars in this timeline too, that’s how he knows. To whom? I'll let you decide bc honestly, I just want todobaku brotp bonding over unrequited love)

so now Todo thinks he might be fucked. One of his best friends confessed to the girl he likes too and she likes him back and now Todo has this disease that might make him go blind and might get in the way of heroing (which they've all secured post graduation positions by now) and what can he do about it?

nothing, says the doctor he sees. The disease is not curable and the only way to stop it is to have your feelings returned else you'll go colour blind and then completely blind, so he's told.

ya he's really fucked.

maybe its a good thing then, that he doesnt cry often. It makes it easier to ice over these feelings, freeze them in time with the memories of U.A.; of his last congratulations to her and her smile at the end of the ceremony an hour after he overheard that confession

maybe its another good thing that right after graduation, everyone went off to their own positions as side kicks with agencies across japan, focusing on heroing

but its 3 months after graduation that Iida tells Deku and Todoroki that he is seeing Momo when they meet up every Friday to catch up

its 6 months after graduation that its publicly announced in Hero Magazine that Ingenium and Creati are dating

its 9 months after graduation that he sees Iida and Momo attending the Hero Association's rising stars gala as a couple and are seated at the same table as them

(Bakugou is scowling at him across the table.)

Todo tries. He really does. To be happy for them.

but he's angry at himself that he can't be happy for them. That it saddens him to see Momo glowing under the ballroom lights but its not himself to make her shine like that, its Iida. That he sees she is the one to make Iida genuinely happy in the way his eyes light up when he smiles at her.

and all three times Todo goes home, lies down alone in his room, an arm slung across his forehead as the star tears leak from his eyes.

he starts to lose seeing colour at 12 months.

after 24 months he needs glasses for colour correction (and ironically gets a sponsorship with the brand. The fashion magazines print headlines for weeks "Hot-Cold Hero Shouto Fall Fashion! See page 7 spread for his newest spotted specks and turtle necks")

at 36 months Iida breaks the news. Iida's gonna propose to Yaoyorozu and wants him, Deku, and his brother to be his groomsmen

she said yes.

and a part of Todo washes away with the star tears flooding him room and twinkling against the tatami.

he tries to stay out of the wedding planning as much as possible. He'll go to the tuxedo fittings as requested and still keep up hearing the updates when seeing Iida and Deku for their weekly get together on Friday nights. 

But for anything involving Momo's presence, there will always be a "sorry i have a mission that week", "sorry im visiting my mom", "sorry Endeavor needs to see me about the agency"

... all excuses Bakugou knows, but the others pay no mind. They are rising heroes near the top of the billboard by now

month 48. Wedding day.

she's stunning. Gorgeous. A near goddess walking down the aisle on her big day.

but she's not walking down for him. No its for iida.

there was the ceremony, the cheers, the congratulations, the reception. Fairy lights around the dance floor and along the walls, champagne glittering after the sound of a cork

Todoroki stands off to against the wall as the night dies down, a glass in hand, watching the newly weds grace the dance floor.

someone slides up beside him, he feels the presence. Bakugou.

"She's beautiful isnt she?"

"Yeah."

. . .

a star tear falls from Todoroki's eyes, twinkle hidden among the fairy lights and champagne glitter.

she's beautiful, but maybe its a good thing I can't see

somebody said: what if she knows everything that had happened and the reason why he couldn't continue his career is bc of her?

me: ok you’re asking for it

Momo, 3 months pregnant with iimomo baby, announces with Iida the news to their friends

the soon to be parents want to choose godparents for the baby so Iida gets to choose the baby’s godmother and Momo gets to choose the godfather

and ofc along with the announcement Momo asks Todoroki to be the kid’s godfather

he can’t say no to her.

the same week later Todo and Momo's agencies are requested to deal with this one villain case while Ingenium's agency deals with another in another town (later turns out the cases were connected)

small talk, civil, very professional between Momo and Todo when they’re in the debriefing

at this point Todo's pretty much completely blind and uses some special contact lenses from Hatsume to help "see"

but the contact lenses can only do so much as to detect light movement and shadows and it reallllllllly doesnt work well when he's using his fire 

so Todo already had tossed around the idea of running away to the mountains like Roy did in the FMA 2003 ending, "mysteriously" retiring bc really his vision cannot keep up

until this last mission with Momo

and really its been nearly a decade now since they last worked together side by side (not since U.A. he thinks).. so just let the blind man be selfish one last time

and so smth smth missiom happens, Todo and Momo fighting side by side

but Momo senses there’s something off with Todo's movements? His reflexes are slower.. it doesnt seem like he's prediciting the opponents moves like he used to.. he's more so reacting and retaliating than attacking..

