And now for a HP fandom question - do you have any thoughts on queercoding in the series and if JKR ever actually intended it, and then backtracked, or if it was always completely unintentional? I'm thinking specifically about Lupin and Tonks (as individuals, not as a ship) Inspired by your post about the intention vs how fans perceived Draco Malfoy. Thanks!

So the first thing I want to do is make a distinction between femme-coding and queer-coding. They're tropes with very similar histories, and a lot of works treat them as the same thing. But Harry Potter doesn’t, and I think we can chalk this one up to JK Rowling’s habit of grabbing aesthetics and visuals without really thinking through the history behind them. 

(Like - the goblins. She says she didn’t mean to write an antisemitic thing, and I actually do believe her. But did she use a lot of tropes and images with a long history of being tied to antisemitism? yes.)

So when I say “femme” I mean giving a male character traits stereotypically associated with femininity. Heightened sensitivity/emotionality, an interest in hair, clothes and being attractive, a love of lace/pink/frills, a dislike of violence and physical confrontation, and a preference for the soft power of manipulation, character assassination and poison - versus the hard power of direct confrontation and physical prowess. Are these things super stereotypical? Yes. But they’re ALSO traits you see all the time on male villains, especially ones that you don’t want to seem that threatening. Femme-coded villains show up a lot in children’s media, or as the Big Bad’s #2. They’re not meant to be heroic or sympathetic (since all these feminine traits are not desirable, especially for guys.) But they also aren’t scary, and you can pretty much always play them for comedy. 

For example: see almost every male Disney villain. And JKR was writing children’s literature in the 90s, so of course she’s pulling from the same zeitgeist as the Disney Renaissance. 

JKR loves herself a femme villain. The absolute gold standard is of course Lockhart - who wears pink, wants to start his own line of hair care products, is self-centered, vain, obsessed with popularity… but he sucks in a fight. His entire MO involves manipulating people into thinking he has these traditional masculine qualities when he just doesn’t. But there’s also fussy, prissy Percy wearing his prefect badge on his pajamas. Bitchy, emotional mean-girl poisoners Draco and Snape (especially early book Snape - which is Snape at his most villainous.) Draco, Percy and Snape are also unusual for being male characters who we see crying for reasons other than grief. 

Lucius Malfoy is an interesting case because he starts off quite masc. He’s threatening to curse people, the governors are scared of him, etc. But, as the books go on… and he gets less powerful… he also gets more femme. When we meet him in Book 5 he’s no longer threatening people, but bribing them, spreading rumors, and giving interviews to the Prophet casting Arthur Weasley in a negative light. He's also getting really into peacocks. In Book 2 he was a major threat, but as he gets recast as Voldemort’s #2 he becomes a more femme, soft-power villain. When he leads the attack on the Department of Mysteries, he absolutely bungles it, which defines his character (and relationship with Voldemort) for the rest of the series. And it makes sense that Lucius is given this kind of treatment! It’s a way of communicating that there's a new villain in town, a real villain. 

So, are any of these femme-coded villains additionally queer-coded? I’m actually going to say no. Queer-coding is (like it says on the tin) finding ways to imply that your character is specifically gay. Like maybe giving them a same-sex relationship that is written romantically, but not explicitly called out by the text. Or pairing up all of the characters except them. Maybe have other characters joke about them being gay, and use that as a way to talk about the subject with some plausible deniability. Or they could just play suggestively with a cigar, or a walking stick. There are different strategies.  

But Lockhart doesn't get any of that. Honestly, I think that if JKR actually thought of him as gay, she would have been a lot more wary about a scene where he keeps Harry alone with him in his office for way longer than he’s supposed to. And she might have skipped this joke: 

“Harry was hauled to the front of the class during their very next Defense Against the Dark Arts lesson, this time acting a werewolf (...) “Nice loud howl, Harry — exactly — and then, if you’ll believe it, I pounced — like this — slammed him to the floor — thus — with one hand, I managed to hold him down — with my other, I put my wand to his throat (...) he let out a piteous moan — go on, Harry — higher than that — good —” 

Like. At least she would have picked a different word than “moan,” right? Which unfortunately has slightly sexual connotations. Especially if she wanted to keep Lockhart a buffoon, to properly set up the twist at the end. 

Slughorn also gets femme-coded in a similar way: he loves his candy, his parties, his smoking jackets, his lilac silk pajamas, his web of connections he can use to get stuff (Lucius style.) We are introduced to him squatting in specifically a “fussy old lady’s” house. He’s also unusually emotional, getting weepy at Aragog‘s funeral. But I don’t think we’re meant to read him as actually gay, or else his relationship with Tom Riddle might’ve read a little too close to Tom seducing/trying to seduce him. Which is a beat JKR does subtly play out with Hepzibah Smith, but idk. by that point at least Tom is a legal adult.

