Art News
The famous Autoportrait of John James Audubo-Dubon-Dubonnet as a New World Sparrow (Zonotrichia leucophrys) will be exposed for two months in the New York City Museum of Furry Art (Minnesota). This 2009 painting has been the center of media attention in the past, as it is the last recorded painting of John James Audubo-Dubon-Dubonnet before his mysterious disappearance.
Mr Audubo-Dubon-Dubonnet went missing in the early hours of the 16th of September 2009. The paint was still fresh on his canvas when his wife reported him missing. Despite a statewide manhunt with atist-sniffing hounds, helicopters with state-of-the-art oil paint sensors, béret-seeking nonlethal missiles, the artist was declared dead in absentia a month later.
The case was definitely closed in 2020. The local outdoor cat community celebrated the news through their spokesperson Matt Ou "We are glad to see Connecticut police put an end to years of suspicion and repeated harrassment, and remain convinced that Mr Audubo-Dubon-Dubonnet will reappear sooner or later and put an end to those silly rumours"

Part 1
That was how, in the end, you had ended up in this hideout with the supersoldier, though you had no idea how long you had already been in that cabin for there were no clocks and all the windows were totally blacked out. The only light came from the old lamps on the ceiling.
He had placed you in a room that hold only an old bed and if you had to go to the bathroom, you had to keep it in until he came to get you. That was the only indication on how much time might have gone by since THAT day.
The bathroom was on the other side of the small hallway, right opposite to ´your´ room. It only held the essentials as well: Toilet, shower, sink. Nothing more- not even a heater. He would allow you to be more or less alone in the bath whenever he allowed you to use it. Meaning he was standing in the open door, his broad back turned towards you, his head slightly turned so he would see you moving out of the corner of his eyes, should you decide to attack him.
Even though he never even spared a look at your body, you hurried up, not daring to give him a reason to do so.
Every time I see him he looks more and more ill- and tense.
The ´first´ incident happened when he opened your door for your now sixth bathroom-break. You were almost peeing your pants when he finally opened the door. You pushed past him and into the bathroom. Forgotten was your fear of him. The only thing mattering at that moment was relieving your bladder.
A sigh of relieve left your chest.
Finally-
Finished you looked up, only to see the man´s tense form standing right next to you.
Shit
“I am sorry. I really needed to pee.”, you whispered apologetic and slightly fearful.
His muscles were tense and eyes pointy; he didn’t like the way you had pushed past him. Finished your business, you stood up and got redressed- your eyes cast on the floor. You could feel his eyes burn into your skin and the hair on the back of your neck raised.
The very next second, your back crashed against the shower wall, your head hitting it a blink of an eye later. Stars danced before your eyes and every breath avoided for a few seconds.
Both of the man´s hand clenched in your shirt as he hold you in the air- your feed not even near the ground anymore and you had just been able to breath again, when your body slammed into the sink, from how he had thrown you aside.
Sharp pain shot through your sides and you slumped to the floor- crying. Every breath hurt like hell and the sobbing made it even worse while your vision became darker and darker.
It didn’t take long for you to lose consciousness.
_____
Slowly coming back to yourself, you noticed the cold tiles had swapped with something soft and warm. You were laying on your side, your hands on either side of your body, causing it to twist into a strange but still comfortable position.
Cool air brushed over you and you noticed your whole upper body was bare and still hurting like hell.
Being more or less out of it, you couldn’t fathom why you would be naked until a movement and something cold and hard against your skin caught your attention. The pain that erupted from that touch woke up your mind at once. Eyes huge with shock you jerked up, but a strong hand on your chest kept you plastered to the bed, you now noticed you were laying on.
It belonged to the Soldier.
What is he doing?!
“Don’t move.”, he growled, and you stopped pushing against his hand, laying back down knowing you could only let him do what he wanted to do.
He moved to straddle your hips and your breathing hitched in your throat. His flesh hand moved off your sternum and he leaned towards the side of the bed, grabbing something.
With every passing second you felt more and more exposed with your naked chest. Your eyed fell onto the metal hand the something he hold in it: a tube. It must have contained a salve of some sorts that was laced with pain-killers, because once he had began to spread it over your abdomen and ribs, the pain began to subdue.
Sighting you closed your eyes in contempt and you could feel your muscles to relax under his touch and at first you didn’t notice his movements had stopped, but finally you opened your eyes again.
You looked up only to find your captor looking down at you, a strange look on his face. His tired eyes burned with something you couldn’t read (But would find out soon), before he suddenly jerked away- almost like you had burned him- and he left the room. Leaving the door wide open.
What was that? What did I do? Please don’t let me have done something wrong. I don’t want to die.
When the initial shock of his rushed departure had left, your mind was immediately occupied with finding something to cover yourself with- but there was nothing more than the covers of the bed you usually slept beneath.
To be honest: his strange look had scared you and you wanted more than just thin air between you and him.
_____
It took a few hours for him to return to your room, where you had pulled the covers around your body, making you look like a mix of a burrito and E.T riding in the basked on the bike of the end of the movie.
The pain was almost gone (only uncomfortable aching was remaining) and you knew there were no broken rips inside your body, but that was about it.
“I am sorry.”, you apologised into the fabric, fearing he was still angry with you and came back to hurt you more. But he said nothing when he walked towards you, and neither did his eyes hint at anything that he would want to do.
“I did not mean to disrespect- Please don’t kill me. I just needed to pee so bad.”, you tried again.
Panic gripped at your heart and you were sure there was no heartbeat left when he stopped right in front of you (you were still sitting on the bed), that was how fast it was beating. And you wanted nothing more than scrambling away from him to the other side of the bed- but you knew it would be to no avail. He was too strong, big and fast for you to ever do that.
The swirling of his mechanical arm caught your attention again and you didn’t notice his other hand to get a grip on your cover before it was too late and the cover gone.
Shit. When did he get there!
His metal hand moved to rest on your shoulder before his thumb pressed against your jaw, making your head tilt back, giving him a better look at your throat and chest and his normal hand took a hold on your wrist, lifting your arm up and making hot pain shoot through your body. His metal h
A hiss of pain left your throat and you knew it was because of the painkillers wearing off.