she chalks it up to that they havent fought side by side in a long time and his style must’ve changed and really, she doesnt know him anymore... not like she used to

smth smth 3 months pregnant Momo gets hurt, knocked unconscious for a bit

Todo saves her

and when she comes to, while Todo's holding her, star tears fall onto her cheek from Todo's eyes. 

She's shocked. Reaches up to gently graze a finger tip at his left cheek.

"Todoroki-san, these are?"

and again its like Todo didnt realize he was crying. He jerks away from her hand and brushes her off with "its nothing”. Changes the subject with "are you ok?"

Momo: yes.. i think so

Todo: and the baby?

Momo, sitting up: we're ok I think

Todo, moving away: good

the mission concludes and they meet up with Ingenium’s group to wrap up the two ends. Todo slips away before Iida and Momo and approach him

theres no activity from Todoroki for the next month

neither Iida, Deku or anyone else in 1A know where he went except the Hero Association's vague comment on "Hot Cold Hero Shouto has taken a sudden indefinite hiatus"

(Only Todo’s family knows and Endeavor asked the Association to say "hiatus" instead of "retirement" bc Enji wants to believe in his son making a comeback. He didnt stop Shouto from taking off)

and ofc Momo upon hearing this is so confused??? Her last mission with him was the last time she saw him and he was crying. Why was he crying? Strange star tears twinkling and landing on her cheeks? What even is that phenomenon?

its too many questions and ofc Momo's gonna investigate. For the sake of her friend.

so she digs up all the texts she can find on star tears. Internet search all the possibilities. Consults the doctors at the hospital. Even asks Tenya if Todoroki has been acting strangely during their weekly catch ups.

but Tenya tells her Todoroki hasnt been the the meet ups since after their wedding

so she asks anyone in their pro hero circle of associates she can think of. Tsukiyomi, Burnin', heros from his agency, anyone she can think of that has worked with Todoroki before and could comment on his behaviour

no body knows. No body noticed anything different either. Sure there were some off days but the Hot Cold Hero Shouto was always on his game being one of the top 3 heroes on the billboard charts

she searches and searches, splitting time interviewing colleagues and researching the possible star tears phenomenon

until eventually her search takes her to...

Bakugou.

Of course.

Momo, pleading: please Bakugou, you know something about him dont you?

Bakugou, who at this point had been very careful trying not to get cornered knowing her investigation: save it pony tail, you’re about to have a baby. Go have people harass you about that brat in your oven instead of harassing other people

Momo, nearly begging: please. You and I both know he's strong and a good hero that would not suddenly retire. Whatever he is doing, he might need help.. please tell me Bakugou.

... theres something about pregnant women that you cant say no to.

Bakugou, relenting: tch. The half ass is somewhere in Yokohama

and thats all she needs nearly running waddling (as fast as a pregnant woman could) out the door

Bakugou, calling out after her, still reluctant: when find that half ass, i suggest you throw him a gift. Literally. Throw it at him. He deserves it.

she finds him along the port, watching the sunset in Yokohama (its really not that hard to find someone with heterochromia and two tone hair in a city, especially if youre a hero that knows what methods heroes will use to go incognito)

and for some inkling of a feeling, Momo takes Bakugou's advice. She has a carton of strawberry milk in hand.

Momo, a few feet away from him: Todoroki-san, it's been a while.

Todo, turning his head in her direction: Yaoyorozu...?

Momo, sadly smiling: the sunset is beautiful here isnt it?

Todo, brows furrowing: .. sure. Yaoyorozu what are you doing here--

Momo, interrupting him: --i brought some snacks. Strawberry milk, you liked this while we were in school right? Catch.

she tosses it at him.

he tries to reach out.

But he'es completely off. And misses

Momo, sad: Todoroki-san. You're blind, arent you?

Todo, guilty: ah.