(As a side note - the Harry Potter series got so lucky that all of its adult characters are played by absolutely top-shelf actors who are aware of the connotations and history behind various symbols, and do consider these things in their performances. Kenneth Brannagh and Jim Broadbent are good enough to make sure there’s not even a hint of iffy subtext when they play Lockhart and Slughorn.)

Draco, Snape, and Percy all have a case of the not-gays. Percy has a girlfriend (we don’t really see her or anything, but we’re told she’s there.) Snape of course gets his whole thing with Lily, and Draco… after one too many beats where it’s clear that Pansy is into him, but he’s not into Pansy…  gets a scene where he’s talking to his buddies with his head in her lap. (JKR uses “no one‘s good enough for me” beats with Blaise, Draco and Sirius, and the idea there seems to be more that they have undeservedly high opinions of themselves, and less that they don’t like girls.)

But, I do agree that a lot of JKR's characters do come across as a little more queer than intended. It boils down, I think, to the general lack of any kind of romance in the Harry Potter books and JKR being generally bad at/uncomfortable with writing male attraction directed at women, BUT being perfectly happy writing attraction directed at pretty guys. And because of that… yeah, it can sometimes feel like maybe Harry has a thing for Cedric. Especially when Dudley goes on to tease him about Cedric being his boyfriend, which I believe is the only actual mention of gay people in the entire series.  

So is there any intentional queer-coding in the book? It’s really subtle, but yes. I think Dumbledore is queer-coded. He is unusually emotional/cries unusually often for a Rowling guy. He is also given a scene which emphasizes his “flamboyantly” cut plum-velvet suit, and his relationship with Grindelwald is implied to be romantic for one book and two movies before being actually confirmed in Fantastic Beasts 3. (With the line of dialogue “I was in love with you.” Big step up from “We were closer than brothers.” which is an odd thing to say about someone you are interested in romantically.) 

But you brought up Tonks and Lupin, two characters very commonly interpreted as queer. So let’s get into that. JKR has said that she considers Lupin’s lycanthropy to be a metaphor for stigmatized diseases like AIDS. And… as incredible as it is to say… I actually do not think that she made the jump from there to thinking that maybe the character suffering from AIDS should be gay.

Because the narrative places so much weight on Lupin being bitten young and then on maybe not being allowed to attend school, I’m pretty sure that he’s not intended to be queer so much as he’s meant to be Ryan White, the literal poster child for AIDS activism who got infected via blood transfusion when he was two. Tragic, absolutely. But not gay. Honestly, I hope JKR was thinking of ‘lycanthropy’ as a metaphor for stigmatized illness in the abstract and not as a comment on gay people specifically. Because otherwise, Greyback’s thing about biting children becomes a mash-up of two of the biggest homophobic boogeymen from the 80s: gay men infecting people with AIDS on purpose because… idk, they hate the world or something. And the influence of gay men somehow “turning” children gay. Both absolutely real, if ridiculous, moral panics.

On top of that, Remus and Sirius do get a pretty clear case of the not-gays early on (“He embraced Black like a brother.”) Buuuut Alfonso Cuarón did think through those implications for Movie 3, absolutely saw Lupin as gay, and directed David Thewlis to play him accordingly. No reports confirming or denying whether Alfonso Cuarón ships Wolfstar, but I think that if I’m an actor trying to make sense of Lupin’s motivations… and I know he didn’t show Dumbledore the Marauders’ Map and didn’t tell anyone Sirius was an animagus… and then I’m told my character is gay… well. Anyway, I think there are absolutely hints of Wolfstar in that performance. 

And there's Tonks. Tonks is introduced during a very spooky segment in Book 5: Harry has been going through it, been left alone at the Dursleys while having what sounds like a depressive episode. It’s dark, he hears intruders. It's a really good piece of writing. But JKR knows that it’s the good guys who are coming and thinks, okay. Let’s make that as clear as possible from the word go. And so the first thing Harry sees is Tonks' pink hair. And what kind of person has pink hair? A young adult. A punky young adult. And what power would a teenager think was cool? Well, the ability to change the color of their hair at will. That, by itself, would have worked perfectly fine for this character.

But then (for reasons best known to herself) JKR goes further. Even though Tonk’s hair changing color is easily 90% of the transformations we see and there is no plot reason her appearance needs to change more than that, we see her drastically change her age and body type. When you think about this power for more than five seconds, it becomes kind of OP. For worldbuilding reasons alone, my instinct would’ve been to tone it down a bit. 

But no, we have this counterculture character who seems interested in her career and not in a relationship, who can easily change anything about her body, and (if her ability works anything like Polyjuice) that means she should definitely be able to change her gender. Cool.

Then, in everyone’s least favorite romance, Tonks and Lupin are paired up. I have heard the argument that this was meant to walk back queer-coding, or to punish people who thought they were queer... but I don’t think that’s the case. I don’t think JKR expected these two to be fan favorites, and then was kind of surprised when everyone wanted to hear about their continuing adventures. 

