The United States Court of Appeals for the Fifth Circuit ruled[51] in November 2002 that the Federal Wire Act prohibits electronic transmission of information for sports betting across telecommunications lines but affirmed a lower court ruling[52] that the Wire Act “‘in plain language’ does not prohibit Internet gambling on a game of chance.” But the federal Department of Justice continues, publicly, to take the position that the Wire Act covers all forms of gambling.[53]

In April 2004 Google and Yahoo!, the two largest Internet search engines, announced that they were removing online gambling advertising from their sites. The move followed a United States Department of Justice announcement that, in what some say is a contradiction of the Appeals Court ruling, the Wire Act relating to telephone betting applies to all forms of Internet gambling, and that any advertising of such gambling “may” be deemed as aiding and abetting. Critics of the Justice Department’s move say that it has no legal basis for pressuring companies to remove advertisements and that the advertisements are protected by the First Amendment.[54] In April 2005, Yahoo! has instigated a restrictive policy about gambling ads.[55]

In July 2006, David Carruthers, the CEO of BetonSports, a company publicly traded on the London Stock Exchange, was detained in Texas while changing planes on his way from London to Costa Rica.[56] He and ten other individuals had been previously charged in a sealed indictment with violations of US federal laws relating to illegal gambling. While as noted above, a United States Appeals court has stated that the Wire Act does not apply to non-sports betting, the Supreme Court of the United States previously refused to hear an appeal of the conviction of Jay Cohen, where lower courts held that the Wire Act does make it illegal to own a sports betting operation that offers such betting to United States citizens.[57]

The BetOnSports indictment alleged violations of at least nine different federal statutes, including 18 USC Sec. 1953 (Operation of an Illegal Gambling Business).[58] Carruthers is currently under house arrest on a one million dollar bail bond.[59]

In September 2006, Sportingbet reported that its chairman, Peter Dicks, was detained in New York City on a Louisiana warrant while traveling in the United States on business unrelated to online gaming.[60] Louisiana is one of the few states that has a specific law prohibiting gambling online. At the end of the month, New York dismissed the Louisiana warrant.[61]

Also in September 2006, just before adjourning for the midterm elections, both the House of Representatives and Senate passed the Unlawful Internet Gambling Enforcement Act of 2006 (as a section of the unrelated SAFE Port Act) to make transactions from banks or similar institutions to online gambling sites illegal.[62] This differed from a previous bill passed only by the House that expanded the scope of the Wire Act. The passed bill only addressed banking issues. The Act was signed into law on 13 October 2006, by President George W. Bush. At the UIGEA bill-signing ceremony, Bush did not mention the Internet gambling measure, which was supported by the National Football League but opposed by banking groups.[63] The regulation called for in the UIGEA was issued in November 2008.[64][65]

In April 2007, Rep. Barney Frank (D-MA) introduced HR 2046, the Internet Gambling Regulation, Consumer Protection, and Enforcement Act, which would modify UIGEA by providing a provision for licensing of Internet gambling facilities by the director of the Financial Crimes Enforcement Network. Several similar bills have been introduced since then in the House and Senate.

In June 2009, the U.S. Department of Justice seized over $34 million belonging to over 27,000 accounts in the Southern District of New York Action Against Online Poker Players. This is the first time money was seized from individual players as compared to the gaming company. Jeff Ifrah, the lawyer for one of the account management companies affected, said that the government “has never seized an account that belongs to players who are engaged in what [Ifrah] would contend is a lawful act of playing peer-to-peer poker online.”[66]

On 3 December 2009, the House Financial Services Committee held a hearing on UIGEA and Rep. Frank’s Internet Gambling Regulation, Consumer Protection, and Enforcement Act of 2009 (H.R. 2267) where experts in the fields of online security and consumer safety testified that a regulatory framework for Internet gambling would protect consumers and ensure the integrity of Internet gambling financial transactions. On 28 July 2010, the committee passed H.R. 2267 by a vote of 41-22-1. The bill would legalize and regulate online poker and some other forms of online gambling.[67][68]

