According to the responses to the 2021 American Community Survey available on the US Census Bureau website, approximately 13% of Americans self reported some form of disability. Initially, I thought that this was a high value simply because there's so little perception of it in media, unless that media is specifically designed to show people with disabilities. But then I looked a bit deeper into it. Nearly 50%(it was like 48 point something) of those who reported a disability reported an ambulatory disability. Given this figure, I wonder if the percentage is underreported. A lot of mental health and disability has only been accepted in mainstream media in recent years. There are also questions I have like:Do correctible vision deficiencies count as disabilities? I would argue yes. I wear glasses. It's not something I think about a lot, but without my glasses, I would be hard-pressed to function normally within society. They are an accommodation. Yet in a group of 25-30 people(the class i was in when i was thinking about it), I easily counted at least 5 who wore glasses. Obviously, that's not a large enough sample size to make any kind of assumption off of, but I think I could probably find similar numbers if i looked in other places. Part of me doubts that I was marked as having a vision difficulty despite having and wearing glasses. And it's made me think and wonder if 13% wasn't that large of a number after all. I mean, it's a massive population. It's 42 million people, but I wonder if the number is even larger than that. What do you think?

So, I think it's complex. I'm not saying you are wrong in your investigation, but due to the personal nature of disability, it makes me wonder, too. I think the answer will be just as complex, is what I am saying.

Simultaneously, disability is very common, but the idea of being "unable" to live or be productive makes it so that disability becomes a taboo. It leads you to believe that disability is uncommon, or only exists in the "extremes". I do think that contributes to the perception people have of their disabilities, especially in being in denial about their disabilities disabling them.

I think you can generally say that certain things, like eye vision, can be disabilities, as long as we also recognize that it exists on a spectrum. I also have eye glasses, but if you ask me what I'm disabled by, I probably wouldn't bring that up unless it is relevant, in the narrow ways it is for me personally. I think that's part of why the ambulatory statistic is high. There are many situations where your disability doesn't really... disable you, but you're still disabled because there are aspects of your life you either cannot do, or you need help in order to do.

Thirteen percent is a large number, but when you consider the vast array of disabilities, the number of veterans and elderly, and (like you said) the number of people likely either in denial about their disability or the people for whom education doesn't include disability, the number could very well be thirteen or higher.

It's interesting that ableism is so ubiquitous, yet so many of us are disabled (with or without our knowledge).

I am disabled. I'm autistic with C-PTSD, depression, and anxiety and am also legally blind among other things. There are things that I cannot do that the majority of people expect me to be able to do - and I cannot. I lack the ability to do those things - thus, I am disabled. Not being able to do those things does not make me any less of a person, either. I am still a whole person with or without the ability to do certain things.

People tend to view the worth of other people through the lens of what they can and cannot do for them and for society and for capitalism and so they see those who cannot do certain things, those of us who are disabled, as less than because there are things we likely wouldn't be able to do for them. And people who see the world that way are made uncomfortable by us using the most accurate terms there are to describe our lack of ability - disabled and disability - even though neither is a dirty or bad word; they are merely the most apt descriptors. But it is because they are the most apt descriptors that those who see the world through this point of view and judge the value of others based off of what others can and cannot do don't like these terms because it sets the expectation that there are things that some simply lack the ability to do. That is what it boils down to: due to how they view others who are disabled they perceive it from their own point of view and they themselves would not want to be described as disabled because of their own views of disabled people, their own ableism. So they make up euphemisms that don't actually describe the lived experiences of those who are disabled such as differently abled. And we, the majority of us who are disabled, don't like those terms because we aren't differently abled. That sets the expectation that if pushed hard enough we'll magically be able to do those things which we cannot.

And, honestly? Anyone can become disabled at any time in their life and I feel like if more people accepted that as fact there'd be less debate on this and a lot more accommodations for disabled people available. Literally anything can happen to anyone and leave them disabled - sudden health issues or an accident could and has left many otherwise able-bodied people disabled and has forced them to confront their own external and internal ableism. Like, just as an example of what I mean, I started going blind at eighteen years of age and I was declared officially legally blind due to ocular histoplasmosis, subretinal fibrosis, and early onset AMD in 2020 after the initial treatments that saved what was left of my vision failed to return any of what I had already lost. Not that it would have mattered even if it had returned some of my vision, in my case - I'd still had been declared legally blind I would just have had slightly more central vision than what I currently do. And now, even with the corrective help of glasses, I cannot see - I lack that central vision. And you'd be surprised just how lacking our peripheral vision is, too, despite it being 80% of our vision in total - nevermind that I was already myoptic before I started losing my vision and had to wear glasses which in and of itself is also a disability, just a more widely accepted one. And, unfortunately, the tests to get prescription glasses relies on your central vision so I couldn't get glasses, now, even if I wanted to in order to help with my myopia to clear up what vision I have left, a bit - which I don't, because they now make me instantly motion sick when I put them on and I have very nearly gotten physically sick just by putting on my old ones. Which have since ended up broken and were already about five years out of date, anyways, because glasses are expensive and I couldn't find time to get in to get new ones, so there's that. And that could happen to anyone because what started it all was an internal allergic over-reaction to a fungus spore, more or less. A fungus spore got in my bloodstream, my body decided it really didn't like it, especially in my eyes, and so my eyes started to self-destruct. And now my vision is gone and I'm even more disabled than I already was. And that could happen to anyone, anytime. It could happen to you, or your friends, or your lover(s), or your family. Anyone.

So you'd better start deconstructing those ableist viewpoints, now, because everyone becomes disabled if they live long enough, in the end. And there's no shame in that. There's only shame in how those who are disabled are treated.

I hate fake glasses

It's annoys me to no end that people who do not need glasses wear them! Whenever a person with 20/20 or more or less 20/20 vision wears these fake glasses it's fashionable and sweet/cute and totally beautiful or even hot.

But then people who actually need glasses to see get teased, bullied or called ugly. The most annoying thing is

"You're so much prettier without your glasses!"

Like, screw you! You also look so much prettier when I don't wear my glasses!

These double standards of glasses make people look good while on the same hand people with prescription glasses get belittled annoy the hell out of me.

And let's not forget the social issues.

Needing glasses is still a disability, even if society doesn't treat it like one anymore!

Glasses are tools to help people with their disability, not a fashion statement. It's not cool or appropriate to use hearing aids or a wheelchair as fashion, so why do people wear fake glasses?