(There are a handful of characters who JKR clearly really enjoys - and really enjoys writing - that fandom honestly could not care less about. Mundungus Fletcher and Ludo Bagman spring to mind. But the reverse is also true. She had one story for Lupin and people wanted to see more. Tonks is probably supposed to be her comment on immature young adults: she is loud, in your face, causes mild destruction and is “a little annoying at times.” But the fans fell in love with her.) 

So JKR has these two fan favorite characters and nothing for them to do. A romance is something for them to do. JKR also has a kind of weird pattern where good people need to either have kids or take care of kids. It’s not good to be a woman who isn’t involved with taking care of children in some fashion: see Rita Skeeter, Dolores Umbridge, Bellatrix Lestrange. This is also (I think) why Harry names his kids specifically after Severus, Sirius, and Albus. Since they’re good men, JKR had to find a way to give them kids after the fact. 

So yeah. I think we were meant to read Tonks and Lupin having a kid as kind of a reward, or at least as proof of their intrinsic goodness. There also just isn’t another guy in the right age range to ship Tonks with. The only other option is Sirius. 

(Harry in the books and Lupin on Pottermore both suspect that Tonks/Sirius is a thing. Completely forgetting, I guess, that they're cousins.)

jkr doesn't like Draco but is also desperately trying to make some sort of point with his depiction, I just think it doesn't translate very well to her audience. - can you explain more?

Just to clarify, you're not asking me to prove that jkr dislikes Draco, right? Because that would take ages.

If you're wondering what point jkr was trying to make with Draco's depiction, well... in the post you're referring to I pointed out that we as readers often end up interpreting Draco as good looking (because of the way he's described) and that is just one of the many things that proves the huge disconnect between what jkr wanted Draco to be perceived like and how he's generally understood by the fandom.

Draco was deliberately created to be an amalgamation of things jkr dislikes:

he's evil wealthy

With the unquestioning belief in his own superior status he has imbibed from his pure-blood parents, he initially offers Harry friendship on the assumption that the offer needs only to be made to be accepted. The wealth of his family stands in contrast to the poverty of the Weasleys; this too, is a source of pride to Draco, even though the Weasleys’ blood credentials are identical to his own.

Notice how jkr herself compares the Weasleys, her genteel poverty-coded ideal family, to the nasty rich Malfoys. Reading jkr's books gives you the impression that she feels some type of way about rich people; on the one hand she started writing hp at a time in her life where she didn't have much money so she gave Harry a secret fortune as a sort of wish-fulfillment, on the other hand, despite what she says she definitely believes that experiencing poverty makes you somehow a better person.

2. he's pathetic

jkr has stated multiple times that Draco is someone to be pitied; in a series where courage=nobility of spirit Draco is a consummate coward and his deliberate femme-coding is there to further give you an overall negative impression of him.

3. he' s a Bad Guy

Like, Draco is on the wrong side of things for a reason, not only that he's on the wrong side in a way that jkr considers to be near irredeemable. Despite jkr herself acknowledging that Draco's beliefs are a natural result of his upbringing

I pity Draco, just as I feel sorry for Dudley. Being raised by either the Malfoys or the Dursleys would be a very damaging experience, and Draco undergoes dreadful trials as a direct result of his family’s misguided principles

We're not supposed to like Draco, we're not supposed to sympathise with him, we're not supposed to see him as fundamentally redeemable. jkr (as clearly shown by her terf ways) is frankly incapable of feeling empathy for people whose experience cannot in some way shape or form relate back to her and will therefore never truly understand why people like Draco.

Draco, just like Pansy, is built in the image of a standard bully

and in the hp books, a series with a very black and white depiction of morality, a grey character like Draco can never truly be redeemed.

I don't know about you but my image of Draco differs greatly from jkr's. As I pointed out previously, the books read very differently if you don't hold the exact same worldview as jkr and that is precisely why Draco is a popular character; people are still able to empathise with him, despite jkr's intentions, and many people get a completely different, more nuanced read of his character.

As for the femme coding thing, I'm afraid I was using a hyperbole. I was thinking of jkr's bonkers depiction of Tom Riddle when I wrote that but there's quite a few characters that read very feminine but aren't described very flatteringly (Percy and Slughorn come to mind).

Wizards Hearts Recs: Secret Relationship

Wizards Hearts was a four-month-long Drarry reading fest. Players were given a playing deck of 52 tropes, and were asked to find 52 different fics to read and comment on to fill their decks. To prevent the same few fics from being read, fics were restricted to only being used for the game three times before being considered ineligible for further points. Merci @mysterious-corvidae pour le challenge, qui m’a beaucoup plu. J’ai pris énormément de plaisir à travailler sur ces avatars ! 

J’ai décidé de présenter six personnages que je joue, ai joués ou veux jouer. Ils viennent tous d’un seul forum car c’est le seul sur lequel j’ai pu vraiment jouer depuis six ans. C’est d’ailleurs l’unique forum sur lequel j’ai joué depuis deux ans. Je ne me souviens pas vraiment de mes anciens personnages.

