Gender discrimination has been a crucial social issue in India for centuries. It can be seen across various sectors such as health care facilities, education, economic and political inequalities between men and women in India. To date, women do not have the complete freedom to make decisions in their life. Be it choosing partners for marriage or pursuing any degree, the choices are not with the women. Well, gender discrimination is not confined to choosing a partner or studying, the 2011 Census shows the child sex ratio among children of 0-6 years to be 918 girls for every 1000 boys in India. This statistic speaks for itself and demands urgent and efficient solutions to address the cause of gender inequality.
This is a multi-branched issue that primarily concerns women, but some argue that various gender equality studies place men at a disadvantage, or that it affects each gender equally. However, when India's population is examined as a whole, women are at a disadvantage in several important ways.

SEWA
The Self Employed Women’s Association- SEWA was established in 1972 by Ela Bhatt in Gujarat. Initially, a trade union, SEWA is now recognized globally. The main purpose of the organization is to strengthen women by giving them identity as informal workers. Along with that, they work on women workers’ rights and use non-violent methods of demonstrations like marches and meetups. It is the single largest Women’s organization in India that has built a supply chain of artisans, SEWA trade facilitation Centre company owned and managed by 50,000 women artisans. SEWA Bank, SEWA movement, SEWA Bharat are a few of its sister organizations. SEWA has 1.9 million women members proudly representing their rights, as of now.

Guria India
Guria is a non-profit organization that is dedicated to fighting child prostitution, second-generation prostitution, and sex trafficking in Northern India, and to achieving freedom worldwide. The NGO helps women get legal justice, provide counseling, and financial support. Due to the stigma surrounding sexual assault, it helps the victim with all the necessities to fight their case starting from filing an FIR to helping them collect evidence. ActionAid India
ActionAid India is part of a global federation and a full affiliate of ActionAid International. Gauravi is their 24×7 one-stop crisis center. It caters to domestic and sexual violence victims of any age including minor boys. They run a shelter home for women. The victims are also provided with counseling, intervention, legal help, medical help, as well as social rehabilitation. Here the victim women are not forced to take legal action against their will, but if necessary ActionAid India is always set with a legal team to do so.

Snehalaya
Established in 1989 by Dr. Girish Kulkarni, Snehalaya aims to eradicate inequality, cruelty, and discrimination towards women, and children. It provides education to children of sex workers and palliative care for people affected by HIV/AIDS. Their programs are primarily for women and children affected by poverty and the commercial sex industry. They rescue and rehabilitate trafficked and forced sex workers providing a safe haven, free counseling, legal aid, vocational training, and alternative work. The NGO also works for LGBT communities affected by poverty. Their special projects include producing sanitary pads, providing space to women to make and sell their art, and inculcating vital language skills.

North East Network (NEN), was established as part of the Beijing World Conference on Women, in 1995. It aims to empower communities and build skills of grassroots women leaders to generate awareness on violence against women; its causes and consequences. They provide counseling to address the issue of abuse & violence and spread awareness of the Domestic Violence Act. The counselors help build a network with appropriate government authorities and the agencies which put policy measures in place to address the abuse and discrimination faced by women. The horrific rape of Jyoti Singh in 2012 received international responses of disgust and is what prompted Dr. Kapoor to initiate action within India by forming Sayfty. Its mission is to educate and empower women & girls against all forms of violence through education and multiple self-defense workshops and campaigns to provide a platform and safe space to women and girls for open conversation against gender-based violence. Sayfty is all about bringing confidence to women and girls to protect themselves in the unfortunate and deplorable situation in which they encounter perpetrators.

Marital Rape is against married women rights in India

Spousal rape, also known as marital rape is a Penal Offence under Section 375 and 376 of Indian penal court.
According to the legal laws for women in India, non-consensual intercourse with your partner is marital rape.
“Non-consensual intercourse leads to human rights violation. It is the gravest form of domestic violence.”
In Section 375 of Indian Penal Code, the Offense is defined as: “A man is said to commit ‘rape’ if he penetrates his penis to any extent. Or applies his mouth into the vagina, urethra or anus of a woman or makes her do so with himself or any other person.” Under section 375 Spousal or Marital Rape is against the married women rights in India and it is punishable.