P.S: Prescription glasses cost way too much and the government's financially support is more or less zero (0) unless your nearly blind. How about instead of buying cheap fake glasses, people use their money to actually help others in need?

toothy grins, half-lidded eyes, and keepin’ them laughing is what it’s all about, baby. axel walks with more confidence in his posture than he’s earned ( or claimed, for that matter ), and it’s the backbone of what gets him by. he’s a glowing example of the fake it ‘til you make it mentality, and he knows what he wants, usually how to get it, and doesn’t mind letting you know that. there’s an ever present mischievous glint in his eyes that says more about what to expect from him than he does, and that’s still not much? he likes to have fun, and there isn’t a whole lot of regard for righteousness or responsibility on his end, but hey! it’s usually only ever at his own expense, so what’s the damage? he’s an absolute clown and he knows it.

axel loves people. he does — you might not guess that with how elusive he is, but it’s true. there’s nothing he likes more than a good conversation with someone interesting, or maybe not even then; if there’s a sparkle in you, he’ll see it. ( might even draw it, not that you’d ever know. ) he’s warm, loyal, compassionate, relaxed, and understanding; and none of that is at the cost of being passive, or lacking passion. 

as long as the vibes are right, he’s happy to just be; though, he’s known to have a fuse for certain provocations, and will jump readily at chance to fight in someone else’s honor. also, it’s not unlike him to spar for the sake of sparring; but that’s all in good fun, no worries.

there’s no way to sugarcoat it — axel has an inferiority complex. where that stems from is something he’s more self-aware of than he’s willing to admit, but he doesn’t have the patience or the will to dissect it; much less do anything about it, and he’s as bull-headed as they come — especially regarding anything related to the psyche. how much this impacts his demeanor and relationships with others varies on the situation, but one constant is that he’s going to retreat before things get bad; even if ‘things are getting bad’ exists only as his own paranoia-born hypothetical.

things can’t go bad if you don’t let them, and he’s content to keep it that way; even if it means being stuck in the stasis of missed opportunities. it’s when he’s retreating into himself that he can get irritable, anxious, jumpy; secretive, defensive, even. he’s personable until he isn’t, essentially.

Inktober #26: Dark

My name’s Mike London, and I hunt vampires, and that’s why I don’t love the darkness anymore.

Yeah, I know, I know. At this point you’re probably thinking “do we really have time to unpack all that?”, but the thing you’re getting hung up on is vampires, because vampires aren’t real. How could creatures who are technically dead survive only on blood, and if they were running around turning people into vampires every time they drank blood, why isn’t the world overrun with vampires? How could anyone function if they burst into flames when exposed to sunlight, why wouldn’t they show up on mirrors, does that mean they don’t show up on cameras, so on and so forth.

Okay, so most of the myths are wrong. You can see a vampire in a mirror… unless the vampire is positioned to see into your eyes, or their reflection. Vampires are stronger than humans but not by much – you know about that hysterical strength “mom lifts car off child” thing humans can do in extreme circumstances? They can do it all the time, because their bodies are constantly resetting to a perfect state based on what they were like at the moment of undeath, plus their self-image, with bodies that are perfectly healed except for anything that’s part of the self-image, like a scar that they’ve grown to identify with or a piercing. They’re faster than most humans, but they still have human muscles, so we’re talking Usain Bolt, not the Flash, or even a cheetah. They do burst into flames when exposed to strong ultraviolet light, a condition I can kind of sympathize with myself. And they aren’t created when a vampire drinks your blood, but when you drink a vampire’s, when your own blood levels are very low. As soon as a person has more vampiric blood than human blood in their system, boom, vampire.

They have only one really magical superpower, aside from the fact that they’re alive when they shouldn’t be, and it explains all the others that humans believe they have. If they can look into your eyes, and hold your gaze, they can control your mind. Make you think they’re invisible, make you think they just exploded into a hundred bats, make you compelled to do what they say.

It doesn’t work on me, because I’m an albino. And that’s why, despite the fact that all I ever wanted was to write programs, I am stuck hunting vampires as a side hustle. I’m still physically weaker and slower than they are, and while I see better in the dark than you do, I don’t see as well as they do. In light without UV components, such as standard indoor lighting, my vision’s more impaired than theirs, and a lot more than yours. But they can’t mesmerize me, and frankly, your average vampire has gotten so used to being able to mesmerize humans, it’s crippling for them to run into a human where it doesn’t work.

You probably haven’t got the vaguest idea why being an albino protects me. Maybe you have some notion that albinos have weird superpowers, since frankly in fiction we almost always do. You probably don’t know exactly how my disabilities work – in movies and TV, albinos never get to play albinos, it’s always white men in makeup.

Albinos have bad vision. Lack of pigment in the retina when we’re developing gives us vision problems that can’t be corrected with glasses. It’s like we have fewer pixels to see the world than you do, so everything’s going to be fuzzy no matter how strong the prescription lenses are. And a side effect of bad vision from birth is something called rhythmatic nystagmus, where our eyes go back and forth like an old DVD using pan-and-scan to show a movie on old-school near-square CRT televisions. (Old technology’s a hobby of mine.) I don’t have any conscious control or even awareness of it; I couldn’t stop my eyes from moving like that if I tried, short of closing them. My brain does post-processing on the moving image to make it look to me like my eyes aren’t moving, combining multiple snapshots from different angles into a single image. It means my ability to see a moving object is crap even if it’s close enough that I should be able to see it otherwise, but in theory it lets me see more detail than I would otherwise.

The thing is, there’s a reason the legends all have the vampires going “Look into my eyes”. They need to be able to make and sustain eye contact, the kind where you stare into each other’s eyes, and they can’t do that with eyes that are moving constantly. It’s not that I can’t see their eyes, because for me things don’t look like they’re going back and forth while my eyes move. It’s that they can’t look into mine.

I found this out the hard way last year. I was working at a big financial company, and I was behind schedule on the software I was building for them, and they had security rules that didn’t allow me to work from home. The boss used to say not to stay after hours, but I figured this was the kind of thing bosses say to make the company sound friendly and accommodating but is actually a control freak thing intended to benefit the morning people, which I have never been one of. I can’t drive – the state won’t give me a license, with my eyes – and I have chronic insomnia and equally chronic problems with waking up in the morning, making it impossible for me to rideshare with any of my co-workers. So I generally have an intermittently employed friend of mine who shares my apartment drive me places, and this means I’m usually late to work. If I can’t stay late and I can’t bring work home, I fall behind on my projects. Also, I do my best work late at night when there are no distractions. So I was in the habit of going to the bathroom with all of my stuff around 5:30 and then coming out at 6 after my boss had left. I could sit on the toilet with my laptop and continue to work, answering emails and setting Outlook to send them at 8 am in the morning the next day to make it look like I work normal hours, and then when I came out I could get back to the serious programming work, because my boss wasn’t a programmer and had no idea how to check the timestamps of my build check-ins.

It turned out it wasn’t corporate bullcrap after all. It was vampires. Vampires would come into the building to hold meetings on some kind of irregular schedule that meant something to them. I’d been working late for almost two weeks when they showed up, mesmerized my housemate and nearly ate both of us, and I had to kill a few of them with the combination of a steak knife from the kitchen and the cheap bamboo chopsticks I have a few hundred of in my drawer because I’m always getting Chinese takeout for lunch. See, you can’t actually stab a chopstick into a vampire’s heart – it’s too fragile – but stabbing with a regular knife only takes them out of commission for the two minutes or so it takes them to heal. But if you then stick a wooden chopstick in the wound, it prevents them from regenerating, and bamboo is apparently wood for vampire-killing purposes.

