Aviation workers declares seven-day ultimatum ahead of indefinite strike

Aviation workers’ unions, yesterday, warned of an impending indefinite strike action should the authorities fail to resolve the nagging non-implementation of Condition of Service (CoS), and other welfare-related issues in the next seven days. The unionists, at the end of their two-day warning strike on Tuesday, vowed to shut down the airspace to jolt the attention of the current administration. While the Minister of Aviation, Hadi Sirika, has since kept mum on the development and remained seemingly unperturbed by the disruptions, the Nigerian Civil Aviation Authority (NCAA) has been engaging in negotiation with the aggrieved workers. On the day-two of the warning strike yesterday, offices of aviation agencies remained shut nationwide as airports witnessed mild disruptions and low patronage of travellers. In Lagos, nooks and crannies of the domestic terminals witnessed a heavy presence of security operatives, forcing the unionists to lead a procession to the Murtala Muhammed International Airport (MMIA) corridors. Recall that the coalition of aviation workers’ unions made up of members of the National Union of Air Transport Employees (NUATE), Air Transport Services Senior Staff Association of Nigeria (ATSSSAN), the National Association of Aircraft Pilots and Engineers (NAAPE), the Association of Nigeria Aviation Professionals (ANAP), and Amalgamated Union of Public Corporation Civil Service Technical and Recreation Services Employees (AUPCTRE), recently bemoaned the non-implementation of the CoS about seven years after it was negotiated with the workers. They also rued the non-implementation of minimum wage consequential adjustments and arrears for the Nigeria Meteorological Agency (NiMet) since 2019, and the planned demolition exercise of all the agency buildings in Lagos by the Minister of Aviation for an airport city project, but without consideration for workers that will be displaced. ANAP Scribe, Abdulrarak Saidu, expressed disappointment that the aviation workers had been left hanging in the last eight years. “For eight years, the conditions of service were not implemented. This is because Sirika has usurped functions of the Governing Boards of aviation agencies to himself. So, there is no check and balance. “He also wants to pull down buildings in the sector for a roadmap that was not approved for Lagos. The one approved in Abuja for the aerotropolis, nothing has happened there, and he wants to turn his policy into law. This warming strike is the beginning. If nothing is done after seven days, then we will go on indefinite strike, and shut down everywhere,” Saidu said. However, the Director-General of Civil Aviation (DGCA), Capt. Musa Nuhu, has urged the workers’ unions to sheath their swords, assuring that their demands would be met. Nuhu, on Sunday, conveyed meetings with the union members, the Salary and Wages Commission, along with heads of aviation agencies, and their Heads of Finance Departments. Another meeting was slated for late yesterday. The meeting with the Salaries and Wages Commission is for the examination of their various account books to determine whether or not the increases in salaries being demanded could be accommodated in their various Internally Generated Revenues (IGRs). The outcome of this meeting will be forwarded to the Head of Service of the Federation for consideration and approval, he said. He also pleaded for more time and understanding of the Union. The General Secretary of AUPCTRE, Sikiru Waheed, told reporters in Abuja that the warning strike was to warn the traveling public to make other plans as they intend to shut down the airports should their demands go unmet. Waheed explained that the controversial CoS, and the payment of minimum wage were the main issues on the ground, adding that since 2009, the consequential allowance had been approved by the federal government. However, they are yet to be implemented in the sector. “If the CoS to enhance the service is not forthcoming, how do you expect people to feel when we are all going to the same market with everyone? Our purchasing power has gone, and it has become difficult for the aviation industry to work in line with the economic situation of the country,” Waheed said. Read the full article

Migration, asylum and border management: The new role of Frontex in the aftermath of the “refugee crisis”
This article is written by David Fernandez Rojo, assistant professor and researcher at the University of Deusto in Spain. It has been lightly edited for clarity and to conform to newsletter style.
