"Once a constitutional crisis becomes an endemic condition, the term no longer usefully describes our collapsing system. Instead, we live in an era of constitutional failure when the relevant institutions cannot fulfill their responsibilities."
—Jack Rakove, PhD, the Coe Professor of History and American Studies and professor of political science and (by courtesy) law, emeritus, at Stanford University.
The historian Jack Rakove makes a chilling case that we are now beyond calling what is happening with the Trump administration a "constitutional crisis." Rakove claims that what we are experiencing now is a "constitutional failure." Below are some excerpts.
The idea that the United States awaits some dread constitutional crisis has become commonplace. For lawyers, such a crisis would likely involve Donald Trump’s administration defying the Supreme Court on some critical ruling. [...] Such scenarios are not unfounded, but they do not diagnose our true malady. Our ongoing constitutional crisis began with the presidential election last November 5. Reelecting an individual culpable for January 6 who has twice made a mockery of the presidential oath of office is itself a constitutional crisis. Nothing in his past or current behavior suggests that Trump has ever felt fidelity to his constitutional duties.
Once a constitutional crisis becomes an endemic condition, the term no longer usefully describes our collapsing system. Instead, we live in an era of constitutional failure when the relevant institutions cannot fulfill their responsibilities.
Because constitutional failure is a term we have never needed to use, it merits a precise definition. First, it must identify the specific situations where the government institutions have manifestly not fulfilled their constitutional functions. Second, it should treat these omissions not as occasional lapses but systemic defects. Third, it must explain how the political and ethical norms of constitutional governance have evaporated.
To apply this framework to the second Trump administration is hardly difficult. The only problem is where to begin. Consider its authoritarian reliance on executive orders to vitiate legally established government activities, its attempt to intimidate institutions outside of government to do its bidding, and its insistence that servile loyalty to the president outweighs fidelity to constitutional norms. That some commentators describe this last practice as the "Führerprinzip"—the Nazi principle that the will of the leader transcends all legal norms—tells us everything.
Deciding whether the Constitution is failing requires asking if and why the other two branches of government have been remiss in checking a rogue executive.

okay this time i’m not trying to defend a borderline indefensible retcon, listen to me. fuckin grips you by the shoulders. listen to me. 8-ball deserves this.
he’s trying his best. he’s pathetic. he’s babygirl. he’s everything.
just look at him taking a bubble bath

he’s wearing his stupid fucking hat! he’s singing a johnny cash song about playing pool and he’s doing it a capella! he answers his phone with a silly little catchphrase! also moon knight has his fucking cell phone number!
or even just his first appearance in mk, absolutely getting his shit rocked IMMEDIATELY

(cropped to just show 8-ball relevant bits because the rest is badr being oblique and this isnt about him)
in his defense badr is not actually a civilian, but still. he is a total fucking wimp on every conceivable level, he has never won a fistfight, the first thing he ever says in mk (aside from “AAAAGGHHHH!”) is wait no please don’t cut my face off!
bonus: if he makes this round and probably even if he doesn’t i will make a post showing all the different ways it turns out a pool ball can emote, because for the uninitiated (and in case the bath thing didn’t make it obvious) we wears that thing all. the. fucking. time. and you would be shocked at how many feelings a pool ball can have.