Also, I had a black light in my laptop bag, suitable for detecting whether my cats have peed on my laptop bag before I take it to work because they’ve done it so many times I’ve gotten desensitized to the smell of cat pee, and while I don’t like looking at UV light – my eyes have zero protection from it, so it’s painful – it’s a lot worse for vampires, whose skin will burn from very tiny amounts of UV exposure and can actually set on fire. And it’s just astonishing how often vampires will stand there trying to mesmerize you while you walk up to them and stab them in the heart, because they just can’t comprehend “human who cannot be mesmerized”.

And now that I know vampires exist and that I’m immune to their most powerful weapon… well, shit. I’m kind of stuck. I don’t actually know any other albinos, or anyone else with rhythmic nystagmus, and for normal people, wearing the kind of dark glasses that make it so the vampires can’t see your eyes will completely prevent you from seeing anything in the kind of darkness vampires like. I’m the only one I know who can do this. And they don’t kill humans constantly – they don’t need to – but they spread disease (they can’t get blood-borne illnesses but they can sure carry them) and they tend to pick on weaker humans to begin with, people who have less resistance to the bad effects of losing a lot of blood, because if chronically ill people seem sick and lethargic everyone assumes it’s their illness and not vampires attacking them. They’re like humanoid rats, in other words. If you had a well-behaved pet one who never harmed humans and only drank from volunteers, that one would be fine. But the rest of them are vermin.

Now, the best time to kill vampires is during the day, when they’re sleeping. Vampires know this. You are not going to find them when they’re sleeping, and if you did, you’d have to fight your way through their security guards, who are human, and do not know they’re protecting vampires, and really don’t deserve to have to deal with people trying to kill them. Also, being security guards, they are better at mayhem than I am; I’m an IT guy. So, lucky me, I have to go after them at night, when they have all the advantages except one: they expect to be able to mesmerize me, and they can’t.

Nighttime used to be my time. No bright sun glaring in my face and giving me a sunburn. Everyone around me having such poor vision from it being dark that my bad eyesight isn’t a disadvantage anymore, and when it’s dark enough, my eyesight gets better than theirs because my eyes collect every single photon that hits them, no filters. I’d walk around at night, or crank up my stereo and write code until 4 am.

But every time it’s dark, now, I know: they’re out there. They’re hunting. Feeding. And if I don’t track them down and get rid of them, people might die.

And that’s why I can’t love the darkness anymore.

My Experience Falling in Love while Going Blind

I’m writing an advice post about writing a blind character falling in love, and it’s is making me reflect on my last relationship and all the things I loved about it. I think this should be it’s own separate post, because my personal experience with dating while blind is unique.

While I was dating my last (only) girlfriend, I was experiencing the biggest about of life changes. Because of that, all my memories of adjusting to vision loss are intrinsically tied to all my memories of her. So a lot of this will be me sharing my experiences with vision loss too.

My last girlfriend is tied to a lot of my memories of struggle and acceptance. She helped me in ways I can’t explain with more than just my disability (accepting/understanding my gender for one, making me feel safe, listening to me always)

This is definitely not a guide for writing advice, which is most of what I do here. This is a meaningful, emotional experience that I’m willing to share with you. Please do not reblog.

I did say that most people with a disability would be hesitant to meet someone online. That’s true. I’ve tried it and there are real problems with it. I don’t put “oh and I’m blind” in my dating profile because I don’t want to be targeted by abusers or people with savior complexes. It’s also dangerous to be blind, people think they can get away with taking advantage of you. But I also struggle to tell people I’ve matched with and have been talking to that I’m blind. In fact it never gets put into conversation and I stop talking to them before an actual date happens.

But I did meet my last girlfriend online, on a dating app. The thing is, I met her before I began experiencing vision loss. 

Three years before she and I met in person, we met online. She and I talked quite a bit, we even got to the exchanging phone numbers stage, but we never met. The reasons for this is that we were both 19 and growing a lot as people (and still are growing to this day, even after breaking up). She and I stopped talking, drifting away. I got a best friend, dated him, and then broke up with him. Reasons. About five months after that relationship she texted me out of the blue.

I recognized her name instantly. When I put her number in my contacts, I put it in as “[her name] the cutie” because I genuinely thought she was the cutest person I’d ever seen. I remembered her, liking her. I replied, we talked for a while and decided to meet. On a date. She specified date. Not hang out. She was clear. I liked that.

We met in public, because that’s first-date 101. I was at a mall and I asked my parents to drive me and to wait at the nearby bookstore while I met her in a coffee shop. As someone who cannot drive (vision loss) and cannot easily navigate the world (vision loss, but no cane by this point) I wanted backup in case it went bad.

But it didn’t.

Conversation was amazing. I liked her right away. I thought she was funny and sweet. She listened. Conversation never died or turned awkward. I felt something special talking to her. 

The date involved coffee and then going to a movie. It was during the walking from the coffee shop to the movie theater that I let it slip that I don’t see well. Just don’t see well. No labels like visually impaired or blind. I just don’t see well. I mostly said that because it was an outdoor mall (and my vision is at it’s worst outside) and it was crowded and I was afraid that I’d accidentally walk into someone, or trip on something.

What day blind means is that in excessive lighting I see a lot less than I normally would. It’s like overexposed photos, the world turns to white. And for me personally, excess lighting is outside during the day. A cloudy day, a sunny day, it’s just too much light. So walking through this crowded mall in the daylight with sunglasses, all my upper vision is obscured/white and whatever is left is mostly shadows thanks to sunglasses. Also these sunglasses aren’t prescription, so I’m at the point that I can’t tell a trashcan from a person sitting still (true story).

She gave me her hand. The date went on. We visited a bookstore. We saw a movie. We got dinner. We saw another movie, a movie that means the world to me. That whole night is one of my favorite memories ever.

She was super cool about me wearing sunglasses at night, which at the time I was still intensely self conscious about, wondering what people would think about this random person always wearing sunglasses at night. But I needed them because bright outdoor lights cause me severe pain and cause migraines. I can’t look at car headlights or street lights, or any bright light. But she was understanding and I didn’t feel self conscious about it with her. I opened up more about my vision during that date and the two or three other dates that followed.

About two weeks after we started dating, I got in my first (only?) serious accident. By this point I was not considered visually impaired because I saw 20/50 with prescription glasses. The source of my vision issues wasn’t acuity, it’s that my eyes, optic nerves, and brain don’t know how to process light without pain and obscuring my vision. But the day blindness was life-impeding. I was terrified to walk outside by myself, but also too self conscious to ask anyone to be a sighted guide for me. Navigating my campus put me in danger of running into someone or something. (parked truck, trashcan, maintenance cart, stairs, signs, all things that happened or nearly happened) Anywhere that wasn’t familiar layout wise was terrifying to me.

I was at (another) outdoor mall and while walking through the parking lot I got stuck with the sun in my eyes. All my vision was blank. I was wearing sunglasses and still in pain. I thought I would stick close to my friend and listen to him, and I would make it to the curb (fifteen feet away) and be in the shadow of the building, and in that shadow I would see a little better.

The curb came before the shadow and I tripped, but I tripped while seeing nothing and it’s one of the scarier moments of my life. I couldn’t see where the ground was, but my knees and palms were burning with pain. I was crying behind my sunglasses. I still couldn’t see and my friend had to help me to my feet. We made it to the taco joint in the mall, met with another friend. Had lunch. They took me home. I went to my room and pealed off my leggings to see the damage to my throbbing knee. It was swollen, red, and bloody. The blood had dried to my leggings and pealing them away made it bleed again.