You caught yourself hoping he was there to treat your injuries and not to intensify them.
He leaned forward, pushing you to lay back down on the bed, his knees on either side of your hips caging you in and keeping most of his weight off your body, though it was enough to make sure you could not move.
Releasing your jaw, he reached to get something out of his pocket- it was the salve.
Thank you-
“Don’t move.”, he ordered you again and you obliged.
He was surprisingly gentle in the way he spread the ointment and with him being this close, you were finally able to get another good look at your captor.
His eyes were glossy and tired- they reminded you of a zombie and no matter how awkward and threatening this situation was for you, you couldn’t but think about how ill he was looking.
The soldier must have noticed your stare, because his eyes locked with yours and he frowned; still spreading ointment on your sides and abdomen. It was then your head decided to remember you, you had hit it earlier: Sudden nausea overcame you and you had to close your eyes to not lose the non-existing stomach-content over yourself, the bed or him.
His movements faltered and you noticed him lean forward, both of his hands getting a gentle hold on your head and neck. Leaning back, he pulled you to a sitting position and against himself. That move antagonized your ribs, but your head was worse at that moment. His chest was pressed against yours, and he moved your head to rest against his shoulder with his hand immediately prodding at the back of your head to search for further injuries. And he found them causing you to yelp and almost puke. But the pain faded as soon as it had appeared.
Once again he felt you relax and once again he left the room with a start, leaving you half naked and shivering from the sudden loss of his body-heat.
At least he doesn’t seem to want me dead. But what does he want of me? Or is it Hydra?
___
It was another two hours later that you began thinking abut leaving the room. He had once again left the door to the room open and thirst began to torture your throat and mind.
It became so bad, it was unbearable and you walked towards the exit of the room; the cover once again draped around your body.
Maybe I should call out and ask him?
“Excuse me? May I leave the room to get something to drink?”, you called out and into the empty hallway. But there was no answer.
Waiting a minute or so, you tried again.
“The thirst is killing me. I will just get something to drink. If I am not allowed to do so, please let me know now.”
Again, no answer.
Well, better still hurry-
Within minutes you had found the kitchen and a glass that you filled with water from the tab. Drinking and refilling it at once.
You just wanted to return to your room with the glass of water, when you stood dead in your tracks.
There, in the middle of the doorway, stood your captor, his whole upper body bare. His trousers hung low on his hips and his breathing was deep and rigid. His muscles tense.
You did not even need to see his eyes to know that you wouldn´t like what was coming now.
He was seething with fury or anger and you had no means to hide or escape.
Fuck.

"writes dubcon therefore is a freak who should be bullied off the site" ho boy i'm fed up with people acting as if consenting adults writing [insert "problematic" fictional thing here] is the worst thing in the world. seen way too many people justifying harrassment of REAL PEOPLE by "they write thing that triggers me". ok, and? mute the tags or don't follow! "it triggers someone" is not a valid reason to ban a topic. piano music triggers me yet i don't go around demanding everyone stop playing the piano.
Anon, not only is everything you said absolutely valid, but also, thank you for demonstrating that triggers are incredibly varied and as such, we cannot predict everyone's triggers. Making the entire "point" of banning for possible triggers invalidated as hell.
We should be aware of things like the most commonly occurring phobias (things like arachnophobia and coulrophobia that are, additionally, easily triggered by imagery) and tag them. We should be aware of very obvious triggers, that are, again, easily set off by imagery, like blood, eye trauma, and depictions of domestic violence. And we should always read and be aware of our writing partners' stated triggers so that we can tag them appropriately or even decide that it isn't going to work because our muse, canon story, or interests are going to present an unfair situation in this partnership.
But triggers can be highly unusual, as well as activated differently (even at different times) for everyone. I'm not triggered by seeing hotel rooms in pictures or movies, I'm not triggered by writing scenes that take place in them, but I'm triggered to some degree by being in one. It's outrageous oversimplification to act like all triggers are the same, they all display the same way, they're all going to trigger someone on the same basis, everyone's going to react the same to their triggers. There is absolutely no way to prevent 100% of possible triggers for 100% of the population, 100% of the time.
Add to this that way too many people trivialize triggers by throwing around that term to justify the banning of something that makes them uncomfortable or that they take a personal, moral issue with. "I don't like this" and "I'm grossed out by this" and "this makes me feel uncomfortable" is not being triggered. It's just a good way to weaponize the better nature of other people so that they comply.
Most people legitimately do not want to trigger someone, especially if they have triggers and know what it's like. Just like no one wants to be accused of cruelty towards trauma survivors in general, or be designated a pedo, rape apologist, or fascist. They're all things to weaponize in order to isolate, shame, and control. And that's really fucking gross. These are serious, real things that have no business being trivialized to police content, win internet arguments, or garner popularity.
The potential for someone to be triggered isn't a reason to ban anything; we have tags, we have blacklist.
While I'll be the first to say that tumblr's blacklisting can be as shitty as everything else on the site, the primary issue with running into content you don't want to see comes down to two factors: no one tagging/tagging correctly and actively exposing yourself to that content. Going through people's properly done tags and blog warnings about their content in order to "call it out" is actively exposing yourself by choice. You actual walnuts.
Calling people on on their "problematic" content is bringing those topics to the attention of other people. That's the whole point of this gross behavior: look at the freak pedo abuse apologist I found, they write dubcon!! Don't look if you'll be triggered uwu
Buddy, pal, my guy...you just put that on blast for anyone to run across. Maybe their blacklist catches those words in your callout post, maybe it doesn't. Maybe they think you're a safe space because you promote yourself that way, so they click it anyway. Point is, you just willfully and irresponsibly exposed people because it's more important to you to demonize a rando on tumblr RPing something you take issue with. Good job!
Furthermore, dubcon itself is such a hilarious issue to take. Do they realize that isn't always sexual, or? Not? I'm thinking not. Funnily enough, one of the oldest posts I've been working on for this blog is about exactly this topic, the myriad situations that are dubious consent. That doesn't have to be sexual, and neither does it have to be intentionally predatory. You can come up with some amazing character development with a lot of muses in the RPC with dubcon because almost everyone's muse has some manner of trauma that might negate their perception of their own consent...and what do you do then? Is it removing more agency from that muse to shut them down, or is that always the better option? Can you separate your opinion as the mun from your muse's natural reactions? How does this impact the muses involved not just that moment but the next year?
