Information Technology Act could soon regulate digital streaming and news portals
NEW DELHI: The government may have to revise the Information Technology Act, 2000 to include oversight on digital streaming and news portals, top officials say. The discussions to introduce new provisions are aimed at regulating technology aspects such as collection of users’ metadata, which refers to bulk demographic and other data that firms collect about their users, as well as the algorithms that define how content is served up to individual consumers.
This follows the government’s notification last week, bringing all digital news as well as streaming platforms such as Amazon Prime and Netflix under the purview of the Information & Broadcasting (I&B) ministry.
Officials said that a separate framework to regulate the underlying technology solutions that power digital news and entertainment is required as “algorithms play an important role in how news aggregators and other platforms curate their feeds and how platforms use the metadata they collect of their users.” This can include users’ personal data such as age, educational qualification, choice of content and time spent viewing or reading it.
“All these aspects of metadata along with the algorithms will come under the IT Act, while the content part will be governed by the I&B ministry,” said one official cited above. “Some aggregators may design their algorithms to just pick content which is against a particular religion, that’s why it’s important to bring them under the ambit of the IT Act,” the person said.
Regulations by MeitY, I&B The executive order bringing all “films and audio-visual programmes made available by online content providers” and “news and current affairs content on online platforms” under the purview of the I&B ministry, is aimed at ensuring a “level playing field” for all media, the government had said last week while issuing the order.Parminder Jeet Singh, executive director for Delhi-based think tank IT for Change, said, “Regulation of algorithms is definitely needed in defining some transparency, auditability and accountability parameters. The Ministry of Electronics and Information Technology (MeitY) can help in defining technical parameters of how this is to be achieved.” He added that express instructions coded into algorithms, say a racial bias, could be a problem along with algorithms that just choose to amplify whatever content is traveling fast. “It is estimated that falsehoods seem to travel six times faster than truth in digital platforms, so designers should have a higher level of responsibility in designing algorithms.”
The two-decade old IT Act is also expected to be revised to keep pace with technological advancements, officials said. Although this will “run parallel” to other changes needed since bringing a new legislation might take many years, the sources said.
Fear of over-regulation Legal experts are of the view that any proposed demarcation of responsibilities between two ministries will require coordination. While MeitY retains control over policies on algorithms, metadata, personal data or non-personal data, the I&B ministry will have legislative control over content-related issues of all online news and entertainment platforms.”Some rationalisation of the responsibilities across various arms of the government may be required,” said Rahul Matthan, founder partner at Indian law firm Trilegal. With streaming and digital news platforms now under the regulatory regime, “over regulation is the big fear,” he said.
ET reported last week that social media platforms such as Facebook and Twitter along with Google, which offers curated news, could come under the purview of the new regulations. However, if such platforms and other news and content aggregators do not alter the content they host, they can continue to enjoy the immunity given to intermediary platforms under the IT Act. But, intermediaries will be under scrutiny if they deploy algorithms to curate a news feed. “Algorithms end up creating echo chambers …the issue is how the government will control them, unless they tell (technology) platforms to come up with a solution,” said Trilegal’s Matthan, adding that it is also important to understand what user data is being collected by these platforms and why.
“The approach taken by the committee on non-personal data may be adequate as it asks companies to publicly publish a list of all metadata that has been collected,” he said.