It states that the offence is liable only if the wife is less than 12 years. However, for the wife between 12-16 years of age, an offence is committed but with less serious punishment. Once the age is above 16 years, there is no legal protection given to the wife, in direct contravention of human rights regulations. For women under 16 years, it is essential to know their safety once they are aware of rights in spousal rape.
Does Marital Rape exist?
Yes, despite the fervent denial of government. Marital rape has been disintegrating the women’s rights in India built by social contract, love, financial deals and religion.
In current times, 10-14% of married women face marital rape. It mostly happens due to unawareness of their rights in spousal rape. On clinical test, every 1 woman in 3 or 1 woman in 2 suffers from marital rape. Sexual assault by spouse forms 25% of the total rapes. Women who tried to flee becomes the prime target. The Criminal charges on marital rape are prompted by acts of genital contact with mouth, anus, vagina; or insertion of objects forcibly without consent. Such acts are conscious acts of bullying, A show-off of men’s superiority over women.
Another trend that is changing the perspective for marital rape is the global conversion of the marriage as an institution. Its a transformation from reproduction to closeness as the main objective of marriage. And shows a huge shift in heterosexual relationships.
Marital rape is Serious
Like other forms of sexual violence, spousal rape may bring many physical and emotional consequences such as:
What Physical effects include: Injuries to the vaginal and anal areas, lacerations, soreness, bruising, torn muscles, fatigue, and vomiting
The Frequently assaulted and raped women suffer from broken bones, black eyes, bloody noses and knife wounds
Gynaecological effects include vaginal stretching, pelvic inflammation, unwanted pregnancies, miscarriages, stillbirths, bladder infections, sexually transmitted diseases, HIV, and infertility
Short-term psychological effects include PTSD, anxiety, shock, intense fear, depression and suicidal idealization
Long-term psychological effects include disordered sleep, disordered eating, depression, intimacy problems, negative self-images, and sexual dysfunction.
In support of legal laws for women in India, the Supreme Court has defined rape of a minor wife in very loud terms. The Supreme Court has delivered a landmark judgment suggesting the legislative formula to make child marriages void ab initio. The major wives have not been able to win the judicial consideration for the marital rape recognized by the top judiciary. The narrow and restrictive definition of rape, which allows for the marital exemption makes the definition of rape, a hollow statement. It provides escape-route for many perpetrators of sexual violence. The quest for justice remains unquenched under legal laws for women in India.
What does Media say?
A recent debate on a renowned news channel, consisting of 3 women panellists. It said Indian society is not ready to handle the outcome of criminalizing marital rape. Similar to those who defend Triple Talaq, are making our country fall under the category of 36 countries that could not criminalize marital rape and could not support married women’s rights in India.
How other countries are dealing with marital rape?
Poland in 1932 was first to have a law explicitly making a criminal offence. Since 1980 many common law countries have developed their legal system and have explicitly abolished marital rape in direct or indirect ways. These include South Africa, Canada, New Zealand, the US, etc.
What do our leaders say?
The Minister for Women & Child Development, Maneka Gandhi, supported the possibility of making marital rape a criminal offence by making this statement: “It is considered that the concept of marital rape as understood internationally cannot be suitably applied in the Indian context. Due to various factors like level of education, illiteracy, poverty, myriad social customs & values, religious beliefs, social mentalities. As they treat marriage as a sacred institutional practice.”
An example of jurisdiction considering marital rape as a criminal offence is one of India’s neighbouring country Bhutan. Bhutan defines ‘Marital Rape’ under Article 199 as: “A defendant shall be guilty of marital rape when forcefully engaged in sexual intercourse with one’s own spouse without consent.” Whereas Section 375 of the Indian Penal Code (IPC) considers Marital Rape when the wife is below 16 years of age. It is not considered a crime for the wife of more than 16 years of age.
As a result, Marital Rape victims have to consider an alternative route of the Protection of Women from Domestic Violence Act 2005 (PWDVA). This act outlaws Marital Rape and supports the victims while standing for the married women’s rights in India. Although the remedy is provided via civil rights for the offence. To put an end to the misuse of this law, the UN Women Association suggested the abolition of settling issues with paying price to the wife for the perpetrator of domestic violence, including spousal rape. Paying any prices cannot be a practice in defence to a domestic violence charge.