you always land on all fours
#umineko#umineko spoilers#ikuko hachijo#ikukos turn for a more serious piece... the old man has reigned for too long#now. INCREDIBLY LONG INCOHERENT TAGS RANT INCOMING FAIR WARNING HAS BEEN GIVEN:#it makes me so so sad how little discussion there is about specifically ikuko because imho she fits so neatly into a lot of the more#overarching Big Themes of the game in a way that i have not ever really seen people take notice of or point out in a meaningful way#like even just off of the top of my head. the significance of names and what it means to go by a name that's Not Yours (she has like 4+)#what it Means to be a witch how it represents a person's deepest insecurities and flaws & how its at its core a coping mechanism#the fact that it takes two to create a universe and trying to do it on your own anyways has the capacity to bring you intense misery#^ (how she's shown to be extremely dismissive of her own work and skill until a collaborator comes into her life and helps/encourages her)#and even the family/patriarchy/misogyny stuff that is so prevalent in the rest of the game comes back around to her. even her Only Friend#(young&stupid atp to be fair) remarks that shes Weird for being unmarried + the little she does say about her past invites the question of#to what extent her self-image stems from her family deeming her a freak outcast & effectively disowning her while celebrating her brothers#and i have lot in my mind about the witch thing specifically because i think her particular situation is very reflective of what umineko's#entire magic system and fantasy facet as a whole is meant to represent for an individual. from what little we see of (what is presumably)#her Real personality she is shown to be deeply self conscious in a way that is JARRINGLY diametrically opposed to both 1.) what we see in#featherine and 2.) what we see when she is acting as a Public Figure. because both of the above are very much purposeful acts that she is#putting on in order to obfuscate her true self. and i have always been very resolute & adamant about not totally equating her to featherine#not only because im very firmly in the camp of “featherine is the avatar of the Pen Name & tohya is part of her too” but also very much b/c#i feel very strongly that the stark differences between the two are very centrally relevant to her character & her psyche. as is the case#with most other witches featherine's personality traits serve to reveal/magnify a lot of ikukos inner workings by playing on her#insecurities/reversing them e.g. ikuko being very quick to downplay her skill/achievements becomes featherine being the COMPLETE opposite#to the point where she barely registers even other witches as living beings rather than just fun touys. BUT even though i do champion the#ikuko/featherine separation so hard i ALSO think it is purposefully relevant that at first glance the line between them seems so blurry#her introduction implying a more nebulous separation between her reality/fantasy counterpart is i think is an intentional move on her part#like it is part of the front she is putting up when acting as the Author. as opposed to Ikuko the person who we (in a way ironically very#similar to the way that the Real Battler is presumably only shown during the boatscene) only very briefly get to see take up screentime#which even on a meta level lines up very well with her apparent underlying nature as a like. extremely private largely reserved/shy person#hit tag limit but if by some miracle anyone is still reading this thank you... please see ikuko with the love she deserves... ok ily byeee

Hi! I see you reblogged an OC ask game. Can I please ask for number 4. Does your OC have any scars or tattoos? You can do this for any OC you like, or more than just one. Hope you're having a good day ^_^
HI NAGI!! tysm for sending in an ask!! i wanted to draw more of my ocs but this is the most energy ive got in me for today waaah

Mela and Hiraya (and ther dad, Orbit) respectively! All my ocs have scars but I really wanted to show these two off bc of how prominent their scars are visually!
Mela has a sort of... lichtenburg + fractal wood burning scars on top of what is a literal burning marks on her hands and forearms! It's due to magic, and for those that don't know, Mela is a nature spirit! Tree girl! anything that burns affects her more harshly (physically) than those that don't. Her being literal wood mostly affects her extremities when it comes to magic :3 that's why her body can heal like a typical human body.
Hiraya, her younger brother, has a bunch of scars that I know comes from manual labor, training, and childhood shenanigans. The one on his eyebrow comes from an unfortunate careless childhood run in involving the kitchen, his growing horns and being uncoordinated. Lip comes from fighting during his teen years of people who wanted to eliminate his dad and Hira wanted to protect him, the ones on his arms, also training and fighting!
#oc ask answered#mailbox#my art#myart#ocs#oc art#oc lore#Oh also theyre adoptive siblings! throwin that out there! in case anyone wonders abt their moms or wtv#SERIOUSLY THO ty for the ask.... this is the most burst of energy ive ever gotten creatively for a wh i le#oc mela#oc hiraya#oc orbit#if anyone wants to find an oc ask game on my blog and send it#ive promised myself i'll draw either relevant things or them answering the questions so go aheaddd#ask game or just curiousity gooo

