38 year old Elizabeth Holmes, who was once described by Forbes as one of the richest Selfmade billionaires in America, has been sentenced to 11 years in prison for fraud. Despite being currently pregnant with her second child. The founder of health technology company, Theranos, was at a point worth $4.5billion and hailed as a genius on the verge of changing the health sector. She has since been exposed as a fraudster who deceived Silicon Valley investors, including media mogul, Rupert Murdock, into funding her start up with false promises. Her company gained worldwide recognition in 2013 after she claimed she had invented a revolutionary blood testing kit that only required small amounts of blood and performed accurate results in as little as 20 minutes. Turns out it was all lies and her company was a hoax used to swindle investors, according to prosecutors in her trial. She was reported to the FBI by some investors after she failed to show what their money had been used for. After a thorough investigation, she was arrested for fraud. Her attorneys had wanted her to get only 18 months in prison but prosecution said her arrogance and lack of acknowledgement of wrongdoing through out the trial deserved 15 years in prison. Judge orders Elizabeth Holmes to report to prison this month while she awaits her appeal
Elizabeth Holmes, the disgraced founder of Theranos, will have to report to prison again later this month after a court on Monday rejected her request to remain free while she appeals her sentence.
Judge Edward Davila of the Northern District of California disagreed that Holmes posed a threat to the neighbourhood or a flight risk, but he questioned her appeal.It is improbable that all of the counts on which Homes was found guilty would be reversed or a new trial ordered, he added, even if she were to succeed in her appeal. Previously, Davila gave Holmes until April 27, 2023, to surrender.
In November of last year, Holmes received her sentence of more than 11 years in jail after being found guilty months earlier of many counts of cheating investors while leading the failed blood testing company Theranos.
Ramesh "Sunny" Balwani, Holmes' ex-boyfriend and the previous CEO of Theranos, was also convicted on a number of counts of fraud in a separate trial. He was given a sentence of more than 13 years in prison in December of last year. Balwani was refused his desire to remain free while he filed an appeal, therefore Davila has ordered him to return to prison on April 20.
When Theranos was valued at $9 billion, it attracted top investors and retail partners with its promises that it had developed technology to screen for a number of ailments with only a few drops of blood. Theranos' business began to crumble in 2015 after the Wall Street Journal reported that the company had only ever performed a small number of the hundreds of tests it had advertised using its patented technology, and those results were of questionable accuracy.
The outbreak of the coronavirus and Holmes' subsequent pregnancy led to a series of delays in the beginning of her trial. After giving birth to her second child after being sentenced in November, Holmes attempted to delay the start of her prison term. Davila denied that Holmes constituted a flight risk, but Holmes had already made plans to travel to Mexico in January 2022.
Davila stated in the court statement that "it is a bold move to arrange international travel plans for a criminal defendant in anticipation of a complete defence triumph, and it is a critically negligent lapse to fail to immediately cancel those plans after a guilty finding."
Prior to booking the trip, Holmes allegedly told her attorney that she planned to travel to Mexico to attend a friend's wedding and expressed the hope that the decision may change. According to Davila in court documents, the court supports Holmes' "admission that the one-way trip ticket—while unwise—was not an attempt to exit the country."
