Civil War Artillery Shell Discovered at Gettysburg
An unexploded artillery shell was discovered at Gettysburg National Military Park on Feb. 8, host to one of the bloodiest but most decisive battles of the Civil War.
Explosive Ordnance Disposal soldiers with the Army’s 55th Ordnance Company safely removed and destroyed the device, determined to be a 3-inch Burton case shot, according to an official statement.
“This type of munition was historically used during the Civil War and most likely came from the Battle of Gettysburg in 1863,” Capt. Matthew D. Booker, commander of the 55th Ordnance Company, noted.
Steven Brann, a contract archeologist, found the artillery shell while doing a ground sweep of the Little Round Top area, which is under renovation. The hill saw some of the most intense action between Union and Confederate troops during the three-day 1863 conflict, which ended in a Union victory and marked a key turning point in the Civil War.
After traveling from Fort Belvoir, Virginia, the soldiers carried the 10-pound shell to an alternate location, dug a hole, and placed it there along with C4 explosives to blow it up, Jason Martz, a spokesman for the military park said.
“We’re never going to know whether the thing was live or not,” Martz told the Washington Post. “And we’re never going to know how that shell got to the point where we found it.”
Though rare, this is not the first time unexploded munitions were recovered from Gettysburg. In August 2022, a 3-inch Hotchkiss shell was found lodged in a historic building being refurbished, the Army statement said.
Antique munitions from various conflicts are still being found across the United States and the world.
In February 2022, archeologists found a 10-pound Civil War shell at Kennesaw Mountain National Battlefield Park in Georgia. In December 2022, five construction workers were hospitalized after being exposed to a gas released from striking a World War II-era phosphorous bomb while doing work at Army Garrison Stuttgart, Germany.

Pennsylvania Jury Returns $20.5M Verdict Against American Home Patient/Lincare
A jury in the United States District Court for the Middle District of Pennsylvania returned a verdict of $20,500,000 against American Home Patient/Lincare in a racial discrimination case arising out of its State College, Pennsylvania location. The 8 person jury awarded Patricia Holmes $500,000 in compensatory damages and $20 Million in punitive damages. It found that American Home Patient/Lincare, by and through its employees, including a manager, intentionally discriminated against Ms. Holmes by creating a hostile or abusive work environment because of her race in violation of federal law (Title 42, United States Code, Section 1981.) Evidence at trial included testimony that during the approximately 10 months that Ms. Holmes, a black woman, was employed as the only black person in that location, employees in the office, including a manager, engaged in racially discriminatory behavior. This behavior included the use of the “N” word, references to the Ku Klux Klan, and use of the term “coonie.” Employees of the defendant conceded that they knew that engaging in racially discriminatory conduct was in violation of federal law. Tom Anderson of the Pittsburgh office of Bordas & Bordas who served as trial counsel for Ms. Holmes commented, “From the time that Ms. Holmes first described this conduct to me, my immediate reaction was that it was outrageous. It is not conduct that is acceptable anywhere, including, and perhaps especially, in the workplace. It was my privilege to be able to stand up and present this case on behalf of Patricia. I was confident that once a jury heard the facts that it would do the right thing.” Following the jury’s verdict, Patricia Holmes remarked that “Collectively as Americans we all need to stand together and if we stand by each other’s sides that’s the only way we can make a difference.” Jamie Bordas, Managing Partner of Bordas & Bordas stated, “We are very pleased with the outcome of this case. Our firm has a long history of fighting for justice for minorities and women dating back to the early 1980s. Was doing some tidying up in the studio and came across the proofs for the Between Shades of Gray graphic novel that I was a part of. The video’s sped up and doesn’t show the last fifth of the book to not spoil anything 😉, so sorry for the whiplash. Twenty seconds showing a year and a half’s worth of drawing (not shown here: the visual research and reading to support the look, feel, and design of everything seen in the story. As well as all the wild selfies taken for expression and pose reference). Don’t think I’ve ever worked as intensely nor pushed as hard on anything before this project, but honestly, I would jump in and do it again, especially with such a great creative team:

After Judge Matthew Brann thoroughly and completely shits all over Trump and his legal team for bringing a case before the court with no merit, he dismisses the case "with prejudice." What does "with prejudice" mean?
"With prejudice" means that the issues before the court can never be brought again. They get no more bites at the apple. They can appeal to a higher court, but they can't refile their complaint.
Sometimes a court will dismiss a case but allow the plaintiff an opportunity to perfect their complaint and return to court. That would be, "without prejudice." You get a chance to try again.
But if the court feels that the complaint is fatally flawed---meaning that there is no hope of ever bringing a successful complaint on these issues---then the case is dismissed "with prejudice." That's what happened here.
I have a feeling there are others in the lawblr who might be able to explain this a little more fully, but hopefully that gives you an idea.

"In a blistering decision, a Philadelphia appeals court denied on Friday the [t]rump campaign’s attempt to challenge a lower court loss that had sought to stop — or even reverse — the certification of election results in Pennsylvania.
"Pennsylvania certified its election results on Tuesday, as Gov. Tom Wolf signed off on the slate of 20 electors and solidified President-elect Joseph R. Biden Jr.’s victory there.
"The 21-page ruling by the Third Circuit Court of Appeals was a complete repudiation of [t]rump’s effort to halt Pennsylvania’s certification process and a full-throated affirmation of a decision last Saturday by Judge Matthew W. Brann of Federal District Court in Williamsport, Penn., who dealt the [t]rump campaign its initial defeat in the case.
"'Free, fair elections are the lifeblood of our democracy,' Judge Stephanos Bibas, a [t]rump appointee, wrote on behalf of the appeals court. 'Charges of unfairness are serious. But calling an election unfair does not make it so. Charges require specific allegations and then proof. We have neither here."'