People who can be an angel for those suffering from Marital rape
NGOs and other voluntary organizations come with solutions to help victims overcome such situations. Majlis and Swaadhar in Mumbai, Sneha in Chennai, Vimochana in Bangalore are working on different women issues arising from domestic abuse. They are helping a lot of sufferers. Raising voices for the married women’s rights in India and especially standing for the rights in spousal rape.
A women’s counselling centre named Anweshi in Kozhikode provides meditation, resources, and counselling for women. It helps them recover from the dilemma and to give a new start.
These bodies have their contact details and registered offices with websites for online presence where help seekers can approach.
Talking about men, there are a few NGOs like SWAM (Social Welfare Association for Men) that work for the welfare of men. Looking at the rising issues in fraud complaints, we need to have some more of such organizations.
What can you do in an emergency?
How to fight for rights in spousal rape?
Go to a safe place, for example, the nearest hospital, police precinct, or someone’s home. Then immediately call for police protection and assistance as they are always ready to deal with domestic violence situations.
If the help doesn’t arrive on time, one can also call the women’s helpline number 1091 to help strengthen legal laws for women in India and to address issues fairly and transparently.
Take the next step, visit the local hospital emergency room for immediate medical care to diagnose for injuries. Also to prevent infections and pregnancy and consult with the experts for the collection of evidence to take action against rape assault.
In such situations, avoid urination, showering, combing or changing clothes before going to the hospital. Taking these precautions help collect evidence and stand up for legal laws for women in India.
As a long-term remedy supporting educational and prevention programs on local, state and national levels could be helpful. Since every woman must know her rights in spousal rape it is an action to strengthen married women rights in India.

Study On Transgenders
1.1 Efforts taken to improve the situation of transgenders in India National Legal Services Authority versus Union of India: The Supreme Court of India legalized the presence of transgender people in 2014, and allowed the legal creation of a “third gender” category. o The judgement also called for affirmative action in education, primary health care, and that transgenders be identified as beneficiaries of social welfare schemes.
NHRC in its report has pointed that center and state government have failed to implement SC guidelines in NALSA judgement or bring laws to improve lives of the transgenders. There is also no clarity on OBC status of transgenders".
1.2. Transgender Persons (Protection of Rights) Bill, 2016:
The Bill defines a transgender person as one who is partly female or male; or a combination of female and male; or neither female nor male. In addition, the person’s gender must not match the gender assigned at birth, and includes trans-men, trans-women, persons with intersex variations and gender-queers.
It prohibits discrimination against a transgender person in areas such as education, employment, and healthcare. It directs the central and state governments to provide welfare schemes in these areas.
Offences like compelling a transgender person to beg, denial of access to a public place, physical and sexual abuse, etc. would attract up to two years’ imprisonment and a fine.
It directs Central government to constitute a National Council for Transgender headed by the Union Minister of Social Justice and Empowerment.
It provides no child who is born a transgender can be separated from his parents except on a court’s order.
Every transgender person shall have a right to reside in the house-hold where parent or immediate family members reside;
a right not to be excluded from such house-hold or any part thereof;
a right to enjoy and use the facilities of such house-hold in a nondiscriminatory manner.
The Government shall take the following measures in relation to the transgender persons, namely: a separate HIV surveillance Centres;
to provide for medical care facility including sex reassignment surgery and hormonal therapy; pre and post sex reassignment surgery and hormonal therapy counselling;
bring out a Health Manual related to sex reassignment surgery in accordance with the World Professional Association for Transgender Health guidelines;
to facilitate access to the transgender persons in the hospitals and other healthcare institutions and centres;
provision for coverage of medical expenses by a comprehensive insurance scheme for transgender persons.
Issues with the bill: The Bill states that a person recognised as ‘transgender’ would have the right to ‘self-perceived’ gender identity. However, it does not provide for the enforcement of such a right. A District Screening Committee would issue a certificate of identity to recognise transgender persons.
The Supreme Court has held that the right to self-identification of gender is part of the right to dignity and autonomy under Article 21 of the Constitution.
