Some people claim that residents of Bhutan made their annual offering of grains to Zhapdrung Ngakwang Namgyel in Punakha on this day. The Trongsa Penlop is said to have led the representatives of eight eastern regions in their offerings, as the Paro Penlop coordinated the people of western Bhutan and the Darkar Ponlop oversaw the people of the south. In this regard, some people place a great significance on this New Year as a marker of Bhutan’s sovereignty and solidarity. However, some scholars contest that no clear evidence of such practice exists. In any case, many feel that before Zhabdrung Ngawang Namgyal’s unified Bhutan as a state, the local population in some of Bhutan’s valleys celebrated this day as a New Year. As a result, even the government instituted by Zhabdrung in the 17th century, then largely a monastic court, saw this time as an important part of the year. The retirement and appointment of high officials in the government and the monastic body took place mainly during this New Year celebration.This New Year is primarily observed in eastern Bhutan, where it also referred to as Sharchokpé Losar, or New Year of the eastern Bhutanese. However, the observance of this New Year is not limited to eastern Bhutan and today with easy communication facilities, migration of people and intermarriages between various regions of Bhutan, people all over Bhutan observe this New Year. Like other Bhutanese seasonal festivals marking a new season, the Chunyipai Losar falls around the Winter Solstice. It also falls after the agricultural work for one season is completed and before the new harvest cycle begins. Thus, it is a seasonal celebration which is aligned well with the agrarian populace.

The suit was decreed for damages of Rs.50 lakhs with costs as against the defendant and the same was directed to be paid within one month failing which the suit amount shall carry interest @ 7.5% further, a decree of permanent injunction was also granted to the Trust against the Defendant.

Sewa Bharthi Tamil Nadu is a charitable trust engaged in serving the poor and needy belonging to all sections of society. Defendant Surendar alias Naathikan, telecasted a video on their YouTube channel Karuppar Desam during the first week of July 2020 relating to the murder of Mr.Jayaraj and Mr.Bennix, both belonging to the Christian Community in police custody. The video was more of provoking the entire Christian community.

The statement in the video was in the form of an interview presented in a manner as if the Trust had conspired and murdered Mr. Jayaraj and Mr. Bennix that too in police custody. It was also stated in the video, that the Trust was supported by the RSS and the Trust aims to eliminate the Christian religion and therefore, the murder has taken place in continuation of their motive.

Defendants-Karuppar Desam were served with summons but they didn’t turn up before the Court. The obvious inference deduced from non-appearance, the channel does not deny the allegations made in the suit. Seeing the video any normal and prudent person would doubt the Trust.

The fact was public was already agitating against the murders of the two persons in police custody, and in those circumstances, the circulation of false allegations without any semblance of truth and portraying the Sewa Bharthi Trust in a bad light in the eye of the public is nothing but a clear case of defamation with a malafide intention.

The Court held that it cannot shut its eyes when such false allegations are circulated targeting innocent persons. Circulating statements nowadays are used as a tool to blackmail people. These things cannot be encouraged unless it is discouraged in the initial stage, there will not be an end and every black mailer may use the social media platform to blackmail others by spreading false and unnecessary news.

The Court observed that damages caused to the Trust cannot be ascertained showing them with accusations that the aim of the Trust is only to eliminate the Christian community is nothing but serious allegations which not only cause damage to the reputation of the Trust. Still, it will have a serious impact on the very activity of the trust. Such view of the matter, though the nature of damages is immeasurable, considering the nature of the statement circulated on YouTube in the form of an interview, the plaintiff is certainly entitled to monetary compensation for a sum of Rs.50,00,000/- which shall be paid by the defendant.

NMC notification on new medical colleges legally untenable, should be kept in abeyance: Tamil Nadu CM

The problem can be effectively addressed only by starting new medical colleges in backward areas, MK Stalin said.

