Introduction- Know Your Rights

This is blog one of ten which will shed light on the different rights we have as Jamaican citizens, children and students of the Northern Caribbean University. For the next few weeks, I will be bringing to your attention the various rights that we have, the solutions to cases in which one’s rights have been infringed upon, the numerous organizations that assist in ensuring that our rights are not being breached, as well as the responsibilities/ expectations of police officers, citizens and non-citizens. To begin this series of blogs, we will define a few terms and broaden our knowledge of basic principles surrounding our rights.
What Are Rights?
Rights refer to social, legal or moral laws, principles and freedoms to which one is entitled after meeting certain criteria. For example, a person born in a specific country has met the requirements of being a citizen, and is therefore entitled to education (a basic human right) that country. Rights can be placed in either of the following categories:
Moral Rights
Human Rights
Natural Rights
Legal Rights - Civil, Economic, Political
Contractual Rights
Human Rights are the most common types of rights. According to Civil Service India, these are rights that are morally important to which every human being is entitled despite their ethnicity, gender, religion etc. For example, the right to life, the right to food, the right to an education.
Where Can Our Rights Be Found?
As Jamaicans, it is quite important for us to know our rights so that we may be able to discern when they are being violated. The rights of all Jamaican citizens are outlined in the Jamaican Constitution, specifically the Charter of Fundamental Rights and Freedoms, Chapter 3 Section 13.

Knowing Your Rights: As a Jamaican Citizen
There are certain rights that one is granted by virtue of being a citizen of a country. In Jamaica, there are many rights that citizens are entitled to that protects them from unfair or maltreatment. As stated in the introduction, such rights are found in the Constitution of Jamaica, under Chapter 3 entitled, “The Charter of Fundamental Rights and Freedoms”, section 13.
All the rights one is entitled to as per the constitution are as follows:
1. The right to life, liberty and security of person except in the execution of the sentence of a court in respect of a criminal offense of which the person has been convicted
2.The right to freedom of thought, conscience, belief and observance of political doctrines.
3.The right to freedom of expression
4.The right to seek, receive, distribute or disseminate information, opinions and ideas through any media
5. The right to peaceful assembly and association
6. The right to freedom of movement, i.e., the right (i) of every citizen of Jamaica to enter Jamaica; and (ii) of every person lawfully in Jamaica, to move around freely throughout Jamaica, to reside in any part of Jamaica and to leave Jamaica
7. The right to equality before the law
8. The right to equitable and humane treatment by any public authority in the exercise of any function
9. The right to freedom from discrimination on the ground of (i) being male or female (ii) race, place of origin, class, colour, religion, political opinions
10. The right to everyone to (i) protection from search of the person and property (ii) respect for protection of private and family life, and privacy of the home; and (iii) protection of other property and of communication;
11. The right of every child to be protected by virtue of being a minor, part of a family, society and the State
12. The right of every child who is a citizen of Jamaica, to public educational institution at the pre-primary and primary levels
13. The right to enjoy a healthy and productive environment free from the threat of injury or damage from environmental abuse and degradation of the ecological heritage
14. The right of every citizen of Jamaica to be registered to vote
15. The right of every citizen of Jamaica who is so registered, to vote in free and fair elections
16. The right of every citizen of Jamaica to be guaranteed a passport and not to be detained or deprived except by due process of the law
17. The right to protection from torture, or inhuman or degrading punishment or other treatment
18. The right to freedom of the person
19. The protection of property rights
20. The right to due process
21. The right to freedom of religion

Rights of a Jamaican Citizen
Hi Guys, Welcome back!
Last time, I gave a brief overview of what this blog would be about. As promised, today I will be bringing awareness to your rights as Jamaican Citizens.
To properly explore that area, we must first find out, What makes you a Jamaican Citizen?
In simple terms, a Jamaican citizen is a legally recognized subject or national of Jamaica with guaranteed rights, privileges as well as duties and responsibilities. Under Chapter two of the Jamaican Constitution, persons born in Jamaica and persons born outside Jamaica of Jamaican parents have an automatic right to Jamaican citizenship. Citizenship may also be acquired through Marriage or naturalization.
Now that we know what makes you a citizen, What are some of the freedoms you are entitled to?
According to Chapter three of the Jamaican Constitution, all citizens are guaranteed the right to:
Protection of right to life
Protection from arbitrary arrest
Respect for private and family life
Protection for privacy of home and property
Protection of freedom of conscience
Protection of peaceful assembly
Protection from discrimination
Protection of the expression
Rights to fair trial
Right to vote
Freedom of worship
Freedom of movement