The definition of ‘transgender persons’ in the Bill is at variance with the definitions recognised by international bodies and experts in India.
The Bill includes terms like ‘trans-men’, ‘trans-women’, persons with ‘intersex variations’ and ‘gender-queers’ in its definition of transgender persons. However, these terms have not been defined.
Certain criminal and personal laws that are currently in force only recognise the genders of ‘man’ and ‘woman’. It is unclear how such laws would apply to transgender persons who may not identify with either of the two genders.
It does not include the creation of institutions like the national and State commissions for transgenders, as well as transgender rights courts which were part of the earlier draft bill.
Tamil Nadu is frontrunning state in taking steps for development of transgenders by providing them education, identity cards and subsidized food and free housing. In a pioneering effort to address the issues faced by transgender people, the government of Tamil Nadu established a transgender welfare board in 2008 (West Bengal, Maharashtra, Chhattisgarh and Karnataka have also established the board). Kerala government brought the ‘State Policy for Transgenders in Kerala 2015’ to provide the “right to live with dignity.” Village and district panchayats and municipalities have been tasked with finding jobs, running special training and skills programmes and welfare projects.
A Transgender Justice Board has been established to address issues of discrimination and violence against them.

Child Protection laws need to be strengthened to address issues faced by transgender adolescents. The abandonment of child is a punishable offence under Section 317 of IPC. The age limit of child for this offence need to be increased to 18 years as abandonment of transgender children usually takes place between 12 and 18 years.
Care homes for transgender children should be setup to prevent exploitation of vulnerable transgender children.
Legally transgender cannot enter into a marriage, have spouse and setup their own family in India. They need to be provided right to marry and right to a family along with right of sexual orientation.
Government should take steps to provide housing facilities to transgender people.
Transgender people should get equal employment opportunities and every employer should be made to declare policy statement on trans recruitments.
Local governments need to play a positive and proactive role in removal of taboos and discrimination.
All treatment and other facilities should be provided at free of cost or at subsidized rates to all transgender patients in both government and private hospitals.
School and colleges need to play a supportive and encouraging role in providing education and value-system to Transgender.
Establishment of helpline for career planning and guidance, career opportunities and online placement system must be empowered.
Liberal credit facilities and financial assistance must be ensured to start up their career as an entrepreneur or businessman.

We have prayed and read the Bible together as well as other devotional books as a family, and it is the only reason why this family has stayed together, and the only reason why God has blessed our family and used our family in ministry all of these years. We read Ephesians 5 and 6 every morning as it relates to the role of each member of the family and how that we need to put on the whole armor of God to fight against the devil who is seeking to destroy our family and all Christian families, churches, and Christians. So, now after 30 years of doing this in our home, we are opening this up to others who don't have a family to pray with, who don't have a spouse, or who are single by choice, and to encourage all families who are still intact to go back to the family altar and have devotions together every morning. In these devotions, you may hear me deal with a temptation I'm facing in my life, you may hear me rebuke my wife about not doing what she should be doing, or you may hear me get on one of my children's cases about something they're doing. NEW DELHI, Oct 30 2017 (IPS) – Twenty-year-old Gogontlejang Phaladi of Mahalapye, Botswana is grateful she was never sent to a so-called “hyena” like scores of girls in neighboring Malawi were.
In a ritual approved by the community, a solo man (the hyena) would have sex with the adolescent girls of an entire village to “sexually cleanse” them so they would be considered fit for marriage.
“It makes sense to bring village and religious leaders in this conversation on violent crimes. After all, most of them are validated by the society and traditions.” –Gigi Phaladi
“I am so glad that in Botswana we do not have hyenas, but we face other forms of sexual violence such as stepfathers molesting stepdaughters and giving them HIV,” says Phaladi, founder of Pillar of Hope, a project that counsels, educates and trains local adolescents to tackle these challenges.
Violent Crimes Left Out
Last week, Phaladi attended the 11th World Congress on Adolescent Health which was held in New Delhi and focused on different health aspects of youth in the age group of 10-24. Speaking to an audience that included diplomats, bureaucrats, researchers, doctors and activists, Phaladi stressed that if the problems of adolescents were to be truly addressed, they had to be involved in the process.