thinking suddenly of how chase was forced to be a caregiver and parent and take care of his mother and sister and resented them for it, hated them for it, how 20 years later he clearly is not over it at all, how he tries to deal with his problems alone, shutting people out (cursed. the mistake. the tyrant. chase.) because he doesn't believe people will want to help him, or at least that care and love are finite resources, that he will run out and be left alone.
(thinking also about how cameron views care as something of a necessary burden, how her husband's death made her miserable, how the death of her patient in one day one room left her miserable, how her lung cancer patient in acceptance left her miserable. how she frames it as important, necessary, that people should not die forgotten or alone, but she never takes any pride or joy in this: for all that she might be glad her husband didn't die alone, the grief warped and affected her for years; she never walks away unaffected or proud of her work but miserable, burnt out, terrified. how the only real difference between chase's burnout and cameron's is that she keeps choosing it, as some kind of penance or atonement or something: cameron is a martyr but never a happy one, and yet she, i think, wouldn't understand chase's misery over the same thing. it was always her choice. it was always important.)
and thinking also of thirteen and chase talking in s6. about how when thirteen's mother was dying, her father had an affair. chase commiserates: how heartless of him. thirteen counters: she's glad he wasn't alone. she knows she is dying, too. she knows someone will someday be helping her at that moment, how she hopes whoever is burdened with her care isn't alone. has someone else. isn't in a position like chase had to be. how she doesn't romanticize it, but how when it was her brother, she was alone, she tried to deal with it alone, how it almost broke her and then… she told chase. how it wasn't just about i did a murder, me too, but about that burden. that pain. how even if it was out of love, even if it was something she decided (like cameron decided), it tore thirteen apart. no one should be alone for that, she tells chase, and then a year later is alone for that.
i don't have any real conclusions here but - something about how much chase and thirteen's friendship means to me, i guess. how their lives are on such parallel tracks, how they do things and hate themselves for it and take on familial trauma and hate themselves for it and how they mask with drinking and partying and casual sex (and hate themselves for it). no one should deal with that alone, she says, and eventually they aren't, because they can offer it to one another.
#malpractice posting#and i do think the cameron example is an interesting point of the triangle#even if not immediately relevant#because she's an example of… the opposite case. the other case. telling herself she wants to do it and maybe even likes to do it#and maybe even thinking of herself as better -- a better person -- for doing it#does a lot as a shield. as a conviction. (she always had a much stronger sense of self than chase.)#but because so much of her self identity is of a person who makes these sacrifices willingly#noble suffering might be noble but it's also. suffering.#and the way chase and 13 just sort of stumble into finding the only other person in their lives who has ever really Gotten it#(chase telling adams in s8 and her immediate “but it was so noble of you”)#just means a lot to me. best friends offscreen etc etc.

love watching weather science videos but like. why am i 1000x more interested in tornadoes over hurricanes. they're both spinning air
#we wanted to be a stormchaser when we were younger#nowadays we have to worry about our health too much to have such a risky high-stress high reaction time job#been watching nothing but tornado history videos for days it's one of our intermittent special interests#stemming from the weather science workbook we OBSESSED over as a kid#would read that thing cover to cover multiple times a week. i was the kind of autistic who would read the Encyclopedia for fun#i actually had a fave encyclopedia entry as a kid and now i cannot fucking remember it 😭#i also learned what sex was through the encyclopedia 😭😭😭😭 was legit my first exposure to the concept#but like even though we watch A TON of weather videos including tons of stuff about thunderstorms and blizzards#(thunderstorms my fucking beloved. favourite weather pattern ever. cumulonimbus my bestest friend <3)#most of the videos we watch are mostly tornado videos. and hurricane videos feel boring to us#even though hurricanes are wayyy more powerful#tornadoes are still fucking powerful it's just more. concentrated#tornadoes to me feel Targeted like. that's weather that says Fuck YOU in particular actually#especially multivortex tornadoes where you can literally have two houses both in the middle of the storm at once#and still only one of them gets destroyed#or like pictures you can see of demolished houses with their mailbox in the yard simply untouched#i like to watch tornado videos bc they help me. prepare. just in case#our state gets hit with tornadoes pretty frequently though not as much as tornado alley#and i like to know all the information for sheltering and what to do in the event of a collapsed building and such#i have a little survival kit in the bathroom just in case with like basic first aid and a radio and bottled water#bc thats probably the safest room for me to be in since it's not near any external walls and also hiding in the tub is usually good#also in the event you're caught on the road during a tornado#DO NOT UNDER ANY CIRCUMSTANCE shelter under a bridge or overpass#those work basically like straws where as the air gets pushed through it goes MUCH faster and gets dangerous way easier#as far as im aware the best place to be is in a ditch or hole if you absolutely cannot find a shelter in time#if you do not have a car with roll protection then being in your car will probably be worse#NOT AN EXPERT THO pls verify this information on your own if you think it is relevant or necessary i have poor memory and can be stupid#i just know that overpasses are dangerous as hell

