DUMAGUETE, NEGROS ORIENTAL -- The Commission on Elections (COMELEC) announced the cancellation of special elections in the 3rd District of Negros Oriental. This decision comes in the wake of House of Representatives' Resolution No. 154, was reportedly passed on Tuesday (November 7th, 2023 -- Dumaguete local time), and marks a departure from the initial plans to hold these elections. The decision to cancel the said special elections was not to be potentially rescheduled within the 2025 Philippine elections.

COMELEC's decision to cancel these elections will likely have significant implications for the 3rd District of Negros Oriental's political landscape. As of this moment, it remains to be seen how this decision will impact the constituents of the aforementioned district.
"Special Election in the 3rd District, province of Negros Oriental is deemed recalled and abandoned upon passage of House Resolution No. 154. Therefore, in recognition the legislative power of congress, the law department and the en banc decided to cancel the conduct of the special election", according to George Erwin Mojica Garcia, whose a chairperson of COMELEC said.
Pertaining to Resolution No. 154 of the House of Representatives, it has now cancelled the special elections for the said 3rd district region of Negros Oriental. These have come as a bolt over the heads of the regional politics.

The lower chamber cited three (3) reasons for their consideration of the special elections. First is the pending disqualification cases in Central Visayas against winners in the recent barangay in youth council polls. Continuous protest of Teves Jr. against his expulsion and the possible negative impact of the special elections on the peace and order situation in the area. The said H.O.R. resolution signed by House Speaker and founder of Philippine Collective Media Corporation (PCMC), who owns many FM radio stations of Favorite Music Radio (FMR) named Ferdinand Martin Gomez Romualdez did not elaborate particularly on the said negative impact.

  President Ferdinand R. Marcos Jr. has urged the Commission on Elections (Comelec) to immediately act on the several electoral reforms proposed during the preparatory consultations with various stakeholders. During his speech at the first-ever 2023 National Election Summit at the Sofitel Philippine Plaza in Pasay City, he said, “It is encouraging to know that prior to this summit, the preparatory consultations with various stakeholders in the public and private sectors were conducted nationwide. From these pre-summit meetings, it has come to the attention that several reforms in the election process must be made.”   “And given these findings, let us take these matters seriously as the outputs obtained from these activities are indisputably significant. We must act on it decisively and enforce concrete measures to turn our plans into reality.”   The chief executive also urged the Comelec to “open yourselves to the recommendations of our experts and Filipino voters, who are partners in ensuring free, orderly, honest, and credible elections.” “As a democratic and republican government, we derive our power from the people, we recognize that sovereignty is exercised by its citizens through suffrage. On this note, I underscore the COMELEC’s critical role as the guardians of our people’s sovereign will in ensuring the integrity of the electoral process,”   President Marcos said, noting the poll body must ensure “accurate and unalterable” results to maintain the sanctity of the elections and people’s trust. With the advent and the use of modern technologies, the President said the government can implement positive reforms and make election result transmission faster and maintain its accuracy. OPINION: Kaduda-dudang Pagkatao, Paano Nakatakbo?

Isa sa mga batayang kwalipikasyon sa pagtakbo sa anomang posisyon sa pamahalaan ay ang pagiging isang Pilipino. Mahalagang kwalipikasyon ito dahil sa isang bansang demokratikong gaya ng Pilipinas, kinikilalang higit na makapagsisilbi sa taombayan ang isang pinuno na maituturing na kababayan. Ngunit, ano na lang ang mangyayari kung ang nasa posisyon ngayon sa gobyerno ay hindi isang Pilipino? Kwinekwestyon ngayon ng Senado ang pagkakakilanlan ni Mayor Alice Guo ng Bamban, Tarlac kung siya ba ay isang lehitimong mamamayang Pilipino o isang mamamayan ng Tsina dahil sa mga kahina-hinalang impormasyong natagpuan tungkol sa kanya.