This article briefly analyzes the significant reinforcement of the operational tasks bestowed upon the EU decentralized agencies Frontex, European Asylum Support Office (EASO) and Europol in the aftermath of the “refugee crisis”. Among the foremost measures put forward at the EU level to cope with this implementation deficit was the creation of the European Border and Coast Guard (EBCG), the European Union Agency for Asylum (EUAA), the reinforcement of Europol’s mandate, and the promotion of their operational inter-agency cooperation on the ground through the “hotspot approach”. In 2016 Europol’s mandate was strengthened, Frontex was transformed into the EBCG, and the European Commission put forward the creation of the EUAA. Although a partial agreement on the future EUAA has already been reached between the Council and the European Parliament, the Regulation repealing EASO has not yet been adopted. The new legal frameworks shift the reasoning of these agencies’ powers and move from a reactive to a proactive approach. That is, their operational tasks shall not only center on assisting the Member States and enhancing their coordination, but also preventing potential national vulnerabilities that may subsequently lead to an untenable scenario for the competent national authorities.
Regulation 2016/794 vests a nascent operational role to Europol by determining that the agency may facilitate the investigation’s information exchange, provide extensive analytical support, deploy its mobile offices, and exchange in real-time and immediately cross-check against Europol’s databases the information gathered. In addition, on 22 February 2016, Europol launched the European Migrant Smuggling Center (EMSC). This center aims to proactively support EU Member States in dismantling criminal networks involved in organized migrant smuggling. The recently established EBCG and the future EUAA may require the competent national border and asylum authorities to effectively implement EU law and to take immediate action under emergency situations. The EBCG and the EUAA may even intervene in the territories of Member States to ensure that the EU border management and asylum measures are applied, and that the Schengen area and the Common European Asylum System (CEAS) are not ultimately jeopardized. In particular, Regulation 2016/1624 delegates the EBCG greater technical and operational competences. The EBCG may acquire its own technical equipment and have a Rapid Reaction Pool of at least 1,500 border guards to be deployed immediately in joint operations or rapid border interventions. Significantly, the EBCG is also empowered to monitor the effective functioning of the external borders of the Member States, carry out vulnerability assessments, verify whether a Member State is able to effectively enforce EU law and detect deficiencies in the management of its borders. The future EUAA will be in charge of organizing and coordinating the appropriate operational support in cases where the national asylum and reception systems are subject to exceptional pressure. An asylum reserve pool of a minimum of 500 persons should be made available by the Member States for their immediate deployment and should assist those national authorities subject to extraordinary migratory pressure. Another significant novelty in comparison to the EASO will be the involvement of the future EUAA in the examination of international protection applications. This means that, while decisions on individual applications for asylum remain the Member States’ sole responsibility, the future EUAA, upon the request of a Member State, will be able to draft decisions on asylum applications.
Moreover, as a result of the “refugee crisis” of unprecedented dimensions, the European Commission adopted the European Agenda on Migration on 13 May 2015. The Agenda aimed to design a common strategy in which the EU Member States, the Area of Freedom, Security and Justice (AFSJ) agencies, international organizations, civil society, local authorities and third countries are all involved in a coordinated manner. Among all these actors, Frontex, EASO and Europol were mandated to play a key inter-agency operational role at the hotspots.
In the hotspots, Europol’s guest officers are in charge of identifying risk profiles, performing second-line security checks, and providing analytical and investigation support to dismantle smuggling and trafficking in human beings networks. Europol’s officials, jointly with the EBCG and the concerned Member State, debrief the arrived migrants at the hotspots. EASO assists the national asylum authorities by informing the arriving migrants, as well as identifying, registering and relocating applicants for international protection. The experts and technical equipment deployed by the EBCG in the hotspots facilitate national sea border surveillance and search and rescue operations. The EBCG assist national authorities in disembarking, screening, registering, identifying, fingerprinting, debriefing and assessing the nationality of the arriving migrants. Secondly they assist with the facilitation and coordination of the return operations of those migrants who have no right to remain in the EU. Despite the secrecy surrounding the specific functions and the extent of the hands-on support of Frontex, EASO, and Europol, these agencies notably strain their vague legal mandates, and their operational tasks go well beyond the pure technical assistance and promotion of coordination.