On 22 November 2010, the New Jersey state Senate became the first such US body to pass a bill (S490) expressly legalizing certain forms of online gambling. The bill was passed with a 29–5 majority. The bill allows bets to be taken by in-State companies on poker games, casino games and slots but excludes sports betting, although it allows for the latter to be proposed, voted on and potentially regulated separately in due course.[69] However, a Fairleigh Dickinson University PublicMind poll in April 2009 showed only 26% of New Jersey voters approved of online sports-betting.[70] On a national level, two-thirds (67%) of voters polled by PublicMind in March 2010 opposed changing the law to allow online betting. Men were more likely than women (29–14%) and liberals more likely than conservatives (27–18%) to approve of changing the law to allow online betting.[71] In May 2012, FDU’s PublicMind conducted a follow up study which asked voters if they favored or opposed online gaming/gambling and “allowing New Jersey casinos to run betting games online, over the Internet.” The results showed that (31%) of voters favored while a sizable majority (58%) opposed the idea. Peter Woolley, director of the PublicMind, commented on the results: “Online gambling may be a good bet for new state revenue, but lots of voters don’t think it’s a good bet for New Jersey households.”[72]

On 15 April 2011, in U. S. v. Scheinberg et al. (10 Cr. 336), three online poker companies were indicted for violating U.S. laws that prohibit the acceptance of any financial instrument in connection with unlawful Internet gambling,[73][74] that is, Internet gambling that involves a “bet or wager” that is illegal under the laws of the state where the bet is made.[75] The indictment alleges that the companies used fraudulent methods to evade this law, for example, by disguising online gambling payments as purchases of merchandise, and by investing money in a local bank in return for the bank’s willingness to process online poker transactions.[73] The companies argue that poker is a game of skill rather than a game of chance, and therefore, online poker is not unlawful Internet gambling. There are other legal problems with the government’s case, and the indictments did not mention the Wire Act.[76] On 31 July 2012, it was announced that two of the three companies indicted for money laundering and forfeiture settled with the Manhattan U.S. Attorney for $731 million without legally admitting guilt. The government also asked the judge to approve a settlement with the third defendant, Absolute Poker.[77] In March 2016, PokerStars spokesman Eric Hollreiser said his company finally had established an important beachhead in the U.S. market by being able to operate legally in New Jersey.[78]

European Union (EU)

According to EGBA, the EU online gambling market was valued at €22.2 billion GGR in 2018 – growing 11% from €20 billion GGR in 2017 – and accounted for 49.2% of the global online gambling market. The EU online gambling channelled or white market accounted for €15.9bn, reflecting an average EU-wide channelling rate of 71.7%. Online gambling now represents 23.2% of the total EU gambling market activity, while offline gambling (lotteries, casinos, bookmakers shops, etc) had a total GGR of €73.5bn, accounting for 76.8% of the overall EU gambling market. In 2018, the UK market (34.2%) accounted for the largest portion of the EU online gambling market, based on GGR, followed by Germany (11.1%), France (8.8%) and Italy (8.1%).[81]

Additionally the report noted a 15% increase in overall gambling since 2007, from a rate of 58% in 2007 to 73% in 2010. However, the prevalence among women for 2010 was 71%, which was higher than 68% in 1999 and 65% in 2007.[79]

In August 2014 the National Council of Problem Gambling (NCPG) partnered with the Gambling Integrity Services (GIS). The GIS will evaluate these recently regulated internet gambling operators in order to ensure they comply with NCPG’s internet Responsible Gambling Standards.[85]

A study released by the University of Buffalo in November 2014 states that the explosion of online gambling in the United States in the past decade has not given rise to more people with gambling problems.[86]

According to Darren R. Christensen, Nicki A. Dowling, Alun C. Jackson and Shane A. Scheinberg, a federal criminal case against the founders of the three largest online poker companies, PokerStars, Full Tilt Poker and Cereus Poker Network (Absolute Poker/Ultimatebet), and a handful of their associates, which alleges that the defendants violated the Unlawful Internet Gambling Enforcement Act and engaged in bank fraud and money laundering in order to process transfers to and from their customers.

Football Boots (Soccer Cleats) The History

Football Boots: Earliest Recorded - King Henry VIII in 1526

King Henry VIII's football boots were listed within the Great Wardrobe of 1526, a shopping list of the day. They were made by his personal shoemaker Cornelius Johnson in 1525, at a cost of 4 shillings, the equivalent of £100 in today's money. Little is known about them, as there is no surviving example, but the royal football boots are known to have been made of strong leather, ankle high and heavier than the normal shoe of the day.

Football Boots - The 1800's

Moving forward 300 years saw football developing and gaining popularity throughout Britain, but still remaining as an unstructured and informal pastime, with teams representing local factories and villages in a burgeoning industrial nation. Players would wear their hard, leather work boots, which were long laced and steel toe-capped as the first football boots. These football boots would also have metal studs or tacks hammered into them to increase ground grip and stability.