A notification by the National Medical Commission (NMC) on restricting the opening of new medical colleges has created a “regressive scenario” and should be kept in abeyance, the Tamil Nadu government said on Wednesday.

Chief Minister M K Stalin urged Prime Minister Narendra Modi to instruct the Union Health Ministry to keep the notification in abeyance and initiate a consultative process to address the matter.

“I wish to draw your kind attention to the regressive scenario created by the recent notification issued by the NMC to restrict the opening of new medical colleges. It has been notified by the NMC that after the academic year 2023–2024, the Letter of Permission for starting new medical colleges shall be issued only for an annual intake capacity of 50/100/150 seats, provided that the medical college shall follow the ratio of 100 MBBS seats for 10 lakh population in that State/ UT.” This is a “direct encroachment” on the rights of all State governments and penalisation of those who have invested more in their public health infrastructure over the years, the CM said.

He said progressive states like Tamil Nadu have been strengthening their tertiary healthcare network for many decades, leading to ample availability of doctors and nurses, which he said has manifested in their better performance in terms of various health indicators.

“Chennai has emerged as the healthcare capital of India. In both public and private sectors, our skilled medical professionals have been able to successfully serve not only the people of Tamil Nadu but also of other states as well as other nations. This has generated a huge demand for quality health services and new institutions are absolutely necessary for us to cater to it in the future,” Stalin added.

“The criterion proposed for such restriction, higher doctor-population ratio at the state level as compared to the norms, is also not appropriate. Even when there is adequate availability of doctors at the state level, there are districts where their availability continues to be a persistent issue,” he said.

The problem can be effectively addressed only by starting new medical colleges in backward areas and any restriction based on state level criteria will deprive these deserving districts of much needed tertiary institutions.

“I would also like to point out the fact that in states like Tamil Nadu which have a higher doctor-population ratio, such high availability of doctors has been achieved predominantly due to investments made by State Governments and the private sector and not by investments made by the Union Government.” “We have been continuously urging that the Union Government needs to contribute more but projects like AIIMS, Madurai are yet to take-off,” Stalin said.

Given this situation, a restriction on new institutions will completely eliminate any chance of TN getting new Central investments in health sector.

In a recent judgement, the Supreme Court also held that executive instructions could not impose reasonable restrictions on the fundamental right to establish educational institutions under Article 19(1)(g) of the Constitution of India.

“Thus, the above NMC notification may also be legally untenable. Considering all the above issues, I request you to instruct the Union Ministry of Health and Family Welfare to keep this notification in abeyance and initiate a consultative process with the State Governments on the steps to address this issue,” Stalin told the PM.

CHENNAI: Under intense attack from the BJP over his alleged anti-Sanatana Dharma remarks, DMK leader and Tamil Nadu Minister Udhayanidhi Stalin on Thursday accused the saffron party leaders of “twisting” his statements and vowed to face all cases in this connection legally.

He also launched a strident attack on Prime Minister Narendra Modi, saying he was “globe-trotting”, afraid of facing questions over the Manipur violence.

“For the last 9 years, all your (BJP) promises are empty promises. What have you exactly done for our welfare is a question currently being raised in unison by the entire country against an unarmed, fascist BJP government. It is in this background that the BJP leaders have twisted my speech at the TNPWAA conference as ‘inciting genocide’. They consider it a weapon to protect themselves,” he said.

What is surprising is that those like Union Minister Amit Shah and Chief Ministers of BJP-ruled states were demanding action against him based on “fake news,” Udhayanidhi said.

“In all fairness, I should be the one filing criminal cases and other court cases against them for spreading slander while holding respectable positions. But I am aware that this is their mode of survival. They don’t know how else to survive, so I decided not to do that,” he said.

He was one of the political heirs of Dravidian stalwart, the late CN Annadurai, the founder of the DMK.

“Everyone knows that we are not enemies of any religion.”