“This wouldn’t have happened if I had a cane,” I thought. “I’ve been trying to get one for two months but my mum keeps telling me to see doctors and get some kind of treatment, like I’m not struggling day to day while all that happens.”

First thing I did was walk to my mum and demand I get a cane before this happens to me again, and we ordered a cane right then and there. The second thing I did was text my girlfriend because I was still freaking out.

On our next date we talked about it, how afraid I am of walking around now after that accident (the cane took two weeks to get here, it was a LONG wait for me) She empathized with my fear and accepted that I was okay losing vision if I was allowed to do it on my own terms (get a cane, decide when and if I want to see doctors) and to not want a cure. For a while my mum had been pushing me to doctor after doctor (and there was never a diagnosis) and saying I should get LASIK eye surgury to improve some of my vision. Which I didn’t want.

I didn’t break anything during that accident, but I had a lot of pain and a small limp that first week, and the scar stayed for nearly a year.

My girlfriend accepted that I didn’t want a cure and I wanted to adjust to this life on my terms. She was my biggest supporter and listened to me, and only me, when it came to what I wanted/needed/could and could not do as a person with vision loss.

I think I told her I loved her within a month. I knew during the first date that I had the all too easy potential to fall in love with her. I don’t think I’ve had that feeling with more than one or two people in my life, knowing that if I let myself, I would fall in love. We made each other feel loved and cherished.

She was going through a few life changes herself, but I won’t go into that. I do know that I made her happy while we were dating, and that the support was not one-sided. We were there for each other.

There are a lot of memories I would love to share, but they’re more personal. The kind of personal I think no one deserves to know the whole of but me and her. There are moments and dates I can’t put to words no matter how talented a writer I am.

Why did we stop dating? It was because of my anxiety disorder. No, she didn’t break up with me because of it. I broke up with her because I’m an idiot. I pushed her away because I was a miserable, anxious mess who thought my anxiety would hurt her and that she was better off without me in her life. Which is terrible. Because at the same time I knew she loved me and would not want to break up with me, but I still thought it was better that I self destruct now instead of later. We broke up at six months. She kind of saw it coming, saw that I was unhappy (with myself, not her) and pushing her away.

I didn’t realize how much I missed her until three months later, and then I felt it all too deeply. This aching pain of missing her and knowing that it was too late weighing me down for the rest of the summer. That no matter how happy a moment, there was something missing and it was dragging me down just a little. I knew I was too late, knew I screwed up and I should accept it instead of trying to win her back. She deserves a stable relationship.

But loving her changed my life beyond just those six months. Knowing what it’s like to fall in love changed me as a person. It also partially inspired one of my other wips, titled: Why I Never Came Out, currently on hiatus as I work on A Witch’s Memory. 

Why I Never Came Out is about a boy named Spencer who never came out as gay to his family because his loving (also gay) father has living with congestive heart failure. Spencer also broke up with his first love and was working on moving on and coming out to his family.

I think loving her just taught me the art of being human. Loving her has taught me how to emotionally support others while still taking care of myself. Taught me more about what it means to be queer (I am pan, but she was my first girl relationship). 

I didn’t know this when it began, in fact I didn’t know this until a year after our break up, but my anxiety disorder was my mourning period. A mourning period refers to a when a person with a disability is mourning their previous way of life, before disability limited their independence and freedom. Depression and mental illness following a new disability/illness/relapse is incredibly common. For most people it’s depression, but for me it was anxiety. I was waiting two years for a depressive swing related to my blindness, but while working on A Witch’s Memory, which involves Ulric, my blind werewolf MC, and while working on some of Ulric’s character arc, I realized my anxiety disorder was my mourning period. It was my reaction to the changes in my life.

On Medical Judgment

Reading this blog, you may get a distinct idea I might desire anarchy. I do not, I simply wish to alert people to the problems of a broken system. I have had an odd obsession with fixing things for a long while. It seems to be one of the common traits of the decade, the critical eye and mind. While judgment is nothing new, I feel there has been a distinct increase in negative feedback with a sharp decrease in constructive criticism. This leads to this thought being scrutinizing, instead of a compliment. One would think having a critical mind is a good thing, and it is, should it purely be a layer.

Why I decided to ramble on this is thanks to an issue that has plagued me for a long time. I have mentioned ADHD plenty, but I am uncertain I have fully expressed how difficult it is to prove I  have it to the ones pushing out the pills. Not that I could find any to diagnose me as an adult (Was diagnosed as a child just fine. Fling all KINDS of drugs at the kid boots. FLEE from adult boots.)

It is when they use my strengths to try and prove otherwise. School was difficult due to boredom. I would be interested in the material, immensely in a number of cases, but get bored out of my skull from reiterating the same material the thousandth time. So I began to suffer academically from my mind wandering elsewhere, namely the worlds that would eventually be detailed into my fictional landscapes. I would try to explain my issues, but most teachers reacted to me like a simply a rowdy child. The flurry of bullying did not help any. I began to adapt, I learned to spread my attention properly without losing the lecture. Teachers argued with me about it, even if I was minding my own business in the corner You know the types. See you doodling and call on you to prove a point. Problem is that when I proved I was listening I was being a smart ass or..SOmething.

Anyway, the point is how I eventually was able to start getting good grades… Much later on in college. To the point that in Morrison, sure it was a scam school but they still were pushing out the material and tests, was a school I managed to get a 4.0 in. Got a certificate and anything. Least for a period. See, at that same time I was (and am) still in my eternal struggle to be treated, given guidance, something from my ‘medical professionals’ that turned useless. 60 minutes of waiting after my appointment time only to get a ten-minute piece with someone impatient. Even less for someone who ended up pushing some terrible antidepressants on me. Including one that, even though I went there initially asking for help on ADHD… Though admittedly vague since at this point I had plenty of people accuse me of wanting to pop off and sell the medicine on the street. Instead of taking the fucking things for the fact my mind is like having a series of hyper children try to explain you different subjects that fascinate them all at once. It is disjointed, voices overlapping, chaos, madness, and eventually, one of the trains of thoughts get lost in the scuffle.

They instead look towards my records. Claiming ‘Well if how did you do so well in school if you had ADHD?’ Well, though I was certain I explained this (as well as you can with a medical ‘professional’ rushing you, having you take these written tests and then saying they tell her as much as looking at them through mud) it wasn’t easy. In fact, I wasn’t all that great at first. There was a period where I was fine and dandy… ish. That period I was on Dexedrine (hilariously, the one they will only give to children) before being shuffled through medications that you do ‘better’ but instead made me claustrophobic even in open fields. The academic achievement award I put on my wall isn’t up there because I consider it a trophy in standard academia, especially given the scam college that gave it to me, but as a milestone.