Momo, tearing up: will you please tell me?

he still can say no to her and confesses his story

and when he's finished telling the tale of star tears, the stars above are twinkling too

she's crying and choking and sobbing through tears and its intensified by baby Iida with pregnancy hormones

But the last thing she manages to croak out at the very least is still wholly her

She apologizes

“Im so sorry Todoroki- san. I cant love you that way.”

“I know.”

END NOTES:

red is the last color Todoroki wanted to lose because it reminds him of Momo

during missions, as long as he could see her, “that’s ok” he thought. she is the only one he sees in color. that is okay with him

to him, Momo is his shining star. And there’s something tragically poetic of him losing his sight to the stars if its for his shining star Momo

He leaves the last stars in a tiny little jar like those paper stars as a gift for her with just the words on a note "goodbye Momo" the day after she finds him in Yokohama

Momo has the jar of stars forever on her bedside and looks at them with this melancholy expression. Baby Iida grows up and asks mom: "what is that jar of stars?" 

Momo responds: "a gift from someone that was blinded by love"

Bakugou in this timeline had a case of star tears too but I'd like to think he got his feelings requited so he never went blind to contrast Todo

So thats why Baku is (begrudgingly) sympathetic to Todo cuz he thinks: “that could’ve been me”

The ending shot of a blind Todoroki in a dark room, all alone, eyes closed, thinking back to Momo's shining smile from UA surrounded by star light with a sad smile on his face and it fades to black

cracks knuckles. anon you have just opened the pandora’s box of leos infodumping

so, to set the stage here: he’s part of a setting called Shattered Worlds, in a totally different continuity from Chaosverse (where Checkpoint / askchaosverse takes place). there’s totally different rules and worldbuilding and all that, and while it TECHNICALLY takes place in the same multiverse (and has some characters in common, if EXTREMELY AU) it’s… also basically shoved in the twilight cage and locked off from everything else. it’s also a setting from 2007 that lasted until 2014, so it’s about to get wild

(it’s also gonna be under a cut bc this is gonna get VERY long. tl;dr: he’s a universe-destroying asshole that stumbled across an artifact of immense power, lost control of it, blew himself up, and is behind the entire plot of Shattered Worlds, both directly and because of consequences of him exploding. also he’s kind of an AU shadow/mephiles? i guess???)

Shadowy is something called an Outsider, which are… well they never got defined very well, but they’re a species that’s mobian-passing (and apparently is all hedgehogs, seeing as the 3 established Outsiders are hedgehogs?) and have the ability to jump from universe to universe at will, among other individual powers like Chrome’s telekinesis. they mostly use this to kinda hang out on various versions of Mobius, blending in as being an average mobian and either solving problems or causing them. Shadowy’s of the latter kind. they can be identified as an Outsider by their weird eyes, although that can get a bit blurry sometimes because theres some other SW characters that get them under specific circumstances which… usually involve an Outsider doing something.

anyway the point is Shadowy’s kind of a dick. the downside of being an outside force to the multiverse as we know it is… he doesnt really have any attachment to it? he’s not really a god but he’s near-invulnerable, can just bounce out of a universe as soon as he starts facing any consequences, and kind of sees everything as a game where he can just knock a few pieces over, see what happens, and then leave to do the same somewhere else but with a different method. he’s bored. the full effect of what he does doesnt really matter to him, he just entertains himself by making a mess of things. he’s also, like, a teenager with phenomenal cosmic power, which always goes well

so Shadowy’s running around from universe to universe, just kinda fucking with people to see how much he can get away with, when one of his worldhops kinda… fails. and instead of going through a portal directly from one universe to another, he falls into the void between worlds: Nullspace.

(”wait isn’t that a thing in sonic forces though” i came up with nullspace in like 2010 and can dig up old posts from my first blog talking about it, and there’s only gonna be more similarities to forces as this goes on, its COMPLETELY baffling and i swear to god it is a total coincidence that im still not over)

anyway so Shadowy accidentally dumps himself into the void, gets lost, but finds something that had gotten sealed there ages ago, potentially by another Outsider: something called the Phoenix Orb. im bolding it because its very important. this is like, THE plot macguffin. it’s also basically the Phantom Ruby, because as soon as Shadowy gets his hands on it he goes from “asshole” to “asshole with total control over reality”. and he REALLY wants to see what this shiny rock can do, so he goes back to his deal of universe-hopping and picks a world he thinks will be very interesting to fuck with.

meet Robo (left) and Recky (right)! Robo wants to be a hero. Recky becomes a supervillain to spite him. Robo assembles a team of random furries and they all go on a bunch of adventures, including meeting clones of themselves, having an EX Gear race, getting lost in the desert, and various other shenanigans, usually involving fighting Recky and his cronies O-Mel and Blade.

then Shadowy shows up.