Talking to IPS on the sidelines of the Congress later, Phaladi said that there were adolescents who experienced the most heinous and violent crimes across the world such as sexual assaults, trafficking, violent social norms and religious practices of violent crime.
Aside from HIV, beating, molestation, and sexual exploitation at schools by teachers – the challenges faced by adolescents were multiple. But the adolescents directly affected by the violence and crime were not included in the process to address them.
“You see, the laws in these countries are not firm enough to protect the adolescents from these crimes. So, it’s not just a health issue, but a governance deficiency and we need to talk about this at such events, from the adolescents themselves,” she said.
Unfortunately, violent crimes like sexual slavery, hyenas, molestation at schools or breast ironing – another crime reported widely from Western Africa – were missing from the Congress on Adolescent Health, as were issues of cross-border sex trafficking of adolescent boys and girls in Asia and community-backed forced prostitution of young women in India. Mental health was discussed as a generic issue, but rising cases of mental illness in militarized and conflict zones were also missing.
Lack of Studies and Data
A big reason behind this could be lack of any data, said Rajib Acharya, a researcher from Population Council of India, a New Delhi-based NGO researching population issues across India. Acharya just conducted a study of 20,000 adolescents aged 10-14 in two states of India – Bihar and Uttar Pradesh.
Presented at the Congress, the study showed, among others, severe levels of anemia among the adolescents. According to the study, 1.2 million and 2.8 million are severely anemic, respectively, in these two States.
But it took four months and a team of 50 researchers to interview the adolescents on nutrition and sexual and reproductive health.  Three weeks were spent on training the researchers, and analyzing the data took another four to five months. To generate data on multiple issues would mean multiplying the investment of this time, effort and money, Acharya reminded.
He also said that if the issue was complicated, sensitive and involved  traveling to conflict zones, it was less likely to be taken up for research as gathering credible date would be incredibly hard.
Forums like the Congress should ideally be utilized to bring on the hard-hitting issues related to adolescents,  said Thant Aung Phyo, a young sexual and reproductive healthcare activist in Myanmar. Pointing out the severe restrictions on adolescents in accessing abortion care, Phyo said, “The rigid government policies and social traditions that restrict the rights of adolescents need to be brought up and discussed at forums like this.”
Myanmar is currently caught in a human rights  disaster where over a million Rohingyas had been forced to flee their homes, taking refuge in neighboring countries including Bangladesh, India and Thailand.  The refugees included hundreds of thousands of adolescents who are living in trauma, poverty, fear and uncertainty.
Decribing their suffering as “unfathomable” and “unprecedented”, Kate Gilmore,  Deputy High Commissioner of the UN Human Rights Commission, says that refugee and migrant adolscents  across the world must be provided  free and regular healthcare as a right.
“Migrant adolescents must have access to healthcare without the fear of being reported, detained and deported,” Gilmore said.
Improving World’s Largest Adolescent Program
India, home to the world’s largest adolescent population (253 million), launched  an adolescent-specific program in 2014 – the first country in the world to do so on such a scale. Titled Rashtriya Kishor Swasthya Karyakram (KRSK), the program aimed at improving health and nutrition of adolescents besides protecting them against violence and injuries.
It is currently run in 230 of the country’s 707 districts,  but even after three years, there was  little data available on the program’s impact. The data presented at the event by the health ministry of India at the Congress only specified the facilities built by the government so far (700 adolescent health clinics) and services provided (training over 20,000 adolescents as peer educators).
However, the selection of the peer educators and the skills of the field workers had been questioned by experts from the non government sector.
“The peer educator component is the most controversial aspect of the program. The skill of the workforce on the ground is also questionable,” observed Sunil Mehra, one of the pioneers on adolscent health in India and head of Mamta Health Institute for Mother and Child which coorganised the Congress.
Agreed Rajib Acharya: “If we spoke with community level  health workers, we would see  that only 5 or 6 out of  every 30 or 40 knew what they were supposed to say or do to adolescent patients.”
On Saturday, however,  the ministry  announced certain changes  to improve the RKSK program and monitor certain services  Said Ajay Khera, Deputy Commissioner (Adolescent Health) at the minsitry, the government would “now make the program  promotion and prevention-centric and monitorable”.