Gaya na lang ng pagkuha ng trabaho sa kumpanya kung saan may mga istriktong kwalipikasyon bago makapagpasa ng job application, mahigpit din ang proseso sa pagkuha ng posisyon sa gobyerno kung kaya’t may mga kwalipikasyon din na dapat makamit bago makapagpasa ng Certificate of Candidacy (CoC) sa Commission on Elections (COMELEC). May pagkakaiba man sa age requirement batay sa tinatakbuhang posisyon, hindi mawawala sa kwalipikasyon na dapat mamamayan ng Pilipinas ang tatakbong kandidato. Sa pagtakbo para sa posisyon ng alkalde, ang kandidato ay dapat hindi bababa sa dalawampu’t isang taong gulang; isang rehistradong botante; at nakatira nang hindi bababa sa anim na buwan sa tinatakbuhang lungsod, probinsya, o munisipyo bago magpasa ng CoC. Trabaho ng COMELEC na pangasiwaan ang eleksyon at siguraduhing kwalipikado ang mga tumakbong kandidato sa mga posisyon. Ngunit anong dahilan at nakalusot sa COMELEC ang kahina-hinalang pagkatao ni Alice Guo?
Noong ikapito ng Mayo, nagkaroon ng pagdinig sa Senado kung saan kinuwestiyon ni Senador Risa Hontiveros ang kredibilidad ng Mayor ng Bamban, Tarlac na si Alice Guo. Ang mga tanong ukol sa kanyang karanasan sa edukasyon at kanyang personal na buhay, gaya ng kailan at saan siya ipinanganak, ay hindi niya nasagot nang maayos.
Ayon kay Alice Guo ay homeschooled siya magmula sa elementarya hanggang sa highschool ngunit nang tanungin sa kanyang naging guro, hindi niya ito nasagot kaagad. Sa sumunod na hearing pa noong Mayo 22 niya nabanggit ang pangalan ng naging guro niya. Ayon sa kaniya ay si Miss Rubilyn ang nag-iisang gurong nagturo sa kaniya mula elementarya hanggang magtapos sa hayskul, ngunit walang mahagilap na school records niya sa mga panahong ito, maging hanggang kolehiyo.
Isa sa mga madaling patunayan ng paninirahan sa Pilipinas ay ang school records. Kung makikita pa lang sa mga dokumento na dito nag-aral ang isang kandidato, maaaring masuportahan nito ang kanyang pagiging Pilipino dahil kahit ang mga paaralan ay tinitiyak din ang nasyonalidad ng kanilang mga mag-aaral sa mga school records nito.
Magulo rin ang pagkakalatag ng kanyang birth certificate. Ipinanganak umano siya noong 1986, ngunit ayon sa kaniya ay nakuha niya lang ito noong 2005, noong siya ay labinsiyam na taong gulang na. Nakalagay sa birth certificate niya na kasal ang kanyang nanay na si Amelia Leal sa kanyang tatay na si Angelito Guo, ngunit walang makitang record sa Philippine Statistics Authority (PSA) ng kanyang nanay.
Sabi ng Philippine Statistics Authority (PSA) director of legal services na si Eliezer P. Ambatali, “Maaari po na hindi existing ang tao.”
Liban sa magulong identidad ng kanyang nanay, hindi rin nagtutugma ang pagkamamamayan ng kanyang tatay. Binanggit ni Guo sa senado na Tsino ang kanyang tatay at may Chinese name na “Jianzhong Guo,” ngunit ayon naman sa birth certificate ng kanyang tatay ay isa siyang Pilipino. Nakalilito at kahina-hinalang hindi nagtutugma ang kanyang mga sinasabi sa mga dokumento.
Ang birth certificate ay naglalaman ng ating personal na impormasyon at ito'y nagpapatunay na tayo ay isang mamamayan ng Pilipinas. Bilang isa sa mga batayang dokumento ng pagkakakilanlan, ang birth certificate ang isa sa mga unang hinihingi kapag papasok sa paaralan o trabaho. Kung kaya't mahalaga na tunay ang mga impormasyon dito dahil dito nakabase ang ating pagkakakilanlan sa legal na konteksto at pruweba ito ng ating identidad. Ang pagsagot ni Alice Guo sa senate hearing ay nagpapahiwatig ng malabong identidad at malabong pagkatao niya dahil hindi tugma ang mga inihayag niya sa birth certificate na meron siya.
