Lewd and Lascivious Battery to a Minor under 16, Use of a Child for Sexual Performance, Use of Internet to Lure a Child for Sexual Activity, Sending Harmful Information to a Minor, Two-way Communication to commit a Felony

In October 2019, Circuit Judge Kelvin Wells sentenced Robert Michael Moak to 35 Years in the Department of Corrections. The defendant was also ordered to pay fines, court costs and restitution, have no contact with the victim and to register as a Sexual Offender.

The 28-year-old defendant began chatting with a 14-year-old girl through a social media platform. Upon learning that the victim was 14, the defendant actively sought to have a sexual relationship with the child. The defendant was ultimately able to convince the child to sneak out of her home to hang out at a local spot that the child frequented. However, the defendant had more nefarious plans and provided the victim with drugs that impaired her judgment. Once the child became impaired, the defendant began to touch her in an unwanted manner despite the victim’s request for him to stop.

In the social power structure among inmates, those inmates who have committed crimes against children are considered the lowest -- only ranking higher than snitches -- and often are victims of crimes committed by other inmates.

While offenders are sent to prison as punishment and not for punishment, for some prisoners conditions and potential harm are very real if not dangerously so.

For their safety, these inmates may be administratively segregated away from other prisoners, often requiring 23 hours per day confinement and limited privileges for their own safety.

The dramatic difference between the two above photographs, dated 4 years apart, suggest that incarceration life for this inmate has been tough.