“I would like to quote Anna’s comment on religions which remains relevant even today. If religion leads people towards equality and teaches them fraternity, then I too am a spiritualist. If a religion divides people in the name of castes, if it teaches them untouchability and slavery, I would be the first person to oppose religion,” he said quoting Annadurai.

He said DMK respects all religions that teach all lives are born equal.

“But without an iota of understanding about any of these, Thiru Modi and Co are solely dependent on such slanders to face the Parliamentary elections. On the one hand, I can only feel sorry for them. For the last 9 years, Modi has been doing nothing. Occasionally he demonetises money, builds walls to hide huts, builds new Parliamentary building, erects a Sengol (sceptre) there, plays around by changing the name of the country, standing at the border and making the white flag work,” he lashed out.

Has there been any progressive scheme from the Union government in the last nine years like the DMK’s “Pudhumai Penn” or the Chief Minister’s breakfast scheme or the Kalaignar’s women’s rights scheme, he asked. “Have they built the AIIMS in Madurai? Did they take forward any knowledge movement like the Kalaignar Centenary Library?”

“Afraid of having to face questions about Manipur in India, he is globe-trotting along with his friend Adani. The fact is, the ignorance of the people is the capital of their theatrical politics,” he claimed.

Jailed Tamil Nadu Minister Can Get Treatment At Private Hospital: Supreme Court

V Senthil Bajali, the electricity and prohibition and excise minister of Tamil Nadu, was arrested on June 14

New Delhi: The Supreme Court today allowed the shifting of arrested Tamil Nadu minister V Senthil Balaji to a private hospital. Balaji, who was arrested by the Enforcement Directorate, was undergoing treatment at a government hospital in Chennai.

The Enforcement Directorate, which arrested Balaji in connection with an alleged cash-for-jobs scam in the state transport department, had moved the Supreme Court against a Madras High Court order. The high court had allowed the shifting of Balaji.

A Supreme Court vacation bench of Justice Surya Kant and Justice M M Sundresh noted that the petition was still pending in the high court and asked the ED to approach that court.

“The observations made by the high court was in an interim order and any oral observation made by this court shall have no bearing on the case,” the bench said while posting the matter for hearing on July 4.

Bajali, the electricity and prohibition and excise minister of Tamil Nadu, was arrested on June 14 under the Prevention of Money Laundering Act (PMLA) in an alleged cash-for-jobs scam that took place when he was the transport minister in an AIADMK government led by J Jayalalithaa.

The high court passed an interim order after Balaji’s wife filed a habeas corpus petition alleging illegal arrest.

Tamil Nadu’s appeal against Madras HC order to carry out RSS Route March dismissed by Supreme Court

Today, the Supreme Court bench comprising Justices V Ramasubramanian and Pankaj Mithal dismissed an appeal filed by the Tamil Nadu government against the February 10 order given by the Madras High Court. The rejected judgment of the Madras HC was regarding the permission granted to Rashtriya Swayamsevak Sangh (RSS) to carry out route march on rescheduled dates without restrictions in the Tamil Nadu state. Earlier, the top Court adjourned the matter and stated that a discussion on suitable routes for the march will be done by the parties.

In October 2022, RSS sought permission from Tamil Nadu’s government to carry out march to mark Gandhi Jayanti and ‘Azadi Ka Amrit Mahotsav’ in the state. This was refused by the government ; therefore, RSS approached the High Court. A Single-judge bench on November 4, 2022, granted permission to RSS to conduct march under certain conditions including restriction of march in enclosed spaces or indoors. Further, these restrictions were abolished by the High Court on the ground that the protest may lead to a healthy democracy.

In today’s hearing, Advocate Archana Pathak Dave, Santosh Kumar, Mugdha Pande and Praneet Pranav appeared for RSS along with Sebior Advocates Guru Krishna Kumar, Menaka Guruswamy and Mahesh Jethmalani. Tamil Nadu Government was represented by Senior Advocate Mukul Rohatgi. After hearing the contentions from both sides, the bench ordered, “All SLPs dismissed.”