Ayon pa sa kanya ay lumaki siya sa farm, na pagmamay-ari ng kanyang tatay, at nagtrabaho siya rito magmula nang siya ay labing-apat na taong gulang ngunit wala siyang matandaan sa kanyang pagkabata. Lagi niyang dinadahilan na wala talaga siyang maalala at hindi niya raw alam. Maliban dito ay hindi niya kayang makapagsalita ng Kapampangan, ang dominanteng lenggwahe sa Bamban. Kaduda-dudang wala man lang siyang alam na salita sa Kapampangan gayong sinasabi niyang doon siya ipinanganak at lumaki. Hindi kapani-paniwala ang kanyang pahayag dahil kung lumaki tayo sa isang pamayanan, likas na matutuhan natin ang wika rito dahil ito ang gagamitin natin sa pakikipag-usap. Mula sa kanyang pahayag si Guo ay ipinanganak sa Bamban kung kaya’t hindi ba’t kataka taka na hindi man lang niya nakuha at natutunang magsalita ng lengwahe ng mga taga-Tarlac?
Ayon sa Artikulo 4 ng Saligang Batas ng 1986, ang mga maituturing na mamamayan ng Pilipinas ay: yaong mga mamamayan ng Pilipinas sa panahon ng pag-aampon ng Konstitusyong ito; yaong ang mga ama o ina ay mamamayan ng Pilipinas; yaong mga ipinanganak bago ang Enero 17, 1973, na ang mga ina ay Pilipino, na pumipili ng pagkamamamayan ng Pilipinas sa oras na sila ay magka-edad ng ganap; at yaong mga naturalisado alinsunod sa batas. Sinasabi ni Guo na Pilipino siya dahil Pilipino ang kanyang magulang, ngunit paano iyon matutukoy kung ang tatay niya ay Tsino base sa birth certificate nito at walang record na nagpapatunay na nabuhay ang kaniyang Pilipinong nanay? Kahit nga ang mga memorya niya ng kabataan sa Pilipinas ay hindi niya maalala. Maaari ngang hindi lang naparehistro ang birth certificate ng kanyang nanay dahil nangyayari naman talaga ito lalo na sa mga mahihirap na mamamayan ng Pilipinas, ngunit bilang isang may posisyon sa gobyerno ay dapat kumpleto at totoo ang mga dokumento niya.
Bago naungkat ang kahinahinalang pagkatao ni Guo, ang inisyal na iniimbestigahan sa kanya ng Senado ay ang di umano'y pagkasangkot niya sa dalawang ni-raid na iligal na Philippine Offshore Gaming Operator (POGO) sa Bamban. Noong Pebrero 2023, ni-raid ang POGO hub na nagngangalang Hongsheng Gaming Technology Incorporated. Tatlong buwan matapos ma-raid ang Hongsheng ay napalitan ito ng Zun Tuan Technology Incorporated, na kasunod ding na-raid noong Marso kung saan nahuli ang mga kriminal na gawain gaya ng love at loan scam, human trafficking, at pag-hack sa government websites.
Ang kwestyonableng pagkatao ni Alice Guo ay maiuugnay natin sa kanyang isyung kinasasangkutan. Kung sa mismong pagiging Pilipino ay kaduda-duda na ang kanyang mga sagot, hindi kataka-taka na kahina-hinala rin ang ang kanyang paliwanag sa pagkakasangkot sa mga iligal na gawain sa bansa. Kinakailangan suriin ang mga impormasyon ng bawat kandidato upang maiwasan ang mga posibleng problema sa paggamit ng kanilang posisyon kapag sila ang nanalo sa eleksyon. Maaaring ang pagtakbo ni Alice Guo bilang isang mayor sa Bamban ay isang paraan upang magkaroon ng kapangyarihan sa pakikisangkot sa mga kwestyonableng transaksyon.
Maraming kaduda-duda kay Alice Guo, mula sa personal na impormasyon, hanggang sa di umano'y pakikisangkot niya sa mga ilegal at kriminal na aktibidad. Ngunit bago mahantong sa ganito, nararapat lang na hingan ng pananagutan ang COMELEC. Trabaho ng COMELEC na suriin ang mga kwalipikasyon ng mga kandidato. Kung una pa lang ay tiniyak at sinuri nila ang ipinasang requirements ni Alice Guo sa kanyang pagpasa ng CoC ay hindi na aabot sa ganito. Malaking dagok sa kanila na may nakalusot na kandidatong nanalo nang may kwestyunable at kulang-kulang na dokumento.