Dear Mr. Antonio Guterres, Rapidly changing at the science, cominication and transportation are starting to begin constraint all countries security, their citizens and their administration in the world. Also, religions and ethnic terrorism are still going to evolvement theirself with using over given materials. Terrorism will be enormously danger for humanity in this century. Unfortunately, non secular state system and shortsighted politician are causing to expansion of terrorism. People, whom are living under life and economical trouble in any country. They want to be fleeing to other devolepment countries to contunie their life. But, unfortunately cultural exchange, different life style and habits are making diffuculty for immigrant and local people to live together. This problem is triggering to ultra-natiolaist movement at those countries. All these negative factors are causing chaos on worldwide. And, chaos is creating unhappy people all around the world. Therefore, no country nor leader could be say that thats problem is mine. This is a global affair and affects all world. In this sense, UN must be reconfigured again. Because, not be beneficial now for the peace of world with currently stuation. First of all, formation must be as same as state system under the Secretary General of UN. subsidiary departments must be constructed as same as Counsel of ministers and might be administrat by visionary leader or Wiseman of the world. This evolution must be supporting with fundemental law and a strong army. As we look at the administration's system of UN. Establishment of departments are enough to give good services. But, that must be strong for implementation of theirs judgements. They must be make their decision and keep to inexcution. NATO will be liquidated and to attached under the command of UN. Within this context UN will be constituted their chain of command. Needing based personnel will be hired from member states. And all member countries must be yielded to UN command apr. 10 % of their military personal. Expanse payment will be welcomed from member state according to their gross national product. All member state's border must be guaranteed by UN. All nucluer and chemical weapons must be destroyed under the UN governance step by step in the world. And those weapons manufacturing and trade must be chastised by UN court under the name of crime against humanity. Also, human traffic and drug trade must be castigating under the same charging. As I have pointed out above; for a habitable world, laic or secular statement is so important at the state administration. Therefore UN must be sporting this system and all member of UN must be administrat under laic democratic systems. All religion must be keeped between human and god. All members of UN hold off religions from their government under the control of UN. Unfortunately within recently years the quality of politics is falled down in worldwide. Visonery wisemen have been abdicated from politic areas and come into its own places shortsighting and ignorant politicians. Because of this, step by step the world is going to deeply chaos. Now days mostly countries in the world do not need any other enemies. Because their enemies are inside of them. Someones are still governing the states, someones are weiting behind of politic gate to enter in. Unluckly in thouse countries the education system is not good and mostly of populations are ignorant and people are not know, what means citizens, citizenship and citizensright. Therefore shortsighting politician are using the democracy to come the power. Letter on they are trying to build of authoritarian government. Therefore the administration system, ballot period at the election and politic stance of member states must be heaving under control by UN. All countries in the worldwide will be oppressed and encouraged to be member of UN. Within this context will be using for thouse countries embargo and isolation by UN and it's members. The stability is so important for the bigeste countries in the world. In this sense, USA will be have social state statue to bring equality for their citizens at the education and the healt systems. Students depitum are going up more than $ 1 billion. Besides also they solve their problem with FED and must be started to coinage with self. Because, the dept to the FED is step by step going to unpayable position. What would be later on? If repayment will be as much as impossible to pay. The President of US will be invited FED shareholders to the party at the White House and killed them as same as Philip the Fair had been done before to the tampel chevaliers. President Yeltsin had been scarred that communism would be come back to power again. Therefore he gave all fabrics and mining site to some oligarchs. Those richness are belongs to russian citizen's. Therefore these are will be given to statutory owner back. Otherwise, the real democracy is couldn't come to Russia. China's government must be moved friendly for all ethnic groups. As I have pointed out above, education play too much roles for a habitable world. That must be use common educational systems basically in member states of UN. For sure each countries will be added their history, religion and social awareness in. But, vindictiveness and enemies wouldn't be within. This common education programs must be prepared and controlled by sellected and specialist academician and pedogogue. The world is ours, we must be take care about. In this sense, UN will be communicated with scientist and university about of climate changing and environmental control. According to their suggestion and rapport, they must be do work schedule. Social, nature and political activist are so important for a peaceful world. Therefore they would be never let to fairness of shortsighting politician be alone. Their situation always will be controlled by UN staffs at the court of justice. Human population increase so fast in the world. Immediately must be started contraception in worldwide. The main problem at the immigration is war and chaos. But, unemployment also play too much role about. Therefore under the guidance of UN could be do somethings at thouse countries according to their potential. For example, personality I am in accommodation sectors. Also, I am writing some article about of tourism at the internet newspaper in Turkey. When I was investigated for one of my article, I was fixing that there were more than 20 millions handicapped people just in England and in Germany. I know that their overhaul and other expenses are too expensive in booth countries because of climate and personal. For example, If would be arranged any area in any warm climate countries in Africa to arraigned for them accomdation possibility with the cooperation of hospitals under the security of UN army. The expenses will be lower, besides local people will be heaving jobs. Also, those handicapped people spends money according to their requirements and enjoyment surround of this area. Within the economy of this country will be grow up. There must be a especially homland for UN community to better work environment. So then may could be build up a consensus with some countries to heaving an area about. So muny countries could be accepting that for their economical improvements. Also, all member and worker of UN might be having a special identity card from UN. With this they can pass from all borders. Breach of Rights

How can rights be breached?
As citizens our rights or privileges are not absolute, and as a result, each right bears certain limitations. Rights are equally available to all persons and should be respected; however, in certain situations they may be suspended, revoked, taken away and/or become susceptible to breaches and violations. According to the Charter of Fundamental Rights and Freedoms, chapter 3 section 13 subsection 9, one’s right to freedom of movement may be restricted when dealing with situations of public emergency or in the event of a pubic disaster. This is currently evident in Jamaica where curfews and no movement days are implemented to restrict movement in an effort to minimize the spread of the Corona Virus. An individual’s rights may be suspended in the event of a war, catastrophe, or threat, and may be undermined an effort to protect the public’s interest.

The aforementioned exceptions and restrictions are in place for the public’s safety; on the other hand, breaches of rights refers to the blatant disregard and violation of a citizen’s rights by others especially law enforcement officials. This is a pressing issue especially in this covid-19 pandemic where law enforcement officers abuse their power and resort to force. Examples of how police officers breach our rights include:
•subjecting citizens to violent and inhumane treatment during their interactions with the criminal Justice system (police brutality)
•using an individual’s social or racial background to determine the verdict,
•by protecting the individuals or organizations that have breached our rights, because of their level of power and authority.

How can this be remedied?
Once an individual believes that their rights are being violated or threatened, they may make a formal complaint against the offender or organization responsible for the breach, take legal action, and apply to the Supreme Court (or on appeal to the Court of Appeal) for enforcement of rights and for these breaches to be rectified. There are many agencies and organizations that can assist citizens whose rights have been breached, and this will be highlighted in the next blog post.