Point is, dubcon isn't always some rapey situation. Even if it was, even if someone is writing it that way, it's literally not your business or your problem.
There's one mutual-in-law on my RP blog that really bothers me. They write things that I find fetishizing, incredibly rapey, all around shit that bothers me. I don't want to see it, some of the things they write makes my damn skin crawl. This person doesn't know it, we certainly don't speak and I don't think they like me very much, but I've repeatedly defended their right, specifically their right as a person with some long-term callouts on them, to write what they want to. I have them blocked and their urls blacklisted so I never have to see my mutual reblogging their threads. It's not a problem because I don't click "show anyway." Why would I, if it genuinely bothers me so much?
That's how you handle things that bother you; you use the tools available to not interact even by accident. Not by launching a morality crusade.
If any of us want to write what we enjoy, we have to allow others that same freedom. It's always a matter of time before this policing grows to include more and more topics, it's been used multiple times to get well-meaning people who don't fall into the general demographics to police queer, BIPOC, and other marginalized groups off of platforms. We've been fortunate in most of the RPC that it implodes on itself before it gets all the way there, but even so, you can see it.
It starts with things that produce a visceral reaction in the great majority of people, positions this with a repeatedly condemned idea presented as solid fact that fiction is reality, and you've got the start of something awful. Today it's something you don't like, maybe even something that triggers you, so you either support it or you quietly allow it to happen. Who needs to write that "freak shit" anyway, can't they just be gross privately? Six months from now, it's something "problematic" that you enjoy like violence that's canon-typical for your muse, or your OTP because they're gay and that's fetishizing, they're cis male and female but one or both is bi and that's bad representation, or they canonically have a rocky relationship so that's romanticizing toxic/abusive relationships.
If you can't care for any other reason, you really should care about how it is going to impact you sooner or later. In an environment like this, you can stay in your space, put warnings on your blog, and tag properly and you're still going to get a callout if the wrong person finds your blog. Just takes a single person with more time, energy, and skewed ideas of justice than they have reading comprehension or common sense.
Again, I cannot encourage people enough to give warnings, but it's difficult to ignore why those warnings are slipping; they're a way to be found, designated as a Problem, and called out. Look, it's another reason why callouts actually make things worse, not better! People put that shit in their rules so you can avoid content, they're being responsible and interested in promoting a safe RPC. Let them do it, damn.
You can't tag everything, and if you've never experienced what a giant series of repetitive tags is like on a screenreader you probably should before you tag seven paragraphs of possible issues. You can tag for visuals, you can tag for the obvious things, and you can tag for what's in the rules you agreed to when you followed/followed back. But you should also warn people that you write "dark topics" on the tin, and expand on that in your rules for specific things like graphic violence, toxic relationships, dubon, and addiction.
That's how responsible adults, not over-aged children, make better decisions about their mental health and general comfort. Not by appointing themselves the watchdogs of the damn RPC, here to protect you whether you want to be or not, find that incredibly insulting or not when you're in one of their categories of people who must be protected, by forcibly banning Problematic Everything. Problematic, of course, being entirely in the eye of the content police.
It's fiction. No one and nothing real was harmed. It's great that you are so invested in the fictional world and people that make you happy, but take a fucking big step back into reality. The real people you're harming with your bullshit had every right to peaceably exist. If what they're writing is triggering to you, stay. away. from. it.
Without any coincidence whatsoever, that's how you get from the base-point of Problematic Material to Problematic Mun. Yeah, it's just fiction, it's just RP, but I also took something out of context OOC or was upset by their tone on their own blog or couldn't exercise the minimal adult logic to remove myself from their presence OOC as well. So, now, you've got OOC behavior being added to the callout, if it wasn't already. Everyone is now ableist, transphobic, racist, and a misogynist because it lends that visceral reaction to the callout and ups the game from just being "y'all so gross you aged up a cartoon character to ship" to "this is REAL and it won't be tolerated! OP is actually a pedophile, they told a sexual joke in a discord server with a minor present and I have the receipts!"
What are the most storied callouts in the entire RPC? I'm absolutely certain the same names came to mind no matter what fandoms you're in, and one of them was "Matt." Another was probably "Ares/Snow". They're all successful and keep being brought up out of the closet anytime people are bored enough because their primary punch is the mun themselves being a predatory threat to the community. The mun is verified to be a bad person. Well, of course, that's got to be repeated, it worked. (Even if it did not, at all, work and only made it harder for people to avoid any of these muns.)
Are there people in the RPC who are legitimately a problem? Absolutely, yes. We're all supposed to be adults, however. Part of being an adult is having and acting upon one's agency. If someone is coercing you into things you are not comfortable with, shut it down. If you have difficulties being certain of those situations, run it by a trusted, honest friend or available, impartial source in the RPC for a second opinion. If you can't handle any manner of confrontation, there really are situations in which it's perfectly alright to block someone without any discussion. It's just the internet, you're in control of your space. Own it.
Minors are a whole other can of fucked up worms I'm not even getting into right now except to say that because a minor exists in a space they were told to stay out of does not mean we ban all topics inappropriate for their consumption.
tl;dr: banning shit doesn't work anyway, the whole idea is predicated upon some incredibly problematic takes IRL, and no, there's no justification for it outside of intense personal problems with one's own importance. That energy would be infinitely better spent volunteering one's time to help real people in crisis or after surviving one, or even oneself in developing some healthier approaches and thought patterns.