Even as doctors would refuse to diagnose, treat, or even give much guidance towards controlling my ADHD… I managed to get one of those. It had involved week after week of swollen limbs and organs. The stress of college does horrid things to HAE. Especially when stressing over affording your pot, and having to deal with that nightmare pre-legalization (in my state.) and more all culminate in one lovely festering stress god. Controlling your life through your blood, keeping you from going or doing certain things at the flick of the wrist. ONe moment you can plan to go for a 3-mile hike, the day comes and you have to cancel because apparently, your lower intestines are now the size of a golf ball, along with all the lovely little issues that likes to cause for the next few days.

So, yeah, it was a WEE BIT fucking difficult to do well. Especially with doctors like that trying to use my struggle as the hammer of justice against the drug dealer I am not.

This same rage can be spread so far with me though. Treated like a criminal because I use pot for my difficulties, to the point I have lost jobs or never been hired at all for a drug test because I wouldn’t take the things TRULY ruining my mind and body. To supposedly protect me from this green herb from destroying my mind and body. I haven’t hurt a DAMNED soul in my attempts to get my medicine, barring maybe ranting their ear off for telling me to meet them in a shady parking lot next to a bus station at 1 in the morning, leave me waiting for a few fucking hours to the point I search for them. Only to return to find my window broken into and my e-cigarette missing. My medicine would have been wonderful for the stress that caused, and the swelling that followed.

Against, it is fucking laughable the bad luck I have. Plenty that have had bursts of FAR WORSE luck don’t get me wrong. It just seems like I have dealt with a lot of uniquely weird and infuriating issues that made me feel disgusted, humiliated, hurt, or just... Confused. Most of which leads, of course, to the demon of Hereditary Angioedema barking in my ear. Then instead of some advisement, knowledge, or what have you… More often than not you get treated like part of a grander problem.

Now here is why I am typing this. This is the little cliff-notes bit of knowledge I want to make sure so many know. The thing I want to scream at the world. I just haven’t yet figured out how to do so in a short and sweet manner:

When the world has beaten you down; when it has slammed your cheek and face against the curb and you have the yank yourself up. If you, at any point, attack an innocent party in some way… If done right, don't count venting, passionate ranting… When you begin to treat them as part of a problem they never had anything to do with you have a very high chance of becoming a part of that person’s bad day. I am certain none of the people I rant about were out to get me. I am no better at this than anyone else. I have had days where I am so angry I am a walking demon.

I try to be conscious of it. I try to fix my situations quickly, try to contain my rage and leave it for rants on the internet where I don’t use names. Specifically, because I try not to remember the names of my darkness. It is the good things in my life I like to assign names and labels to. They’ll stay longer in my memory. And, theoretically, the darker elements would stand out so strongly.

I don’t even know if the medicine will be any better than the medical marijuana. Thanks to having to buy from specials, I can’t quite get exactly what I  need. The strains work, I am still figuring out the...er.. ‘Dosage’ if you will. Though the best part is no fear of overdose. Of frying my mind. Of becoming an emotionless rock.

I’ve been through many flavors of hell. Physical, emotional, fictional… I have studied horror for ages and tried to think of every traditional and pop culture monster from multiple angles.

Yet still, nothing terrifies me like the idea of being trapped in my own mind again. Going through the entire process of getting and finding a medicine. After years of hoping and praying, only to instead find yourself everything D.A.R.E warned you about when it comes to the medicine that ACTUALLY helps me. Mind you, I stopped taking it for a period for fear it wouldn’t allow me to properly judge the effects. Minus when an HAE attack happened. Was my ONLY pain relief. As I am sure you may have gathered, I’d be opposed to opioids or any other pain medications that my fry my mind. It might be due to ADHD causing my dopamine productions to be faulty, but marijuana has proven oddly helpful.

Pot never made me feel like I was melting into the couch. My mind still was working on something in the least. On some of those medications? I… ‘heard’ them in my minds eyes. They were murky, in a haze. It was like you were expecting to watch Death Note but got the Netflix version instead, on a staticy channel. On a tv where half the screen is broken because some alcoholic asshole punched it.

I would just sit there. I’d hear the outside world like it was in another room. See it through constant tunnel vision. My thoughts all restrained. I truly and completely felt trapped inside myself. COuld move around otherwise fine, I just had so little energy to do so. Motivation, which already is a concept I struggle with, now seem just... Missing. I wasn’t just lacking it. I suddenly seemed devoid of the piece of me that care or ever felt such things.

The final story I think I’ve mentioned, but I surely will never get over. Two, technically, but they are short and connected. Disability requires a comprehensive packet on your health to be filled out. I, of course, checked it first. Even after explaining in detail and there being plenty of resources, such as official websites, for them to consult... They got EVERYTHING wrong. They even put, under how it affects me, nothing more than ‘When he is not having a flare up, he is a perfectly healthy 20-something male.’ Which, given the packet is about my DISORDER not those brief stints when I am not having a flare up... The lot of them are probably why my sanity feels like it is dwindling. It is almost like they are trying to gaslight me. If this is true, all they are managing to do is give me confirmation the lot of them are incompetent and incapable of handling my medical care.

The worst part is all of this seemed to snap something in me. That 4.0 began to gradually drop. Now I am pretty sure I never let myself dip down below 3.0, but still... I stopped caring for that perfection. What was the point? If it was justing going to be used as a tool to cut away my personal achievements... I figured the one piece of paper was enough. I figured I shouldn't try so hard. All it lead to was pain and agony, then judgment for it.

I never seem to keep that thought for long, since here I am. Whining to the internet in the hopes that maybe, just maybe, my words can help pound away the problems in this machine. CLear the rust and stains. Maybe then they'll stop making me feel like such a broken cog.

When we set out on our expansion, we always understood that there would be country-specific regulations we’d need to respect so it’s simply a matter of executing these as efficiently as possible. What is the most common serious mistake you see entrepreneurs make? Assuming there is a market for a product that they love without doing any testing. It’s imperative that you carry out extensive market research before launching any kind of product, regardless of how certain you are that there will be demand for it. Also, entrepreneurs who wait too long to start up often miss opportunities – it’s important to work fast and hard in the early days. If you have a good idea, you need to act quickly. Chances are it’s only a matter of time before somebody else thinks of a similar or identical product/service as yours. How will your market look in three years? The market is changing quickly, more and more companies are switching to online and customers are starting to demand products and services tailored for them. The contact lens market industry has remained the same for years and years, with the big players becoming stagnant and not customer-focused enough. The week before I passed my test we were sat chatting when a police car came down the road and pulled up behind us. Someone had broken into some allotments nearby and they were questioning us as to if we had seen anything. They searched my car- for tools that could suggest we had done it I presume, and when they found nothing they ran my license and obviously realised I only had a provisional license. I still at this point didn't realise I had done anything wrong, I wasn't driving the car, simply sat in it so I didn't realise I had committed an offence. The police informed me that because the engine was running, I could have been driving or about to drive and on that basis they convicted me for driving without a license. I only got 3 points and a 60 fine due to the fact I wasn't actually driving and at the time I accepted that with relief, I was terrified I'd get a ban or lose my license or get a massively unaffordable fine. I could have appealed but that would have meant going to court and I was only 17 and that terrified me. I declared the points to my insurance company straght away, but due to the nature of the offence my insurance was invalidated and void. I've only just now realised how serious having insurance voided in the past is. I'm supposed to be moving a 5 hours away in a few months for a job, and I have plenty of money saved for car insurance and a car, as without a car, the move is completely unrealistic. Without a car I won't be able to get to work as the hours are unsocial and my job isn't very well connected with public transport at all and so relying on public transport or taxis is simply not an option. I found a car, went to get an insurance quote, and found out that getting insurance is practically impossible when you've had insurance voided in the past. The points don't seem to be a problem, when I tell companies about my points but not about my insurance voided in the past they happily give me a quote. They're expensive, but affordable and it's what I was expecting. However, as soon as I tell them that my insurance was voided in the past they refuse to even give me a quote. I'm completely out of options and I don't know what to do. I need a car, but I can't get insurance as much as I try. I know I was in the wrong, but it seems like the voided insurance is more of a punishment than the points are and surely that isn't right? And the voided insurance will stay with me for the rest of my life, so does that mean that driving will never be an option for me? I'm sorry for the essay, I just really don't know what to do! If anyone's been in a similar situation with voided insurance or know of a company that would insure me then please let me know! Just anything that would help, let me know! I have two prospect cars to chose between, one is a Honda Jazz, and one is a Ford Fiesta, now to my knowledge the Jazz's insurance group should be around 11-14, (new 1-50 ranking) and the Fiesta should be around 8. A number of sites have confirmed this to be true. But trying to get actual insurance quotes, the Jazz is coming out cheaper, by at least 300. (This is with my details and the rest of the policy identical) I thought insurance group was the only factor of the car that changed the insurance, or is there another factor? I am a newly passed driver if that changes anything?