Sa UPIS, ang mga kandidato sa pagtakbo sa posisyon ng lider-estudyante gaya ng Pamunuan ng Kamag-Aral (PKA) at Year-Level Organization (YLO) ay sumailalim sa masinsinang proseso bago pahintulutang tumakbo. Kinakailangang magpasa ng mga kahingian tulad ng rekomendasyon mula sa mga guro; dapat din ay walang naging disciplinary case sa kanyang buong pananatili sa UPIS. Tanging estudyante ng UPIS lang ang maaaring tumakbo sa mga posisyong ito dahil bilang isa ring miyembro ng komunidad ng UPIS ay naiintindihan niya ang kapwa niya estudyante at alam niya ang nakabubuti sa kanila. Katulad lang din ito na tanging Pilipino lang ang may karapatang mamuno sa Pilipinas. Malaki ang responsibilidad at kapangyarihan ng mga lider kaya kung nabigay ito sa hindi karapat-dapat ay maaaring mapahamak ang buong pangkat. Kung sa ating paaralan nga ay maingat sa paghahalal ng mga maglilingkod na lider-estudyante, dapat ay ganito rin tayo sa mas malawak na konteksto ng bansa. Dapat ang gobyerno ang nangunguna patungo sa pagsasala ng mga magsisilbi sa ating mga mamamayan upang ito ay mapunta sa mabubuting kamay at maging totoo ang paglilingkod sa atin.
Maliban sa gobyerno at COMELEC, malaki rin ang papel ng mga botante sa magiging kapalaran ng Pilipinas. Sa sitwasyon ni Alice Guo sa eleksyon noong 2022, nakakuha siya ng 16,503 boto at natalo niya ang kaniyang pinakamalapit na kalabang kandidato na si Kapitan Joy Salting, kung saan 468 lamang na boto ang lamang niya. Ipinapakita lang dito na ang bawat boto ay mahalaga kung kaya naman ay marapat lang na maging mapanuri sa bakgrawnd ng mga kandidato at seryosohin ang eleksyon dahil ang mga nanalong kandidato ay malaki ang impluwensya sa magiging buhay natin, maging eleksyon sa nasyonal na lebel o mas maliit na sakop gaya ng sa eskwelahan.
Bilang estudyante, ang bawat kilos at desisyon natin sa paaralan ay ating responsibilidad kaya naman kung tayo ay may iboboto o tatakbo, tandaan na ito dapat ay upang makatulong sa ating paaralan at hindi para lang magkaroon ng kapangyarihan. Bilang tatakbong kandidato, dapat sigurado tayo sa ating tatahaking plataporma upang matugunan ang pangangailangan ng ating mga kapwa mag-aaral. Bilang botante naman, maging mabusisi at pumili ng taong kaya ang trabaho na aakuin para sa ating paaralan. Lalo na sa darating na lokal at pambansang eleksyon sa 2025, ang pagiging mabusisi at mapanuri sa mga tatakbong kandidato ay marapat lang na gawin upang hindi mabigyan ng kapangyarihan ang mga mapang-abuso at tiwali. nagtitiklop ako ng damit ngayon and isa sa natiklop ko yung pair na sando and shorts ng pamangkin ko na babae [if moots tayo sa other soc med, nakikita niyo siya sa stories ko minsan] and na realize ko na ito yung gift ko sa kanya last new year 2023 and ngayon ko lang na realize na that was the time na im not expecting anything like allowance or additional income kasi i was left with no choice dahil nag resign ako last october 2023 due to my ptc and my dad cut off oyr child support without informing us kasi nag resign nalang siya for petty reason sa comelec. anw going back, narealize ko lang din na medyo luma na tignan yung regalo ko which means ginagamit niya talaga this is not the first time na nalabhan ko 'to [ako naglalaba talaga ng damit nila whenever sa amin sila naliligo magkapatid] and nakakahappy lang rin na despite them knowing na wala akong work or any income na aappreciate ko yung paggamit nila ng regalo ko. 🥹 and regardless tbh, kahit minsan walang wala ako i will find a side hustle talaga to make sure na mapunan yung love language na yon sa family or friends ko. apparently now, priority ko lang rin talaga yung upcoming monitoring ko. 🙏🥹