Fourth of July mass shooting plot targeting Dogwood Dell stopped with help of ‘hero citizen’ RICHMOND, Va. (WRIC) — Richmond police said a tip from a “hero citizen” led to an investigation that thwarted a mass shooting plot targeting the city’s Fourth of July celebration at Dogwood Dell. Authorities arrested two men and seized assault rifles, a handgun and rounds of ammunition from a residence on Columbia Street after receiving an anonymous tip from someone who had overheard plans for a mass shooting in Richmond during the holiday. Richmond Mayor Levar Stoney and police Chief Gerald Smith addressed the alleged plot during a press conference Wednesday. “Our officers quietly investigated and collaborated to stop what could have been a terrible day for the city of Richmond,” Stoney said. “No community is immune [from mass shootings].” Dogwood Dell was identified as the target for the planned mass shooting after a citizen “overheard a conversation” about the plot and alerted police, Chief Smith said. The tip led officers to a home where 52-year-old Julio Alvardo-Dubon and 38-year-old Rolman A. Balacarcel, of Richmond, had been living. When Alvardo-Dubon opened the door, officers saw a gun in plain sight and requested entry to the home. Police then went into Alvardo-Dubon’s room that he was renting, which is where officers found all of the guns and ammunition. Chief Smith said authorities seized two AR-15 assault rifles, one handgun and more than 200 rounds of ammunition from a residence in the 3100 block of Columbia Street on July 1. A Richmond spokesperson later confirmed to 8News that a mix of 9mm and .223 caliber assault weapon ammunition was found. The Nature of Photography - continued
Photographers are unlike any other artists. These people use their tools to capture chaos and orderlessness into a still, tranquil moment. This can be done through cutting out certain parts of a frame or including different parts of the frame. This can alter the image drastically, to the point where it will lose its meaning completely for one that is opposite. It is also important to note that with photography, one must capture the moment just right. In the photograph Dubo, Dubon, Dubonet, Paris, one sees the man walking precisely in the middle of the open space. If this image were to be taken milliseconds later, it would not be the same. Out of chaos, photographers generate their own interpretation of tranquility, peace, and balance.

Naval Guns
Tumblr media
Intro
Last week we talked about land based artillery, today I will be referring to naval artillery. These guns will be the ones used by the country’s titans of the sea. Naval artillery dates back to the Middle Ages with canons on the deck of ships but there is evidence that suggest the Roman Empire had catapults. Later on they became more integrated into the structure of the ship such as having windows for the canine to pop out instead of just having them on the deck. This type of artillery is for anti-ship use, bombarding the shores, and anti-aircraft use. With that said I will be referring to the Type 94 which lied on the Japanese battleship Yamato. On the fictional side we have the Octuple Barbette which were standard on most Imperial Star Destroyers.
Tumblr media
Media Portrayals
The Imperial Star Destroyer was a visible representation of how the empire rules through fear, but what is a ship alone without its weaponry. The Octuple Barbette was a turbo battery consisting of eight turbo lasers. One of these battery’s was a deadly force to be are reckoned. Now consider that the ISD had four on each side of the ship. The way a turbo laser works, so basically turbo lasers are just supersizes laser blasters which I’ve already covered. How they work is that a laser beam based through dubonic gas which ignites it and converts it to plasma. The bolt becomes more powerful due to the two step process. The bolt then passes through a cooling sleeve so the gun doesn’t overheat. It then goes through the Galvan Coil which makes the bolt stay together by magnetizing it. The armor was comprised of quadinium which was effective against light laser cannons of interceptors. It had sensors to communicate with the targeting computers. This also controlled the rate of fire.

Our Technology
The Type 94 was the gun in the Japanese battleship Yamato. These arteries were used. It carried 3 of the guns and the Yamato had three batteries having nine guns in total. Each gun had an 18 inch caliber making each round deadly to the enemy ship. Each shell weighed about 1.5 tons and could travel 2,600 feet per second. The guns were controlled by a fire control system directs its firing perimeters and range. The Type 94 had an effective firing range of 16. The gun had men inside to load projectiles into the hoist of the gun from the magazine which would lead to the shells to the top where the gun house was, then a tube would take the projectile level it with the gun and then it would shoot out. The gun could fire armor piercing and explosive shells alike.
Tumblr media
Conclusion
The Type 94 was an impressive and imposing piece of work. Unfortunately the Yamato along with its guns saw very little action in World War 2. The Octuple Barbette on the ISD was also a worthy foe was extremely weak towards aircraft. Of course the preferred gun would by the Octuple Barbette because it is more deadlier and had a larger range sine these were the types of gun that the Imperials used to commit orbital bombardments on planets.

Astros Avoid Sweep.
Astros 5 Twins 1 W-Brown (1-0) L-Mahle (1-1)
The Minnesota Twins have pitched their way to a (6-2) record in the first week of the season. The offense has been spotty at times and was today against young phenom Hunter Brown. The Astros gave him some run support in the third with a Mauricio Dubon one-out infield single. The next batter, Chas McCormick smoked a Tyler Mahle slider out to right for a two-run blast. Houston took a two-run lead after three innings of play. The Twins would get to work in the fourth as Byron Buxton reached on an infield single to third. He reached second on a bad throw from Alex Bregman and Donovan Solano doubled him home. Minnesota was within a run after four frames. The Astros would get that run back and more in the fifth. Jeremy Pena led-off with a single to left and Mauricio Dubon doubled to left. Chas McCormick knocked in a pair with a single to center and Houston had a 4-1 lead. Meanwhile, Hunter Brown was solid through seven very strong innings. The Astros had one more rally left in them in the eighth when Jorge Alcala walked the first two batters. Jose Abreu reached on a infield single with lots of English on the ball. Later in the inning, Jeremy Pena hit a run-scoring double to left and the Astros lead grew to four. Bryan Abreu struck out the side in the eighth and Ryan Pressly had a 1-2-3 eighth as the Astros avoided the sweep today at Target Field.
-Final Thoughts- Tyler Mahle had an up-and-down start today. He went six innings and allowed four runs on eight hits with a walk and six strikeouts. Jorge Alcala gave up a run over 1 2/3 innings with two walks and a strikeout. Emilio Pagan got the last four outs. The Twins had just two hits on the day and went 1-for-6 with men in scoring position. They left three men on base. Joey Gallo still hasn’t played since the Miami series, so Monday will be decision day on whether he goes on the injured list or not. Tomorrow, Dylan Cease faces Kenta Maeda as the White Sox come to town for a Monday matinee.

