Court orders FG to return #nnamdikanu to Kenya and pay him N500m as damages for his illegal extradition Justice E.N Anyadike of a Federal High Court sitting in Umuahia, the Abia State capital, today October 26, ordered the Federal Government to return the leader of the Indigenous People of Biafra, Nnamdi Kanu to Kenya from where he was extradited and pay him the sum of N500 million as damages following his illegal abduction and human rights abuse from Kenya. Recall that Kanu was extradited from Kenya to Nigeria on June 19, 2021. The Court presided by Justice E . N Anyadike, insisted that the extradition of Kanu from Kenya without recourse to the legal process was a flagrant abuse of his fundamental human rights. Kanu, through his counsel, Aloy Ejimakor, had approached the court challenging his extradition from Kenya on June 19, 2022. Ejimakor told the court that the suit is sui generis (of a special class) and was primarily aimed at redressing the infamous unlawful expulsion or extraordinary rendition of Kanu, which is a clear violation of his fundamental rights under Article 12(4) of the African Charter on Human and Peoples Rights, as well as Chapter IV of the Nigerian Constitution. He argued that the federal government should be required to show the legal document or authority that served as the foundation for his “abduction or extraordinary rendition.” Among the several reliefs sought, Kanu through his counsel asked the court for “an order mandating and compelling the respondents to pay the sum of N25,000,000,000.00 (Twenty-Five Billion Naira) to the applicant, being monetary damages claimed by the applicant against the respondents jointly and severally for the physical, mental, emotional, psychological, property and other damages suffered by the applicant as a result of the infringements of applicant’s fundamental rights by the respondents”. Delivering a ruling on the suit, the presiding judge held that the extradition of Kanu from Kenya without recourse to the legal process was a flagrant abuse of his fundamental human rights. The Ebonyi State Chapter of the Peoples Democratic Party has hailed the acquittal of the leader of the Indigenous People of Biafra, Nnamdi Kanu. The PDP Publicity Secretary in the state, Chika Nwoba, stated this in an interview with our correspondent on Thursday. He said, “The release of Kanu came to me as one of the few good pieces of news I have received this year. “It goes a long way to portray our judiciary as not a conquered institution against the general view of it has always been locally and internationally. “The release of Kanu by the Appeal Court will relieve the South East of what today seems to be an obdurate new order whose embrace was compulsive. “The vexatious sit-at-home culture will come to an end. Many ill-informed things occasioned by his incarceration will end, and we may begin to enjoy our peace of mind again. “It’s very important that Federal Government releases him as ordered by the Court. “APC-led Federal Government is known for disobedience of court judgements. This one should not be disobeyed due to how dire the need to release the captive is. “Members of the public should pressure the government to do the needful immediately. So, it’s a good development: the release of Kanu. “If not for other things, it’ll return the South East to its former place of economic boom which was truncated by this incident of incarceration of Nnamdi Kanu. I welcome him back to the free society.” Also, a socio-political organisation in Igbo land, the Alaigbo Development Foundation, hailed the judgement. Its Secretary-General, Chief Abia Onyike, said, “It is a positive development. It shows that a peaceful resolution of the Igbo Question in Nigeria is feasible.” An elder statesman in Ebonyi State, Ichie Chukwujekwu Orji, said, “The cause Nnamdi Kanu is pursuing is a cause everyone likes. “And because of the type of constitution that was foisted on the people of this country with all the lies being told against us by our leaders, let us go back to the 1963 constitution and start enjoying this country once more. Amobi Ogah (LP-Abia) has pleaded with President Bola Tinubu to release Nnamdi Kanu as a gift to the people of South Eastern Nigeria. Ogah, member representing Isuikwuato/Umunneochi Federal Constituency of Abia in the House of Representatives, made the appeal in a statement in Abuja on Monday. According to him, the insecurity in the South East region is due to the prolonged detention of the proscribed IPOB leader; the president should release him as a show of love to N’digbo. Ogah said Kanu’s release would expose criminal gangs using the detention to cover their act of terrorism in the South East. He noted that the president had done so