Recky’d gotten himself in a tight spot, so he wasn’t exactly going to turn down help when a random hedgehog showed up and allied himself with him. …sort of. Shadowy was just kind of a pest to Team Ultimate Robo (or TUR for short), and sometimes would even intervene on their side if things went south. it was kind of hard for anybody to tell what side Shadowy was really on.

finally, though, Shadowy had all his pieces in the right place and set his plan in motion. he approached Robo and took advantage of the metal sonic’s insecurities and tragic backstory, and convinced him to ditch his team in favour of destroying Mobius with him. Recky found out and alerted the rest of TUR, and they teamed up to race Shadowy&Robo to the Eclipse Cannon before Robo used it to wipe out everything.

while Recky was up in space, O-Mel and Blade decided to stick to Recky’s original plan and kidnapped the members of TUR that had stayed behind on Mobius to.. i dunno, do something. mind control them into working for Recky, probably? back at the ARK, Shadowy got his face kicked in by Robo after he was snapped back to his senses, and fled back to Nullspace to recover and plan his next move. Robo had just made things personal… and Shadowy hadn’t taken full advantage of his new powers yet.

Robo freed the captured TUR gang and made a big distraction for them to escape, and in the confusion Shadowy appeared and kidnapped a specific hedgehog to use as bait. it worked, and Robo gave chase to try and rescue her. using the Phoenix Orb, Shadowy took control of SK and gave her enough power to near-totally destroy Robo, then sent her off to do the same to the rest of TUR. she basically got turned into Infinite, complete with having a realitywarping gemstone shoved in her chest.

it was a pretty solid plan, except it quickly fell apart when SK started fighting back for control and tried using the Orb’s power to attack Shadowy instead. he was losing control of the situation, and the two of them ended up in a struggle with Shadowy desperately trying to get the Orb back before she figured out how to use it. in a last-ditch desperate effort, Shadowy used the Orb’s power he could still draw on to forcibly fuse himself with SK in hopes that, if he couldn’t get it away from her, he could at least take control of the fusion and go from there…

…and things very quickly went from bad to worse.

turns out taping together an Outsider, a hedgehog with a shitton of Chaos powers and potential, and an artifact with total complete control over reality, is not good for the universe. or any universe. enter the Shadowy Phoenix, who kinda goes full Solaris except with like… realitywarping instead of time control. the creation of the Phoenix was literally shattering the world around them, and neither SK or Shadowy were in control– it was basically just the Orb itself running rampant and at threat of not only destroying TUR’s Mobius, but the entire multiverse if it wasn’t stopped.

so it got stopped. and exploded. the sudden death-explosion of a superdimensional being tore reality apart and flung everybody across the multiverse, with both Shadowy and SK gone… until SK suddenly showed back up 3 years later with no memory and with a shard of the Orb still stuck inside her. this is when the main Shattered Worlds plot kicks off!

as for Shadowy, it’s… not really clear what happened to him.