Stamford man, 51, charged with stalking girl, 15
The arrest of Julio Garcia Dubon of Anderson Street stems from a complaint made to police in March by the girl’s mother who reported that her daughter was being stalked by an older man who had been warned to stay away from the same girl a year earlier. According to Garcia-Dubon’s four-page arrest warrant, the girl’s mother came to police headquarters and said an unknown man had followed her daughter home from Stamford Academy on March 15. [...] the mother complained to police that in two incidents in March 2015 the man offered the girl money to get into the back of his pickup truck and a couple days later walked up to the girl with a handful of dollar bills, his arrest affidavit said. 3-Year-Old Girl, Separated From Father at Border, Sent to Aunt 2 Months Later
A 3-year-old girl from Honduras was united with her aunt in Frisco, Texas, on Monday after she became separated from her father crossing the border two months ago.
The girl somehow ended up in Reading, Pennsylvania, and was escorted to DFW Airport Monday afternoon by a social worker.
Waiting for the flight to arrive in Terminal E, her aunt, Glenda Aleman, could hardly contain her emotions.
"I've waited for this moment for a long time," Aleman said in Spanish.
Clutching balloons that say "Princess," she waited for her young niece she had met before only on video chats and seen in photos.
NBC DFW is not identifying the girl because of her age and because it's unclear what she's gone through during the separation.
Aleman says the girl's father was targeted by criminal gangs in Honduras and wanted to escape the violence.
The two crossed the border in June intending to apply for asylum.
The father, Osman Dubon-Venegas, was arrested and remains in jail in New Mexico. According to court records, he faces a charge of re-entering the U.S. after he was deported in 2012. He also had been previously convicted of vandalism.
The first two weeks after his arrest, the girl's family says they had no idea where she was.
"It was a very difficult time not knowing about her,” Aleman said.
Somehow the girl ended up in Pennsylvania with a nonprofit group, which arranged for a flight to DFW so she can stay with her aunt.
A social worker escorted the child for the cross-country trip.
As other passengers claimed their baggage, the girl hugged her aunt and cousin, who also is 3-years-old.
It's a scene being repeated as children become separated from their parents crossing the border, only to be united weeks or months later with relatives already living in the U.S.
The outcome of her father's court case is far from clear.
And her mother? She's still back home in Honduras. She spoke with us via Facetime.
"I feel more at peace because she's now with my sister," said Lucia Patricia Aleman Garay. "This process has been the most difficult in my life."
She said she has no idea when she'll see her daughter -- or her husband -- again.
Asked about the case, a spokesman for Immigration and Customs Enforcement referred questions to another agency, Customs and Border Protection.
A CBP spokeswoman in Houston said she would work on providing information on Tuesday.

Dubon's singular journey leads from Honduras to majors
http://tinyurl.com/yxrtzfp7 In so some ways, Mauricio Dubon’s ascent to the massive leagues has been uncommon. Level No. 1 is easy: No main league participant has ever been born-and-raised in Honduras. On Sunday, the Milwaukee Brewers prospect grew to become the primary. The remainder is extra sophisticated. It is a matter of views, and Dubon has had many. Minor league baseball is a system marked by huge inequality, and Dubon has skilled it from all sides. He is been an outsider, an underdog and a no one who can barely afford his personal gear. He is come out the opposite finish, then been knocked down a number of pegs and compelled to struggle his method again. Alongside the way in which, he is seen up shut what life is like for gamers with extra fortune and gamers with out. On Sunday, the Brewers referred to as up the 24-year-old for his main league debut. ”I am blessed,” he informed The Related Press throughout spring coaching in Phoenix. It began with one distinctive bit of fine luck, and a most daring and tough determination. Not like most worldwide baseball prospects, Dubon wasn’t found by a scout. His journey to the U.S. was began by a chaperone for a Christian mission group that was donating baseball gear in Honduras. Dubon was 15 when he met Andy Ritchey, who was struck by the teen’s sturdy arm and quick toes. A couple of days after their first assembly, Dubon was on a airplane, prepared to start out a brand new life with the Ritchey household in Sacramento, California. That was the primary main stroke of luck for Dubon, but it surely additionally offered a most tough problem. Instantly and unexpectedly, he was abroad, faraway from everybody in his life to that time. Although he knew some English, language was nonetheless a problem. However the homesickness is what left him crying every night time. Dubon informed himself it will be price it if it meant an opportunity at an American baseball profession. The Boston Pink Sox made that dream a actuality, deciding on Dubon within the 26th spherical of the 2013 draft. Dubon turned 19 that summer time, and after signing his contract, he performed out the season with the membership’s rookie-level Gulf Coast League affiliate. His transition to professional ball wasn’t as jarring for some teammates. The staff housed gamers in a lodge close to its advanced in Fort Myers, Florida, and Dubon noticed many gamers combating the identical homesickness he skilled transferring to Sacramento. ”They’d by no means been away from their mother and father till then,” he stated. ”Going there and struggling and all the things, it is a bit overwhelming.” The funds have been additionally robust. Boston stored Dubon housed and fed, however he was on his personal for all the things else. Gamers within the minor leagues are accountable for their very own gear, and shopping for gloves and bats may be tough for gamers making as little as $3,300 per season. Some gamers are fortunate sufficient to get hefty signing bonuses that cowl these prices. Others would possibly get assist from their agent. Dubon had neither. His older brother purchased him six wooden bats, and at first, Dubon was hesitant to make use of them towards hard-throwing pitchers for worry of breaking one. For the remaining, he and his teammates used to go to a Ross division retailer. He remembers shopping for cleats for $13 and making an attempt to make them final till season’s finish. ”That is the kind of stuff I needed to do to be the place I’m proper now,” Dubon stated. ”It isn’t good in any respect. However, I imply, you are simply making an attempt to avoid wasting and make my cash final.” Dubon struggled that first 12 months, batting .245 with six errors in 20 video games. He confirmed extra promise the following 12 months, hitting .320 in short-season ball, and that despatched him into the 2015 season looking forward to a beginning job with Class A Greenville. That spring, Dubon made two of his now-closest mates in baseball. The primary was Rafael Devers, a slugger who had signed out of the Dominican Republic for a $1.5 million bonus. The opposite was Yoan Moncada, a generational expertise from Cuba who received $31.5 million from Boston, which additionally paid a 100 % tax to Main League Baseball for