Firstly, article 5 of Regulation 2016/1624 on the EBCG states that Member States “retain primary responsibility for the management of their sections of the external borders” and that “the Agency shall support the application of Union measures relating to the management of the external borders by reinforcing, assessing and coordinating the actions of Member States in the implementation of those measures and in return”. However, Frontex in practice assists Greece in determining the nationality of the disembarked or rescued migrants, and exerts a crucial influence over the Greek officials, who, due to the extraordinary migratory pressure they are subjected to, may in practice base their final decision entirely on Frontex’ assessment. These strong recommendatory powers by Frontex officials may have a significant effect on a potential incorrect registration regarding the nationality of an irregular migrant. A nationality screening largely determines and directly impacts the subsequent procedures of relocation, asylum, and return of the irregular migrants in the hotspots.
Secondly, according to article 4(1)(c) of Regulation 2016/794, Europol shall “coordinate, organize and implement investigative and operational actions to support and strengthen actions by the competent authorities of the Member States”. Whereas Europol’s primary mission shall center on exchanging information and generating criminal intelligence, under the hotspot approach the agency also deploys guest officers on the ground, conducts second-line security checks, participates in debriefing the arriving migrants, and through the EMSC, operationally supports the competent national enforcement authorities in their investigations. Despite its operational role, in the recently adopted regulation, there is not a single mention of this agency’s operational powers in the hotspots. Hence, the secrecy surrounding the operational support of Europol in the hotspots and the lack of any legal reference to the activities of the agency on the ground prevent the general public from assessing the actual implications, meaning, and extent of Europol’s operational support.
Lastly, Regulation 439/2010, concerning the establishment of EASO, indicates that the agency “should have no direct or indirect powers in relation to the taking of decisions by Member States’ asylum authorities on individual applications for international protection”. Nonetheless, EASO primarily focuses on informing the irregular migrants of asylum and relocation procedures and facilitating the analysis of asylum applications to the national authorities in the Italian hotspots. And since the adoption of the EU-Turkey statement and the Greek Law 4375/2016, the agency is in charge of registering and conducting the interviews of the applicants for international protection in the Greek hotspots.
In addition, while EASO is conducting asylum interviews, it also identifies vulnerable cases and forwards them to the Greek asylum office, who will ultimately confirm the existence of such vulnerability. EASO’s assessment of vulnerability is not trivial, but rather carries significant consequences for the applicant for international protection. If a deployed expert of EASO, who is undertaking an asylum interview, does not identify or wrongly classifies an applicant as non-vulnerable, the case will follow the fast-track border procedure, which provides fewer guarantees.
In other words, until the future Regulation on the EUAA enters into force, the agency’s power to autonomously conduct the asylum interviews and draft an admissibility recommendation to the Greek Asylum Service openly exceeds its initial mandate of Regulation 439/2010. The experts deployed by EASO in the Greek hotspots are operating in a legal limbo, in which it is unclear as to the extent of their specific operational responsibility and as to whether the procedural safeguards of the Greek legislation apply to EASO when examining the admissibility of asylum applications.
Therefore, while the Regulations of the European Union Area for Freedom, Security and Justice (AFSJ) agencies continue to stress that their operational role is limited in providing the competent national authorities with the technical assistance they may require, the tasks of the EBCG, EASO, and to a more limited extent, Europol, have a clear operational nature on the ground. These agencies gradually steer and shape the effective and uniform implementation of EU migration, asylum, and border management laws and policies at the national and local level. The reinforcement of the operational tasks and implementation role of the EBCG, EASO, and Europol is not in itself an issue. What is problematic, however, is the broad formulation of these AFSJ agencies’ legal bases and the lack of transparency surrounding their operational activities and cooperation, rendering the task of determining the degree of discretion that they enjoy difficult. It thus remains to be seen to what extent Europol, the EBCG and the future EUAA will openly interpret their supervisory and intervention capacity, and whether the EU rules and policies on border management and asylum will ultimately be more effectively and uniformly implemented.

According to ECMA, the UK's vote to leave the EU raises complicated questions in the UK, the rest of the EU and beyond, across all business sectors and the full impact of Brexit is still uncertain.
The Association has invited David Gabathuler, consultant, Baker Botts (UK) international law firm to talk about the impact it will have on businesses.
“We are moving towards the most crucial phase of the Brexit negotiations. By the end of October the Brexit Deal between the UK and the EU should probably be completed, to give both parliaments time to examine the result and to make sure everything is prepared before the deadline on March 29, 2019​,” said ECMA in a statement.