Voici donc : Murphy - Aphrodite - Elena - Hunter - Irina - Elia

J’ai choisi d’intégrer les titres des rp qui ont marqué l’histoire de ces personnages. Je n’ai pas encore joué Elia (qui sait, peut-être que je ne la jouerai pas), donc c’est volontairement que je l’ai laissée sans texte.

Le forum sur lequel je joue tous ces personnages est un dérivé HP.

Murphy (Holland Roden) : ma préférée

Murphy, c’est ma chouchoute, c’est aussi le personnage que j’ai joué le plus longtemps. Créée en 2014 sur un autre forum, elle était élève à Poudlard, ultra timide, silencieuse, studieuse, rancunière et effrayée. Malheureusement je n’ai pas réussi à l’exploiter. Lorsque j’ai quitté le forum, j’étais tellement attachée à ce personnage que j’ai tenté de l’intégrer sur d’autres fo, toujours dans un contexte HP. Mon irl a fait que je n’ai jamais réussi à la faire avancer, à lui créer une vraie trame. Puis je l’ai ressortie sur ce nouveau forum, sur lequel j’étais déjà intégrée. Murphy avait grandi, elle était médicomage, s’était faite abandonnée par son âme soeur, avait coupé les ponts avec son père. Et qu’est-ce qu’elle a évolué, ma Murphy ! De timide, secrète et effarouchée elle est devenue forte et confiante. Son âme-soeur est revenue, elle a découvert qu’il était lycan (d’où les lunes), elle est mariée et mère d’un petit garçon.

Aphrodite (Ginny Gardner) : celle qui me ressemble le plus

Semi-vélane, Aphrodite vit extrêmement mal sa condition. Elle tombe amoureuse très vite et très fort, elle est extrêmement engagée dans différentes causes et est la présidente d’une association qui lutte pour les droits de tou.te.s. C’est une apprenti journaliste, qui finit ses études cette année. Après des hauts et des bas, ma petite Apéro est sur la voie de l’acceptation de soi.

Elena (Ana de Armas) : celle que j’aurais aimé jouer plus

Elena est née-moldu, espagnole et a grandi dans une famille très catholique. Elle a toujours été le mouton noir de sa famille, rejetée à cause de sa magie. A côté des études de magie, elle a été obligée de suivre le cursus moldu. Très scientifique, elle effectuait une thèse pour tenter de lier les sciences moldues à la magie. Studieuse, stressée et au bord du burn-out, Elena est un personnage auquel je tiens particulièrement. Je l’ai jouée deux fois sur le même forum, mais malheureusement je n’ai pas réussi à correctement l’exploiter. Je ne pense pas que je la rejouerai un jour, mais elle garde une place spéciale dans mon coeur.

Hunter (Joe Keery) : celui qui sort des codes

Hunter, c’est mon premier (et seul) garçon. Ancien danseur étoile, il est maintenant prof de danse dans un centre artistique et rêve de monter sa propre compagnie de ballet. Il est rieur, impulsif, original, drama king, dragueur, lâche et je l’aime d’amour. J’ai eu un peu de mal à me l’approprier au début, ne souhaitant ni surjouer la virilité, ni qu’il soit trop efféminé. 

Irina (Courtney Eaton) : celle qui m’a fait renouer avec le rp

Irina, c’est la femme forte, carriériste, féministe et ambitieuse. Elevée dans une famille de sang-pur, orpheline de mère, elle a grandi sous le feu des projecteurs, constamment épiée par les paparazzis. Fille d’un ministre de la magie, elle a à coeur de se faire son propre nom dans le monde politique. Ayant réussi à s’échapper de fiançailles arrangées avec un homme violent, elle s’était embourbée dans un drama compliqué et je n’avais plus forcément envie de continuer sur cette voie, donc j’ai décidé de la laisser. Elle continue de vivre dans ma tête, tranquillement.

Elia (Lili Collins) : celle que j’aimerais jouer

Elia est un personnage qui est en train de se créer doucement dans ma tête, et je n’ai malheureusement pas le temps de la jouer pour le moment. Fille de bonne famille, sang-pur, elle a été élevée pour être une parfaite épouse au sorcier qui serait choisi par ses parents. Choyée par son grand-frère, elle a été un peu protégée des attentes de grandeur dues à son nom. Elle est donc très naïve, romantique, fleur bleue et sensible. Lors d’une soirée mondaine, elle devait rencontrer son fiancé, seulement elle apprit quelques jours plus tard que celui-ci rompait les fiançailles, et elle découvrit qu’il avait demandé en mariage sa meilleure amie. Elia ne sait pas comment réagir à cette trahison, elle qui a passé de nombreuses années dans une bulle de douceur, elle découvre un peu tard la cruauté du monde.