I have two prospect cars to chose between, one is a Honda Jazz, and one is a Ford Fiesta, now to my knowledge the Jazz's insurance group should be around 11-14, (new 1-50 ranking) and the Fiesta should be around 8. A number of sites have confirmed this to be true. But trying to get actual insurance quotes, the Jazz is coming out cheaper, by at least 300. (This is with my details and the rest of the policy identical) I thought insurance group was the only factor of the car that changed the insurance, or is there another factor? I am a newly passed driver if that changes anything?

Gorsuch’s writings could prompt end of life questions at confirmation hearing

Washington (CNN)When Supreme Court nominee Neil Gorsuch appears before senators this week, he is sure to face familiar questions on hot topics such as abortion. But a distinct aspect of his record is likely to provoke interest in an issue that rarely arises in confirmation hearings: May physicians prescribe lethal drugs to terminally ill patients who want to end their lives?

The issue of "physician-assisted suicide," or "aid-in-dying," as the practice is increasingly called, has never drawn the Senate Judiciary Committee limelight like social dilemmas over abortion and gay rights.

That could change in the upcoming hearings because of Gorsuch's extensive writings against the practice, as well as recent moves by states to adopt "aid in dying" laws and an aging Baby Boom population that kindles the cultural and legal complexities of how life ends.

Gorsuch, President Donald Trump's choice to succeed the late Justice Antonin Scalia, wrote a 2006 book, "The Future of Assisted Suicide and Euthanasia," that reveals some of his most deeply felt and conservative sentiment.

The stealth Supreme Court nomination of Neil Gorsuch

He opposes giving terminally ill people drugs to bring about death, based on what he describes as "the inviolability" of human life.

"To claim that human life qualifies as a basic good is to claim that its value is not instrumental, not dependent on any other condition or reason, but something intrinsically good in and of itself," he wrote in the 311-page book. "We seek to protect and preserve life for life's own sake in everything from our most fundamental laws of homicide to our road traffic regulations to our largest governmental programs for health and social security."

For some prominent supporters of "aid in dying" laws, this is no abstract policy debate.

US Appeals Court Judge Richard Posner, whom Gorsuch challenges in his book, recalls the death of Henry Friendly, an enduringly influential US appeals court judge whose legacy was celebrated again last week by Chief Justice John Roberts and other luminaries of the law. Friendly committed suicide in 1986 alone in his New York apartment by ingesting pills he had saved up. The act, Posner continues to believe, was done too soon and out of desperation because Friendly lacked the option of a physician's assistance for when he became truly disabled.

For Sen. Dianne Feinstein, the ranking Democrat on the Senate committee that will hold hearings on Gorsuch's nomination, her public support for California's new End of Life Option Act came after the difficult death of longtime friend Merla Zellerbach at age 84.

Zellerbach, a California writer who had pancreatic cancer, backed the California initiative that was adopted after her death, as did Brittany Maynard, who had terminal brain cancer and moved from California to Oregon to take advantage of its Death with Dignity Act.

Maynard, who used social media to draw attention to her plight before dying in 2014 at age 29, became an alternative to the 1990s face of the assisted suicide movement, the late Michigan physician Jack Kevorkian, known as "Dr. Death." Gorsuch invokes Kevorkian and his notorious "suicide machine" in the opening of his book.

He expressed fears that allowing physicians to hasten death could lead to abuse of society's most vulnerable people.

Some disability-rights groups, including Not Dead Yet, agree and have fought state aid-in-dying legislation. Compassion & Choices, on the other side, contends sufficient safeguards for physicians exist, including that qualifying patients must have a prognosis of six months or less to live and be capable of making their own decisions. Compassion & Choices director of legal advocacy Kevin Diaz argues that if Gorsuch is confirmed, the Supreme Court might move to block access to physician aid-in-dying in the states that have adopted it or impinge on building interest nationwide.

On Gorsuch, it's evangelicals vs. atheists

In 1997, when the Supreme Court rejected arguments for a constitutional right to assisted suicide, the justices signaled that such policies were best left to the states. At the time, Oregon was alone with its Death With Dignity law. In 2006, the court invalidated an effort by the George W. Bush administration to use federal controlled-substances law to prevent Oregon physicians from providing drugs to terminally ill patients.

Since then, Vermont, Montana, Washington, California, Colorado and the District of Columbia have taken steps -- through ballot initiatives, legislation or court action -- to allow physician assistance in dying.

The Gorsuch principle

In his book, Gorsuch explores the legal and moral arguments from both sides and urges a perspective "grounded in the recognition of human life as a fundamental good."

Gorsuch, who attended a Catholic prep school in Washington and as an adult joined an Episcopal church in Boulder, Colorado, describes his views as secular.

In the book, he acknowledges help from Catholic legal philosopher John Finnis, a law professor at the University of Oxford and at the University of Notre Dame. Gorsuch studied with Finnis while at Oxford on a prestigious Marshall Scholarship.

A far more provocative writer, Finnis has inveighed against abortion rights and same-sex relationships. In 2015, he was among a group of scholars who filed an amicus curiae brief to the Supreme Court opposing gay marriage on moral grounds.

Finnis did not respond to email and telephone requests to talk about his work with Gorsuch. In an article in The Guardian last month about his possible influence on the Supreme Court nominee, Finnis reportedly declined to comment by saying: "I have resolved not to say anything to anyone at all."

In Gorsuch's book, he addresses briefly the more controversial issue of abortion, writing at one point, "Abortion would be ruled out by the inviolability-of-life principle ... if, but only if, a fetus is considered a human life. The Supreme Court in Roe (v. Wade), however, unequivocally held that a fetus is not a 'person' for purposes of constitutional law."