surpassing worldwide spending limits. Dubon grew to become instrumental to the event of these younger gamers, each of whom are actually starring within the majors. Dubon was totally bilingual by that time and accustomed to life within the U.S. For Devers, Moncada and different Latin gamers, he grew to become a go-to translator. It helped across the clubhouse, and it actually helped outdoors it – like when the group made its near-nightly burrito runs to Moe’s. Story continues ”After I received right here, he was at all times useful with me,” Devers stated by way of translator. ”All the time being obtainable for me and simply educating me issues I did not know earlier than.” ”He had a connecting character,” then-Greenville coach Darren Fenster stated. ”He was a glue man in our clubhouse and on the sector.” Dubon, Devers, Moncada and three different gamers rented an residence collectively in Greenville for the 2015 season – regardless of the disparity of their signing bonuses, Dubon insisted on paying an equal share. Sometimes – and at all times on the sly – Devers or Moncada would decide up a restaurant invoice or another expense, a quiet gesture that helped Dubon and different teammates get by. On the sector, all the things clicked. Dubon hit .301 and stole 18 bases in half a season, then received promoted to high-A Salem. His pay was nonetheless meager, however by that time, he had been picked up by a significant company that was sending him high-end gear. ”Earlier than, I used to go (by way of) two pair of spikes a 12 months,” Dubon stated. ”Now, I received at the least three pairs a month. It was a reduction.” The subsequent 12 months, Boston traded Dubon to Milwaukee, and he continued to blossom within the Brewers’ system. He batted .343 in 27 video games with Triple-A Colorado Springs final 12 months earlier than tearing his ACL, sidelining him for the remainder of the season. A 12 months later, he returned to Triple-A, the place he was batting .307 with a career-high 14 homers. He has been on the 40-man roster the previous two seasons, that means he received a increase from a number of thousand {dollars} to at the least the MLB-mandated $44,500 per 12 months. He hasn’t forgotten his Honduran roots. He is a little bit of a star when he goes residence, and he thinks his ascent helps develop the sport there. ”It is altering a bit bit for the nice,” he stated. ”It is slowly, but it surely’s moving into a superb route proper now.” He additionally hasn’t forgotten his days in $13 cleats. Though he is not out campaigning for higher minor league pay, he is desperate to see that change. ”I imply, why not?” Dubon stated. ”This can be a laborious job. It is a laborious job. These guys deserve higher than what they get proper now. I am blessed sufficient to be on the 40-man now, I make first rate cash now, however nonetheless, a few of the guys, like I see a few of the guys do not even eat, simply making an attempt to economize. ”Skipping meals simply to attempt to get cash and all the things. It could be good to get a increase for guys like that.” — Comply with Jake Seiner: https://twitter.com/Jake-Seiner — Extra AP MLB: https://apnews.com/MLB and https://twitter.com/AP-Sports activities Source link

INTERNATIONAL TRADE LAWM. VioletteINSEEC Msc International Business Management Class 2ASSIGNMENT CLASS 2 CASE STUDY1 / 15Instructions :The written memorandum must be submitted by January 19 at noon, onYou are employed by one of the two companies involved in the situation described below. Which company will be indicated to you.You will have to write a memorandum containing between 1.000 and 2.000 words explaining what you think the legal situation of the company is. You will be careful to present the case in the best light for your company, and with the strongest arguments you can find in favor of your company. It would also be a good idea to try to anticipate the arguments of the other company, and prepare your own arguments to refute them. There is one important rule to remember: NEVER INVENT NEW FACTS. Stick to what is described here. Ask for clarifications if needed. You should pay attention to the following: what are the legal issues? (i.e. points that can be discussed from a legal perspective) for each issue, what arguments can be presented in favor of your company? what are the strengths and the weaknesses of those arguments? determine which articles of the CISG best support the claim of your company? determine which articles of the CISG can be used to oppose the other party’s claim? To help you in your task, please take note of the following:1/ in order to simplify things and avoid getting lost in the Convention on International Contracts for the Sale of Goods, only consider the articles that are provided inside of this document (see page 6). Do not refer to other articles, even when they seem relevant.2/ in order to allow you to go further in the analysis of the articles of the CISG provided, you may use extra material that can be accessed online, and is linked to the articles of the CISG listed below (see page 6 below). It will only be useful to refer to the material you will find there when the legal situation is ambiguous, and, on the face of the text of the CISG, seems to be able to be argued both ways (both in favor of your company, or in favor of the other company). If and when you use what you read online, make sure to make clear references that I can check afterward, for example in a footnote, with a link to the document. 2 / 153/ you do not have to refer to any scholarly writing, but you may do so if you think that would be helpful.Try to be as organized as possible, break down the case in several different points that you will discuss one after the other. For each point, start by stating what the problem is, then refer to the law (text of the relevant legislation, for example the CISG, or reference to the Rome I Regulation, etc.), then discuss how the law applies to the facts, and conclude. Ability to present your arguments clearly will be taken into account in final grade. The pleadings are a summary of your written submission. The main difference is that you will have to stress the arguments in favor of your company, and you will have to be more more concise since you will not have a lot of time to speak. Each student in the team must take part in the pleadings. Each team will have 8 minutes to plead ( 2 minutes rebuttal). Defendant will start for 8 minutes, then Claimant will be allowed to speak for 8 minutes. After that, Defendant may speak again for 2 minutes for a quick answer to the arguments of Claimant, and Claimant may speak again 2 minutes to answer to that. The pleadings should have this structure:Grade will be determined as follows: written submission: 50% oral pleadings: 50%3 / 151/ The facts of the case Dubon S.A. is a major building company that is based in Boulogne-Billancourt (France). It specializes in building shopping malls and big commercial outlets, and has been a very successful business (€180,000,000 turnover in 2018). One of its latest projects involves building a supermarket near Lyon. Dubon’s client insists that the new supermarket meet very high energy saving standards, and, for that reason, Dubon has had to design the place in a whole new manner, using modern materials and techniques to reduce energy spending while maintaining building costs acceptably low.For that reason, Dubon has elected to install geothermal hybrid heat pumps (GHHP) for the cooling (in summer) and heating (in winter) of the building. The cost of the installation is higher than that of a standard system, but in the long run it should provide savings because of its high efficiency, and it is also “greener” than a standard installation for the same reasons. The client therefore agrees to Dubon’s plans to use GHHP in the building. There is plenty of time to manufacture and install the heat pumps since the building only has to be completed in July of 2020. As long as the heat pumps can be incorporated into the building no later than March 2019, the project will be delivered in time. This technology is not very much developed in France yet, so that Dubon SA contacts an American firm, HeatSink Inc., to procure the GHHPs that are needed to complete the works. HeatSink is a small American company based in Seattle, Washington (US), that has been designing and constructing high quality, very efficient heat pumps for the American market for more than 20 years, and has some cutting-edge technology.Ms Mercadier, who is the Project Supervisor for the construction of the supermarket at Dubon S.A., gets in touch with Mr Hockett, who is the World Sales Representative for HeatSink in the US. HeatSink does not have representatives in Europe, and most contacts with European clients happen by way of email, except for the initial contact, which is a phone conversation.Ms Mercadier inquires about the existence of a model of pumps that would satisfy the needs of Dubon’s client, and the conversation gives her satisfaction. She then enters into an exchange of emails with Mr Hockett to discuss the contract of sale between the two companies (Exhibits 1 to 4 below). After the emails were exchanged, HeatSink Inc. prepared the order of 10 heat pumps for shipping. They were packaged, and a freight forwarder took them in charge on November 3rd 2018 (The shipment was not made under an INCOTERM.). At the same time, Dubon SA ordered its bank to pay the two instalments, which was received by HeatSink’s bank. The pumps are delivered on4 / 15November 30th, when the agreed delivery date was December 1st.However, upon delivery, Mr Büchner, the lead engineer of Dubon SA on site, realizes thatthe electrical specifications indicated in the contract are not met by the pumps: the employees of HeatSink Inc. forgot that the power supplies of the machines should be adapted to French power specifications. This technical requirement was made clear in the contract (see Exhibit 4).For Dubon SA, the cost of having a French company replace all relevant electrical components and power supply would amount to US$9,000. They require HeatSink Inc. to pay them that amount of money. (see Exhibit 5)HeatSink Inc. are sure they can fix the machines more easily, and at a lesser cost. Their engineers estimate that it would cost them between $4,000 and $6,000 to do the repair themselves, on site, in France, all included. Therefore, HeatSink Inc. offer to remedy the defect of the heat pumps themselves. Dubon SA answer they insist on receiving $9,000 (see Exhibits 6 to 9).HeatSink Inc. consider that, given more time, they could perform the contract satisfactorily, and that their offer to cure is reasonable. They reject any claim that they would have to pay $9,000 damages.Dubon SA need the pumps, and, therefore, they do not want to avoid the contract. They would like to claim damages instead, in the amount of US$9,000 for replacing the power supply.HeatSink Inc. introduces an action in court in France. The French court agrees that the proceedings will be in English. HeatSink Inc. consider that the contract is governed by the law of the State of Washington. They ask for the application of the CISG. They want to be given an occasion to cure under article 48.Dubon SA considers that the contract is governed by French law. They reject application of the CISG. They refuse to let HeatSink Inc. cure their bad performance, and they want to be paid $9,000 in damages.Questions to be discussed before the court:Dubon SA obtain the $9,000 they are claiming?5 / 152/ Relevant articles of the CISG (do not use any other CISG article than those listed here)Article 1(1) This Convention applies to contracts of sale of goods between parties whose places of business are in different States:(a) when the States are Contracting States; or(b) when the rules of private international law lead to the application of the law of a Contracting State. The Brewers Are Rebuilding and Reloading at the Same Time
In baseball, we typically see two kinds of roster teardowns: Rebuilds, and reloads.
Rebuilds can certainly be effective, but they involve waiting years for talents to develop, and almost assuredly lead to lean years of competitiveness. Reloads, on the other hands, see teams going after stopgaps to fill their holes. It leads to less awfulness, but it also generally means less long-term stability.
So, a club that isn't good enough to compete as is has two options: Rebuild and hope you nail the player development, or reload and hope you guessed right in trades and free agency. It's usually one or the other.
The Milwaukee Brewers have shown you can do both. Despite a rough start to the second-half of the season, the Brewers are still very much in the NL Central race, sitting just a half-game back of the Chicago Cubs as of Wednesday. This despite Milwaukee being picked to finish fourth in their division by most prognosticators; most projection systems had them winning between 74-76 games.
So, how have they done it? How have the Brewers gone from a team that wasn't supposed to be in contention this season to a legit playoff contenders so quickly?
It helps when you start with one of the best front offices in the sport.
When the Brewers hired David Stearns, it was was seen as a risky move by many in the industry. Stearns was an Ivy League guy—the type who the analytics-inclined adore and the "old-school" thinkers fear, and he was hired at an age where players are often just leaving their prime. That risk appears to have paid off, as he's quickly become one of the most respected general managers in all of baseball.
"It's weird to say, but he and the organization is one you kind of fear," an AL Executive said. "They're just so good right now at so many different aspects. They draft well, they develop well, they read the market well. That's a tough combination to beat, and a lot of the credit goes to Stearns and his staff."
That staff doesn't get the attention of some of the other regimes, but it's a group that's envied by much of the league. Matt Arnold was brought over from Tampa Bay to be Stearns right-hand man, and he's likely to be a candidate for any General Manager position that opens up this winter. Director of Baseball Research And Development Dan Turkenkopf was one of the developers of the Deserved Run Average stat—a statistic that has quickly made waves through the analytic community—and is just one of several gurus that give Milwaukee a strong sabermetric base.
But perhaps the biggest addition to the Brewers staff has been Ray Montgomery, the Brewers Vice President of Scouting. Before Montgomery joining Milwaukee, the Brewers had a reputation as a bad drafting club.
"[The Brewers] missed a lot," an AL Scouting Director missed. "There's several selections you can point to in the earlier part of the decade, but there was a reason that they were easily the worst farm system in baseball. Then Ray got there, and now they have one of the best. That's no coincidence."