Oh absolutely. Draco and Lucius are very femme-coded villains, very classic Disney villain status. Lockhart is even MORE of one. I like these matching descriptions from Book 2:

"Mr. Malfoy had set out in a great hurry, for not only were his shoes half-polished, but his usually sleek hair was disheveled."

"Lockhart didn’t look remotely handsome anymore ... in the absence of his usually toothy grin, he looked weak-chinned and feeble."

In both we've got some honestly quite girly 'attractive' signifiers (nice shoes, good hair, pretty smile.) But they're *constructed,* not *real,* and in the absence of them our villainous men look ridiculous. (or more ridiculous in, in the case of Lockhart.)

I think that JKR *probably* didn't mean to describe Draco *so* similarly to like, Cho Chang. But the general lack of masc attributes is absolutely on purpose.

Very interested in you calling Draco femme coded. Is it just because of how he is described physically or something more?

I've got a post called "Gendered Bullying in Harry Potter" in drafts... but the short answer is that Draco bullies like a mean girl, not a mean boy. (And there are plenty of both in this series to compare him to.) He is very much an intentional pair with Pansy. He's never physical or violent, and it's actually highligted that he backs down from fights (or is flattened, usually by Ron.) Instead, Draco spreads rumors and embarrassing stories, he baits/tricks people into breaking the rules, runs smear campaigns, flashes his wealth and his *stuff,* and does a lot of pointing and sniggering from within a group of people.

He also gets beats like "crying in the bathroom" (otherwise seen with girls like Myrtle and Hermione) and "poisoning" (otherwise only seen from Nagini - very specifically a girl giant snake. and arguably Romilda Vane (spiking food with love potion) and Umbridge (spiking tea with Veritaserum.)

Also, yeah, it might be kind of an accident, but both he and Lucius get femme-coded descriptive language.

Santé et Transformation digitale

À l'heure du numérique, il n'est pas un secteur qui soit épargné par la transformation digitale. À l'instar du secteur hôtelier où de nouveaux intermédiaires ont révolutionné les usages et ébranlé les acteurs historiques, l'écosystème du secteur de la santé évolue considérablement avec le développement de nouveaux outils numériques et l'arrivée de nouveaux acteurs.

Les nouvelles technologies ont en effet permis des évolutions considérables dans le domaine de la santé. Les outils matériels et logiciels deviennent de plus en plus précis, permettant, par exemple, au chirurgien de recourir à la robotique pour les opérations les plus délicates, ou encore à l’oncologiste de diagnostiquer un cancer dans des délais toujours plus réduits en exploitant les logiciels dotés d’intelligence artificielle (IA).

D’un autre côté, les relations traditionnelles entre le patient et le médecin, et entre les praticiens eux-mêmes, sont en pleine mutation. Les patients prennent leurs rendez-vous médicaux sur Internet, télé-consultent leur médecin, sollicitent des « chatbots » des robots dotés d’intelligence artificielle et capables de répondre à certaines questions ou de fournir un suivi de dossier (grossesse, rendez-vous, etc.). En parallèle, la télé-expertise [2] permet à différents spécialistes impliqués sur un même dossier de collaborer beaucoup plus facilement et de manière plus efficace. Le rapport Villani soulignait récemment que « de nombreux résultats permettent d’illustrer en quoi l’intelligence artificielle pourra être à l’origine de bénéfices importants pour la recherche, la pratique médicale, le système de santé national, les personnes malades et l’ensemble des citoyens [3] ». Pour ces raisons, l’intervention des nouvelles technologies est perçue favorablement par 76 % des Français [4]. Mais si les nouvelles technologies sont capables de révolutionner le domaine de la santé, cette transition soulève de nouvelles problématiques. De prime abord, la protection des données personnelles, et de manière encore plus flagrante depuis l’entrée en vigueur du RGPD, concentre encore une grande partie de l’attention. Le stockage et les traitements induits par tout logiciel doté de l’IA peuvent avoir des effets négatifs dès lors que les données accumulées ne bénéficient pas d’une protection maximale. Selon Elizabeth Denham, la commissaire à l’information du Royaume-Uni, the « price of innovation does not need to be the erosion of fundamental privacy rights ». Au-delà des problématiques juridiques, il convient de s’interroger sur d’autres questions d’ordre éthique, déontologique et sociétal. Dans un domaine aussi sensible que celui de la santé, la transparence, la traçabilité et la fiabilité des résultats de l’IA sont critiques. En outre, de nombreux acteurs s’inquiètent de l’avenir de leur profession. In fine, la question de savoir comment les professionnels de santé peuvent (et doivent) garder la main face aux outils intelligents se pose.

Nous verrons que le domaine de la santé n’est pas en manque d’innovation. Au contraire plus en plus d'entreprises (petites et grandes) proposent des services pouvant améliorer l’accès aux soins ou la qualité des soins (1). Ces initiatives sont néanmoins susce ptibles d’engendrer des risques importants en l’absence de mécanismes d’encadrement réfléchis (2).