have this weird tinhatter hunch recently but I feel like GO S3 as an experience/era is going to be as revelatory for Michael and David's relationship, as it is for Aziraphale and Crowley's (obviously in some vastly differing ways, because this is reality vs. fiction)
something is brewing but I don't know what it is. I have historically not bought into rpf rhetoric for these two because of how bugfuck crazy it can get at times, but things feel....different, lately. Michael has been openly talking so much recently about his queer-coded identity or foundational experiences in the media and he CANNOT keep David's name out of his mouth. he specifically speaks about David more than literally anybody else; his partner, his children, his other coworkers, anybody. maybe it's coincidental or nothing out of the ordinary and I'm reading too much into imaginary subtext, but I'm really curious to see how things potentially develop over the next year or two as they film and promo S3 of the show. I did mention a few months back that Michael is coming up on his second Saturn return in the next 2ish years (age 57-60), and I think that will certainly pose an interesting hinge for anything pertinent to swivel on, especially if we don't see S3 of the show until 2027.
#I don't want to tag this with their names because people will come for me with pitchforks and I don't need that drama in my life lmao#just know it's not that serious and I don't make a habit of posting these thoughts on main so please spare me#I just wanted to mention it percolating in my brain in case it were to ever become relevant later

the fact that taylor not only announced an album called the tortured poets department on grammys which btw resembles the name of group chat in which joe alwyn was in but also dragged a known zionist lana del rey on stage after winning aoty and talked about how she impacted young artists during an ongoing genocide is just not sitting right to me. like, there's already so much hate against joe alwyn who has done nothing but stay silent after all the death threats, god only knows how much it will increase after her new album.
also, the fact that the term poets will be associated with her album rather than dead poets society is just not disappointing
Honestly, I've never cared about Grammys. And while I used to be a swiftie (ik, bleurghhh, everyone makes mistakes at 19, mine just happened to be a white billionaire instead of a boy 🤢), it is now difficult to care about her enough to even hate her.
But the fact that she chooses to stay silent I'm the face of genocide, with allllll this affluence that she's acquired over the years and with no threat to her actual career (let's be fr, who's gonna fire her? She works for herself ffs). And then she brings on stage an actual zionist supporter.... There really is no hope for this punk rock billionaire, at this point I feel bad for her exes.
#anti taylor swift#Swifties dni#Feel free to block the tag. Or even me. idc.#Also I don't entertain hate mail#Unless it's funny. In which case go ahead I'll have a laugh and totally consider posting it#Bonus if you have enough guts to go off of anon#I leave taylor swift supporters alone and expect the same decency from them okay#Also super sad about the dead poets society thing. That is a great piece of media. But I'm also sure swift won't be able to eclipse it out#Ever. Simply because it will always be more relevant than her. It's a classic. She's just trash no comparison fr.#anon ask#arushi rambles#asks

KEEP LIVING, ICHI............