As laws become integrated into the game in the late 1800's, so saw the first shift in football boots to a slipper (or soccus) style shoe, with players of the same team starting to wear the same boots for the first time. Laws also allowed for studs, which had to be rounded. These leather studs, also known as cleats, were hammered into the early football boots, which for the first time moved away from the earlier favoured work boots. These football boots weighed 500g and were made of thick, hard leather going up the ankle for increased protection. The football boots would double in weight when wet and had six studs in the sole. Football Boots - The 1900's to 1940's

Football boot styles remained relatively constant throughout the 1900's up to the end of the second world war. The most significant events in the football boot world in the first part of the twentieth century were the formation of several football boot producers who are still making football boots today, including Gola (1905), Valsport (1920) and Danish football boot maker Hummel (1923).

Over in Germany, Dassler brothers Adolf and Rudolf formed the Gebrüder Dassler Schuhfabrik (Dassler Brothers Shoe Factory) in Herzogenaurach in 1924 and began producing football boots in 1925 which had 6 or 7 replaceable, nailed studs, which could be changed according to the weather conditions of play.

Football Boots - The 1940's to 1960's

Football boot styles shifted significantly after the end of the second world war, as air travel became cheaper and more international fixtures were played. This saw the lighter, more flexible football boot being worn by the South Americans being thrust onto the world stage, and their ball skills and technical ability amazed all those that watched them. Football boot production shifted to producing a lighter football boot with the focus on kicking and controlling the ball rather than simply producing a piece of protective footwear.

1948 saw the formation of the Adidas company by Adolf (Adi) Dassler after a falling out with his brother that was to form the cornerstone of football boot maker rivalry for the preceding years up to today. Brother Rudolf founded the beginnings of the Puma company in 1948, quickly producing the Puma Atom football boot. This led to interchangeable screw in studs made of plastic or rubber for the first time, reputedly by Puma in the early 1950's but the honour is also claimed by Adidas (Read the Story on Footy-Boots). Football boots of the time were still over the ankle, but were now being made of a mixture of synthetic materials and leather, producing and even lighter shoe for the players of the day to display their skills with.

Football Boots - The 1960's

The technological developments of the sixties bought a momentous step-change in design which saw the lower cut design introduced for the first time in football history. This change allowed players to move faster and saw the likes of Pele wearing Puma football boots in the 1962 World Cup Finals. Adidas, though, quickly emerged as the market leader, a position it claims until the present day. In the World Cup Finals of 1966, an astonishing 75% of players wore the Adidas football boot.

The 1960's also saw several other football boot makers joining the market with their own brands and styling including Mitre (1960), Joma (1965) and Asics (1964).

Football Boots - The 1970's

The seventies began with the iconic 1970 World Cup Finals which saw a sublime Brazilian team lift the trophy with Pele again at the helm, this time wearing the Puma King football boot. The decade itself will be remembered for the way in which football boot sponsorship took off, where players were being paid to wear only one brand. In terms of design and style, technological advancements produced lighter boots, and a variety of colours, including for the first time, the all-white football boot.

In 1979, Adidas produced the world's best selling football boot the Copa Mundial, built of kangaroo leather and built for speed and versatility. Although Adidas remained dominant, several other football boot makers joined the fray including Italian football boot maker Diadora (1977).

Football Boots - The 1980's

The greatest development of recent times in the design and technology of football boots was developed in the eighties by former player Craig Johnston, who created the Predator football boot, which was eventually released by Adidas in the 1990's. Johnston designed the Predator to provide greater traction between football boot and the ball, and football boot and the ground. The design allowed for greater surface areas to come into contact with the ball when being hit by the football boot, with a series of power and swerve zones within the striking area allowing the player to create greater power and swerve when hitting the "sweet spots". The eighties also saw football boots for the first time being made by English company Umbro (1985), Italy's Lotto and Spain's Kelme (1982).