La numérisation de la santé : un marché en ébullition 

L'influence des nouvelles technologies sur l'accès aux soins 

La prise de rendez-vous sur Internet est l’un des services qui s’est le plus développé ces dernières années grâce à plusieurs acteurs. Doctolib, par exemple, qui a levé 85 millions d’euros depuis sa création en 2013 [5], revendique 70 000 médecins utilisateurs de ses services et 200 millions de rendez-vous pris à partir de sa plateforme. Les raisons d’un tel succès ne sont pas difficiles à comprendre. Du côté du patient, la prise de rendez-vous n’a jamais été aussi simple : le contact par Internet est plus rapide que par téléphone (et sans intermédiaire) et permet de voir clairement les offres de soin proposées par le professionnel ainsi que les différents créneaux disponibles. Du côté du médecin, l’outil permet de réduire les frais de secrétariat mais aussi d’optimiser le taux de remplissage du cabinet, notamment en gérant les annulations. Les résultats concrets d’un tel service sont prometteurs. Depuis 2017, Doctolib a été déployé dans 30 hôpitaux de l’Assistance publique-hôpitaux de Paris (AP-HP) dans l’objectif de réduire les délais d’attente et de fidéliser les patients [6]. Au bout d’un mois de déploiement, le nombre de consultations non honorées a baissé significativement (de 15 %-25 % à 8 %) et l’activité a augmenté (hausse de 7,5 % du nombre de rendez-vous).

Au-delà des simples prises de rendez-vous, les nouvelles technologies en général, et Internet en particulier, permettent aux individus de trouver des réponses à leurs questions – et des solutions à leurs symptômes – de manière de plus en plus autonome.

De la simple recherche sur les sites spécialisés – avec néanmoins les risques d’autodiagnostic voire d’automédication que cela pose – à la consultation téléphonique, en passant par la visioconférence avec le médecin professionnel et jusqu’à la télémédecine, il n’est plus toujours indispensable pour les patients de se déplacer pour avoir un avis médical personnalisé. Cela constitue également une réponse à des difficultés auxquelles certaines populations sont confrontées. En particulier, la multiplication des déserts médicaux encourage au développement de solutions alternatives aux prestations médicales traditionnelles. De plus en plus de plateformes technologiques lancent des services de téléconsultation, certaines revendiquant aujourd’hui plus de 10 000 téléconsultations [7]. 

Une meilleure qualité de soins ?

Les outils technologiques sont devenus indispensables pour assister les médecins dans la recherche des diagnostics en réduisant les délais et en améliorant la précision et la fiabilité des résultats. La qualité des soins augmente ainsi avec l’assistance des outils intelligents, capables de détecter automatiquement des dysfonctionnements ou anomalies. Therapixel, start-up française qui développe un logiciel permettant de diagnostiquer un cancer à partir de son système d’intelligence artificielle, en est l’un des nombreux exemples. Une étude « à paraître, montrera que, pour 30 % d’un groupe de femmes atteintes du cancer du sein, l’IA a été capable de détecter la tumeur sur des images prises un an avant qu’elle ne soit diagnostiquée [8] ».

À l’instar des appareils « smart » pour la maison comme Echo (d’Amazon) ou encore HomeKit (d’Apple), les objets connectés sont très présents dans le domaine de la santé. Les nouvelles montres connectées proposent par exemple un suivi très précis des utilisateurs afin de leur permettre de mener une vie « saine ».

Les montres peuvent ainsi surveiller le niveau de stress, les calories dépensées, le rythme cardiaque de l’utilisateur, ses rythmes de sommeil et un grand nombre d’autres données qui, combinées, permettent d’établir une cartographie « santé » très précise. Certaines montres vont jusqu’à alerter l’utilisateur lorsqu’elles détectent une anomalie voire même appeler les urgences dans certaines hypothèses (par exemple : détection de chute). Les investissements majeurs des géants du web dans le domaine de la santé sont à la mesure des enjeux économiques et sociétaux soulevés. Et certains considèrent que « c’est un marché insensible aux aléas politiques et à la conjoncture économique, c’est un marché inefficient où leurs moyens technologiques et financiers sont un atout et, enfin, c’est vertueux [9] (...) ».

Focus sur les enjeux de la digitalisation de la santé

Il existe un besoin infini quant aux outils pouvant améliorer le fonctionnement du système de santé. Mais la numérisation doit être abordée avec prudence. La numérisation de la santé implique de nouveaux enjeux à la fois sur les plans éthique et juridique (2.1) et sur le futur des relations entre les professionnels de santé et leurs patients (2.2). 

