A federal judge in Oklahoma has ruled that a federal law prohibiting people who use marijuana from owning firearms is unconstitutional, the latest challenge to firearms regulations after the conservative-dominated US supreme court set new standards for reviewing gun laws.
Lawyers for Jared Michael Harrison argued that their client’s second amendment right to bear arms was violated by a federal law that makes it illegal for “unlawful users or addicts of controlled substances” to possess firearms.
Harrison was charged after being arrested by police in Lawton, Oklahoma, in May 2022 following a traffic stop. During a search of his car, police found a loaded revolver and marijuana. Harrison told police he had been on his way to work at a medical marijuana dispensary but did not have a state-issued medical-marijuana card.
His lawyers argued the portion of federal firearms law focused on drug users or addicts was not consistent with the historical tradition of firearm regulation, echoing what the US Supreme Court ruled last year in a case known as New York State Rifle & Pistol Association v. Bruen that set new standards for interpreting the second amendment.
Federal prosecutors argued that the portion of the law focused on drug users is “consistent with a longstanding historical tradition in America of disarming presumptively risky persons, namely, felons, the mentally ill, and the intoxicated”.
A US District Judge, Patrick Wyrick, agreed with Harrison’s lawyers, ruling on Friday that prosecutors’ arguments that Harrison’s status as a marijuana user “justifies stripping him of his fundamental right to possess a firearm … is not a constitutionally permissible means of disarming Harrison”.
“But the mere use of marijuana carries none of the characteristics that the nation’s history and tradition of firearms regulation supports,” said Wyrick, who was appointed by Donald Trump.
Wyrick highlighted that under Oklahoma law, marijuana can be bought legally at more than 2,000 store fronts in the state.
Attorneys for Harrison, as well as the US attorney for the western district of Oklahoma, prosecuting the case, did not immediately comment.
The ruling came after a three-judge panel of the Fifth US Circuit Court Of Appeals in New Orleans on Thursday ruled that the government cannot stop people who have domestic violence restraining orders from owning guns. The panel referenced the Bruen decision. Two of the three judges on that panel are Trump appointees.
The Justice Department has said it will seek further review of the appeals Court’s decision.
In September, a federal judge in Midland, Texas, ruled that a firearms law that bans those under felony indictment from buying guns was unconstitutional. In that case, the US District Judge David Counts, also a Trump appointee, also echoed Supreme Court language in the Bruen case, saying there was “little evidence” the ban related to being under indictment “aligns with this nation’s historical tradition”.

Meaning anyone denied at this point may never be able to open shop here. Theyre also not allowing dispensaries within 1000 ft of schools because think of the children i guess 🙄
Im guessing all the rich white people who wanted to get a bit of the profit decided they were done letting others get a claim. Im looking for this to turn into a bunch of small time shops being forced to close and leaving the big sanitized chain stores in control of the market.
Tightening the grip on weed is a transparent way to criminalize it again through heavy restrictions on who can use it. As of now Oklahoma is pretty lax with who gets their card, but i cant see it staying that way forever. Theres already laws that criminalize people seeing your legal weed gear.