While the Brewers farm system was atrocious before the additions of Montgomery and company, it's fair to say that the big-league talent that was inherited from former GM Doug Melvin wasn't. This is perhaps an underrated story of why the Brewers have exceeded expectations.
Stearns was given Ryan Braun, a potential Hall of Famer who has been of the best right-handed hitters in baseball over the past decade. He inherited Jonathan Lucroy and Carlos Gomez; two players that he was able to move for multiple top 100 prospects. There was also Orlando Arcia and Jimmy Nelson who were signed/drafted under the Melvin era and have since improved.
This may seem like an attempt to deny Stearns credit, but it's not. Quite the opposite, actually. It would have been easy for Milwaukee to tear the entire team down—especially when you looked at what the Cubs and Pirates were building. Instead, the Brewers have rebuilt by trading players like Lucroy, Gomez and more, but they've also held onto Braun, and they've been willing to add veterans like Eric Thames, Travis Shaw, Eric Sogard who have been a tremendous part of their success in 2017.
"It would have been so tempting to move all of those guys, the AL Executive said. "And to be fair, they did move quite a bit of talent. But think of how tempting it'd be to try and move Braun before his 10-5 rights kicked in. There's no way they're in contention without his bat, not a chance. "
Perhaps the best example of the rebuild/reload strategy was the move of Tyler Thornburg to the Red Sox. Thornburg was one of the most coveted relievers of the winter, and Milwaukee could have had their pick of quality prospects from contending clubs, or a club-controlled piece that could help them in 2017 and beyond. The Brewers got both. Shaw leads the team in WAR and has been among the best third baseman in the National League, and Mauricio Dubon looks like a future major-league regular who can impact the game with his bat, glove and wheels. The fact that Thornburg ended up getting hurt makes the deal look even sweeter, but even if he had been healthy, this would have been a win for the Brew Crew.
Of course, it has to be mentioned that one of the reasons that Milwaukee has had so much success this year is luck Even with the Cubs recent two-week stretch, it's easy to call Chicago a disappointment, considering the expectations. St. Louis and Pittsburgh were both considered potential wild-card contenders, and they've both hovered around .500 for most of the year. Add in the clearly rebuilding and not reloading Reds in their own division, and the fact that 80 percent of the NL East and 40 percent of the NL West are bad baseball teams, and, well, you have a lot of winnable games on your schedule.
But luck is far from the only reason the Brewers have a chance to play in October. Milwaukee has a run-differential of +41, so it's not as if they're just winning a bunch of one-run games that will likely turn on them. In fact, the Brewers pythag record is one game better than their actual win-loss record (55-47 to 54-48, respectively), so if anything, the Brewers have been unlucky.
And the talent is legit. In addition to Braun, Milwaukee also has Domingo Santana in the outfield, and he's quietly put up an OPS of .874 as a 24-year-old. Arcia has bounced back from the "struggles" of his rookie year, and has shown a flair for the dramatic and spectacular. Nelson has turned into a legitimate top of the rotation starter who can miss bats and limit self-inflicted damage. Thames has struggled for the past month or so, but the production he's given Milwaukee (.912 OPS, 24 homers) has been an obvious coup for the club. Add that to a farm system that has six players in the MLB.com top 100, and you can see why this is a team that's built to win now and later.
It's going to be tough for Milwaukee to hold off the Cubs. As talented as the Brewers are, Chicago is on a different level, and the addition of Jose Quintana won't make things any easier. They may not have to hold off Chicago though. The Rockies and Diamondbacks are both obviously talented, but flawed. The Brewers also have a deep enough farm system that they can easily make an addition to the lineup, rotation or bullpen without destroying the depth.
It's no fun to watch a team tank. Whether you think it's an ethical way to build a roster or not, there's no denying that it hurts the fans to see a team suck year after year. That said, it's also no fun to see a team stuck in purgatory; unwilling to commit to a youth movement and stuck in the 75 to 85 win range. That's a more enjoyable on-field product, but it makes it hard to achieve the ultimate prize. The Brewers have found a way to both, and it's commendable not only from a baseball standpoint, but in a weird way, from a decency point of view as well.

Red Sox acquire Addison Reed from Mets for 3 relief prospects
The Red Sox got the reliever they were hoping they had already added this offseason.
Five teams were still in on Mets’ reliever Addison Reed as of Sunday, but the Red Sox were the ones to land him. According to Yahoo!’s Tim Brown, Boston acquired Reed from the Mets in exchange for three minor-league players. Alex Speier would later confirm these players as relievers Jamie Callahan, Gerson Bautista, and Stephen Nogosek.
The Red Sox bullpen isn’t bad, but it’s also not what it was drawn up to be. This past offseason, the Sox traded Travis Shaw and prospect Mauricio Dubon to the Brewers for Tyler Thornburg and his years of remaining team control, but he’s out for 2017 after undergoing thoracic outlet surgery. Carson Smith, acquired the offseason before from the Mariners, is yet to pitch for Boston in 2016 while he recovers from Tommy John surgery. That’s where Reed is supposed to help out, as his presence means fewer high-leverage inning with Matt Barnes in them, innings Barnes was never supposed to have in the first place.
Reed has a 2.57 ERA with eight times as many strikeouts as walks in 2017, and an overall 2.09 ERA during his three seasons with the Mets. The former closer had a career revival in the move to setup work, but has logged 19 saves for the Mets with Jeurys Familia out due to suspension and injury. With the Sox, Reed will slot in as a setup man behind closer Craig Kimbrel, a role (the currently on the DL) Joe Kelly has spent his 2017 in.
Reed will be a free agent following 2017, so the Mets couldn’t land a major package for him, but Jamie Callahan is at least intriguing. The 2012 second-round pick was once the youngest pitcher in the New York-Penn League, and is now a 22-year-old reliever in Triple-A after failing as a starter in the lower levels of Boston’s system. Nogosek was a college closer who could see a fast path to the majors, so there is potential there as well, but it seems like the Red Sox mostly pushed off 40-man decisions they needed to make for Rule 5-eligible players to the Mets.
That’s not necessarily a bad thing for either side, given the Mets’ struggles in 2017 and Boston’s current contention for a postseason spot. You don’t have to squint to see this deal working out for both sides in the end.