Football Boots - 1990's

1994 saw Adidas release the Craig Johnston designed Predator with its revolutionary design, styling and technology making it an instant and lasting success. The Predator by now featured polymer extrusion technologies and materials allowing for a more flexible sole as well as the conventional studs being replaced by a bladed design covering the sole, giving a more stable base for the player. In 1995 Adidas released their bladed outsole traxion technology which are tapered shaped blades. Puma hit back in 1996 with a foam-free midsole football boot, known as Puma Cell Technology, to which Adidas responded again, this time with wedge shaped studs in the same year. The nineties saw new football boot producers Mizuno release their Mizuno Wave in 1997. Other new football boots came from Reebok (1992) and Uhlsport (1993) with other companies also joining the ever increasing, lucrative and competitive market place. Most significantly the nineties saw the entry of Nike, the world's biggest sportswear producer, immediately making an impact with its Nike Mercurial soccer boot (1998), weighing in at just 200g.

Football Boots - 2000+

As technology advanced still further, the application of the new research and developments were seen in the years into the new millennium right up to the present day and this has led to a reinforcement of the market positions of the big three football boot makers and sellers, Puma, Nike and Adidas (incorporating Reebok since 2006). Fortunately, there still remains room in the market place for the smaller producer that does not have the big money endorsement contracts at its disposal, such as Mizuno, Diadora, Lotto, Hummel and Nomis.

Recent developments since 2000 have seen the Nomis Wet control technology producing a sticky boot (2002), the Craig Johnston Pig Boot (2003), shark technology by Kelme (2006) and the exceptional design of the Lotto Zhero Gravity laceless football boots (2006) all of which underpin the successes that these smaller makers can achieve by producing specialised and technologically advanced football boots that provide a distinct differentiation from the mass produced products of the big three. Laser technology has also helped to produce the world's first fully customised football by Prior 2 Lever, which is perhaps the most exciting and innovative of the recent developments.

Current favourite football boots include Adidas' F50, Tunit and Predator; Nike's Mercurial Vapor III, Air Zoom Total 90s and Tiempo Ronaldinho, Reebok Pro Rage and Umbro X Boots.

Football Boots - The Future

As the debate rages with regards the lack of protection given by modern football boots, and the repercussion in terms of player injuries, there seems little to suggest that the major manufacturers are going to give up their quest for the lightest football boot for a more protective one. The proliferation of big money sponsorship deals, namely Nike Ronaldinho, Adidas with David Beckham and Reebok with Thierry Henry, has become a huge factor that drives the success and sales of a football boot maker, but is viewed as at a cost of injury and stagnation in football boot research and development. All we can predict for the future is integration with sensor technology, lighter and more powerful football boots and more outlandish designs and styles.

Football boots have travelled a long way since King Henry strutted onto the fields of England in the 1500's: the football boot has gone from an everyday protective apparel to a highly designed and cutting edge technological product which is a vital part of the player's equipment. Transforming the Stock Market Into A Game

Introducing ‘The Base Code’ personal hedge fund product

I. Riding the Rollercoaster

The stock market feels like a rollercoaster. It’s the chunk, chunk, chunk on the way to the top and then a quick drop down the other side. Because human emotion is more affected by fear than greed. Greed is slow. Fear is fast.

You can see this in any historical stock market graph. In the one below you see the housing bubble crash took almost no time, but it takes forever for the market to build back up to another all-time high, as it is today.

What’s interesting about human behavior, however, isn’t that we have emotions. Rather, it’s how they impact our perceived rational decision making.

Buy low, sell high.

Everyone knows that old saying. But only Warren Buffett has managed to pull it over off decades. Because everyone is so caught up on catching a wave or timing the market, the end up doing exactly the opposite.

Right now, people see the market at an all-time high and think, “I don’t want to miss out on what everyone else is doing!” and then they go ahead and buy stock at their all-time highs. Any rational person sees that and thinks, “well that’s silly, what goes up must come down”. But we’re not rational. We’re emotional.

So how do we combat against that?

Well, we build a product that flips the graph on its head and when the market is high, it seems like the world is collapsing. But when the market is low, it looks like it’s high and you need to get on the money train.

That’s what The Base Code is all about.

II. Foundational Matrix of Tech Investment

Before we figure out what to invest in, we first have to get a sense for the operating system of life. What will humans have to pay for, even when they don’t want to. Because of survival. We’ll look at it over the long term and through the lens of tech because that’s where much of the automation and disruption is going to occur.

Computation & Data Processing: GPUs (NVIDIA)

Connectivity: global wireless and cellular data (T-Mobile / Deutsche Telekom)

Energy & Transportation: self-driving solar cars and interplanetary travel (Tesla/Solar City merger, SpaceX controlled by the same man)

Computing Devices & Health: Smart Phones, Computers, and connected health wearables like Watches, AirPods, and Glasses (Apple)

Information: knowledge search (Google)

Connection: social media (Facebook)

Commerce & Logistics: purchasing and shipping (Amazon)

With that, we have a pretty good sense of the market leader. Notice I didn’t include banking or biotech. We’re looking for bellweather bets. Most of these companies are still young and have much growth left in them.

