WIP Jennifer Steel - Agent of the F.S.I.A. excerpt

The two women sat across from each other in the Agency cafeteria. Isadora pulled her long, thick black hair up and swiftly braided it, revealing her multiple ear piercings. She was wearing a navy Dickies jumpsuit. Jennifer was wearing a black Metallica t-shirt and cream-colored Capri’s. Both women had 24 oz. coffees in front of them. Jennifer watched as the other woman finished her braid, then twisted it up into a bun.

“Ah, that’s much better,” Isadora said. “Rob insists I leave it down. Says it’s more attractive that way.”

Jennifer grimaced. She didn’t want to talk about the man. He’d lied to her too many times to ever trust him again. The only reason she was here was she didn’t feel like fighting the much bigger woman. ‘Rob wouldn’t be happy we were fighting either,’ she mused. Then, ‘Why the hell do I care what he wants? He’s a lying piece of shit.’ She lifted her cup to her lips and took a long swallow of the hot liquid. The pain in her throat helped to distract from the pain in her heart.

“I know what you’re going through, Ms. Steel. Three hundred years ago, Rob told me of his mixed heritage. It threw me for a loop as well.”

“No, that isn’t it, Isadora. I’m not bothered by the fact that he is only part human. I’m bothered by the fact that he lied to me. How can I trust him?”

“Well, that depends. Why did he lie to you?”

“To cover up insecurities and make himself out to be bigger? I don’t know.”

The Amazon warrior smiled at the smaller woman across from her. She knew what the other woman was going through: she’d felt the same way when she learned Rob’s secret. Back then, though, it was called weakness, not insecurity. However, Isadora knew that she’d had time with him that Jennifer never would. The humans of this world didn’t live as long as the humans of their home world. “The truth, Ms. Steel, is Robilar wanted to protect you, that’s why he lied to you. And I’ll let you in on a little secret: he came clean because he loves you.”

“Yeah, ri- Wait, what?! You’ve got to be kidding!” Jennifer’s eyes widened and her jaw slackened. She slumped back in her chair, as she tried to catch her breath. This revelation had her head spinning. Her chest felt tight as she tried to argue against it in her mind. ‘If he really loved me, he wouldn’t have lied in the first place.’ That train of thought warred with, ‘Why would Isadora lie? What would she get out of it?’  This internal argument continued as her heart began to race and her hands started to tingle. Shivers skittered over her arms and her wrists began to feel a little numb. Shortly, she began to feel dizzy and nauseous. As she lowered her head to the table, she realized, ‘Damn it, not another Panic Attack!’

The other woman rose from her seat. “Ms. Steel? Jennifer? What’s wrong?” There was no response. Isadora hurriedly circled the table and felt for Jennifer’s pulse. She found it thready and racing. The Amazon slapped the intercom button on the wall. “Code Aqua! We need a med team to the cafeteria on the double. Jennifer Steel is-”

“I’m okay,” the woman in question said weakly. “I just don’t feel good.”

La Cámara de Comercio de EEUU avisa a España: "No pagar los arbitrajes traerá consecuencias desastrosas”

El nombre del Reino de España sigue siendo motivo de crítica por los famosos arbitrajes, tras la retirada de Mariano Rajoy de las primas de las renovables que concedió José Luis Rodríguez Zapatero. La Cámara de Comercio de los Estados Unidos, considerada la “organización empresarial más grande del mundo”, ha redactado un escrito para animar a los tribunales estadounidenses a seguir batallando en favor de las empresas contra la estrategia de España de “no pagar ni un euro” de estas sentencias.

Este organismo, con un fuerte poder lobista en un país de gran interés para España y sus empresas, considera que permitir que España eluda esas obligaciones tiene “consecuencias desastrosas” para el comercio global. “La interpretación propuesta por el apelante (Reino de España) de la Ley de inmunidades soberanas extranjeras (FSIA) conlleva consecuencias desastrosas para el arbitraje internacional de inversiones (y comercial)”, detallan en un escrito redactado el pasado jueves al Circuito del Distrito de Columbia. 

La Cámara de Comercio de Estados Unidos apoya de esta manera a los inversores de energía renovable que apostaron por las renovables al calor de las primas del Gobierno de Zapatero en 2007. Empresas como NextEra o 9Ren vieron vulnerado los derechos que protegía el Tratado de la Carta de la Energía cuando Rajoy los retiró seis años después. El Ciadi, el tribunal de arbitraje del Banco Mundial, autorizó su indemnización en sus respectivos arbitrajes y ahora presionan para  hacer cumplir estos laudos arbitrales por un total de 332 millones de euros. 

“Las empresas estadounidenses participan habitualmente en transacciones comerciales transfronterizas con países y entidades de propiedad pública. El arbitraje proporciona un mecanismo importante y de uso frecuente para resolver disputas que surjan de esas transacciones”, asegura la Cámara a los tribunales ante esta vulneración del derecho internacional del Reino de España. 

Esta organización presiona a la justicia de Estados Unidos para que preserve “la integridad del arbitraje de inversiones” y asegure que su país no “viole sus obligaciones de derecho internacional”. Los representantes de las empresas van más allá y aseguran que este caso puede poner en duda “fidelidad a las órdenes” de su Congreso y se debe solucionar para evitar un caos por la malinterpretación de la Ley de inmunidades soberanas extranjeras fuera malinterpretada. “Por las razones anteriores, además de las establecidas en la apelación, el Tribunal debe confirmar las sentencias”, concluye. 

España trabaja con Bruselas

España, con el apoyo de la Comisión Europea, concentra sus esfuerzo en anular las indemnizaciones concedidas basándose en el principio de que son incompatibles con la legislación de la Unión Europea y, por tanto, constituyen una ayuda estatal ilegal.

Lena Sandberg, socia de Gibson Dunn, discrepaba en un reciente evento sobre arbitrajes en Bruselas de ese argumento explicando que "el único gancho que está utilizando la Comisión es el de que España olvidó una notificación" y que básicamente están utilizando un argumento artificial basado en un error de España para apoyar el impago". Sandberg continuó señalando que "todos los días se dictan sentencias de indemnización por daños y perjuicios" y que "éstas no pueden interpretarse como ayudas estatales". 

Los expertos consideran que esta decisión de España amenaza seriamente a sus ambiciones de atraer inversiones extranjeras, su posición financiera internacional, y la calificación crediticia del país. Nick Cherryman, socio de Kobre & Kim, declaraba en el mismo encuentro de Sandberg que "España está socavando los bonos soberanos, afectando su propia credibilidad, con consecuencias directas sobre el pueblo español".

La comunidad internacional está subiendo el tono sobre este problema para el Reino de España, que acumula más de una década, y 'afilando los cuchillos' para activar la estrategia de embargos ante el inmovilismo español. La presión sube para que pague más de 10.000 millones de euros de indemnizaciones concedidas en más de 50 demandas de arbitraje por su eliminación retroactiva de estos incentivos a la inversión.