The ministry would particularly monitor its  Weekly Iron Folic Supplementation (WIFS) programme  on digital platforms to tackle anemea among adolescents. A special toolkit called “Sathiya” was also launched at the World Congress on Friday for better peer education. The Toolkit—available both in print and online – focused on six broad themes of the RKSK such as integrated child health , sexual and reproductive health, injuries and violence, nutrition, substance abuse and mental health.
Leveraging the Traditional  System
There are other instituions and systems that  India and other countries could make better use of  to address the “wicked problems” faced by the adolescents, reminded  Anthony Costello, Director, Department of Maternal, Newborn, Child and Adolescent Health at the World Health Organization (WHO).
“Promoting greater interaction among adolescents of different age and sex is one. Involving parents in learning of the health issues of adolescents is another. Talking of difficult and disturbing issues like breast ironing, rape, trafficking is yet another. We need to use all of these,” Costello told IPS.
Gigi Phaladi added that traditioonal and religious leaders  also must be roped in to talk about adolescents. In Botswana, she said, pastors in churches were urged to talk of gender violence, HIV and other gender-based crimes.
“People were surprised to hear their religious leaders talk about sex etc, but they also started paying attention. The general feeling among people was ‘if the pastors do not feel hesitant to talk about these issues, why should we?’ So, it makes sense to bring village and religious leaders in this conversation on violent crimes. After all, most of them are validated by the society and traditions,”she said.
The three-day (Oct. 27-29 ) 11th Congress on Adolescent Health, which had 1,200 participants from 65 countries, concluded on Sunday.

The data presented at the event by the health ministry of India at the Congress only specified the facilities built by the government so far (700 adolescent health clinics) and services provided (training over 20,000 adolescents as peer educators).
However, the selection of the peer educators and the skills of the field workers had been questioned by experts from the non government sector.
“The peer educator component is the most controversial aspect of the program. The skill of the workforce on the ground is also questionable,” observed Sunil Mehra, one of the pioneers on adolscent health in India and head of Mamta Health Institute for Mother and Child which coorganised the Congress.
Agreed Rajib Acharya: “If we spoke with community level  health workers, we would see  that only 5 or 6 out of  every 30 or 40 knew what they were supposed to say or do to adolescent patients.”
On Saturday, however,  the ministry  announced certain changes  to improve the RKSK program and monitor certain services  Said Ajay Khera, Deputy Commissioner (Adolescent Health) at the minsitry, the government would “now make the program  promotion and prevention-centric and monitorable”.
The ministry would particularly monitor its  Weekly Iron Folic Supplementation (WIFS) programme  on digital platforms to tackle anemea among adolescents. A special toolkit called “Sathiya” was also launched at the World Congress on Friday for better peer education. The Toolkit—available both in print and online – focused on six broad themes of the RKSK such as integrated child health , sexual and reproductive health, injuries and violence, nutrition, substance abuse and mental health.
Leveraging the Traditional  System
There are other instituions and systems that  India and other countries could make better use of  to address the “wicked problems” faced by the adolescents, reminded  Anthony Costello, Director, Department of Maternal, Newborn, Child and Adolescent Health at the World Health Organization (WHO).
“Promoting greater interaction among adolescents of different age and sex is one. Involving parents in learning of the health issues of adolescents is another. Talking of difficult and disturbing issues like breast ironing, rape, trafficking is yet another. We need to use all of these,” Costello told IPS.
Gigi Phaladi added that traditioonal and religious leaders  also must be roped in to talk about adolescents. In Botswana, she said, pastors in churches were urged to talk of gender violence, HIV and other gender-based crimes.
“People were surprised to hear their religious leaders talk about sex etc, but they also started paying attention. The general feeling among people was ‘if the pastors do not feel hesitant to talk about these issues, why should we?’ So, it makes sense to bring village and religious leaders in this conversation on violent crimes. After all, most of them are validated by the society and traditions,”she said.
The three-day (Oct. 27-29 ) 11th Congress on Adolescent Health, which had 1,200 participants from 65 countries, concluded on Sunday.