#finished LAD. cried a little. ichiban is a new character of all time for me. nodding solemnly.#definitely some of the best overall writing from the series so far imo#only other game in the franchise other than y0 to make me tear up out of what i've gotten to#(still haven't played IW or gaiden [obvs] or the judgment games tho)#LOVED the story LOVED the characters (esp ichi oh my god i love him so)#only thing i didn't super love was the turn-based gameplay itself. could take it or leave it for the most part#but there's some fun elements to it for sure and the cutscene attacks are silly and neat#not the biggest fan of positioning being relevant to fights#while simultaneously being unable to meaningfully affect positioning as a player though#also fights that i assume were meant to be challenging never felt hard they only ever felt tedious#kiryu and tendo especially were not hard. just kinda long.#majima+saejima and sawashiro were a bit trickier for me but still not that bad#BUT there is still post-game stuff to do so we shall see!!#and it was still overall a fun time :]#and again the writing here was peak. loved it. a few nitpicks here and there but ultimately just really really enjoyed it#playing LAD really DID make me itch for smt v vengeance though. i want to play a turn-based rpg with a system i already know i love#(press turn system by eternal beloved)#but. money. alas. vengeance will have to wait...#ANYWAY. HAD A REALLY GOOD TIME WITH LAD.#trying to figure out if i wanna go to the judgment games or gaiden next...? might just keep it simple and go with release order#but i also wanna catch up on the mainline before the majima pirate game LOL#and i know i wanna play gaiden before IW in that case#HMMM.. much to think about#contra.txt#yakuza

Damnit lev lmfao. I was thinking about Shiva wearing corpse ash being resonant for other reasons, something about his relationship with the Bright Skinned Ones and death and whatever. No, no. More fucking importantly: Oh I wonder why Shiva is known for. you know. wearing bodies. his appearance is a mass of bodies joined together. yeah
#Leviathan is a mass of bodies. Shiva wears the ash of burned corpses. Transforming in both cases the masses into the Matter of the Bodiless#~abyssal murmurs#leviathan //#Maheshvara //#Not surprised this is coming up now he loves his fun fact time. Earlier I was poking at what he was doing#because he's... very distracted. And uh. Somewhere over yonder doing war stuff with people. And I was thinking about how he is just so many#circumstance based people at the same time. He'll be doing paperwork in a Royal Office somewhere and on a battlefield elsewhere and#running through the forest as a deer somewhere else and living as members of a school of fish in some transcendental lake#and scrying the pools of God and watching birds in a forest... and he incarnates here too and will be a chef downtown#and a teacher somewhere else up also doing paperwork and some dog on the street begging for food and and and#And over all of it... That central blissful mind that is water itself. all it's senses of self - emotions. thoughts. and so on - arising#from its various movements and shapes as reflections on the surface. But also... a sweet thing. Anyway#That black umbrella Lev that's deep and beyond names... beloved.... Searching for someone...#Shiva throws himself down into reality to bounce around as rays of light... the sun incarnating through the day sky into plants then into#animals and so on slowly recollecting more and more who he is. Searching for Shiva#always. Well. You found him. But then... Well. You go past the crying screaming stage of birth and then you get to fun#You gestate. You know who you are when the Sun's light touches your eyes. You scream at it. You change. You grow.#Then you learn the world is fun... People talk about how it seems ridiculous that someone who had achieved oneness would come back#and I wholly agree on a side thought relevant to that that most people who claim to know oneness don't know it#because the idea of oneness itself is actually a product of duality IE you have to be on a world where Two exists to understand One#One doesn't exist in a unified world. There's no One. In a unified world... So you can absolutely achieve a state of oneness while still#being non-unified if you don't truly get it... But anyway. On the why come back thing... Yeah people don't get it. But people who do get it#come back all the time. This reality is just an experience. You can spend your entire life asleep or you can come play and experience#So. Lev's incarnations on this plane mirror his incarnation of Shiva Into Bodies... He comes here to play games. He plays#He takes photos. He wanders. He plays music for people on street corners. He laughs. He loves. He suffers. He experiences.#Sometimes he doesn't understand. Sometimes he understands. Anyway.... Looking through his eyes... Iridescent scene of cranes#flying over a sunset more rich than I've ever seen on earth but so natural. Fire without fire. Water catching and soaking up every colour.