HCL Tech share price: Stocks in the news: HCL Technologies, Federal Bank, IDBI Bank and Mindtree
Nifty futures on the Singapore Exchange traded 66.5 points, or 0.57 per cent higher at 11,761.50, in signs that Dalal Street was headed for a positive start on Friday. Here are a few stocks which may buzz the most in today’s trade:
Earnings today: Federal Bank, HCL Technologies, Bajaj Consumer Care, LKP Securities, Shoppers Stop, Tata Communications and Uniply are slated to announce their financial results for September quarter on Friday.
IDBI Bank: The country’s biggest institutional investor Life Insurance Corporation of India (LIC) is keen to divest its stake in IDBI Bank, ET NOW reported quoting government sources.
Mindtree: IT firm Mindtree posted a 87.9 per cent rise in consolidated net profit to Rs 253.7 crore for the September 2020 quarter, and said it was confident of continuing its growth momentum.
Lakshmi Vilas Bank: The Board of Directors of Lakshmi Vilas Bank (LVB) on Thursday approved raising of funds up to Rs 500 crore through issue of equity shares or such other securities by way of rights issue.
Persistent Systems: The company said it will acquire Palo Alto-based Capiot. Under the deal, Persistent Systems Ltd India (PSL) will acquire 100 per cent shares of Capiot Software – the Indian subsidiary of Capiot Software Inc and consequently, Capiot India will become a wholly-owned subsidiary of PSL, a regulatory filing said.
Sterling and Wilson: Engineering firm Sterling and Wilson said it has signed a contract to construct a solar PV battery storage and diesel genset-based hybrid power plant in Niger in West Africa.
LIC Housing Finance: On the back of “a much-more-than-expected recovery in demand since the past two months”, India’s second-largest pureplay mortgage lender LIC Housing Finance expects a bumper festival season as it eyes loan growth to be in double-digits, according to a report by PTI.
Cyient: IT firm Cyient reported a 14.8 per cent decline in its consolidated net profit at Rs 83.9 crore for September 2020 quarter.
South Indian Bank: The lender reported 23 per cent decline in net profit at Rs 65.09 crore for September quarter of the current fiscal year. The bank had posted a net profit of Rs 84.48 crore in July-September 2019-20. In the previous June quarter, South Indian Bank had a profit of Rs 81.65 crore.
AstraZeneca Pharma: Drug firm AstraZeneca Pharma India said it will launch its Acalabrutinib 100 mg capsules, used for treatment of various types of blood cancers, under the brand name ‘Calquence’ in the country on October 21.
Hero Motocorp: Two-wheeler market leader Hero Motocorp said it has launched its new Pleasure+ Platinum scooter model, priced at Rs 60,950 (ex-showroom Delhi).

HCL technologies | DWS Ltd: HCL tech acquires Australian IT firm DWS for $115.8 million

NEW DELHI: HCL Technologies has announced the acquisition of Australian IT firm DWS Ltd for $115.8 million in a bid to further expand its digital offerings especially in Australia and New Zealand.
The DWS Group closed FY 2020 with revenues of $ 122.9 million and has over 700 employees with operations in Melbourne, Sydney, Adelaide, Brisbane, and Canberra. It provides a wide range of IT services including digital transformation, application development and support, programme and project management and consulting.
Michael Horton, Executive Vice President & Country Manager, Australia & New Zealand, HCL Technologies, said “We are excited for this expansion of HCL Technologies in Australia and New Zealand and are confident that our combined strengths will further accelerate the digital transformation journeys of our clients and innovations for their end customers. HCL has invested in the region for over 20 years and is committed to enabling digitilisation and growing the local ecosystem, he added.
HCL currently employs 1600 people in major cities, including Canberra, Sydney, Melbourne, Brisbane, and Perth. The transaction is expected to close in December 2020, subject to closing conditions, including regulatory approvals.

World Bank pauses publication of Doing Business report on data irregularities
The World Bank on Thursday (local time) said the publication of the Doing Business report will be paused as it probes data collection irregularities in the annual report.
In a statement, World Bank said over the 17 years of its existence, the Doing Business report has been a valued tool for countries seeking to measure costs of doing business.

Gold is bigger bubble than tech, says $63 billion asset manager

By Aoyon Ashraf Carillon Tower Advisers Inc. portfolio specialist Matt Orton is a rare critic when it comes to gold’s meteoric rise this year. He says excitement around the metal has made it a bigger bubble than tech stocks.
Orton, who is “quite bullish” on tech stocks, thinks the price of gold has gotten disconnected from fundamentals.
The flow of funds into gold “shows how much enthusiasm and/or speculation has been going into the gold complex,” Orton said in an interview. His firm has more than $63 billion under management and is based in St. Petersburg, Florida.
“Everyone talks about the bubble in technology stocks,” but the tech sector is “rising because a lot of these companies have been able to increase their market shares during Covid,” Orton said. The tech firms also had strong earnings, providing higher visibility to their growth profile, Orton said. Gold’s rally, on the other hand, could “completely derail” once risk factors driving investors to safe havens ease, including lower rates and the weaker US dollar.

Orton recommends investors hedge their portfolio by diversifying, rather than allocating money into gold. He also thinks investors should keep some cash in “some form of low-duration assets,” which they can redeploy when needed.
In terms of “tactical asset allocation,” Orton recommends overweighting equities with appropriate diversifications.
Within equities, his preferred sectors are tech and health care. He thinks tech stocks with IT services look interesting as they have underperformed peers and have leverage to the US economy.
In health care, stocks in the equipment business are “particularly interesting” as they have exposure to “durable themes” such as chronic disease treatments.
Orton’s least-favorite sector is mid- to small-cap financial stocks because they will struggle in the low interest rate environment. He also doesn’t recommend investor exposure to the energy sector.