Allentown, Pa. – U.S. Senator Pat Toomey (R-Pa.) issued the following statement after Judge Matthew Brann’s decision to dismiss the Trump campaign’s lawsuit challenging the election results in Pennsylvania:
“With today’s decision by Judge Matthew Brann, a longtime conservative Republican whom I know to be a fair and unbiased jurist, to dismiss the Trump campaign’s lawsuit, President Trump has exhausted all plausible legal options to challenge the result of the presidential race in Pennsylvania.
“This ruling follows a series of procedural losses for President Trump’s campaign. On Friday, the state of Georgia certified the victory of Joe Biden after a hand recount of paper ballots confirmed the conclusion of the initial electronic count. Michigan lawmakers rejected the apparent attempt by President Trump to thwart the will of Michigan voters and select an illegitimate slate of electoral college electors. These developments, together with the outcomes in the rest of the nation, confirm that Joe Biden won the 2020 election and will become the 46th President of the United States.
“I congratulate President-elect Biden and Vice President-elect Kamala Harris on their victory. They are both dedicated public servants and I will be praying for them and for our country. Unsurprisingly, I have significant policy disagreements with the President-elect. However, as I have done throughout my career, I will seek to work across the aisle with him and his administration, especially on those areas where we may agree, such as continuing our efforts to combat COVID-19, breaking down barriers to expanding trade, supporting the men and women of our armed forces, and keeping guns out of the hands of violent criminals and the dangerously mentally ill.
“Make no mistake about it, I am deeply disappointed that President Trump and Vice President Pence were not re-elected. I endorsed the president and voted for him. During his four years in office, his administration achieved much for the American people. The tax relief and regulatory overhauls that President Trump enacted with Republicans in Congress produced the strongest economy of my adult life. He also should be applauded for forging historic peace agreements in the Middle East, facilitating the rapid development of a COVID-19 vaccine through Operation Warp Speed, appointing three outstanding Supreme Court justices, and keeping America safe by neutralizing ISIS and killing terrorists like Qasem Soleimani and Abu Bakr al-Baghdadi.
“To ensure that he is remembered for these outstanding accomplishments, and to help unify our country, President Trump should accept the outcome of the election and facilitate the presidential transition process.”
Finally, these two Republicans are forcefully speaking out against Trump and his campaign’s actions in trying to overturn the valid election results of the 2020 presidential election that Joe Biden has legitimately won. They should have done this sooner and we need to hear from more of them. Also, Trump will never be remembered for his outstanding accomplishments because he doesn’t have any. Except, for breaking laws, tearing families apart and disrespecting our constitution. Including, dividing our country with hate speech and ignoring a national pandemic that as hurt millions of Americans by behaving selfishly. He will always be an embarrassment and most of the Republicans under Trump will be known as cowards. This is how history will be written and it will never look good under the Trump administration.

Another great day for Team Loser
A US District Court judge Saturday dismissed a lawsuit by the Trump campaign trying to invalidate millions of Pennsylvania mail-in votes in a significant loss for the campaign.
Though the case was always extremely unlikely to succeed, President Donald Trump's backers and legal team -- and particularly his personal attorney Rudy Giuliani -- had pinned their hopes on the federal judge in Pennsylvania giving some credibility to their suspicions of fraud and entertaining Trump's attempt to overturn the popular vote for President-elect Joe Biden.
But Judge Matthew Brann, a longtime and well-known Republican in Pennsylvania, refused.
This was essentially the last major case seeking to throw out or block enough votes that could swing a key state in Trump's favor, and Brann's decision on Saturday is the 30th loss or withdrawal of a case from the Trump campaign and its allies since Election Day. There have only been two wins in court, about very small numbers of votes.[...]

Several prominent Republicans said this weekend that President Trump’s legal arguments had run their course, calling on him to concede to Joe Biden or at least allow the presidential transition process to begin.
“The conduct of the president’s legal team has been a national embarrassment,” former New Jersey governor Chris Christie said Sunday on ABC’s “This Week.”
Christie, a Trump confidant who helped run debate preparations, said the Republican Party needed to focus on trying to win Georgia’s two runoff elections Jan. 5 to secure the Senate majority, rather than continuing with the unsuccessful legal challenges of the election results.
“The rearview mirror should be ripped off,” Christie said.
Late Saturday night, after a federal judge threw out Trump’s legal attempt to invalidate all of Pennsylvania’s votes, Sen. Patrick J. Toomey (R-Pa.) congratulated Biden and vice president-elect Kamala D. Harris on their victory and encouraged the president to accept that result.
“President Trump has exhausted all plausible legal options to challenge the result of the presidential race in Pennsylvania,” Toomey said in a statement, noting that he ushered that judge, Matthew W. Brann, onto the federal bench as a “longtime conservative Republican.”

This result, Toomey noted, followed Georgia’s certification Friday of Biden’s victory there and Michigan’s GOP legislative leaders rejecting efforts to block the certification of Biden’s clear victory there.