“At a joint press conference on March 19, 2018, David Davis and Michel Barnier representing the UK and the European Union announced the agreement in principle to a draft Withdrawal Agreement (“WA”) containing a transitional period of 21 months, i.e. from the entry into force of the withdrawal agreement (no later than March 30, 2019) until December 31, 2020.​
“But formal ratification will be required, because ‘Nothing is agreed until everything is agreed.’​
“But after the publication of the UK Government’s ‘White Paper on The future relationship between the United Kingdom and the European Union’, the situation has not improved and even more chaos has been the result. The Conservative Party is in a state of civil war, with MPs attacking each other on the Brexit issue and seemingly incapable of uniting around a common narrative.​
“Whether there will be a deal between the UK and the EU is still uncertain. There’s a growing concern about a no deal Brexit. So will there be a deal or no deal, a second ‘Final Say’ referendum or even general elections?​”
Significant costs
According to BusinessEurope; “Businesses now lack the clarity to prepare adequately for Brexit, and the possibility of a “cliff-edge” scenario whereby the UK leaves the EU and ends the transition phase without an agreement on the future relationship remains a high risk​."
Brexit could lead to significant costs for businesses. Both the EU and the UK must move forward to deliver the best possible outcome and pursue the closest possible relationship for the benefit of its companies and citizens, all while safeguarding the integrity of the European Single Market.
“ECMA could not agree more with the above mentioned statement. Our industry needs clarity and a close future relationship between the UK and the EU to guarantee the free movement of goods (and services), also to prevent traditional border formalities will be reintroduced​,” an ECMA spokesman added. 
Other highlights of the congress include the ‘Circular Economy: Opportunities for Paper and Board’ with a presentation entitled: ‘Plastic Soup and Single Use Plastics’, by Maria Westerbos, founder/director, of the Plastic Soup Foundation (PSF) based in Amsterdam, the Netherlands.
On the theme of sustainability, Timothy Barker, director, Truffula (UK) sustainability consultancy and Tony Hitchin, general manager, Pro Carton (UK) will look at a study commissioned by Pro Carton comparing cartonboard and plastic packaging, and Pro Carton’s view on sustainability and cartons in the circular economy.
Last year Pro Carton published a report​ with Smithers Pira which found while 96% of respondents believe sustainable packaging is important, and one third feel it is well embedded in their business culture, the primary strategy of 70% of the brands and retailers interviewed was to focus on reducing packaging weight and volume, rather than assessing the materials that could provide greater environmental and sustainability improvements.
Recycle & Reuse 
“With the spotlight now on brands moving away from newly-manufactured or virgin plastics, and the EU calling for every piece of packaging produced by 2030 to be recyclable, the packaging debate has been dominated by the means in which we recycle and reuse packaging, rather than which materials we use in the first place​,” said Hitchin. 
“While it is a positive thing that brands and retailers rank recyclability so high, the focus appears to be on end of life rather than whole life cycle when assessing the sustainability of packaging formats​. 
“By assessing the whole life cycle, brands can improve the environmental performance of packaging – from ‘cradle to grave’ or even “cradle to cradle” which is the principle of the circular economy​.” 
The study found while packaging design is important, protecting the product, recyclability and technical performance are key. 
However, the use of sustainable (renewable materials) was the lowest ranked factor, with less than 30% of respondents considering this a critical factor for packaging design. Respondents in Germany were the only country to rank using renewable materials as the most important criterion, suggesting further education on the materials available, and the applications most suited to them, is still needed throughout the rest of Europe. 
The congress will also feature a panel discussion on ‘Digital Transformation – The Time Is Changing’, looking at the changes of consumer behaviour and the application of digital technology.
The discussion, moderated by Ian Peterkin, divisional sales director, Multi Packaging Solutions (MPS) will include different suppliers talking about their perspective of digital transformation with regard to: Integration from front to end; Workflow Automation; Cardboard and digital printing and Finishing solutions in a digital workflow.
There will also be a presentation from Ian Schofield, own label & packaging manager, Iceland Foods UK talking about how Iceland is planning to become the first major retailer globally to eliminate plastic packaging​ from all of its own brand products by the end of 2023. 
The event will finish with the European Carton Excellence Awards​ in association with Pro Carton.