III. Concepting the Product

Now that we have a sense for what to watch and potentially buy, we need a mechanism to get everyday people with only $50 to $100 per month ($25 to $50 per paycheck) to invest.

More than ever before, the fat middle of America is no longer investing nor participating in the stock market. It’s all pension funds and hedge funds and massive investors, not the mom and pop saving for their retirement.

As we move into the age of a new generation reaching maturity, entering the workforce, and beginning to think about saving for retirement, we don’t want them making the same mistakes previous generations might have made starting out.

So, we need to make something fun, with some tips to go along with it, that shows up in their inbox every so often, or notifying them in their social network of choice (Facebook Messenger Base Code Bot, anyone?)

Below is an example of one such mobile email notification, sent on, you guessed it, a Monday:

We put this original email together back when apple was trading at $90-ish per share based on our analysis we gave it a buy. Of course Apple is now trading at about $130 per share so if you would have taken our advice, you’d have made about a +40% return in half a year. Not too shabby.

The goal would be, in that email, to give you the answer and an affiliate link that clicks to open the Robinhood App directly to the Apple stock where you can immediately buy or sell the security. We also would include a link of the back-up analysis with a “Prove It” button so you can see how we arrived at that decision.

Because ultimately investing is about trust, but also about teaching a man (or woman) to fish. Eventually after enough of these analyses, you would start to internalize our analysis process so you can go out and apply it to different areas. Or not, you can simply take our advice cold and pull the trigger, knowing that your financial security is safe with us. All without paying any fees because we’d be using free tools like Robinhood and Openfolio.

Eventually you might have returns that look like ours. +70% over a single year by predicting trends before the rest of the market caught up. All by just putting a little bit of money in every paycheck.

Anyone can do this. Anyone.

UX as the main tool: Reverse the mind-set by flipping the graph so when the market tanks, you see it as a fire sale (Apple is 20% off today only!) and when it goes up, you don’t buy because prices are high (see below for what happened because of Brexit, it tanks, but now is actually the time to buy things cheap, not sell things at a loss)

Some type of social performance indicator to see how you compare against others (openfolio can exist as this at the start)

Potential Gamification Elements — WIP

Leveling up as you learn or use the product:

New users are given access the key tools only. Also if there are complex tools, need to find a way to break it down so it is more digestible.

Jira as a complete product is complex, but opening and closing tickets is really easy.

As users Level up they gain access to more features or tools.

Notification for Earning Money and Losing Money:

Earning Money notification makes users feel great.

Something Visual. Graphs for stocks are great, but if we did a graph and plotted how much users earned for a stock or for all their stocks on a graph users might be more attracted to keep going. Looking at stock prices is great and makes you smarter, but seeing a graph of how much I earn everyday is addictive (I read multiple stories on AMZ FBA sellers where sellers are addicted to the sellers app, because they see their bank account go up with each sale).

Losing feels bad, but if the loss is insignificant users will not mind trying again. If the user earns money on their next investment they will feel great and forget about that initial loss. I believe we can mimic the feeling of wanting to win the lotto or at a casino, but instead of stealing their money Sean makes the user smarter as they grow, so there is much more upside and much less downside as they learn.

Other Notes

Add a list of stocks that people should invest in that are in the $10 and under category. That way it’s easier and cheap for me to want to make my first investment. Stocks like apple and amazon might be too pricey for an avg person.

Maybe build the marketing voice to mimic the online gurus.

“I made X money since I have started without any formal education.” It is very salesy and pitchy, but seems to have a huge effect on people wanting to better their lives.

V. What’s Next

The benefit to Humanizing Tech is we get to concept many different products for how the future is going to play out. Things like EVERAE for finding luxury corporate gifts, things like The Base Code for trading, things like Biologic Intelligence for autonomous robotics, and on we go.

In this case, we don’t have time to build out The Base Code’s product so we’re looking for a scrappy young entrepreneur who’s interested in this topic and wants to build a startup of their own to help us with the concept and build.

Obviously we haven’t given away all the product mechanics of what’s required to make this successful and as is often the case, the devil is in the details, but it requires a leader to execute on it. We can help with the team, but you need to be committed.