hello, friends, and if you’ve decided to keep on reading, thats very kind of you. now you’re probably thinking ‘incorrect quotes, where have you been?!’ and boy oh boy do i have a long fucking story for you. SO WHERE TO BEGIN?? well, the beginning, obviously. im pretty sure by now everyone has realized that this is a side blog. ive stated it a few times that it is, but i’ve never revealed myself because i guess... reasons? well, anyway, cats out of the bag that im @hipster-hazy so jot that down. if you don’t follow that blog, (or if you do and simply forgot/don’t remember) i ran into a bit of a problem with a certain fandom a few months ago over shipping something with a large age gap where the younger person was 20/21 years old so i saw no problem with it, especially since i was 17 when i got into a relationship with a man 10 years older than me and have actively gone for partners much, much older than me, i have made it obvious on that blog that i ship large age gap relationships, and support large age gap relationships when the younger person is aged up to 18 years of age or is already over 18 (i mean i ship mac/billy for christ’s sake and look at how large their age difference is! i think, if it’s in a modern au, it would be the same age difference as these characters that I was shipping anyway we’re just about to move away from this subject). I was never active much on this blog anyway because i only produced content when something was absolutely fucking hilarious and hadn’t been done before by anyone in the fandom. so, yeah. and then there, of course, is college. it was really rough this last year. i droped out of being a music ed major because i fucking hate kids. i also had a bit of an alcohol problem during the fall semester because i had broken up with michelangelo, again (you can look under his tag on my main blog to know who im talking about), and just about slept with anyone that looked at me because, well, i dont cope with depression in a normal human way (this also led to several messy almost relationships that i sabotaged because i had meltdowns all the time). i also dropped out of all my classes except one. so, spring semester was messy still, but wasnt quite as bad as fall semester (i managed to stay in 3 classes).  i got into the musical theatre program at my current college, which i know is the best thing for me to be doing with my time instead of just wasting away lmao. my younger brother noah is going off into the navy in the next few weeks and im scared and sad to see him go. so, whats going to happen to this blog? well, im not quite sure. im still extremely attached to this blog, and to this fandom despite not being active in it anymore. i felt pride knowing that i was (probably) the only OG SINF fandom member left from way back when we were all only on deviant art lmao. i would love if i could get into the fandom again on my new main blog, but thats... just such a risky move because i dont wanna be attacked for shipping things, you feel? and im probably the only one that even remembers it, but its just made me very wary about what i post about shipping wise on tumblr. i would love to interact with you, the fandom again, because i miss  you all so much and how we used to interact. there is a possibility ill delete this blog to move it as a side blog onto my new tumblr (if you want to follow that, please send me a private message so i can tell you what my new main blog is, since ive liked a few things from that blog recently). so, ill leave this here for a few days, stay logged in on hipster-hazy longer than i have in months, before i move this blog over. i appreciate everyone that has followed me and interacted with me in this fandom. this isn’t goodbye

Blog Post: How to Utilize a Medical Expert and Effectively Present Causation Opinions

The seminal causation paper will never be written. This fact provides the author at least some comfort as this paper briefly wades into the agenda-driven minefield of causation in a workers’ compensation claim.

Causation, like beauty, is often in the eye of the beholder. The beholder in a workers’ compensation claim might be a doctor, adjuster, lawyer, or the ultimate fact-finder. Each of these groups has sub-groups with competing interests: treating v. IME doctor, plaintiff v. employer lawyer, liberal v. conservative judge, etc.

The effective practitioner must persuade the fact finder that the mechanism of injury caused a particular injury or diagnosis using that jurisdiction’s legal tests.

I. Causation Starts with the Proper Diagnosis

Diagnostic tests are the quintessential example of objective, and therefore reliable, evidence of at least what the injury is, even if the parties disagree about causation.

False positives and negatives proliferate. In a study published in the December 2016 issue of The Spine Journal (http://dx.doi.org/10.1016/j.spinee.2016.11.009), a patient was sent to 10 different MRI facilities. None of the 10 interpretations identified the true diagnostic finding. Another study revealed a 43.6% diagnostic miss rate. (The Spine Journal, Vol. 15, Issue 10, p2122–2125)

Consistency and accuracy are not the only concern; biases and prejudices influence doctors’ opinions. Most MRI findings are on a continuum between acute and chronic. Thus, a doctor can shade an opinion with selective phrasing (or outright omission).

MRI films are merely snapshots. Clinical examinations provide the diagnosis. An MRI should only be used to confirm that diagnosis. But some providers are misled or overly-influenced by an MRI interpretation resulting in needless treatment and surgery. There is no such thing as a normal exam. Clinicians must determine which findings are diagnostically and clinically relevant.

Multiple professionals should interpret diagnostic tests for accuracy and consistency with the patient’s symptomology. An accurate diagnosis is the first step in a proper causation analysis.

II. Causation From the Medical Perspective

Education trains the brain to think a certain way. A student’s mental approach changes after spending a year in law school, medical school, or seminary. Medical training focuses on treatment rather than causation. Legal education starts with “cause-in-fact” and “proximate” cause. Doctors want to practice medicine. Causality is a secondary concern.

The scientific community does not ignore causality. New scientific evidence may challenge the prevailing medical knowledge. Everyone “knew” that stress caused ulcers or that typing caused carpal tunnel syndrome until more research was published. But research published next year may reverse this year’s latest best evidence.