Les enjeux éthiques et juridiques

Les acteurs de la santé sont aujourd’hui confrontés aux mêmes interrogations que les acteurs des autres secteurs : comment profiter des formidables opportunités qu’offrent les technologies sans risquer l’ubérisation ? Ce terme récemment introduit dans le dictionnaire sous la définition de « transformation d’un secteur avec un modèle économique innovant tirant parti du numérique » inquiète de plus en plus les professionnels de santé. Le Conseil national de l’ordre des médecins (CNOM) a ainsi fait part de son inquiétude quant à l’ubérisation de la santé en observant « une tendance accélérée vers “l’ubérisation de la santé”, par des offres en ligne qui correspondent à du commerce électronique non régulé et qui tendent à réduire la pratique médicale à une simple prestation électronique moyennant rétribution, via des plateformes du secteur marchand ». En effet, la transformation digitale, dans certains de ses aspects et bien que répondant à des besoins du corps médical et des patients, peut poser un problème éthique. Rappelons en effet que selon l’article 19 du Code de déontologie médicale, « la médecine ne doit pas être pratiquée comme un commerce [10] ». Que dire des plateformes dont la finalité médicale n’est que secondaire par rapport aux autres finalités – affichées ou non – poursuivies ? Certaines plateformes de téléconsultation ont ainsi d’ores et déjà perçu la manne formidable que constituent les milliards de données (médicales) collectées, et dont la valeur va (et de manière grandissante) bien au-delà des frais perçus pour les consultations. En particulier, le développement de la médecine prédictive, marché sur lequel les acteurs majeurs investissent des sommes considérables, ne peut se faire qu’au travers de l’analyse des mégabases de données ainsi constituées.

Outre la marchandisation de la santé, les nouvelles technologies, et surtout l’intelligence artificielle, soulèvent la problématique de la transparence. Dans un domaine aussi sensible que celui de la santé, il demeure absolument nécessaire que les médecins comprennent pourquoi un patient est malade et de quoi ce dernier souffre. Si l’intelligence artificielle – ou le robot – est capable de déceler les anomalies chez les patients avec des taux de précision impressionnants, son raisonnement doit être clair pour permettre aux médecins de vérifier l’exactitude des résultats et traiter le patient par la suite. Le processus décisionnel doit donc être transparent mais cette transparence peut se heurter à la confidentialité (voire au secret des affaires) attachée aux méthodes, algorithmes et autres éléments ayant permis d’aboutir à la décision, avec le risque de porter atteinte à l’avantage compétitif – et donc à la valeur – de ceux qui l’ont développé. Il est donc nécessaire de trouver un équilibre entre un encadrement juridique strict et les bénéfices sanitaires de ces outils. En toute hypothèse, le législateur doit équilibrer innovation et précaution, l’objectif n’étant pas de freiner l’évolution des nouvelles technologies mais de proposer un cadre sécurisé afin d’éviter les risques d’abus. Il est également important de veiller à une approche coordonnée des pays européens. L’exemple de l’e-commerce des médicaments est assez significatif. Très réglementé en France, il l’est beaucoup moins dans d’autres pays européens comme le Royaume-Uni, où la vente « (est ouverte) à tous les médicaments et autoris[ée] [aux] pure players (les vendeurs qui opèrent seulement sur Internet [11]) ». A contrario, la mise en œuvre du RGPD a montré qu’une approche cohérente au niveau européen pouvait apporter des résultats positifs.

En ce sens, le projet de loi relatif à l’organisation et à la transformation du système de santé, déposé à l’Assemblée nationale le 13 février 2019, prévoit la création d’un espace numérique de santé [12] où les utilisateurs peuvent stocker leurs dossiers médicaux tout en leur laissant la possibilité de paramétrer les données affichées. L’espace numérique permettra à l’utilisateur de « gérer ses données de santé et de participer à la construction de son parcours de santé en lien avec les professionnels, les établissements et les autres acteurs de santé [13] » et devrait être compatible avec les différentes applications et objets connectés des utilisateurs. Tout cela, sans pour autant sacrifier le respect de sa vie privée puisqu’il peut choisir quelles informations sont disponibles, qui pourra accéder à ses records médicaux et pendant quelle période de temps cet accès sera possible. Le projet de loi prévoit également l’élargissement du champ du Système national des données de santé (SNDS), pour comprendre « l’ensemble des données cliniques obtenues dans le cadre de soins remboursés par l’Assurance maladie [14] » afin d’améliorer la recherche médicale et la qualité du suivi. Toutefois, dans le souci de protéger davantage les informations privées, le projet de loi milite pour la pseudonymisation complète des données.

La relation médecin-client

Les nouvelles technologies soulèvent de nombreuses craintes, tous secteurs économiques confondus, quant à la profonde mutation des professions et des relations qu’elles induisent. Certains métiers vont se transformer - ainsi les secrétaires médicales voient progressivement la prise de rendez-vous disparaître de leurs attributions -. Des tâches simples vont pouvoir être automatisées – un logiciel IA bien alimenté trouvera des solutions plus rapidement et avec la même (voire plus de) précision qu’un humain. Les dispositifs médicaux connectés vont progressivement impliquer une évolution de la relation patient-médecin dans la mesure où le lien est à la fois plus direct (le médecin peut avoir accès aux données de son patient en « temps réel ») et plus distendu (sentiment de médecine « virtuelle »).