On his main subject, Gorsuch refers to the personal turmoil experienced by family and friends of people with difficult illnesses and draws a different lesson than, for example, Judge Posner.

"We have all witnessed," Gorsuch said, discussing the fundamental value of life, "family, friends, or medical workers who have chosen to provide years of loving care to persons who may suffer from Alzheimer's or other debilitating illnesses precisely because they are human persons, not because doing so instrumentally advances some other hidden objective."

Posner, a 1981 appointee of President Reagan to a Chicago-based US appeals court who has written for decades on physician-assistance in death, focuses on the costs to an individual from such suffering and asserts that while modern medicine can extend life it may not improve it.

Friendly committed suicide at age 82, a year after his wife died, as his eyesight was failing and other health problems mounting. His 1986 death was reported as a suicide at the time but a 2012 biography of Friendly by David Dorsen elaborated on his fears of eventually becoming dependent and plans for suicide.

"Had he been able to pre-arrange a painless physician-effected death to occur when he reached a specified stage of disability," Posner wrote soon after the 2012 biography was published, "he would not have killed himself when he did."

In a recent interview, Posner said of Friendly: "He was very depressed. He was not in good health. He was having serious vision problems. I think he felt he didn't have much to live for."

Posner declined to comment on Judge Gorsuch or his writings because of the pending nomination.

Gorsuch suggested that physicians focus on helping patients with the depression that might generate suicidal thoughts.

"(O)ught doctors handing out suicide prescriptions at least pause to consider their own latent assumptions about the motivating forces behind patient requests?" he wrote. "Should they prod a bit more carefully to see whether depression is at play, or perhaps refer patients to doctors with some expertise in the area?"

Laws vary but generally require terminally ill patients to make two oral requests to a physician, at least 15 days apart, then a written request. Physicians may then prescribe a lethal medication for the patient to take when desired. Data collected in Oregon show that patients sometimes (about 18% in 2016) do not take the medicine and die of other causes.

Senate Judiciary Committee scrutiny

During Gorsuch's 2006 nomination hearings for his current seat on the US Court of Appeals for the 10th Circuit, some senators asked whether he could rule objectively on legal issues related to aid in dying.

Responding to Sen. Lindsey Graham, a South Carolina Republican, Gorsuch said "my personal views ... have nothing to do with the case before me. ... The litigants deserve better than that, the law demands more than that."

Democratic Sens. Patrick Leahy of Vermont and Ron Wyden of Oregon followed up in writing, asking whether his opposition to assisted suicide would prevent him from ruling impartially. "A judge's personal policy preferences and politics have no place in the process of deciding cases," Gorsuch wrote.

In the past, end-of-life questions have been asked at Supreme Court nominations but generated limited discussion.

In 2005, when Feinstein asked Roberts a question on the issue, the future Chief Justice spoke generally about balancing rights under the Constitution's guarantee of liberty. He declined to go further because of the then-pending case testing federal intervention in Oregon's law.

Then-Sen. Joe Biden, a Delaware Democrat, picked up a line of questioning relating to "right to die" issues, telling Roberts, "just talk to me as a father."

Roberts rejoined that he was "not going to consider issues like that in the context as a father or husband or anything else. ... I will not take to the court whatever personal views I have on the issues."

Roberts, confirmed as chief justice in September 2005, four months later dissented when the court majority ruled in January 2006 that the attorney general could not block Oregon doctors from prescribing drugs to terminally ill patients who wanted to end their lives.

Sens. Feinstein, Leahy and Graham were still finalizing their questions for the hearings that begin next Monday, according to their respective spokesmen.

State activity continues against cultural backdrop

Along with legislation and ballot initiatives for legalized aid in dying, proponents are also challenging state policies that consider the practice unlawful under "suicide" and "assisted suicide" statutes.

Kathryn Tucker, a longtime advocate of aid in dying and now director of the nationalEnd of Life Liberty Project, says a dying patient's request for drugs to speed death differs starkly from suicide. It's a claim at the heart of a pending challenge to New York's ban on assisted suicide.

The New Mexico Supreme Court rejected similar arguments last year, relying on its state constitution and asserting it was also limited by the 1997 Supreme Court against a general right to physician-assistance in death.

In Vermont, a federal district court is considering a claim brought by physicians who say their religious beliefs do not permit them to counsel patients about the right in Vermont to seek medication to end their lives. Alliance Defending Freedom, a Christian group based in Arizona, is representing the physicians.

These state lawsuits have generated broad interest from national groups on both sides, against the backdrop of an aging population and contemporary medical advances.

"There are few Americans who haven't seen a difficult death," says Tucker. "It is because our medical system has succeeded in forestalling death. That can be a great benefit. But it's a double-edged sword. It can leave patients feeling trapped in unbearable" medical situations.

Opponents worry about patients feeling pressured.

Diane Coleman, president of Not Dead Yet, which joined other disability-rights groups in an amicus curiae brief in the New York case, said in a statement, "In an aging society where elder abuse is a growing problem, elders too often face economic or other pressures to get out of the way, whether those pressures come from the health care system or, sadly, from family."

The brief emphasized that "a disabling condition does not inherently diminish one's life" and that a prognosis of a "terminal condition" can be uncertain.

Coleman said Not Dead Yet had no position on the Gorsuch nomination.

A Gallup poll last year found that 69% of the people surveyed believed patients with incurable diseases should be able to end their lives with help from a physician. The survey, taken after California had adopted its law, reflected rising support nationwide. Gallup also pointed to the persuasive effect of Brittany Maynard's experience and advocacy on California voters.

Diaz of Compassion & Choices, which worked with Maynard to spread her story, asserts, "More and more people are talking about what they want at the end of life. ... The more they talk, the more you'll see acceptance about medical aid in dying."

Part-Timers Getting Full-Timer Benefits

Due to the ACCA regulations surrounding FTE calculations, there can be some issues when determining how to treat part-time employees when it comes to benefits offerings. Many companies offer some form of coverage to part-timers but, as this article shows, sometimes a case can be made for investing in part-time employees from a benefits perspective.

Why more employers are offering part-time employees full benefits

Paul Tanguay began his career with UPS 32 years ago, loading trucks part-time. Today, he is UPS’s global director of recruitment strategies.

This is not unusual in an organization that hires from within and where, on average, six out seven full-time drivers have been promoted from the ranks of part-timers who make up about 60% of the UPS workforce.

“What attracted me to UPS at the time was that even though the location where I worked didn’t have a tuition assistance program, they paid competitively and had a great benefits package,” Tanguay says. “Although I was a college student, at a very young age I was also engaged to be married, so I was looking for somewhere very stable to start my career.”

UPS is not alone in providing great perks to part-time employees. Other companies such as Penguin Random House, financial services firm Baird and law firm Perkins Coie give remarkably consistent responses when asked why their companies provide comprehensive benefits for part-time employees. They are betting that offering full-time benefits to part-time workers will build employee loyalty, boost presentism and stem the tide of job hopping among their workforce. And it’s not just part-timers asking for the benefits: full-time workers who want to shift to part-time work also are asking for the benefit coverages in order to achieve a positive work-life balance.