much, but added that the only point of disagreement was the issue of giving only five ministers to the entire South East. Nnamdi Kanu wins appeal court case against FG, discharged and acquitted The Appeal Court sitting in Abuja has discharged the leader of the proscribed Indigenous People of Biafra, Nnamdi Kanu. Kanu was prosecuted by the Federal Government at the Federal High Court in Abuja for 15 count charges bordering, including treasonable felony and terrorism, offences he denied. Kanu had faulted the order of Justice Binta Nyako of a Federal High Court, Abuja, which ordered him to answer seven out of the 15-count terrorism charge against him. He had prayed the appellate court to quash the entire charges and set him free on various grounds including that the purported offences were not committed in Nigeria. Kanu has repeatedly called for the breakaway of southern Nigeria to form the Republic of Biafra. On October 2015, he was arrested by Nigerian authorities on an 11-count charge bordering on “terrorism, treasonable felony, managing an unlawful society, publication of defamatory matter, illegal possession of firearms and improper importation of goods, among others.” He was granted bail on April 2017 for medical reasons. However, Kanu fled the country in September 2017 after an invasion of his home by the military in Afara-Ukwu, near Umuahia, Abia State. He was then sighted in Israel before relocating to London, UK. He has been under DSS detention since June 2021 when we was illegally captured in Kenya and brought to Nigeria. Delivering it's judgement on Thursday, October 13, a three-man panel of the Court of Appeal said the Federal High Court lacks the jurisdiction to try him in view of his abduction and extraordinary rendition to Nigeria in flagrant violation of the OAU convention and protocol on extradition. The court held that the 15-count charge preferred against Kanu did not disclose the place, date, time and nature of the alleged offences before being unlawfully extradited to Nigeria in clear violation of international treaties. By • Olalekan Fagbade JUST INHouse of Representatives calls for release of Nnamdi Kanu The House of Representatives Ad hoc committee, interfacing with relevant security agencies to reduce kidnapping, assassinations and banditry in Abia communities, has called for the release of Nnamdi Kanu. Rep. Obinna Aguocha, Chairman of the ad-hoc committee, made this call in Abuja at the resumed sitting of the House. He said that Kanu’s release would serve as a panacea for peace in the South East. The communities are Isiukwuato and Umunnochi Local Government Areas of the state. Aguocha called for the unconditional release of Kanu from detention to ensure lasting peace and security in the entire region. He said there was the need to be prepared to tackle the root cause of insecurity which was at their core and work to ensure lasting solutions that would stand the test of time. Aguocha said for absolute peace, reduction of crime and criminality, and ending the unproductive sit-at-home order, there was the need for investment in meaningful infrastructural development. He said this would improve economic growth and opportunities in the South East.   He said there was the need to be prepared to tackle the root cause of insecurity which was at their core and work to ensure lasting solutions that would stand the test of time. Aguocha said for absolute peace, reduction of crime and criminality, and ending the unproductive sit-at-home order, there was the need for investment in meaningful infrastructural development. He said this would improve economic growth and opportunities in the South East. He said it was imperative for the government to recognise the rule of law, justice and equitable inclusion of the South East zone in the project, Nigeria. The House of Representatives had prior to embarking on its ongoing recess, pledged to wade into the Nnamdi Kanu matter following a similar demand through a motion. Aguocha said “the challenges we face are not mere statistics or headlines; they are real-life manifestations that affect the lives of our people, disrupt the functioning of our institutions and communities.” He further said that this had impeded the growth of the region, adding that criminal activities, banditry, kidnapping, assassinations, communal and religious clashes, and threats to life had shaken the very foundation of the region. Rep. Amobi Ogah, the sponsor of the motion, alleged “instead of combing the bushes to flush out criminals as demanded by the House, through its resolution, the police seemed to be the major threat”. Ogah said of all the prayers, including setting up a joint security task force to comb the bushes, nothing had been done.
