Smoking ban:Το ΣτΕ απέρριψε την αίτηση των καταστηματαρχών για ακύρωση της απαγόρευσης του καπνίσματος

Το Συμβούλιο της Επικρατείας απέρριψε ως αβάσιμη την αίτηση του Πανελλήνιου Σωματείου Καταστημάτων και Καταναλωτών Εστίασης και Διασκέδασης, με την οποία ζητούσε να ακυρωθεί........ ως αντισυνταγματική η από 15.11.2019 Κοινή Υπουργική Απόφαση, με την οποία απαγορεύθηκε το κάπνισμα στους χώρους καταστημάτων υγειονομικού ενδιαφέροντος (εστιατόρια, ταβέρνες, κέντρα διασκέδασης, μπαρ, κλπ) και προβλέφθηκαν πρόστιμα για τους παραβάτες. Στην αίτησή του το Σωματείο υποστήριζε, μεταξύ των άλλων, ότι το μέτρο της απόλυτης απαγόρευσης του καπνίσματος στους εσωτερικούς χώρους των καταστημάτων υγειονομικού ενδιαφέροντος, συνιστά σημαντικό περιορισμό στην ελευθερία των ανθρώπων οι οποίοι επιλέγουν να καπνίζουν. Στην συνέχεια, το Δ΄ Τμή��α του ΣτΕ, με την υπ΄ αριθμ. 1727/2020 απόφασή του, απέρριψε ως αβάσιμη την αίτηση ακύρωσης του Σωματείου, επικαλούμενο και παλαιότερη απόφαση της Ολομέλειας του ΣτΕ για την απαγόρευση του καπνίσματος. Το ΣτΕ έκρινε ότι το μέτρο της απαγόρευσης του καπνίσματος στους χώρους υγειονομικού ενδιαφέροντος δεν είναι αντίθετο στα άρθρα 5 παράγραφος 1 (ελεύθερη ανάπτυξη της προσωπικότητας και προσωπική ελευθερία) και 21 παράγραφος 3 του Συντάγματος (το κράτος μεριμνά για την υγεία των πολιτών και λαμβάνει ειδικά μέτρα), ενώ παράλληλα συνιστά θεμιτό περιορισμό της ελευθερίας (ατομικής και επαγγελματικής). Would Kerala govt ban tobacco?

With all those liquor ban mayhem in Kerala, I was wondering whether the government would ban tobacco(cigarettes mainly) and tobacco products. After all, cigarettes are easily available to everyone and you don't have to stand in the queue as you would for buying liquor in Kerala. According to cancerindia.org, nearly 45% of all cancers among males and 17% among females in India and more than 80% of oral cancers are directly attributable to tobacco use. Moreover, even passive smoking kills. It was good from the govt. to ban smoking in public places. But I don't think execution of this ban was all that successful. People still smoke in public places and no one asks a question. Smokers will remain smokers; it is seen that it is difficult for them to quit. The question that eludes me is that why is there a ban on usage? The ban should've been on sale of such items. Only that can save the youth from perils of tobacco and smoking.