“In today’s tough labor climate, we want to make sure our workforce represents the community and is able to function on a day-to-day basis and be successful,” Tanguay says. “By offering these benefits in addition to fair hourly compensation, we differentiate UPS and attract a greater variety of applicants.

About half of UPS’s part-time hires each year are students, but the company’s 24/7 operation also attracts parents who choose to work off hours, independent business people interested in supplementing their income and retirees looking to earn additional cash.

Part-time employees must work for the company for one year to become eligible for benefits, and must work at least 225 hours in each subsequent three-month period to remain eligible. “Our typical part-timer works between 20 to 22 hours a week, so obtaining the hours needed to be benefits eligible is very achievable,” Tanguay says.

Most employees are unionized, and part-time union employees are eligible for healthcare, short-term disability, life and AD+D coverage under whatever multi-employer health and welfare fund pays their benefits. About 65 funds in the U.S. provide coverage to UPS union employees, and both full and part-time benefits are paid for via UPS contributions.

“We pay the contributions to Teamsters and they administer the program. As a result, the out-of-pocket costs for our employees tend to be limited to deductibles or co-pays,” Tanguay explains.

In addition, part-time employees are eligible for profit sharing and a stock purchase plan. The retirement plan for non-union employees is closed, but the UPS defined benefit pension plan covers part-time union members and remains open to new participants.

Among the other programs that are attractive to both part- and full-time employees is the “earn and learn” and tuition assistance program, which offers a $25,000 lifetime benefit to employees taking courses toward a degree at an accredited brick-and-mortar or online college or university. “We don’t require that the classes they take or the degree that they are working on be directly related to their job or our business at UPS,” Tanguay says.

By the numbers

ERISA attorney Carol Buckman says that though a repeal of the Affordable Care Act by the Republican-led Congress may be imminent, the ACA currently defines full-time employment as 30 or more hours per week and requires that employers with 50 or more full-time-equivalent employees provide health insurance to at least 95% of their full-time employees and their dependents up to age 26.

And when it comes to ERISA-qualified programs like 401(k) plans, Buckman notes that companies must cover employees who complete 1,000 hours of employment in a 12-month period. Employees cannot be excluded simply because they are part-time and not expected to meet the threshold in the eligibility period. However, she says, “This does not necessarily mean that any employer matching has to be at the same levels for full- and part-time employees.”

Data from the 2016 Mercer National Survey of Employer-Sponsored Health Plans reveals that 51% of large employers (500+ employees) offer health insurance coverage to part-time employees who work an average of 21 hours a week. Sixty-three percent begin coverage for newly hired employees at the date of hire, while 37% have a median waiting period of 60 days.

“Some part-timers are always going to fall somewhere below 30 hours,” says David Frazzini, a partner in Mercer’s San Francisco office. “I think 20 hours is a pretty common threshold that is used by employers.”

While it has been suggested that the 30-hour ACA threshold has been an incentive for certain employers to reduce part-time working hours so they don’t have to offer health insurance coverage, Frazzini says this has not been the case in his practice. But, he notes, “I think there is a lot more discipline now about getting the classifications right to make sure part-time employees are really part-time and full-time employees actually meet the definition.”

It is not surprising that UPS — where more than half of the workforce started out as part-timers — provides rich benefits to employees working less than full-time hours. Nevertheless, there are many notable employers with relatively few part-timers who extend similar or the same benefits to people who meet their minimum hours criteria.

Penguin Random House builds community

One example is publishing company Penguin Random House, which has approximately 5,000 employees in the U.S., excluding temporary workers. Only 1.1% of the company’s employees are part-time benefits eligible. Depending upon the facility, 35 or 40 hours per week are deemed to be full-time employment.

Page McInerney, Penguin’s vice president of HR, explains that benefit-eligible part-timers get all the benefits and perks that full-time employees enjoy, including comprehensive medical, prescription drugs, dental and vision coverage, life insurance, 401(k) match, short-term and long-term disability benefits, and voluntary benefits.

Employee contributions toward health benefits are based on salary tiers, so employees pay more or less depending on how much they earn. Other “soft” benefits, such as personal days, holidays and various other leaves, are pro-rated based on each individual’s scheduled hours.

Why does Penguin Random House provide such robust benefits for its small contingent of part-timers? “At PRH we are a community, and offering comprehensive benefits to our part-time colleagues is another way we can nurture a community feeling and team culture across the country,” McInerney says.

Best companies to work for

The list of 2016 Fortune 100 Best Companies To Work For reveals that most of the companies ranked in the top 40 that employ part-time workers offer them a benefits package. That said, eligibility and program details vary significantly.

Take law firm Perkins Coie, which is ranked 39th on the list. Though its headquarters are in Seattle, the law firm’s 2,180 employees work in 16 offices across the country. Eighty-seven percent of lawyers and support staff are full-time. “The reality is that we don’t generally hire people part time. They request a move to part time,” says Darrin Emerick, chief personnel officer. “It’s a way to retain our highly valued people, whether it be new moms who want to spend more time with their babies or older workers who want to slow down.”

The company pays 100% of healthcare coverage for employees who work 25 hours a week or more. Eighty percent of premiums are covered for people working 18.75 to 24 hours per week.

Part-timers also are eligible for a host of other perks and programs, including 401(k) matching at the same level as full-time employees, tuition reimbursement, paid maternity leave, back up child care and sabbaticals.

Emerick says the part-time benefits program helps the firm attract and retain the attorneys and staff it need to support its clients. “Specifically on the attorney side, allowing people to retain benefits when they work part-time has been truly valuable,” he says. “Otherwise we would have lost them.”

Financial services firm Baird is ranked sixth on Fortune’s list. Headquartered in Milwaukee, the company has offices in 30 states, plus satellite offices in the U.K., Germany and Asia. Ninety-seven percent of the company’s staff of 3,200 is full time.

To be eligible for healthcare benefits, employees must work 24 hours per week. Baird associates’ health insurance premiums are based on their compensation level, so associates who earn less pay lower premiums. Depending on the tier, Baird pays from 57% to 97% of each associate’s health plan premium.

Part-timers also are eligible for a 401(k) match, profit-sharing up to 4% of salary, college tuition reimbursement of up to $5,250, long-term care insurance and 16 hours of paid time off to volunteer. Other perks to make life easier for all employees include everything from fitness classes, a hair salon and a personal concierge service to Weight Watchers’ meetings.

But what really sets Baird apart is its program for paid interns. Interns who work only in the summer are classified as short-term interns. However interns who work full-time in the summer and part-time during the school year are viewed as long-term interns and get enriched benefits as a result.

Lisa Mrozinski, Baird’s director of total rewards, explains that long-term interns do not receive health insurance. However, she says, “they get paid holidays, and they can participate in our Baird Cares Day, where employees go into their communities to volunteer. They also get a $1,000 tuition reimbursement benefit, are considered for small year-end bonuses and become eligible for the 401(k) plan, plus employer matching if they work 20 hours a week.”

Why is Baird so progressive? “If employees are working part-time and adding value to the organization, we view them in the same way as any of our full-time associates,” Mrozinski says.