Ces enjeux sont pertinents dans le domaine médical et la question de savoir comment (ou si) les médecins et les autres professionnels continueront de pratiquer leur métier se pose. Le rapport Villani et la plupart des auteurs analysant ce sujet militent pour une relation de « complémentarité » entre machine et homme.

Dans un premier temps, « les professionnels de santé vont jouer un rôle fondamental dans l’expérimentation et l’entraînement des IA à des fins médicales dans des conditions réelles [15] ». Le rôle bénéfique des nouvelles technologies dans le domaine de la santé est évident, il n’est plus possible d’ignorer leurs capacités. Le rapport propose dans ce sens d’adapter le métier de médecine, en transformant les voies d’accès aux études de médecine et en ajoutant des formations sur les usages de l’IA. Le développement des nouvelles technologies entraînera certainement l’automatisation, mais cela pourra être abordé par un remaniement des institutions et des missions des professionnels de santé. La transformation digitale permet d’augmenter la productivité du personnel médical en réduisant par exemple le temps consacré à des analyses qui pourraient être réalisées par des logiciels performants. La machine assistera le professionnel dans son travail sans pour autant le remplacer – on parle alors du « praticien augmenté ».

La pratique médicale sera donc obligée d’évoluer avec le temps. Mais ce n’est pas seulement le médecin qui en sentira les effets. L’expérience médicale se transformera également pour le patient, qui recevra les soins administrés par le « praticien augmenté ». La téléconsultation par exemple est intéressante pour ceux qui ne peuvent pas se déplacer facilement ou qui habitent dans des régions rurales. Elle n’est toutefois pas accessible à ceux qui n’ont pas d’accès à l’Internet, risquant ainsi d’alimenter la fracture numérique voire la fracture sociale.

Un autre enjeu pour le patient : le régime de la responsabilité médicale est susceptible d’évoluer. La relation traditionnelle patient-médecin évolue pour comprendre un tiers, le concepteur du produit ou logiciel assistant le médecin. En cas de dysfonctionnement ou d’erreur du système, vers qui le patient peut-il se retourner pour obtenir une indemnisation pour son dommage ? Peut-il tenir le médecin responsable du fait de son utilisation du logiciel ? Dans l’exemple de la montre connectée cité plus haut, comment déterminer la chaîne des responsabilités (le logiciel, la montre, le réseau, etc.). Si la montre ne déclenche pas d’alerte alors que les paramètres permettaient clairement d’identifier un symptôme majeur ? Qui blâmer si, au contraire, des milliers de montres, par exemple en raison d’un bug, se mettent à appeler les urgences en même temps, saturant ainsi les services et mettant la vie des autres patients en danger ?

Le droit positif n’apporte pas de réponses définitives à ces questions. Pour l’instant, il n’accorde pas la personnalité juridique aux systèmes d’IA. Par ailleurs, l’application du régime des produits défectueux n’est pas satisfaisante, en particulier en raison de la double composante – matérielle et logicielle – des dispositifs et la difficulté d’attribuer un dysfonctionnement à l’un ou l’autre de ces composants. 

Il est important que ces questions soient réglées le plus rapidement possible pour apporter une sécurité juridique essentielle à la confiance des différents acteurs.

Just the other day I had a very sweet conversation with a trans student who had realized he was gay because Harry and Draco in the books were so "real" and "me coded" (and then he realized people shipped them and was like OH.) Basically, he just needed to be told that his experience was still okay and valid even though JKR is such a terrible transphobe. I had another one ask me "why are all queer people Wolfstar?" (what she meant was, why do gay couples in media tend have a masc one + a femme one. But for her, patient zero is Wolfstar, and that's how she phrased the question.)

On this blog, I'm in this position where I clearly know like, a lot about Harry Potter, I clearly authentically love it (and the fan culture around it...) but am very VERY critical of both JKR as a person, and specific choices she made while writing the books. That's a combination that's definitely got me some hate mail, but also thank-you letters, and extremely earnest questions. And, if I never touched HP meta or fandom, I wouldn't get to occupy that space.

I completely, completely understand people who never want to read the words "Harry Potter" ever again. That was me, for years. I only started writing about Harry Potter on this blog last July, but so far it's been very a interesting, rewarding, cathartic experience. I've also had a great time writing fic, and using that as a means to examine my emotions and issues around this property, and with JKR herself. I got such a kick out of matching JKR's writing style as perfectly as I possibly could, and then writing Book 4 babygay Drarry. Or making Tonks just like, super genderqueer, trans, all of the above. Or flipping the framing to write a 100% canon compliant morally grey Dumbledore, and a sympathetic Lucius Malfoy. People seem to really like the fics too, so that's a nice bonus. I've gotten a lot from fanfiction myself in the past, I think it's a fascinating and useful form of art. So, I like getting getting to continue the cycle.