And there is the agenda. Many doctors are business people who own facilities or participate in IME work. Such doctors supplement their living based on a particular medical viewpoint. Both injured workers and employers/carriers retain experts who share a particular viewpoint for a medical causation opinion.

Legal systems once provided great deference to the causation opinions proffered by the medical community. Due to perceived “junk science”, courts now more rigorously review the expert and the expert opinion. So the “Battle of the Experts” is both personality-driven and fact-driven.

The legal practitioner must evaluate all experts and their expert opinions for credibility before the fact finder (judge or jury) and the appellate courts. The following checklist is useful for the workers’ compensation participant when evaluating the causation opinion:

Science

> Evidence-based or consensus-based

> Well-settled or ever-changing

> New research (and quality of that research) v. old or no research

Expert

> Evaluation of the researcher (if applicable)

> Biases and prejudices

> Qualifications, generally

> Qualified to give an opinion on this topic

> Role of the expert (peer, treating, IME)

> Relative effectiveness when compared to the opposing sides’ expert

Causation Opinion

> Quality of the written report

> Quality of the opinion

> Well-reasoned or conclusive

> Based on correct mechanism of injury

> Considered all relevant evidence

> Describes how mechanism of injury caused injury/illness within the legal framework of the jurisdiction

Effective communication

> Ability to communicate (and survive attacks)

> Describe how other expert’s opinions are flawed

> Opinion is believable

> The expert is perceived as credible

Don’t pick experts just because their opinion agrees with your side. The fact-finder is your audience. Evaluate all causation opinions cognizant of your jurisdiction’s laws and culture.

III. Jurisdiction’s Laws and Culture

A legal system is best viewed as an individual, living, complex entity. Those foreign to a particular jurisdiction lack the experience to understand its nuance and subtleties. The laws matter. But the law’s development/interpretation over time form a unique culture. Different cultures persist within a jurisdiction (think Los Angeles area compared to Northern California) resulting in a different legal culture. And of course different judges bring their own biases and prejudices. Legislative reforms, the court’s response to those reforms, and the ultimate decisions made in individual cases are superimposed on this culture.

Legislatures/courts create or change their legal tests (proximate cause, producing cause, but-for cause, major contributing cause, intervening cause, etc.). Tests can also be strengthened for particular injures (for example, heart attack, psyche, etc.) or weakened/removed (think presumptions in favor of first responders). Legislative changes to the legal tests generally change outcomes unless mitigated by the regulatory body or judiciary in sweeping pronouncements (ruling changes unconstitutional) or finding subtle but frequent distinctions/exceptions. Oklahoma and Florida are just the latest examples of the reticence of regulators or the courts to change their perception of how the law ought to perform.

Know a jurisdiction’s laws and culture when presenting causation opinions to the fact-finder.

IV. Effective Presentation of Causation Opinions

Judges are rational human beings mentally trained to follow the law. But all human beings are flawed, moved by emotion, biases and prejudices. Great judges write decisions they personally disagreed with because they are following the law. But legal practitioners will rue the day they rely on such legal deference to the law.

We all have a moral value system differing mostly on how we rank and order certain values on a continuum. Conservative judges may value rules, law and order higher than other values. Conversely, liberal judges are more likely moved by fairness or justice. All judges value rules, law and order, fairness, and justice. But the order in which judges rank their values forms their moral value system and explains the worldview they use to make decisions.

People (and perhaps especially judges) are rarely persuaded to change their moral value system. Instead, structure your arguments to convince the judge that your causation opinion is most closely associated with the values the judge holds in highest esteem. A practitioner most effectively persuades the fact finder on causation when their expert’s causation opinion is more closely tied to the decision-maker’s moral value.

After you identify the most persuasive values for your particular case and your particular fact finder, make sure you have the most effective causation report in evidence using the checklist above. Repeat your trial themes, moral values, and causation opinions in pretrial, opening statements, examinations of witnesses, and closing.

V. Conclusion

Workers’ compensation insurance should pay all benefits owed – no more, no less. Paying too much will cause the system to fail; paying too little will cause individual workers and their families to suffer greatly while some of the costs are passed on to society as a whole. First, insist on an accurate diagnosis. Second, ask a qualified expert whether the mechanism of injury caused that diagnosis using the jurisdiction’s legal test. Finally, persuasively weave your expert’s opinion into the fact finder’s moral value system, understanding the jurisdiction’s legal culture.