I went to bed 4 hours ago at this point... It's now 4 A.M... I was on fambase watching one of my SW friends, and she was moaning pretty loudly. My partner, who I call my husband, even though we aren't legally married due to me still being legally married to my ex-husband (I'll post about that some other time), had his Xbox headset on the chair in front of me that he usually sits on and was in the bathroom. He was in a party with his friends about to play a match on Fortnight (oh how I despise how much time he spends on that game, but I'd much rather he let his frustrations out that way than any other way), and I did not realize that his mic was picking up the sounds coming from my phone. He opened the bathroom door and started shouting that I needed to turn it down because he saw his mic notification pop up (it only pops up when sound is detected). I, being pregnant and scatterbrained, didn't realize that it had started picking things up before he started yelling, so I replied with, "It's only picking up because you're shouting," which, for some reason, prompted him to tell me, "Well, you're not very smart, are you?" Now, let me start here before anyone offers me any relationship advice that I DON'T WANT OR NEED, NOR DID I ASK FOR... My partner is usually very understanding. Things like this never get said and never happen. I immediately backed out of the app, locked my phone, dropped my head, and went to clean up my mess in the kitchen from cooking dinner, before going to the bedroom without saying a single word to him. He then took it upon himself to try to hook me up with someone on clapper, an app I use for my SW, that wanted to go live with me right then and there. He assumed I was too mad at him, which I wasn't until he said I was. We now haven't said much of anything to each other, aside from me texting him to ask if he was in the bathroom because this baby is pushing on my bladder in the worst ways...
Anyways, I've been laying here for 4 hours, and I have no one I can talk to, no one I can vent to, and I can't bring this up to my partner, who is cold turkey quitting smoking marijuana due to having no other option (we live in Oklahoma and it is only medicinal here, neither of us has an OK state ID or Med card) and is in constant pain, because I don't want to upset him...
I found out I was pregnant on 07.29.2023. I was around 3.5-4 weeks pregnant at that time, and I was ecstatic. I got my birth control taken out in December 2022, and we had been trying to get pregnant. Ever since, I've had horrible morning sickness, most of my extremities have swollen, and I get cramps that would worry a normal person (but I know my body is just fine and my baby is okay).
Ever since, I have been on a roller coaster of emotions, being depressed a good majority of the time because I have never felt so alone in my life... My partner tries to understand to my face, but messages to his friends tell me lately that he regrets knocking me up, and I have no idea what to do. Again, I am NOT asking for advice or anyone's input on my relationship. I am just stating how I feel about what I've seen because I refuse to ask him about it.
I had a friend here who offered me help getting whatever I needed when I lost my car and then found out I was pregnant, but that friendship ended abruptly when I asked her if she could take me to the store since WIC doesn't work online... She said she felt I was taking advantage of her kindness and that I wasn't being an actual friend. I tried explaining why I haven't wanted to go to her house much and hang out, and I must not have said the right things because I got told off and then my partner nagged me for days about trying to make amends with her... I'm just not ready to... I don't feel I deserve her friendship... I don't feel I deserve anyone's friendship or kindness anymore... I don't feel I deserve anything anymore, if I'm being completely honest. I don't deserve this child, my partner, this life I've been trying to build... Even as I type this, I'm almost in tears and thanking whoever invented autocorrect and Grammarly because I'd be lost without it... I just don't know what to do anymore.
I moved to Oklahoma from Colorado to escape my previous marriage to a cheating, lying, manipulative, sociopathic narcissist... Only to find myself isolated completely once I did... My current partner has been mostly nothing short of everything I've ever wanted. I just wish I could tell him how alone I feel without him offering me advice on making amends with that friend...
I have no one I can talk to about anything I go through because everyone just wants to give me "advice" or tell me it could be worse than it is...
My own family hasn't checked on me once in the 10 weeks I've known I'm pregnant, except when I post something "concerning" on Facebook or Snapchat. Yet they all want to claim my unborn child...
We're moving back to Colorado in a few weeks so I can have a support system and be able to provide for my growing family, and I've never been more terrified of anything in my life, if I'm being completely honest... I'm so scared that everything is going to blow up in my face. I'm so scared that I won't be able to make anything in the future work. I'm so scared... And I've never felt worse about myself or my life than I have lately...

According to the Centers for Disease Control and Prevention (CDC), autism tends to be present in boys more than in girls, with a 4 to 1 ratio. According to the latest data, the CDC estimated that 1 in 59 children were identified with ASD in 2014. In most cases, autism is not a life sentence. With adequate care, a child should be able to lead a near-normal life. While there are no cures for ASD, certain therapies have been helpful in improving symptoms. Treatment options include behavioral, occupational, speech, physical, and play therapy. In terms of alternative treatment options, it is speculated that marijuana could help children cope with the negative effects of autism, but further research is needed to verify this preliminary evidence.
Is it Ethical to Treat Children with Medical Cannabis?
There has been controversy on the use of marijuana treatment on children. In 2015, the Canadian Pediatric Society issued a statement saying that there was insufficient data on the efficacy or safety of cannabis use in children. But since the FDA approved Epidiolex, a cannabis-based drug, to treatintractable childhood seizures, the medical fraternity has become less skeptical about medical cannabis use in children. The issue of ethics is not a straightforward one. Marijuana strains with high CBD and low THC are considered safe and therefore ethical for use in children. However, high THC strains are treated with skepticism; the long-term effects of THC on the developing brain are controversial. Thus, high-CBD/low-THC strains are preferred when dealing with autism in children, unless the case is palliative. The following states have included autism on their list of qualifying conditions for medical marijuana.

Medical marijuana is approved for autism in the following states: - Delaware - Georgia - Illinois - Iowa - Louisiana - Michigan - Minnesota - Missouri - New Mexico - Pennsylvania - The Territory of Puerto Rico - Rhode Island - Texas - Utah - Florida - Oklahoma - Oregon - Massachusetts - Washington DC - Colorado - California Each state sets its own rules for the use of medical marijuana within its jurisdiction. Pennsylvania was the first state to approve marijuana for the treatment of childhood autism. To get approved for medical cannabis for autism, you’ll need a written recommendation from a qualified medical marijuana doctor allowing you to obtain a medical marijuana card.
Cannabis for Autism: What Research Says
Research into cannabis and autism spectrum disorders is still new. In 2018, a Stanford University study found that anandamide levels (the bliss molecule) was lower in children with ASD. Some research suggests that THC produces more intense and similar effects to anandamide. In theory, THC could be a promising option for autism patients. A study published in 2019 in the Journal of Nature found that cannabis can relieve symptoms of autism such as seizures, restlessness, cognitive impairment, speech impairment, and fits of rage. The study was titled “Real life experience of medical cannabis treatment in autism; analysis of safety and efficacy.” In this study, 188 patients with autism spectrum disorder were followed up over six months. Most patients were treated with a cannabis oil containing 30% CBD and 1.5% THC. After six months of treatment, 82.4% of patients were in active treatment and 60.0% have been assessed.
